You have been in communication with Phil Sodoma regarding this property. I am in receipt of your Correction Letter No. 2, dated December 1, 2014, wherein you request written confirmation as to whether the property will be used as a boarding house or correctional facility as defined in TMC 18.06.073 and 18.06.178. You also requested more information regarding the wet bar. My client will confirm the details of the wet bar with you directly. The purpose of my letter is to help my client expedite the permitting process so they can begin the remodel and update of the property. It appears that the City of Tukwila is delaying permit approval because of concerns about how my client may intend to use the house — specifically that it may be used as a "clean and sober" house. Mr. Sodoma previously communicated to the City of Tukwila that he was keeping his options open as to the use of the property. His primary plan is to use this as a "clean and sober" home, but he reserves his option to use the property as an adult family home, a "regular" rental, or simply renovate the home and sell it. The intended renovation modifies what is already in the home and is necessary regardless of the use. The requested permit does not ask for additional space or rooms. Rather, some of the modifications bring the property into compliance with existing code and allows for greater accessibility to individuals with disabilities. The primary use of the property will not change. The property will continue to be used as a dwelling which fits squarely within the zoning requirements. My client requests approval of the permit in order to avoid any further monetary damages due to the delay. A legal analysis regarding "clean and sober housing" and boarding homes is provided below, as many municipalities are unfamiliar with the law and the operation of these dwellings. CORRECTION LTR# t„ Dig--o3Is RECEIVED CITY OF TUKWILA DEC 1 2 2014 PERMIT CENTER 2 Despite the City of Tukwila's prohibition of boarding houses in certain residential zones, federal law, state law, and corresponding case law prohibit the City of Tukwila from discriminating against disabled individuals by use of local zoning codes and permitting process. The Federal Housing Act Amendment (FHAA) and Fair Housing Act (FHA) were enacted to protect individuals with disability.' The FHA and FHAA have been applied to local zoning codes. E.g., City of Edmonds v. Oxford House, Inc. 514 U.S. 725, 115 S. Ct. 1776, 131 L. Ed. 2d 801 (1995). Boarding homes and "clean and sober" homes are protected by the FHA and FHAA because they fit the definition of a dwelling. 42 U.S.C. § 3602(d). Moreover, courts recognize that individuals recovering from drug addiction and alcoholism fall under the protections of the FHA and FHAA.2 The Washington Housing Protection Act (WHPA) also prohibits "ordinances, practices or policies that distinguish between residential structures based on the residents' handicaps and familial status, regardless of a city's intent when enacting or enforcing the ordinance, policy or practice." Sunderland Family Treatment v. City of Pasco, 107 Wn. App. 109, 119-20, 26 P.3d 955 (2001); see also RCW 35A.63.240. The City of Tukwila's definition of "boarding house" and exclusion of them from certain residential zones is the type of ordinance which courts have previously invalidated. The definition is so broad that it could arguably encompass "clean and sober" homes for individuals recovering from alcoholism and drug addiction. Denying individuals with a disability the opportunity to reside in the residence of their choice in the community is the exact result the FHAA intended to prevent. H. Rep. No. 100-711, at 24 (1888), as reprinted in, 1988 U.S.C.C.A.N. 2173, 2185. If this matter were to go before a court, it would find that the City of Tukwila's ordinance is invalid based upon a disparate treatment and/or disparate impact analysis. Assuming for the sake of argument that the City of Tukwila's ordinance is valid, a failure to make a reasonable accommodation for people with disabilities gives rise to a cause of action under FHAA. Sunderland, 107 Wn. App. at 119, 26 P.3d at 961. The WHPA has a lower standard than the FHAA and all that must be established is that an ordinance treats residential structures occupied by handicapped persons differently than a structure occupied by a family or other unrelated individuals. Id. if you need more details regarding "clean and sober" homes, my client can easily provide you with that information. Typically, tenancy is conditioned upon following house rules and living a sober lifestyle. Their intended use would not operate as a rehabilitation facility or require confinement of any kind. However, my client is not prepared to unequivocally state that a "boarding house" will not be operated since a "clean and sober" house could arguably fit into that definition. Whether my client uses the property as an "ordinary" rental or a "clean and sober" rental is immaterial to the approval of the permit at issue. In either case, the remodel and updates are necessary. Failure to grant a reasonable Other laws prohibiting discrimination on the basis of handicap also apply to zoning codes and permitting processes. See e.g. Section 504 of the Rehabilitation Act of 1973, 29 U.S.C. § 794(a); Americans with Disabilities Act, 42 U.S.C. § 12132. 2 The intent to include recovering drug addicts and alcoholics under the protections of handicapped individuals became clear when Congress adopted the Rehabilitation Act of 1973, prior to the FHA. In discussing the Legislative intent of Congress, the court stated "[i[ndividuals who have a record of drug use or addiction but who are not currently using illegal drugs would continue to be protected if they fell under the definition of handicap...Just like any other person with a disability, such as cancer or tuberculosis, former drug -dependent persons do not pose a threat to a dwelling or its inhabitants on the basis of status. Depriving such individuals of housing, or evicting them, would constitute irrational discrimination that may seriously jeopardize their continuing recovery." Oxford House v. Township ofCheriy Hill, 799 F.Supp. 450, 459 (D.N.J. 1992.). See also 24 C.F.R. § 100 201(a)(2); City of Edmonds, Supra. • 3 accommodation if the property is used as a "clean and sober" house would result in unequal treatment for persons with a disability. If the City of Tukwila finds that a "clean and sober" home fits within the definition of a boarding house, this letter serves as a formal reasonable accommodation request to the requirement that a boarding house be operated in another zone. Upholding the City's restriction would prevent disabled individuals form having an equal opportunity to use and enjoy the property.
