HOW TO TESTIFY
If you would like to address the Council, please go to the podium and state your name and address clearly for
the record. Please observe the basic rules of courtesy when speaking and limit your continents to five
minutes. The Council appreciates hearing from citizens but may not be able to take immediate action on
continents received until they are referred to a Committee or discussed under New Business.
COUNCIL MEETINGS
No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given.
Regular Meetings The Mayor, elected by the people to a four -year term, presides at all Regular Council
Meetings held on the 1st and 3rd Mondays of each month at 7:00 p.m. Official Council action in the
form of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular
Council meetings.
Committee of the Whole Meetings Council members are elected for a four -year term. The Council
President is elected by the Council members to preside at all Committee of the Whole meetings for a
one -year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m.
Issues discussed are forwarded to the Regular Council meeting for official action.
GENERAL INFORMATION
At each Council meeting citizens are given the opportunity to address the Council on items that are not
included on the agenda during CITIZENS COMMENTS. Please limit your comments to 5 minutes.
Special Meetings may be called at any time with proper public notice. Procedures followed are the same as
those used in Regular Council meetings.
Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel
matters.
PUBLIC HEARINGS
Public Hearings are required by law before the Council can take action on matters affecting the public interest
such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the
Tukwila Municipal Code states the following guidelines for Public Hearings:
The proponent shall speak first and is allowed 15 minutes for a presentation.
2. The opponent is then allowed 15 minutes to make a presentation.
Each side is then allowed 5 minutes for rebuttal.
4. Citizens who wish to address the Council may speak for 5 minutes each. No one may speak a second
time until everyone wishing to speak has spoken.
5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the
question, but may not engage in further debate at this time.
6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss
the issue among themselves, or defer the discussion to a future Council meeting, without further public
testimony. Council action may only be taken during Regular or Special Meetings.

SPONSOR'S The City of Tukwila is installing public sanitary sewer mains as part of the Southcenter
SUMMARY Parkway Extension Project. King County has requested that the City provide an additional
manhole and sewer piping to the edge of the right -of -way for future side sewer connection
to the Bow Lake Transfer Station (currently under construction). This interlocal agreement
will reimburse the City for the $74,182.56 in charges for the Bow Lake side sewer
connection as well as have King County agree to a future sewer connection fee.

SUMMARY Repair Program. Five consultant firms were short- listed from the Consultant Works Roster

ISSUE
Accept contract as complete and authorize release of retainage.
BACKGROUND
The Notice to Proceed for Contract No. 09 -149 with Reed Trucking and Excavating, Inc., of Puyallup, Washington,
was issued on September 28, 2009 for construction of the Gilliam Creek Stormwater Overflow Project. This involved
the construction of a 24" overflow pipe along Strander Blvd. between Andover Park East and Andover Park West to
allow the Gilliam Creek Basin to drain to the Strander Blvd. pump station to reduce potential flooding associated with
high river events.
ANALYSIS
Construction was physically completed on November 19, 2009. Six change orders were issued during
construction for $68,256.04. Change Orders included providing additional Portable Changeable Message
Boards to alert motorists of pending construction, dewatering pumping, excavation and disposal of unsuitable
materials for re -use, utility lines conflicts and the discovery of a manhole labeled "sanitary sewer" which was
actually a combination sanitary sewer /storm drainage structure, which then became the connection point of the
new system.
Change Order No. 6 in the amount of $50,000.00, is the end result of the claim filed by the contractor on May 3,
2010 after negotiations and deliberation. Cost over -runs and under -runs, were due to changes infield
conditions. The budget for this contract with a 20% contingency was $432,636.00 and the outstanding
retainage amount is $21,752.94.

The Council is being asked for formal acceptance and retainage release authorization, subject to standard claim and
lien release procedures, forthe contract with Reed Trucking Excavating, Inc. in the amount of $435,058.98 and
consider this item on the consent agenda of the September 6, 2011 Regular Meeting.

CHANGE:
The Gilliam Creek Stormwater Overflow Project involved the construction of a 24" overflow pipe along Strander

Excavating, Inc. filed a claim requesting additional payments primarily for unanticipated storm trench sloughing and
backfill, and asphalt replacement costs. The City and Reed Trucking and Excavating, Inc. have agreed to resolve that
claim for an additional payment by the City of $50,000 to Reed Trucking and Excavating, Inc.
The undersigned Contractor and City agree that payment pursuant to this change shall operate to release and discharge all claims
by and among them relating to the above referenced project.

SUBJECT: USW Police Commanders Collective Bargaining Agreement
BACKGROUND
City staff, the USW Police Commanders, and the City's labor relations negotiator Cabot
Dow have been in negotiations since December 2010, in an effort to reach agreement
on a first collective bargaining agreement (CBA) for Police Commanders. A tentative
agreement that was negotiated in good faith between the parties was reached on June
30, 2011.
Some of the guiding principles that led the City and USW Police Commanders to reach
agreement were centered around the need to address the internal wage compression in
comparison to the Sergeants they supervise; to be competitive on the total
compensation package with the external market, and to provide promotional incentives
for Officers seeking to progress their careers into leadership positions within the
department.
The contract implements a three step salary schedule and incorporates longevity pay
into that base salary. In addition the salary schedule adjusts each January based on the
Consumer Price Index (CPI -W) 90% formula with a minimum 2.5% and maximum of
3.5% in 2012, and 90% CPI -W with no minimum or maximum in 2013. The contract
implements a cap on medical insurance premium increases to 8 and allows for
premium sharing if the cap is exceeded.
In addition, the City and USW reached agreement on a broad management rights
clause, reinforce the commanders' overtime exemption status, no added education or
premium pay; and take home vehicle language that provides greater flexibility for the
department to manage resources during these challenging economic times.
The duration of this agreement is for three years from 2011 -2013.
RECOMMENDATION
The Council is being asked to authorize the Mayor to sign the collective bargaining
agreement between the City and USW Police Commanders.
