PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS
Claims for Damages: John McFarland, Administrative Assistant, reported the City
Jean C. Tourville received a Claim for Damages from Jean C. Tourville whose
Beatrice Leroux car tire was punctured when she drove over a traffic counter
device which was apparently installed incorrectly. The
claim is in the amount of $101.41. He recommended the claim
be approved. Councilman Van Dusen asked if this was the cost
of a new tire and asked how badly worn the old tire was.
Mr. McFarland said he had not considered depreciating the
value of the old tire and recommended the claim be paid in
full.

THE CLAIM FOR DAMAGES FILED BY JEAN C. TOURVILLE. MOTION

ANOTHER CLAIM. MOTION CARRIED.
Mr. McFarland reported that Beatrice M. Leroux filed a Claim
for Damages in the amount of $4.00; the portion of a Doctor
office call not covered by Medicare. The claim involved an
incident which occurred when the City's Senior Van stopped
suddenly. He recommended this claim be paid. Since this
incident, all people transported in City Vans are required
to wear seat belts.

Budget Transfer Motion Number 80 -19 is to transfer funds
for the settlement of the 1980 Fire Fighter contract.
MOVED BY PHELPS, SECONDED BY HARRIS, THAT COUNCIL APPROVE
BUDGET TRANSFER MOTION NO. 80 -19. MOTION CARRIED.
Budget Transfer Motion No. 80 -20 is to upgrade the air
conditioning system in the computer room. The current
system is inadequate to handle the heat generated by the
machinery in the room, creating intolerable working con-
ditions.
Mayor Pro Tem Saul reported that the Company selected to
do the work is unable to get the equipment necessary to
do the project. The Public Works Director signed a contract
with Kenmore Sheet Metal, the low bidder, with a completion
date of 8 -8 -80.

BUDGET TRANSFER MOTION NO. 80 -20.*
Councilman Bohrer noted that he could not find the fund
identification numbers in his 1980 Budget. Shirley
Kristofferson explained that the line item was included
in the 1979 Budget for the completion of City Hall but was
not put in the 1980 Budget. City Hall was to be completed from
the Land Acquisition Fund. The number on the Budget Transfer is
City Hall related construction. This is the correct BARS account
number. Councilman Bohrer said he was concerned because this
includes a line item that there is no account for in the budget.
Are there more of them? Mrs. Kristofferson explained the
transfer and where the funds are being moved from. This is a
procedural move. Councilman Bohrer said his question is,did
line item 301/519.50.65 exist in the 1979 Budget and why doesn't
it exist in the 1980 Budget?

MOVED BY VAN DUSEN, SECONDED BY BOHRER, THAT COUNCILMAN BOHRER'S
INQUIRY ABOUT THE BUDGET BE PUT IN THE FINANCE AND PERSONNEL
COMMITTEE. MOTION CARRIED.
Public Works Department recommended corrective improvements to
three properties (Eastwood, Aldridge, Ives) which were not accomp-
lished during the street improvement projects. Total transfer
is $7,713.00.
MOVED BY VAN DUSEN, SECONDED BY PHELPS, THAT COUNCIL APPROVE THE
ROCKERY AND CHAIN LINK FENCE FOR THE EASTWOOD PROPERTY PER THE
RECOMMENDATION OF THE PUBLIC WORKS DIRECTOR IN THE AMOUNT OF
$4,078.00.
Councilman Johanson explained that Mr. Eastwood would like a
concrete wall and ornamental iron fence. He could still have these
installed, but the City will only participate up to $4,078. This
is keeping consistent with improvements to other properties in
the area.

Mr. Uomoto, Public Works Director, asked Council to consider
four items pertinent to design criteria on the 59th Avenue Street
project. Specific waivers to consider are for:
1) Twenty -foot roadway width (S. 142nd St., 59th Ave. S.)
2) Twenty -eight foot width roadway with on- street parking
on one side only (S. 144th Street).
3) Road grades up to 20
4) Twenty -five M.P.H. and slower speed limits.
If Council does not grant a waiver to these items the consulting
engineer should not proceed with the final plans and specifications.
Any change in design, once it is completed, will result in higher
costs.
Councilman Hill commented that the 28 foot roadway with parking
on one side only along South 144th Street is almost mandatory
because there is a lot of traffic on that street. If 59th is
narrower maybe it will help keep through traffic from using it.
Mr. Fraser reported that no additional right -of -way is required
along South 144th.
Mr. Tanino, ST Engineering, Inc., reported on their proposed
design for the intersection of 59th Avenue South and South 144th.
Councilman Van Dusen asked how he felt about the four waiver
items. He said, due to the existing situation,each one is approp-
riate. Councilman Saul asked about road grades. Mr. Tanino
said there are some 20% now but they intend to cut down to
18 -1/2% maximum.

THE FOUR WAIVERS PRESENTED IN MR. FRASER'S MEMORANDUM OF
JULY 17, 1980 ON THE 59TH AVENUE PROJECT.
Councilman Johanson asked about the drainage problems.
Mr. Tanino said the storm drain system should take care of it.

BUDGET TRANSFER MOTION NO. 80 -22 TO ALLOW THE DESIGN PHASE FOR
THE 59TH AVENUE SOUTH AND SOUTH 142ND STREET PROJECT. MOTION
CARRIED.
The Police Department is in need of a light bar with speaker
due to the addition of the K -9 unit to the Patrol Fleet. The
funds will come from the sale of a motor vehicle that was
seized by the Police Deparment during a drug arrest.

Attorney Hard read an ordinance adopting by reference certain
statutes of the State of Washington relating to motor vehicles

Attorney Hard explained that last Monday night a version of this
ordinance was presented to Council. He had questions about it
and has made some changes in it. Al Pieper, Building Official,
called him and said he does not agree with the changes. Council-
man Saul said the one originally worked with is better than the
revised copy. Attorney Hard said the original did not make
sense. Attorney Hard said his revision gives the Planning Commission
the right of review. Council compared the two versions.
Mr. Pieper said the Planning Commission said they are willing to
act as a Board of Architectural Review for multiple signs and /or
signs that exceed 150 square feet on buildings larger than 4,000
square feet of face area. The revised copy of the ordinance
does not stipulate that the Planning Commission will sit as a
Board of Architectural Review on buildings larger than 4,000
square feet of face area.
Attorney Hard explained that the Municipal Code says the City
Council and the Planning Commission shall be the Board of
Architectural Review. This is unclear and it is compounding
the problem to pass another ordinance referring back to something
that is unclear. Each statute should speak for itself; they
should be clear and not subject to administrative explanation.

Councilman Bohrer commented on the problems he has with the proposed
ordinance as it is written. Attorney Hard said the Sign Code is
one of the most troublesome pieces of legislation the City has.
Councilman Bohrer expressed concern about a piecemeal approach to
revising the Sign Code. Things could be changed now that might
not fit into the overall revision of the Code.

Councilman Johanson said complaints have been received because
people say they cannot see the painted symbol on the parking stall.
Attorney Hard said the wording in the ordinance has been changed
to read: "Parking spaces marked with or indicated by." This
means they can be marked by sign or painted on the parking space.

Councilman Bohrer asked why this is necessary. Mrs. Kristofferson
explained that it is not covered by the regular payroll process.
Any expenditures, other than payroll, have to be done through
the claims process. This is the procedure recommended by the
State Auditor's Office.

Attorney Hard read a resolution of the City of Tukwila, Washington,
accepting a grant of easement for public access to, and use of,
a portion of the Green River Shoreline Trail System.

ADOPTED AS READ.
Councilman Bohrer said he noted in the letter from the Acting Plan-
ning Director that one of the purposes here was to allow the
Grantor to construct, on the levee, a fire lane. There is no
place in the agreement where it says he is authorized to construct or
required to maintain that fire lane. Is the City going to maintain
the fire lane? Councilman Saul said the fire lane is in conjunction
with the trail system. This fire lane is not intended to be a
driveway, it is just for emergencies. Councilman Hill read
paragraph 2, page 2, and felt this covers the situation. Councilman
Bohrer said it doesn't say he will install the fire lane.
Attorney Hard said he worked on this easement. There is additional
property owned by the same property owner that will be subject
to the same trail system. As far as this fire lane goes, the owner
was, last week, preparing to lay the base for construction.
Attorney Hard said, if Council is concerned about this, you do
not have to accept the easement this evening. The City is
working well with this property owner.

Councilman Bohrer noted further confusion on the second page on
who will provide and maintain the landscaping. Attorney Hard
recommended that Council allow him to review the easement before
it is accepted.
MOVED BY BOHRER, SECONDED BY HARRIS, THAT THIS ITEM BE TABLED TO
THE NEXT COMMITTEE OF THE WHOLE MEETING. MOTION CARRIED.
Councilman Phelps read the investment report submitted by Mrs.
Shirley Kristofferson, Acting Finance Director. Interest income
from the month of June 1980 amounted to $45,489.82 from the
following activity:
Investments Sold $2,828,000
Investments Purchased $3,337,000
Councilman Saul reported he was unable to contact the owner of
the property near So. 144th and 56th Ave. South. This is a
marshy area causing a mosquito problem to the surrounding
residents. It is difficult for the City to take care of matters
on private property. He said he will continue to try to contact
the owner. If the owner refuses to spray the pond area the City
may have to declare it a nuisance and go in and spray but this
would be done only as a last resort. The City does not want to
take on this liability. The City does not want to get started
in mosquito control as part of the regular work day so it is
expected by all the citizens.
Councilman Van Dusen said the City has a bigger problem with rats.
They affect health and spread disease. If an ordinance is going
to be written covering the mosquito problem it needs to address
rat control also. Councilman Phelps said the City needs to look
at our current legislation and start enforcing it.
Councilman Phelps asked if the City was still receiving complaints
on dog control since the leash law was passed. She said the
problem is just as bad, if not worse, in her area. Three big
dogs are out on the street each evening. King County Animal
Control will be notified of this continuing problem.
