EASEMENT
For and in consideration of Ten Dollars (S10.00 US) and other good and valuable
consideration in hand paid, receipt of which is hereby acknowledged, and for benefits to be derived
by the Grantor herein, Grantor Sally R. Young hereby conveys and warrants to the CITY OF
TUKWILA, a Municipal Corporation of the State of Washington, its successors and assigns, a
perpetual nonexclusive easement under, over, through and across the following described land for
the purpose of laying, maintaining, and installing a storm drainage pipeline. catch basins. and
appurtenances thereof said land being described as follows:
SEE EXHIBIT °A" ATTACHED HERETO AND BY THIS REFERENCE MADE A PART HEREOF.
The purpose of the Easement contemplated herein is solely for the construction, reconstruction,
repair, and maintenance of a storm drainage pipeline and catch basins, which shall originate and
terminate on adjacent properties while crossing the Grantor's property.
Access and egress on the Easement area shall be for the purposes of construction, reconstruction,
maintenance, repairs, and compliance with all codes, regulation or policies, which may affect said
storm drainage facilities beyond the date of original construction.
In compliance with the terms and conditions under which the Grantor took the property, the Grantee
herein agrees to hold the Grantor harmless for any and all expenses, damages, costs, liabilities, or
judgements directly attributable to the construction, reconstruction, repair, and maintenance of said
drainage facilities over the Grantor's property within the defined Easement boundaries as set forth in
Exhibit "A" hereto.
The Grantor shall retain the right to use the surface of said easement. so long as said use does not
interfere with the installation and maintenance of the storm drainage pipe and so long as no
permanent buildings or structures are placed on said easement.
If any dispute arises under this Easement, it is expressly agreed that venue shall lie in King County,
State of Washington and that the prevailing party in any such action shall be entitled to reasonable
attorney's fees and costs as set by the court.
This easement shall be a covenant running with the land and shall be binding on the successors, heirs
and assigns of all parties hereto.

Beginning on the west line of said Section at a point which is north 0'32'45" west 527.74 feet
from the southwest corner thereof; and
thence continuing north 0°32'45" west 200 feet;
thence south 89 °49'00" east to a point which is north 89 °49'00" west 106 feet from the
westerly line of 34 Avenue South;
thence south 0°32'45" east 93 feet
thence south 89 °49'00" east to the southwesterly line of 34 Avenue South;
thence southeasterly along said avenue line to a point which the said point of beginning bears
