This project was divided into two phases. The first phase has been awarded to furnish the poles, mast arms, illuminar, controller, controller cabinet and assorted hardware. This is the second phase. It includes the furnishing of all labor, all other materials and equipment necessary to complete the installation. They hope to have the project completed by Thanksgiving. The first phase amounted to $16,300 and the estimated cost of the second phase is $20,000. THE BID OPENING ON AUGUST 26, 1980.* Councilman Bohrer asked about the possibility of a freeway off or on ramp at that location and wondered if the signalization would be compatible. Mr. Uomoto assured him it would be compatible with any redesign. *MOTION CARRIED. PETITIONS, COMMUNICATIONS, APPEALS AND SIMILAR MATTERS Waiver Request: Harold Wynn -for property on north side of South 152nd Mark Caughey, Acting Planning Director, noted that Harold Wynn has requested a waiver for property located on the north side of south 152nd street between Macadam Road South and 57th Avenue South. The property consists of 5 acres and is proposed for a multi family housing development. They have presented two plans. One alternative is at a density of 16 units per acre, the other is about 20 units per acre. The waiver application is on the agenda because the applicant indicates the intent to have the development encroach upon an area which exceeds 25% in average slope. The department probably has enough information at this time to enable Council to authorize the applicant to pursue the rezone process. The property is currently zoned single family. The Comprehensive Plan provides for medium and high density. Prior to the rezone, staff will complete a very extensive environmental analysis which will address the questions of topography, drainage, soil stability, etc. and determine what is a reasonable density figure for the development of this property. The waiver is triggered by environmental concerns. Councilman Van Dusen clarified that the waiver is required because of encroachment on the slope. Mr. Caughey said Council has the opportunity to address the question of slope and give the applicant any other guidance which will help in the approval process. In addition to the northeast corner, there are other areas that have been identified as excessive in slope or have unstable soil conditions. Councilman Van Dusen asked if Council should address the whole site now and Mr. Caughey recommended they do. Councilman Bohrer asked about the density indicated on the Comprehensive Plan map. Mr. Caughey said the southerly half is designated high density; to the north it drops to a medium density. Councilman Harris asked if the slope is a slide area or if the soil is unstable. Mr. Caughey said primarily because it is a slope and covered with heavy vegetation. The pre- liminary soils investigation indicates the soil stability probably won't be a problem. Mr. Bob Thorpe, representing Harold Wynn, said they are attempting to show conceptual things at this stage. Once they get the waiver they will have the topography and trees surveyed. They believe the areas that are shown 25% are not actually that steep. He noted the surrounding average density is almost 30 units per acre. They are attempting to tier their units up the site and use structured parking. They are set back 100 feet from the corner. After they have a better slope analysis they can do a better job of locating the units. They feel there is less area than is shown that is over 20 The majority is in the corner and they have protected most of that. They are working closely with staff and are getting prepared to go to the Planning Commission. Unless the concerns are "set in concrete," two or three years down the road they are forgotten. Attorney Hard said the sooner the property owner understands the Council's concerns, the better off everyone is. Councilman Van Dusen said you can walk the site and identify green areas but during the actual construction, most of the trees will be taken down. His concern are the hilly areas. When you start cutting into the hillside, there is a problem. He said he would like to see the northeast 200 foot elevation left undeveloped. Councilman Phelps said she would like to see the transition from high to medium density preserved on the site as you move up the hillside. Councilman Bohrer said it has been noted that the site survey data is of dubious quality. There are probably a number of places on the site where the gradient is 25% or greater. There is one portion indicated to be a slope of 40% to 50 Council does need an updated topography of this site. Councilman Van Dusen agreed, since they have not been addressed at this time, he would have to vote "NO." Councilman Bohrer agreed that this is very difficult to address because there is no specific site proposal. Councilman Harris noted that staff says this criteria is the key to the waiver request because of the topography. MOVED BY VAN DUSEN, SECONDED BY PHELPS, THAT COUNCIL VOTE YES ON CRITERIA #5 -Is the request for waiver consistent with the goals and policies of the comprehensive land use policy plan Councilman Bohrer said his interpretation is that the applicant is familiar with all the considerations and has generally made an attempt to comply with them. Councilman Harris read the staff's opinion that the criteria is not applicable. The waiver process, even though exempt from SEPA, is a valuable tool for identifying aspects of the project worthy of intensive environmental investigation and for focusing attention on areas of public policy concern. Councilman Bohrer said he agrees with the staff's analysis, but is not sure about the conclusion. It is not at the border of the zone. It is an environmentally sensitive area, however, the City has said they would attempt to control development there and regulate it, but not prohibit it. In light of this, there is no major commitment of policy here that is consistent with the policies that have previously been laid down. Mr. Caughey said this covers all the concerns except the concept of stepping -down the density as you move northward across the site. Councilman Van Dusen said this should be part of the density consideration. Councilman Phelps said if the developer were to cluster buildings and save part of the site for the natural environment, it would be a trade off for stepping the density up the hill. Councilman Bohrer said the motion is consistent with the recommendation of staff. Mr. Caughey said he would prefer Council use the more specific language used in the staff report. The main thing they want the applicants to understand is that the Council is not making any commitments, at this point, on these particular sites development plans. When it goes to the Planning Commission the "table is wide open." Councilman Johanson said without a plan, Council cannot discuss specifics or details. He said he would like to see the density graduated toward the top. The developer could use some type of a buffer effect to separate it from the residential area. Council- man Harris, referring to Exhibit D, said she finds it very pleasing, and it looks like it would be very little excavation. Councilman Van Dusen noted that it is no good to try to save just the large trees without preserving some of the smaller ones around to protect the larger ones especially if they are firs. Budget Transfer Motion #80 -23: Funding of Project Planner Graphic Intern Budget Transfer Motion #80 -24: Repay Interfund Loan -LID #28 Budget Transfer Motion #80 -25: Shelving for Library Councilman Bohrer referred to the staff recommendation, and there are a couple of points in it that reflect Council's intent; one is, the grant of the waiver is approved only for authorization to proceed with application for SEPA review and rezoning. The second part says that Council makes no expressed or implied approval of the site or specific layout. MOVED BY BOHRER, SECONDED BY HARRIS, THAT THE MOTION BE AMENDED TO ADD CONDITIONS 1 AND 2 THAT ARE IN THE STAFF RECOMMENDATION. (1) The grant of waiver is approved only for authorization to proceed with application for SEPA review and rezoning. By this action, City Council makes no expressed or implied approval of a site development layout concept or dwelling unit /acre density level. (2) Determination of a site sensitive development pattern and appropriate density level shall be made by recom- mendation of the Planning Commission at the rezone hearing stage after all pertinent SEPA information is available. The Planning Commission recommendation shall be subject to final approval, modification or rejection by the City Council. MOTION CARRIED. *MOTION CARRIED TO GRANT THE WAIVER WITH CONDITIONS. Mr. Caughey noted that there is a moratorium in effect in this area that effects this property. What is Council's intent toward lifting the moratorium. Attorney Hard said the ordinance approving the creation of LID #30 provides that if insufficient protests are filed within the 30 day protest period, Council will take action to repeal the moratorium. Mr. Uomoto said the street widening project along Southcenter Pkwy. was constructed by Moss Construction and administered and inspected by city staff. The total project will run slightly over $80,000. The contract was awarded for $68,923.50, and there were two change orders amounting to $5,500. The project was under the control of the Public Works staff. Wes Jorgenson, Junior Engineer, did an outstanding job. Budget Transfer Motion No. 80 -23 provides funding for the Project Planner and Graphic Intern through December 31, 1980 to enable completion of revised zoning ordinance text, map material and environmental impact statement. Budget Transfer Motion No. 80 -24 is to provide funds to repay interfund loan and all costs incurred on LID #28. ($78,676.00) Councilman Phelps noted that there was a voucher, approved earlier this evening for this amount. MOTION CARRIED. Budget Transfer Motion No. 80 -26 is to cover costs for converting old City Hall to Library use. 1979 encumbrances paid from 1980 Budget. ($9,700.00) ORDINANCES Proposed Ordinance Authorizing the Planning Com. to review ad- vertising signs MOVED BY JOHANSON, SECONDED BY PHELPS, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read an ordinance of the City of Tukwila, Wash., authorizing the Planning Commission to review advertising signs and amending Ordinance No. 773, Section 011, Paragraph 7, (TMC 19.32.140). Attorney Hard proposed the following changes to the proposed ordinance: 1. Section A (1) Signs on Faces of Buildings On buildings less than 4,000 square feet face area, one sign is permitted for each street upon which the property fronts. 2. Make new Section A (2) of the second sentence in original A (2) to read: Buildings over 4,000 square feet face area may utilize two (2) or more signs on the faces of the building, not to exceed 3% of face area of buildings providing the additional signs or signing is approved by the Planning Commission. 3. Change first sentence in Section A (2) to Section A (3). Where signs can be shown to be an integral part of the main building design, a greater percentage of area or additional signs may be allowed upon approval of the Planning Commission. 4. Change the third sentence in A (2) to new Section A (4). Where buildings house more than one tenant, the sign area on the building allotted to each tenant shall be uniform; office buildings with multiple tenancies shall only be identified by the official name of the building, and internal directories shall be used to identify the individual tenants. 5. Change A (3) to read A (5). One free standing sign per building shall be allowed, except when buildings are supportive to the principle activity of a business where signs are allowed only for the principle use, unless specifically permitted by the Planning Commission. The total area of all the faces of this sign shall not exceed two times the area given in Table 1. MOVED BY VAN DUSEN, SECONDED BY PHELPS, THAT THE PROPOSED ORDINANCE BE AMENDED AS RECOMMENDED BY ATTORNEY HARD.* Councilman Bohrer said he still has a number of problems with the ordinance. It does not make sense. He explained the problem with Section (1), Table I. A building 2,000 square feet is allowed 4 1/2% for the sign which is a 90 square foot sign. A building 2,001 to 3,000 square feet is allowed 3 1/2% which is 70 square feet -20 square feet less for a larger building. The same inconsistency follows all the way through the Table. Also, the ordinance, as written, strikes the upper limitation the City now has on sign areas. It is currently limited to 150 square feet maximum. This is inconsistent with the sign ordinance. Signs should be non cluttering and non obtrusive. It potentially raises a condition that can be a gross imposition on surrounding properties by having such a sign. He said he opposes continuing with this ordinance without the limitation imposed. He suggested leaving in the fifth line of the table TUKWILA CITY COUNCIL, REGULAR MEETING August 4, 1980 Page 8 ORDINANCES Proposed Ordinance Authorizing the Planning Com. to review ad- vertising signs RESOLUTIONS Proposed Resolution Accepting a grant of easement for public access to a portion of the Green River Shore- line Trail System Resolution #753 Authorizing the Mayor to apply for 1981 inter- juris- dictional Block Grant Funds that reads "over 4,000 square feet, 150 square feet maximum." This would not be consistent with the text. There is a mis- conception in the title on this ordinance. It says the ordinance is going to authorize the Planning Commission to review signs. They are already authorized to review signs. At an earlier time, criteria for making a judgment on the sign review was discussed. What are we specifically trying to accomplish with this ordinance. It accomplishes some things he is very much opposed to. *MOVED BY HARRIS, SECONDED BY JOHANSON, THAT THE PROPOSED ORDINANCE BE TABLED TO THE COMMITTEE OF THE WHOLE MEETING OF AUGUST 11TH. City Attorney Hard read a resolution of the City of Tukwila, Wash., accepting a grant of easement for public access to, and use of a portion of the Green River Shoreline Trail System. MOVED BY VAN DUSEN, SECONDED BY JOHANSON, THAT THE PROPOSED RESOLUTION BE ADOPTED AS READ.* Attorney Hard said he has the easement, but finds it needs more revisions. He asked Council not to consider the proposed resolution this evening. City Attorney read a resolution of the City of Tukwila authorizing the Mayor to apply for 1981 Interjurisdictional Block Grant Funds with King County. MOVED BY VAN DUSEN, SECONDED BY HARRIS, THAT RESOLUTION NO. 753 BE ADOPTED AS READ.* Don Williams, Recreation Department, explained the source of the Interjurisdictional Block Grant Funds. With this resolution, we are applying for joint application money. If the City joins with King County Parks on this project, it will not affect the population money. The City will still have the $17,000 population funds to be used at a later date. The project under discussion is the construction of a youth athletic field at Joseph Foster Memorial Field. The last estimate for 1981 is $38,000. A letter from the Director of King County Parks states that they endorse the project and would participate in a joint project. The reason for pursuing a youth field is because some day the General Electric Field will no longer be available. Councilman Hill asked if the City of Tukwila will do the scheduling for the field or will the County do it. Mr. Williams said it has already been agreed that the City will do the scheduling and the maintaining of the facility. *MOTION CARRIED. TUKWILA CITY COUNCIL, REGULAR MEETING August 4, 1980 Page 9 DEPARTMENT REPORTS Attorney's Report MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS Release of Lease Agreement for Old Thorndyke School Site Golf Course Irrigation Project EXECUTIVE SESSION: 9:35 P.M. *MOTION CARRIED. Attorney Hard reported that the biggest issued being handled by them right now is the public hearing before the Civil Service Commission concerning the appeal of John Sheets, Police Chief. The hearing is set for 7:00 P.M., Wednesday night. Maxine Anderson, City Clerk, explained that Mr. Ron Keesling has purchased the old Thorndyke School site from the School District. A title search shows that the City of Tukwila still has a 15 year lease on the property that has never been legally released. His attorney has drawn up a release agreement and is asking Council's approval for the Mayor to execute the document. MOVED BY VAN DUSEN, SECONDED BY BOHRER, THAT THE MAYOR BE AUTHORIZED TO EXECUTE THE RELEASE AGREEMENT FOR THE LEASE OF THE OLD THORNDYKE SCHOOL SITE AFTER APPROVAL OF THE CITY ATTORNEY.* It was noted that the City of Tukwila paid the sewer assessment of $5,416.81. Council discussed the possibility of asking for payment for relinquishment of purchase rights. This would reimburse the City for the sewer assessment. It was noted that the City did not use the building at all. Councilman Bohrer said forget it; the City's relationship with the School District has been excellent. Council agreed. Councilman Phelps asked Mr. Williams for a report on the Foster Golf Course Irrigation Project. Mr. Williams explained that there have been problems with the Contractor and lengthy delays because some of the equipment that is on order takes 8 to 12 weeks before delivery. There have been many problems from the start. We needed a hydraulics engineer on the project. Right now, we have a conflict of opinion between the Contractor and the Consultant as to how the automatic irrigation system (starting and stopping of the pumps) is to be done. There are definite problems. There are some decisions that have to be made. There may be decisions that involve going to an outside consultant who can help resolve the conflicts. The project is at a standstill until three issues are resolved: (1) The starting and stopping of the pumps; (2) One of the pumps the contractor has provided has a flatter curve than the original pumps designated on the design; (3) Ohno Construction is a small company, and he has many projects going. Mr. Williams said, in his opinion, the consultants have not provided all the technical data, electrical, schematic drawings, etc. that should have been done in the initial stages. He said he will discuss specific problems with the Mayor, and it may be necessary to come back to Council with some alternatives and potential costs. Everything is done except the pump station. Councilman Phelps asked for assurance that the City will be provided with all the operating data available. If the City takes over the operation of the Golf Course at a later date, we will need all the technical information to run it. Mr. Williams said it is the obligation of the supplier of the equipment to provide this to the City and the maintenance personnel will be trained to operate it.
