The project includes construction of street, curb and gutter, sidewalk, storm drainage, lighting and water revisions on South 152nd Street from Macadam Road to 57th Avenue South and on 57th Avenue South from South 152nd Street South to the end of 57th Avenue So. MOVED BY SAUL, SECONDED BY HILL, THAT COUNCIL SET THE BID OPENING DATE FOR THE LID #30 STREET IMPROVEMENTS FOR SEPTEMBER 17, 1980, 10:00 A.M. MOTION CARRIED. Construction on LID #29 Street Improvement is completed and ready for the Public Hearing on the final assessment roll. MOVED BY SAUL, SECONDED BY HARRIS, THAT THE PUBLIC HEARING ON THE FINAL ASSESSMENT ROLL FOR LID #29 BE SEPTEMBER 15, 1980, 7:00 P.M. MOTION CARRIED. Mayor Todd awarded service pins to the employees present for 5 and 10 years of service to the City. He also awarded Council Member Mabel Harris a service pin for the four terms she served as the elected City Treasurer. TUKWILA CITY COUNCIL, REGULAR MEETING August 18, 1980 Page 2 CITIZEN'S COMMENTS Cont. 56th Ave. Bridge Resolution #754 To support the Block Grant Joint Application sub- mitted by King County for the Foster Bridge Replacement Final Acceptance of LID #29/ Contract 79 -03 Credit Allowance to Mr. Patton for Sewer Metro Charges Budget Transfer Motion No. 80 -27 To allow a low cost pavement re- juvination prog. Attorney Hard submitted a resolution to Council for adoption. He read, in its entirety, a resolution to support the Block Grant Joint Application submitted by King County for the Foster Bridge Replacement Program. Attorney Hard explained that the resolution is intended, at this point, only to have the City of Tukwila agree to participate with King County in seeking an application for funds under the Federal Block Grant Program. This is not a commitment by the City for a specific dollar amount or even an agreement as to relative responsibility between the County and the City. The reason for doing this is to allow both agencies to seek as much grant money as is possible to get this bridge replacement project completed. Mayor Todd explained that this does not mean the City agrees with King County or that the City has any liability for the problems at the 56th Ave. Bridge. We are willing to cooperate with King County to the extent that we will jointly, with them, apply for Grant Funds to replace the bridge. We are asking for Council approval. Attorney Hard recommended that Section I of the resolution be amended by adding "block grant application." MOVED BY SAUL, SECONDED BY HARRIS, THAT THE RESOLUTION BE AMENDED TO ADD "BLOCK GRANT APPLICATION" TO THE END OF SECTION 1. MOTION CARRIED. MOVED BY SAUL, SECONDED BY HARRIS, THAT RESOLUTION NO. 754, AS AMENDED, BE ADOPTED AS READ. MOTION CARRIED. PETITIONS, COMMUNICATIONS, APPEALS, AND SIMILAR MATTERS MOVED BY SAUL, SECONDED BY JOHANSON, THAT COUNCIL ACCEPT LID #29 /CONTRACT #79 -03 AS COMPLETED PER THE RECOMMENDATION OF TED UOMOTO IN HIS MEMORANDUM OF AUGUST 14, 1980. MOTION CARRIED. LID #29 /Contract 79 -03 is the street improvement project along 62nd Avenue South and South 153rd Street. Mr. Jim Patton, 13904 56th Place South, has requested a credit of $165.50 for sewer and Metro charges from 10/77 thru 3/79 on his Utility Account. This is the result of the sewer stub to the Patton property not being installed until April, 1979. MOVED BY SAUL, SECONDED BY HILL, THAT MR. PATTON BE ALLOWED A CREDIT OF $165.50 ON HIS UTILITY ACCOUNT. MOTION CARRIED. MOVED BY SAUL, SECONDED BY HILL, THAT BUDGET TRANSFER MOTION NO. 80 -27 BE APPROVED AS SUBMITTED. MOTION CARRIED. Budget Transfer Motion No. 80 -27, in the amount of $15,000, is to allow for a low cost pavement rejuvination program for three miles of city streets to extend the life of the pavement several years. Budget Transfer Motion No. 80 -30, in the amount of $36,556, is to refund the FICA contributions the City would have made for the period from 10/1/76 thru 12/31/77 for Firefighters Union Members, plus interest thru 8/20/80, per Court award 7/31/80. Budget Transfer Motion No. 80 -31, in the amount of $1,000, is to cover repairs to the Foster Golf Course Foot Bridge. MOVED BY HILL, SECONDED BY SAUL, THAT BUDGET TRANSFER MOTION NO. 80 -31 BE APPROVED AS SUBMITTED. MOTION CARRIED. MOVED BY SAUL, SECONDED BY HARRIS, THAT THE PROPOSED ORDINANCE BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read an ordinance of the City of Tukwila extending the interim Finance period and changing the interest rate for LID #29 as set by ordinance #1105. MOVED BY SAUL, SECONDED BY HARRIS, THAT ORDINANCE NO. 1174 BE ADOPTED AS READ. MOTION CARRIED Budget Transfer Motion No. 80 -28, in the amount of $13,950, is to allow the cost to correct the City Hall water line (buried 18 feet deep). This project was done by West Coast Construction during LID #29 construction. Budget Transfer Motion No. 80 -29, in the amount of $39,415 is to cover special assessment for Centrex sidewalk ($4,611.38); legals, interest and undergrounding ($22,800); and $12,000 for negotiated settlement with Jones Associates, Consulting Engineers. MOVED BY HILL, SECONDED BY JOHANSON, THAT BUDGET TRANSFER MOTION NO. 80 -29 BE APPROVED AS SUBMITTED. MOTION CARRIED. Councilman Hill referred to a memorandum from Al Pieper, Building Official. Mr. Pieper is requesting the proposed ordinance revising the Sign Code not be passed. The original intent of the ordinance was a simple change allowing applicants, under certain conditions, to apply for relief from code restrictions. After several revisions to the original draft, the proposed ordinance adopts provisions and conditions that an applicant cannot meet. Councilman Hill said he would like to have the full Council discuss this ordinance again. MOVED BY HILL, SECONDED BY JOHANSON, THAT THIS ITEM BE REFERRED TO THE COMMITTEE OF THE WHOLE OF AUGUST 25, 1980.* Mrs. Regel, audience, said she has worked on the Board of Adjustment with the Sign Code. She said we do not need any amendments; we need a complete new code. The code expired last May and was extended for one year. It is going to take a long time to revise the code, and it should be undertaken right away. Councilman Saul said no one has been able to agree on this. It is time Council made a decision. We keep putting this off every week and it is time to do something. Now, we have letters from both the City Attorney and the Building Official asking us to put it off again. Proposed Ordinance Authorizing the Planning Com. to review advertising signs Proposed Ordinance Providing for accrual of sick leave RESOLUTIONS Resolution #755 Providing for an interfund loan be- tween the Street Fund the LID #30 Construction Fund Resolution #756 Eliminating a moratorium on the issuance of any building or site preparation permits in the area affected by former LID #28 DEPARTMENT REPORTS Mayor's Report Finance Director's Monthly Report of Investments Councilman Johanson said Council has not been given the reasons why people do not want this proposed ordinance passed. Mayor Todd requested that both Attorney Hard and Mr. Pieper attend next weeks work meeting to get this issue settled. Attorney Hard said it is now up to Council to make the decision. He agreed with Mrs. Regel that this is a bigger problem than just this simple amendment. Mayor Todd said he didn't see any problem with Council approving the proposed ordinance, but now is the time to change the whole code. *MOTION CARRIED WITH SAUL VOTING NO. Councilman Saul said that some Council Members still have a problem with this item and recommended that the proposed ordinance providing for accrual of sick leave on a monthly basis for Tukwila City employees be tabled. MOVED BY HARRIS, SECONDED BY HILL, THAT THIS ITEM BE TABLED UNTIL AFTER THE POLICE NEGOTIATIONS ARE COMPLETED. MOTION CARRIED. MOVED BY SAUL, SECONDED BY HILL, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read a resolution providing for an inter fund loan between the Street Fund and the LID 30 Construction Fund. MOVED BY SAUL, SECONDED BY HILL, THAT RESOLUTION NO. 755 BE ADOPTED AS READ. MOTION CARRIED. MOVED BY SAUL, SECONDED BY HILL, THAT THE PROPOSED RESOLUTION BE READ BY TITLE ONLY. MOTION CARRIED. City Attorney Hard read a resolution of the City of Tukwila, Wash., eliminating a moratorium on the issuance of any building or site preparation permits in the area affected by former LID No. 28 and repealing Resolution #695. MOVED BY SAUL, SECONDED BY HILL, THAT RESOLUTION NO. 756 BE ADOPTED AS READ. MOTION CARRIED. Mayor Todd reported that the State Auditor's office will conduct two 4 hour classes on the BARS system here at City Hall. He invited all Council Members to attend. He reported that, tomorrow, he and the Public Works Director will be meeting with officials from the City of Renton on the Grady Way Bridge Project. He further reported that the totem pole, carved for Tukwila's Sister City, Ikawa, Japan, is boxed and ready to ship. Councilman Harris read the investment report submitted by Shirley Kristofferson, Acting Finance Director. Interest income for the month of July, 1980, amounted to $18,245.83 on the following activity: Investments Sold $2,731,000 Investments Purchased $2,593,000 TUKWILA CITY COUNCIL, REGULAR MEETING August 18, 1980 Page 5 MISCELLANEOUS AND FURTHER AUDIENCE COMMENTS Dog Leash Law ADJOURNMENT Al Pieper, audience, commented that the new leash law has not helped the dog problems in Tukwila's McMicken Heights area. Councilman Saul agreed that the problem is still very much there. He was chased by a Doberman while jogging along 51st Avenue South. 7:50 P.M.
