PERMIT CONDITIONS: 21: The attached set of building plans have been reviewed by the Fire Prevention Bureau and are acceptable with the following concerns: 4: The total number of fire extinguishers required for an ordinary hazard occupancy with Class A fire hazards is calculated at one extinguisher for each 1,500 sq. ft. of area. The extinguisher(s) should be of the "All Purpose" (2A, 20B:C) dry chemical type. Travel distance to any fire extinguisher must be 75' or less. (IFC 906.3) (NFPA 10, 3-2.1) 1: Portable fire extinguishers, not housed in cabinets, shall be installed on the hangers or brackets supplied. Hangers or brackets shall be securely anchored to the mounting surface in accordance with the manufacturer's installation instructions. Portable fire extinguishers having a gross weight not exceeding 40 pounds (18 kg) shall be installed so that its top is not more than 5 feet (1524 mm) above the floor. Hand- held portable fire extinguishers having a gross weight exceeding 40 pounds (18 kg) shall be installed so that its top is not more than 3.5 feet (1067 mm) above the floor. The clearance between the floor and the bottom of the installed hand-held extinguishers shall not be Tess than 4 inches (102 mm). (IFC 906.7 and IFC 906.9) 2: Extinguishers shall be located in conspicuous locations where they will be readily accessible and immediately available for use. These locations shall be along normal paths of travel, unless the fire code official determines that the hazard posed indicates the need for placement away from normal paths of travel. (IFC 906.5) 3: Fire extinguishers require monthly and yearly inspections. They must have a tag or label securely attached that indicates the month and year that the inspection was performed and shall identify the company or person performing the service. Every six years stored pressure extinguishers shall be emptied and subjected to the applicable recharge procedures. If the required monthly and yearly inspections of the fire extinguisher(s) are not accomplished or the inspection tag is not completed, a reputable fire extinguisher service company will be required to conduct these required surveys. (NFPA 10, 4-3, 4-4) 5: Egress doors shall be readily openable from the egress side without the use of a key or special knowledge or effort. (IFC 1008.1.8.3 subsection 2.2) 6: Dead bolts are not allowed on auxiliary exit doors unless the dead bolt is automatically retracted when the door handle is engaged from inside the tenant space. (IFC Chapter 10) 7: Exit hardware and marking shall meet the requirements of the International Fire Code. (IFC Chapter 10) 8: Door handles, pulls, latches, locks and other operating devices on doors required to be accessible by Chapter 11 of the International Building Code shall not require tight grasping, tight pinching or twisting of the wrist to operate. (IFC 1008.1.8.1) 9: Exits and exit access doors shall be marked by an approved exit sign readily visible from any direction of egress travel. Access to exits shall be marked by readily visible exit signs in cases where the exit or the path of egress travel is not immediately visible to the occupants. Exit sign placement shall be such that no point in an exit access corridor is more than 100 feet (30,480 mm) or the listed viewing distance for the sign, whichever is less, from the nearest visible exit sign. (IFC 1011.1) 10: Every exit sign and directional exit sign shall have plainly legible letters not less than 6 inches (152 mm) high with the principal strokes of the letters not less than 0.75 inch (19.1 mm) wide. The word "EXIT" shall have letters having a width not less than 2 inches (51 mm) wide except the letter "I", and the minimum spacing between letters shall not be less than 0.375 inch (9.5 mm). Signs larger than the minimum established in section 1011.5.1 of the International Fire Code shall have letter widths, strokes and spacing in proportion to their height. The word "EXIT" shall be in high contrast with the background and shall be clearly discernible when the exit sign illumination means is or is not energized. If an arrow is provided as part of the exit sign, the construction shall be such that the arrow direction cannot be readily changed. (IFC 1011.5.1) 11: Aisles leading to required exits shall be provided from all portions of the building and the required width of the aisles shall be unobstructed. (IFC 1013.4) 12: Exit signs shall be illuminated at all times. To ensure continued illumination for a duration of not less than 90 minutes in case of primary power loss, the sign illumination means shall be connected to an emergency power system provided from storage batteries, unit equipment or on -site generator. (IFC 1006.1, 1006.2, 1006.3) 13: Emergency lighting facilities shall be arranged to provide initial illumination that is at least an average of 1 foot-candle (11 lux) and a minimum at any point of 0.1 foot-candle (1 lux) measured along the path of egress at floor level. Illumination levels shall be permitted to decline to 0.6 foot-candle (6 lux) average and a minimum at any point of 0.06 foot-candle (0.6 lux) at the end of the emergency lighting time duration. A maximum -to -minimum illumination uniformity ratio of 40 to 1 shall not be exceeded. (IFC 1006.4) 15: A fire alarm system is required for this project. The fire alarm system shall meet the requirements of N.F.P.A. 72 and City Ordinance #2328. 16: Maintain square foot coverage of detectors per manufacturer's specifications in all areas including: closets, elevator shafts, top of stairwells, etc. (NFPA 72-5.5.2.1) 17: Local U.L. central station supervision is required. (City Ordinance #2328) 18: Maintain automatic fire detector coverage per N.F.P.A. 72. Addition/relocation of walls, closets or partitions may require relocating and/or adding automatic fire detectors. 19: Maintain fire alarm system audible/visual notification. (City Ordinance #2328) 20: An electrical permit from the City of Tukwila Building Department Permit Center (206-431-3670) is required for this project. 22: The maximum flame spread class of finish materials used on interior walls and ceilings shall not exceed that set forth in Table No. 803.5 of the International Building Code. 23: New and existing buildings shall have approved address numbers, building numbers or approved building identification placed in a position that is plainly legible and visible from the street or road fronting the property. These numbers shall contrast with their background. Address numbers shall be Arabic numbers or alphabet letters. Numbers shall be a minimum of 4 inches (102mm) high with a minimum stroke width of 0.5 inch (12.7mm). (IFC 505.1) 24: Any overlooked hazardous condition and/or violation of the adopted Fire or Building Codes does not imply approval of such condition or violation. 14: Contact The Tukwila Fire Prevention Bureau to witness all required inspections and tests. If you have any questions, please call Tukwila Fire Prevention Bureau at (206)575-4407. 26: ***BUILDING PERMIT CONDITIONS*** 27: Work shall be installed in accordance with the approved construction documents, and any changes made during construction that are not in accordance with the approved construction documents shall be resubmitted for approval. 28: All permits, inspection record card and approved construction documents shall be kept at the site of work and shall be open to inspection by the Building Inspector until final inspection approval is granted. 29: All construction shall be done in conformance with the Washington State Building Code and the Washington State Energy Code. 30: Notify the City of Tukwila Building Division prior to placing any concrete. This procedure is in addition to any requirements for special inspection. 31: All rack storage requires a separate permit issued through the City of Tukwila Permit Center. Rack storage over 8-feet in height shall be anchored or braced to prevent overturning or displacement during seismic events. The design and calculations for the anchorage or bracing shall be prepared by a registered professional engineer licensed in the State of Washington. Periodic special inspection is required during anchorage of storage racks 8 feet or greater in height. 32: There shall be no occupancy of a building until final inspection has been completed and approved by Tukwila building inspector. No exception. 33: Remove all demolition rubble and loose miscellaneous material from lot or parcel of ground, properly cap the sanitary sewer connections, and properly fill or otherwise protect all basements, cellars, septic tanks, wells, and other excavations. Final inspection approval will be determined by the building inspector based on satisfactory completion of this requirement. 34: A Certificate of Occupancy shall be issued for this building upon final inspection approval by Tukwila building inspector. 35: Water heaters shall be anchored or strapped to resist horizontal displacement due to earthquake motion. Strapping shall be at points within the upper one-third and lower one-third of the water heater's vertical dimension. A minimum distance of 4-inches shall be maintained above the controls with the strapping. 36: All plumbing and gas piping work shall be inspected and approved under a separate permit issued by the City of Tukwila Building Department (206-431-3670). 37: All electrical work shall be inspected and approved under a separate permit issued by the City of Tukwila Permit Center. 38: Preparation before concrete placement: Water shall be removed from place of deposit before concrete is placed unless a tremie is to be used or unless otherwise permitted by the building official. All debris and ice shall be removed from spaces to be occupied by concrete. 39: VALIDITY OF PERMIT: The issuance or granting of a permit shall not be construed to be a permit for, or an approval of, any violation of any of the provisions of the building code or of any other ordinances of the City of Tukwila. Permits presuming to give authority to violate or cancel the provisions of the code or other ordinances of the City of Tukwila shall not be valid. PREAMBLE THIS RIGHT OF WAY USE AGREEMENT is made and entered into thisday of, 2015, by and between the City of Tukwila, a noncharter, optional code Washington municipal co poration, hereinafter the "City," and Randal Walker, an individual, hereinafter "Property Owner", owner of the real property located at 13003 Tukwila International Blvd. (King County Parcel #7359600610), hereinafter "Subject Property." II. RECITALS WHEREAS, the Property Owner desires to complete a tenant improvement of the commercial building (the "Project") located on the Subject Property; and WHEREAS, the building on the Subject Property has been vacant for a number of years; and WHEREAS, the City prescribes the minimum number of parking stalls in Tukwila Municipal Code Title 18, "Zoning"; and WHEREAS, located adjacent to the Subject Property is unimproved right of way, currently used to provide access to public utilities, controlled by the City; and WHEREAS, the Property Owner desires to use the City's unimproved right of way for parking; and WHEREAS, the Property Owner has submitted a site plan as depicted in Exhibit 2 showing parking within the City's unimproved right of way; and WHEREAS, allowing the Property Owner to use the City's unimproved right of way expands the type of tenants the Property Owner can pursue for the Subject Property, allowing the Subject Property to stabilize, reducing crime, thus improving the overall neighborhood; and WHEREAS, Tukwila Municipal Code 11.08 permits the long term use of City right of way, subject to the issuance of a Type D permit by the City's Public Works Department; and NOW THEREFORE, in consideration of the mutual promises set forth herein, the parties agree as follows: III. AGREEMENT Section 1. Use of Right -of -Way Area CORRE�T��N LTR#_.3---- A. Use of Right of Way - The Property Owner shall obtain a Type D permit pursuant to Chapter 11.08 TMC for use of the City right of way located adjacent to the Subject Property (the "ROW Area"), as depicted in Exhibit 1 attached hereto and incorporated herein by this reference. The Property Owner is responsible for the payment of any permit fees associated with the Type D permit. The ROW Area shall not be used for any purpose not explicitly permitted by this Agreement, prohibited uses include, but not limited to, use of the ROW Area for outdoor sales of merchandise, vehicle sales, or airport parking. 4. The Property Owner shall ensure that the City has access to the utility equipment on the property at all times. 5. The Property Owner is responsible for construction of the parking stalls shown in Exhibit 2. The Property Owner shall obtain all required permits for the stalls construction. The Property Owner is solely responsible for the construction costs and permit fee costs. 6. The Property Owner shall keep the ROW Area, shown in Exhibit 1, free of any refuse, garbage, and debris. Property Owner is responsible for any disposal costs associated with any items abandoned in the ROW Area. 7. Property Owner shall meet the insurance requirements of Tukwila Municipal Code 11.08.100 for the duration of this Agreement. B. Parking Limitations - The Property Owner acknowledges that, even with use of the ROW Area, parking for the Subject Property is severely limited. This parking limitation will likely limit the types of uses permitted within the building on the Subject Property. All uses in the building on the Subject Property shall comply with the minimum parking requirements of Tukwila Municipal Code Title 18. Property Owner understands that the City will not issue any building permits or business licenses for any use on the Subject Property that creates a parking deficiency. This Agreement does not waive or reduce the required number of parking stalls for any potential uses in the building. C. Notice to Tenants. The Property Owner shall provide a copy of this Agreement to any current or prospective tenant. The obligation to provide copies of this Agreement to tenants lies solely with the Property Owner. No duty or obligation is placed on the City to furnish copies of the Agreement to tenants. Section 2. Proiect is a Private Undertaking. It is agreed among the parties that the Project is a Eprivate undertaking by the Property Owner and that the City has no interest therein except as explicitly outlined in this Agreement and as authorized in the exercise of its governmental functions. Section 3. Duration of Agreement. This Agreement and the Type D permit required to be obtained shall expire on December 31, 2020, unless otherwise terminated pursuant to Section 7 below. Upon expiration of the Agreement, Property Owner shall discontinue use of the ROW Area, unless the Property Owner obtains a new Type D permit and enters into a new right of way use agreement with the City, or the right-of-way is vacated. This Agreement provides no assurances or guarantees that the City will permit parking in the ROW Area beyond December 31, 2020, or that the City Council will approve a street vacation. Section 4. Termination. This Agreement shall terminate on December 31, 2020, or as otherwise provided below: A. The Property Owner can terminate the Agreement by providing the City 90-days' written notice. B. This Agreement shall terminate automatically on July 1, 2016 if a building permit to complete a tenant improvement is not obtained by the Property Owner by July 1, 2016. Nothing in this Agreement shall extend the expiration date of any permit or approval issued by the City for any development. Furthermore, if any tenant improvement permits, issued prior to July 1, 2016, subsequently expire due to inactivity, then this Agreement shall terminate immediately upon such expiration. C. ' Upon ten days' written notice, the City may terminate the Agreement if: 1. Property Owner fails to apply for and receive a Type D Right of Way Use Permit within 120 days of executing this Agreement; 2. The Property Owner fails to maintain insurance as required by TMC 11.08.100; 3. The Property Owner fails to keep the ROW Area free of rubbish, garbage and debris; 4. The uses in the building on the Subject Property create a parking requirement exceeding the maximum parking spaces available on the Subject Property and in the ROW Area; 5. The Property Owner or occupants fail to obtain any required licenses, permits, or approval from the City; or 6. The Property Owner sells or transfers his interest in the Subject Property. Section 5. Condition of Right -of -Way Upon Termination. Upon expiration or termination of this Agreement, the Property Owner shall ensure that no garbage, debris, and/or rubbish is located in the ROW Area. The Property Owner shall remove any parking signage (i.e. handicapped parking signs, etc) or wheel stops that may have been placed in the ROW Area. All work outlined in this section shall occur no later than 14-days from expiration or termination of this Agreement. In the event of noncompliance, the City may remove the items and bill the Property Owner for the cost of removal and disposal. Section 6. Governing Law and Venue. This Agreement shall be construed and enforced in accordance with the laws of the State of Washington. Venue for any action shall lie in King County Superior Court or the U.S. District Court for Western Washington. Section 7. Attorneys' Fees. In the event of any litigation or dispute resolution process between the Parties regarding an alleged breach of this Agreement, neither Party shall be entitled to any award of attorneys' fees. Section 8. No Third -Party Beneficiaries. This Agreement is for the benefit of the Parties hereto only and is not intended to benefit any other person or entity, and no person or entity not a signatory to this Agreement shall have any third -party beneficiary or other rights whatsoever under this Agreement. No other person or entity not a Party to this Agreement may enforce the terms and provisions of this Agreement. Section 9. Incorporation of Recitals. The Recitals contained in this Agreement, and the Preamble paragraph preceding the Recitals, are hereby incorporated into this Agreement as if fully set forth herein. Section 10. Severability. The provisions of this Agreement are separate and severable. The invalidity of any clause, sentence, paragraph, subdivision, section, or portion or the invalidity of the application thereof to any person or circumstance, shall not affect the validity of the remainder of this Agreement, or the validity of its application to other persons or circumstances. Section 11. Integration. This Agreement and its exhibits represent the entire agreement of the parties with respect to the subject matter hereof. There are no other agreements, oral or written, except as expressly set forth herein. Section 12. Authority. The Parties each represent and warrant that they have full power and actual authority to enter into this Agreement and to carry out all actions required of them by this Agreement. All persons are executing this Agreement in their representative capacities and represent and warrant that they have full power and authority to bind their respective organizations. Section 13. Amendment to Agreement; Effect of Agreement on Future Actions. This Agreement may be amended by mutual consent of all of the parties, provided that any such amendments are in writing. Section 14. Notices. Notices, demands, correspondence to the City and Property Owner shall be sufficiently given if dispatched by pre -paid first-class mail to the addresses of the parties as designated in Section 5. Notice to the City shall be to the attention of the Public Works Director and Economic Development Manager. Notices to subsequent Landowners shall be required to be given by the City only for those Landowners who have given the City written notice of their address for such notice. The parties hereto may, from time to time, advise the other of new addresses for such notices, demands or correspondence. Section 15. No Assignment. This Agreement shall not be assigned by either party. Section 16. Police Power. Nothing in this Agreement shall be construed to diminish, restrict or limit the police powers of the City granted by the Washington State Constitution or by general law. Section 17. No Presumption Against Drafter. This Agreement has been reviewed and revised by legal counsel for both Parties and no presumption or rule that ambiguity shall be construed against the party drafting the document shall apply to the interpretation or enforcement of this Agreement. Section 18. Legal Representation. In entering into this Agreement, Property Owner represents that it has been advised to seek legal advice and counsel from its attorney concerning the legal consequences of this Agreement; that it has carefully read the foregoing Agreement and knows the contents thereof, and signs the same of its own free act; and that it fully understands and voluntarily accepts the terms and conditions of this Agreement. The building is actually two distinct sections that share a full -height stud wall. The north portion of the building, Retail and Retail Storage is approximately 2,300 square feet and the roof is an average height of 10'-0" above finished floor. The south portion of the building, Industrial Storeroom and Offices, is approximately 3,270 square feet and the roof is about 19'-0" above the finished floor. There is a wood framed loft at 10'-0" above the floor along the west wall of this portion and also above the offices along the east wall. The lofts are framed with 2x12's and a double layer of 1/2" plywood. Reference Sheet A2.0 to view this in plan. The loft along the east wall does brace the wall and also contributes additional walls in line with the storefront. The majority of this remodel consists of replacing existing exterior doors and windows with new storefront systems. Several of the existing exterior wall openings will be filled in with framing to match the existing. This part of the remodel will improve the structural integrity of the existing structure. A new opening is proposed to access the Industrial Showroom in the Southeast corner with a man -door in this same wall segment. All correction requests from each department must be addressed at the same time and reflected on your drawings. I have enclosed comments from the following departments: BUILDING DEPARTMENT: Allen Johannessen at 206-433-7163 if you have questions regarding these comments. 1. The plan shows an ADA parking stall. However the stall does not appear to meet the requirements for a van parking stall. There shall be at least one "ADA Van Parking stall. Revise the plan to show hatch markings provided adjacent to the ADA parking with all dimensions for the ADA off-loading space and ADA parking stall. Show the location of the van parking sign on the site plan. Also specify with details the access to the walkways from the parking shall meet ANSI barrier free changes in level. (IBC 1106.5, ANSI 303 & Section 502) 2. Both interior and exterior ramps are not in compliance with ANSE standards. The minimum clear width of the ramp shall be 36 inches. Handrails and handrail supports that are provided on the ramp run shall not project into the required clear width of the ramp run. The total width of the exterior ramp is shown as 36 inches wide which will not work with the handrails inside that width. Also Change of direction from both ramps shall not be less than 60 inches at the ramp landings. Revise plan to show ramps meet currant ANSI standards. Also include edge protection details for these ramps. (ANSI 405.5, 405.7 & 405.9) 3. At the front entrance the maneuvering clearance of the walkway appears not to meet the required width. Where a door is provided with a closer, the minimum width shall be 54 inches. Show the dimensions for the walkway leading to the entry door to show ADA compliance. (ANSI 404.2.3 & Table 404.2.3.2 #f.) 4. The cover sheet indicates prescriptive approach for energy code compliance. It is not clear as to how the building is heated with the individual spaces. Where the new bathrooms (and offices) are to be installed, they will need to be insulated to meet currant energy codes especially if the warehouses are semi heated spaces or are not up to currant energy codes. This means ceilings shall be minimum R-38, walls R-21. Demising wall shall also be insulated. Bathrooms shall be provided with a source of heat to protect pipes from possible freezing. Please provide clarification and to show energy code compliance with revised details. 5. Provide a reflective ceiling plan to indicate lighting changes. Also specify if any changes to the mechanical ventilation. Provide a completed 2012 WSEC building code compliance form. In addition provide a lighting budget compliance form specifying any changes to the building lighting and new lighting to be installed. Any construction, alteration, improvement, or repair carried on within the limits and boundaries of any site or reservation under the legal jurisdiction of the federal government; 8. Any work or operation on one undertaking or project by one or more contracts, the aggregate contract price of which for labor and materials and all other items is less than five hundred dollars, such work or operations being considered as of a casual, minor, or inconsequential nature. The exemption prescribed in this subsection does not apply in any instance wherein the work or construction is only a part of a larger or major operation, whether undertaken by the same or a different contractor, or in which a division of the operation is made into contracts of amounts less than five hundred dollars for the purpose of evasion of this chapter or otherwise. The exemption prescribed in this subsection does not apply to a person who advertises or puts out any sign or card or other device which might indicate to the public that he or she is a contractor, or that he or she is qualified to engage in the business of contractor; io. Any construction or operation incidental to the construction and repair of irrigation and drainage ditches of regularly constituted irrigation districts or reclamation districts; or to farming, dairying, agriculture, viticulture, horticulture, or stock or poultry raising; or to clearing or other work upon land in rural districts for fire prevention purposes; except when any of the above work is performed by a registered contractor; 11. An owner* who performs maintenance, repair, and alteration work in or upon his or her own properties, or who uses his or her own employees to do such work; 14. A licensed architect or civil or professional engineer acting solely in his or her professional capacity, an electrician certified under the laws of the state of Washington, or a plumber certified under the laws of the state of Washington or licensed by a political subdivision of the state of Washington while operating within the boundaries of such political subdivision. Any person who engages in the activities herein regulated as an employee of a registered contractor with wages as his or her sole compensation or as an employee with wages as his or her sole compensation; 16. Contractors on highway projects who have been prequalified as required by RCW 47.28.070, with the department of transportation to perform highway construction, reconstruction, or maintenance work; 17. A mobile/manufactured home dealer or manufacturer who subcontracts the installation, set-up, or repair work to actively registered contractors.
