ORDINANCE NO. 275
AN ORDINANCE OF THE TOWN OF TUKWILA REGULATING THE SALE AND
THE OFFERING OR EXPOSING FOR SALE OF CERTAIN FIREWORKS, DE-
FINING SUCH FIREWORKS AND REGULATING THE MANNER OF USING
FIREWORKS: PROVIDING PENALTIES FOR VIOLATION OF THE PROVISIONS
OF THIS ORDINANCE AND "REPEALING ALL ORDINANCES OH PARTS OF ORDI-
NANCES IN CONFLICT HEREWITH.
BE IT ORDAINED by the Council of the Town of Tukwila as follows:
SECTION 1. Thetert "Fireworks" shall mean those items of combust-
ion or explosive composition as defined in Sections 1 and 2, of Chap-
ter 174, Laws of 1951, as enacted by the Legislature of the State of
Washington, which is hereby adopted by a reference as the Ordinance
Law of the Town of Tukwila.
SECTION 2. It shall be unlawful to sell as a wholesaler, jobber
or broker, offer for retail sale, sell retail or use or explode
those fireworks as defined and set forth in Section 3, (Jhapter 174,
Laws of 1951, as amended by Section 1, ihapter 34, Laws of 1953, as
enacted by Iiegislature of the State of Washington; which are hereby r
adopted by reference as the Ordinance Law of the Tovm of Tukwila.
SECTION 3. It shall be unlawful for any person, firm, co- partner-
ship, or corporation to offer for retail sale, expose for retail sale,
sell at retail or use or explode any fireworks within the Town of
Tukwila, except between the dates of June 25th and July 5th, inclusive,
and only between the hours 3 :00 a.m. and 12:00 midnight of each of said
days.
SGTION 4. It shall be unlawful for any person, firm,co- partnership
or corporation to engage in the retail sale of fireworks without first
having obtained a permit from the Town Clerk of the Town of Tukwila.
The fee charged for the issuance of such retail sales permit shall be
set by the License Committee after approval of the Town Council. That
in the interest of public peace, safety, morality and good order, the
Clerk of the Town shall not issue in any one year more than two retail
permits. All fees collected under this act shall be credited to the
general fund of the Town of Tukwila.
SECTION 5. One uniformed Law enforcement officer, approved by the
Towm Marshal, shall be on duty during all business hours at each
retail sales outlet.
No person shall light or explode any fireworks within a radius of 500
feet pf any retail fireworks sales outlet.
SECTION 6. All permit holders hereunder agree to save the Town of
Tukwila harmless from any liability, as a result of the sale and use
of fireworks herein permitted.
SECTION 7. The '}gown Clerk shall keep on file at all times and open
for public inspection, at least three copies of the sections of the
Session Laws of the State of Washington which were adopted hereby or
referred to herein.
SECTION 8. Any person, firm, co- partnership or corporation convict-
ed of violation of any of the provisions of this Ordinance shall be
deemed guilty of a misdemeanor and punished by a fine of not more
than 300.00 or imprisonment for a term not exceeding 90 days, or
both such fine and imprisonment.
SECTION 9. All other ordinances or parts of ordinances in conflict
herewith are hereby repealed.
SECTION 10. If any section, paragraph, sentence, clause or phrase
of this ordinance is declared unconstitutional or invalid for any
reason, such decision shall not effect the validity of the remaining
portions of this ordinance.
SECTION 11. This Ordinance shall be and become effective im1iediatel:
upon the passage and posting thereof in the manner provided by law.
PASSED at a regular meeting of the Town Council held on the 18th
day of May 1959.
