The purpose of the Easement contemplated herein is solely for the construction, reconstruction, repair, and maintenance of a storm drainage pipeline and catch basins, which shall originate on the Grantee's property and terminate on other private property while crossing the Grantor's property. Access and egress on the Easement area shall be for the purposes of construction, reconstruction, maintenance, repairs, and compliance with all codes, regulation or policies, which may affect said storm drainage facilities beyond the date of original construction. In compliance with the terms and conditions under which the Grantor took the property, the Grantee herein agrees to hold the Grantor harmless for any and all expenses, damages, costs, liabilities, or judgements d attributable to the construction, reconstruction, repair, and maintenance of said drainage facilities over the Grantor's property within the defined Easement boundaries as set forth in Exhibit "A" hereto. The Grantor shall retain the right to use the surface of said easement, so long as said use does not interfere with the installation and maintenance of the storm drainage pipe and so long as no permanent buildings or structures are placed on said easement. If any dispute arises under this Fasement, it is expressly agreed that venue shall lie in King County, State of Washington and that the prevailing party in any such action shall be entitled to reasonable attorneys fees and costs as set by the court. This easement shall be a covenant running with the land and shall be binding on the successors, heirs and assigns of all parties hereto.
