Mayor Haggerton called the Regular Meeting of the Tukwila City Council to order at 7:01 p.m. and led the
audience in the Pledge of Allegiance.

ROLL CALL
Christy O'Flaherty, City Clerk, called the roll of the Council. Present were Councilmembers Joe Duffie,
Joan Hernandez, Allan Ekberg, Dennis Robertson, Verna Seal, Kathy Hougardy and De'Sean Quinn.
SPECIAL PRESENTATIONS
a. Federal legislative update: Hal Hiemstra from Ball Janik
Hal Hiemstra from Ball Janik is the City's federal legislative lobbyist. Mr. Hiemstra explained that the
congressional delegation understands the needs of Tukwila. Representative Adam Smith and Senators
Cantwell and Murray are well positioned to provide influence related to issues involving Burlington
Northern Santa Fe (BNSF) railroad, as well as transit and aviation related matters that could affect the
City. Additionally, the federal debt agreement will have impacts on municipal, county and state
governments. It is anticipated that impacts could be visible as early as 2012, with greater impacts in
2013. He will be analyzing the effects of cuts in federal funding to Tukwila and relay the findings back to
the City.
The Councilmembers and Mayor thanked Mr. Hiemstra for his advocacy in Washington D.C. on matters
affecting the City of Tukwila.
b. Crime mapping software update: Trina Cook, Crime Analyst, Police Department
Mike Villa, Police Chief, and Trina Cook, Crime Analyst, provided an overview of the new crime mapping
software. Ms. Cook utilized an internet connection to navigate to the crime mapping software from the
Police Department section of the City of Tukwila website. She explained that once a Police Case Report
is written and approved, it is entered into the system within 24 hours.
The Crime Reports program displays a map of Tukwila and the surrounding region, and viewers can
select or deselect the types of crime they would like to view. Features of the system include, and are not
limited to: a search box for a particular area, incident details, email alerts, review by patrol or reporting
district, and "submit a tip."
Ms. Cook relayed that the system is currently live and is an excellent tool for the public.
The Councilmembers thanked Chief Villa and Ms. Cook for the informative presentation, and they look
forward to reviewing the new program.

b. Shoreline Master Program (SMP).
Carol Lumb, Senior Planner, provided a summary of this issue. At the Committee of the Whole meeting
on August 8, 2011, Council moved the 4 ordinances incorporating the Department of Ecology required
and some recommended changes, as well as the housekeeping items that fell within the scope of the
Ecology required changes to the Regular Meeting on August 15, 2011. The Council also heard from Mr.
Joe Desimone, on behalf of the Desimone Trust, who requested a change of shoreline environment
designation to a portion of a property the Trust owns on the Duwamish River. The map change would
affect Map 6 of the color quarter section maps of the shoreline environments, by changing the designation
from High Intensity to Urban Conservancy.
Ms. Lumb contacted Dave Radabaugh with the Department of Ecology regarding the map change, and
he did not have sufficient time to review the issue. In Ms. Lumb's view, the map amendment is a
technical housekeeping change that can be included in the ordinance before the Council this evening.
Additionally, staff would like to revisit the SMP a year from the time the City hears back from the
Department of Ecology. Once that occurs, staff will get the word out to stakeholders via email, the
Hazelnut and the Tukwila Reporter.

M. J. Durkan, representing the Desimone Family Trust, indicated that the changes to the ordinance create
greater clarity. He would like to see a date certain to revisit the SMP and an opportunity to look at use of
the administrative buffer reduction.

question of whether the City Council should allow licensed gambling in the form of the operation
of social card rooms within the Tukwila city limits.

Mayor Haggerton called for public comments.
Sam Mickelson, Manager of the Riverside Casino, relayed that he used to work in construction and has a
great job in the casino industry. He has a wife and small children and would like to keep his job and
support his family. While he appreciates the opportunity for people to vote on the issue, he feels the
ballot language is cold and does not address the human factor. In his view, the Council has the required
information to make this decision, and he would like to see the Council reconsider this issue and take
action.
Victor Mena is the Chief Operating Officer for Washington Gold Casinos and the Golden Nugget. He
stated that the financial impacts of Ordinance 2323 need to be addressed. They ran a poll last month
regarding how voters felt about keeping casinos and there was a 60% approval rating. From his
standpoint, an advisory vote is not needed as the Council is qualified to make the decision. He asked the
Council to draft a new ordinance to replace Ordinance 2323 that will keep jobs and services.
Mark Palmer is the General Manager of the Great American Casino. He indicated the title of the ballot
measure says nothing of what is currently happening in Tukwila and the loss of $2 million in revenue.
Additional information would need to be made available to voters for an advisory vote. He said that as
elected leaders, the Council should make the decision for the group.

David Fretz is the President of Great American Gaming Corporation. He referenced the petition with 367
signatures asking that Ordinance 2323 be repealed. He has found that very few people in Tukwila
realized that card rooms had been banned, and that most willingly signed the petition. In his view, it
would be costly to educate the citizens regarding this issue. Council has the information and the facts to
make a decision and amend the ordinance. He encouraged the Council to follow through with the goal
from last week to place a limitation on the number and location of establishments to include a step tax
that will preserve jobs and revenues.
Chuck Parrish, 4430 South 150 Street, emphasized that this is a divisive issue with well- meaning people
on both sides of the issue. He conveyed that an advisory vote is not necessary and suggested the
Council give people a voice by listening to what they have to say and then making a decision based on
experience and reason. The last and the loudest should not win the debate. He noted the gaming
commission has stated that growth in gambling establishments is unlikely. The Council could make a
change to the ordinance knowing there is support from the Mayor, Chamber of Commerce, public safety
employees, and at least 367 citizens who signed the petition.
Marie Parrish, 4430 South 150 Street, stated that an advisory vote is a waste of time and money, and
the concept of preventing proliferation of gambling establishments with step -tax rates is very promising.
She would like to see that option pursued. She is concerned about a decision to strip over $2 million in
revenue with no plan to replace it. She wonders if the next step will be to eliminate businesses where
alcohol is served. She asked the Council to forego an advisory vote and revisit the ordinance by allowing
existing gambling businesses, but not letting expansion run rampant.
Thomas McLeod, 13017 37 Avenue South, believes the Council has the facts and information to make a
decision on the gaming issue without an advisory vote. The Chamber of Commerce supports the gaming
establishments and crime is not an issue at these businesses. More budget cuts are forthcoming and
gaming revenue is earmarked for public safety services. He encouraged the Council to get the City on
track.
Gerry Myklebust, 14718 58 Avenue South, is in favor of keeping the casinos. As a former police officer
in Tukwila, he found that calls for police service decreased when the businesses became casinos. There
are in -house security officers and disruptive behavior is not allowed. If we get rid of the casinos, there
could be more bars and nightclubs coming into Tukwila where there is a greater degree of violence and
disruption. Tukwila has already endured a loss of sales tax revenue, and if the gambling revenue also
goes away, the Police TAC team may also go away.
Kathryn Law, 14937 57 Avenue South, understands the former Denny's Restaurant is going to become
a casino. She is unhappy about having a casino near her home, and she has had friends and family
members suffer due to the effects of gambling addiction. In her view, this is being penny -wise and
pound foolish, and Tukwila should be moving up in class and not setting its sights lower.
David Law, 14937 57 Avenue South, stated that he had a personal friend who lost his family and
restaurant due to gambling problems. He would rather do without the services than take what he feels is
blood money. From his standpoint, it is not worth it.
Kim McCoy, 14202 56 Avenue South, said that gambling is not a virtue and both sides are appealing to
morality. He would like to see this issue go to a vote of the people.
Jennifer McCoy, 14202 56 Avenue South, relayed that she would like to see this go to an advisory vote.
She referenced a website of www.freetukwila.oro, that will provide information about the issue. She would
like to see it on the November ballot to avoid the need to file for an initiative.
Joanne McManus, 5610 South 133` Street, does not think that gambling is bad and many find it fun.
There are 4 times the number of people who attend the senior citizen trips when they are at casinos. For
many seniors, it is the only form of entertainment. She has lived near the casinos in Tukwila for years,
and has not observed problems. She is not in favor of an advisory vote and asked the Council to use
their own judgment and repeal the ordinance.

Mary Fertakis, 11822 42 Avenue South, emphasized that citizens in Tukwila are educated on the
issues, and she has concerns about polls that are taken by those who have a vested interest in the
outcome and control over the questions. She is in favor of an advisory vote.
Lisa Forsyth, 5668 South 149 Street, relayed that while the ballot question may not focus on the human
factor like jobs and the future, it also does not address the negative consequences of gambling. When
the petition came to their door, they did not sign it and indicated they wanted to see the ordinance remain
as it is. She is in support of an advisory vote.
Robert Ferguson, 13961 56 Avenue South, is in favor of an advisory vote.
The Councilmembers discussed the resolution establishing an advisory vote regarding social card rooms
acknowledging that this has become a divisive issue for the community; there is value in allowing all
citizens the opportunity to vote on the matter; conducting an advisory vote in November will have very
little cost to the City; the loss of approximately $2 million in revenue presents a critical situation; it is the
role of the Council to be fiscally responsible and ensure essential services are provided; the need to
explore other options to solve this problem.
The Councilmembers also exchanged comments regarding the wording of the ballot question in the
resolution which reads, "Should gambling in the form of social card rooms be allowed in Tukwila
While the Councilmembers considered adding additional facts to the ballot question, the determination
was to keep the language simple and neutral, and retain the question as it is currently written. It was
noted that the explanatory statement, as well as pro and con statements, will be available to citizens in
the voters' pamphlet.

Mayor Haggerton made the following announcement
With the passage of this resolution, an advisory vote on social card rooms will be on the ballot for the
November 8, 2011 General Election. The timelines, which are set by the County, are very tight and Pro
and Con Committees are now being formed.
The City Clerk is placing sign -up sheets on the side table at this time. The County will take 3 names for
each committee, and we will be submitting the first 3 names provided for each committee to King County.
Please note that while 3 names for each committee will be submitted, other interested people can work
with the 3 who are named.
The committees will submit statements in favor of and in opposition to the ballot measure, as well as the
rebuttal statement, for the local voters' pamphlet. The committees are responsible for following all
guidelines and submitting information to King County Elections by the appropriate deadlines:

Those who would like to be a committee member in support of allowing social card rooms in Tukwila or a
committee member against allowing social card rooms in Tukwila should contact the Tukwila City Clerk's
Office at 206 433 -1800 by 4:00 p.m. this Thursday, August 18, 2011. Those interested in participating
should be prepared to provide their name, address, phone number, and email address and /or fax
number.
After the committee member names are submitted to the County, King County Elections will be their
contact for the rest of the process, including the submittal of pro /con statements and rebuttals.

NEW BUSINESS
An ordinance declaring an emergency and adopting a 12 -month moratorium on the establishment,
location, operation, licensing, maintenance or continuation of medical cannabis collective
gardens or dispensaries.

Jack Pace, Community Development Director, provided an overview of this issue. Recent amendments
to RCW 69.51A, the medical marijuana law, now allow "collective gardens However, portions of the law
were vetoed by the Governor and possession and distribution of cannabis remain a violation of federal
law. Given the contradictory legal framework and the lack of clarity in RCW 69.51 A, the City needs
additional time to study the issue and analyze the impacts of allowing these uses and facilities in
residential zones, as well as impacts arising from the proximity to schools, daycares, parks, religious and
cultural facilities, jails and courthouses.
Establishing a moratorium on these uses would allow the City time to perform this analysis and develop a
legally sound approach to the issue. The Council is being asked to approve this emergency ordinance
and schedule a public hearing for October 3, 2011.
Council President Ekberg asked if there were any dispensaries in the City that could be grandfathered,
and Mr. Pace answered in the negative.

MISCELLANEOUS
Council President Ekberg relayed that he will be calling in via conference call to participate in the budget
workshop on August 23, 2011.
EXECUTIVE SESSION
Mayor Haggerton announced the purpose of the Executive Session is to discuss a Personnel Issue
Pursuant to RCW 42.30.110(1)(g).
It will last no more than 30 minutes, and no decisions will be made during the Executive Session.
9:55 p.m Mayor Haggerton declared a brief recess to allow the audience time to leave the Council
Chambers prior to the start of the Executive Session.
