Decision on Substantive Permit: The City Community Development Director has determined that the application for a Minor
Modification to the Board of Architectural Review approved design review does comply with applicable City and state code
requirements and has that application subject to the following condition:
1. Landscaping, including trees and groundcover, shall be installed around the building to match the landscape
planting plan approved in the original design review. Landscaping shall be installed and inspected prior to final
approval of the building permit for Jos. A. Bank.
III. YOUR APPEAL RIGHTS
The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other
land use applications related to this project may still be pending.
One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not
satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the
Hearing Examiner's decision.
IV. PROCEDURES AND TIME FOR APPEALING
In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal
must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is by
April 21, 2011.
The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be
submitted to the Department of Community Development. Appeal materials MUST include:
1. The name of the appealing party.
2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other
group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf.
3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific
challenge to an MDNS.
4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision
being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal
shall be limited to matters or issues raised in the Notice of Appeal.
5. Appeal fee of $515.
V. APPEAL HEARINGS PROCESS
Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing
Examiner based on the information presented to the Community Development Director, who made the original decision.
No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral
argument based on the information presented to the Community Development Director before their decision was issued.
The Hearing Examiner's decision on the appeal is the City's final decision.
Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the
procedures and time limitations set forth in RCW ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be

included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within

for this permit and any other pending permit applications for the development of the subject property.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are available for
inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington

Dear Ms. Walker:
Based upon the plans and information submitted in connection with your request for minor modification
of the Board of Architectural Review (BAR) approval, I hereby approve the proposed changes subject to
the conditions listed at the end of this letter.
BACKGROUND
A Notice of Decision was issued by the Tukwila Board of Architectural Review on January 12, 1989
under Tukwila land use file number 88-12-DR approving design of the Southcenter Plaza Shopping
Center. Southcenter Plaza is a 170,000 square foot single story retail center consisting of four separate
buildings, including two long, linear buildings on the east ("Building B") and south ("Building A") sides
of the site which contain multiple tenant spaces, a large building on the west side of the site containing
Target, and a smaller building located adjacent to the driveway providing access to the shopping center
from Strander Blvd. One of the tenant spaces within "Building C" is the subject of this application.
On December 16, 2010, a tenant improvement permit for Jos. A. Bank was submitted to the City of
Tukwila for the tenant space located at 321 Strander Blvd formerly occupied by International Jewelers.
The tenant improvement permit proposed changes to the building exterior corresponding to the Jos. A.
Bank tenant space. These proposed changes included (1) the elimination of window transparency along
the north and south building elevations through the addition of opaque window film and the construction
of a window display area, and (2) the addition of awnings over windows on the north, west, and south
elevations of the building.
According to Tukwila Municipal Code section 18.60.030 (E):
No changes shall be made to approved designs without further BAR or Director approval and
consideration of the change in the context of the entire project; except that the Director is
authorized to approve minor, insignificant modifications which have no impact on the project
design.

The City received this request for a modification to the approved design on January 28, 2011. The
changes proposed were determined to be minor in character; subject to administrative review as a minor
modification to the approved design review.
COMPARISON OF PROPOSED MODIFICATIONS TO THE ORIGINAL APPROVED DESIGN
1. Site Plan
There are no changes to the site plan proposed as part of this modification.
2. Building Design
Window Transparency
The original design review approval for `Building C" included glazing on three sides of the building
corresponding to the proposed Jos. A. Bank tenant space; the north, west, and south building
elevations. Window transparency, especially along the public street frontage, provides visual interest
for pedestrians and motorists who are able to view activity within the store, helping to create a
desirable transition from the streetscape to the structure consistent with Board of Architectural Review
criteria in Tukwila Municipal Code section 18.60.050.
North Elevation
Original plans for the tenant improvement permit included the addition of white, frosted window film
along all of the windows of the north building elevation and construction of walls directly behind the
windows on the interior side of the glazing to create additional room for store fixtures, fitting rooms,
restrooms, and a tailoring area within the store. Staff was concerned with the addition of window film
and walls constructed directly behind the windows inside the store, effectively creating a blank wall
area along the public street frontage of Strander Blvd. Additionally, the Tukwila Sign Code does not
allow signage on building elevations that do not have an exterior public entrance, unless the site can
qualify for "Incentive Signage." Businesses may obtain approval for flush -mounted building signage
on elevations that do not contain an exterior public entrance under the following circumstances:
a. The business or use may not have any other building -mounted signage oriented in the same
direction as the incentive sign.
b. Architectural interest must be provided through at least one of the following methods:
1) At least 50 percent of the wall area between the height of two and seven feet must be
transparent with either an unobstructed view into the business or use, or a display window
with a depth of at least three feet.
2) Architectural detailing consistent with the building design using changes in color,
materials, texture and variations in the wall plane.
3) Artwork such as mosaic, mural or sculptural relief over at least 50 percent of the wall
surface.
4) One or more trellises covering at least 50 percent of the wall area between the height of
two and seven feet, planted with climbing vines and other plant materials in a planting bed
at least two feet in width and provided with permanent irrigation.
5) The allowable area of the sign is 50 percent of that calculated in "Table 2 — Allowable
Message Area for Permanent Wall Signs in Commercial and Industrial Zones."

In order to address design review concerns related to the elimination of window transparency, and in
order to qualify for incentive signage, plans for the tenant improvement permit and minor
modification application were revised to include a window display area with a depth of three feet
within two of the window bays facing Strander Blvd. The remaining window bay located in the center
of the north elevation underneath the area of decorative metal tubing is proposed to include an opaque,
"Shadow Grey" window film. This central window bay is recessed behind columns which project out
from the face of the north elevation. Rather than using the frosted white window film which would be
a contrast to the neutral earth tones of the building, the use of a grey color window film was chosen to
help make the window area less noticeable from the public street frontage. The addition of trees in
front of the central window bay, in conformance with the original landscape plan, will help screen this
area from view (see Landscaping and Site Treatment section below).
South Elevation
On the south building elevation, the glazing for the exterior public entrance and immediate area is
proposed to remain transparent, and a window display area is proposed for windows located to the
west of the public entrance. The window display area involves construction of a wall approximately
three feet behind the window area. The construction of a wall behind the windows prevents the ability
to see inside the store; however, the window display will provide visual interest for visitors to the site,
creating a desirable transition from the parking lot to the front entrance of the store.
West Elevation
The glazing on the west side of the store, including the entrance door and the windows to either side
of the entrance, is proposed to remain transparent.
A wnings
Jos. A. Bank is proposing to install awnings over windows located on the north, west, and south
building elevations. On the north elevation, two awnings are proposed on the western -most window
bays that will contain window display areas. On the west elevation, an awning is proposed on either
side of the store entrance. On the south elevation, two awnings are proposed over the two window
bays to the west of the store entrance.
Awnings installed for Jos. A. Bank stores are typically a green color, with the store name displayed on
the bottom vertical face of the awning. One of the Board of Architectural Review criteria under
Building Design in TMC 18.60.050 is "Colors should be harmonious, with bright or brilliant colors
used only for accent." The colors within the shopping center include different bands of concrete block.
The primary color concrete block color is a reddish -brown, broken up with horizontal gray bands of
concrete block. Dark grey or black tiles are incorporated into the columns which separate the window
bays for accent. Each elevation includes a peaked decorative roofline modulation in the center of the
building elevation which contains a white, tubular decorative metal grid, underneath which is a section
of concrete currently painted a maroon color to match the reddish -brown color of concrete block used
in the building. Staff requested that the applicant revise the awning color to be consistent with the
Southcenter Plaza color scheme. The black color proposed is consistent with the neutral color scheme
of the building, and will compliment the black tiles used for accent in between window bay areas.

3. Landscaping and Site Treatment
A review of the landscape planting plan originally approved during design review of Southcenter
Plaza, as well as recent pictures showing landscaping in front of the tenant space at 321 Strander Blvd,
revealed that existing landscaping does not match the original plans and that trees located between the
sidewalk and building have recently been removed. Tukwila landscaping requirements contained in
TMC 18.52.050 (b) require the property owner to maintain landscaping in conformance with the
intent of the approved landscape plan and TMC 8.28.180 for the life of the project, including keeping
all planting areas free of weeds and trash and replacement of any unhealthy or dead plant materials.
Staff reviewed the original landscape plantings plans approved during the Southcenter Plaza design
review, and subsequently made a site visit on February 28, 2011 to determine the existing landscape
conditions and to provide recommendations consistent with the original design review. The landscape
plans approved during the original design review for Southcenter Plaza show two street trees located
between the roadway and the sidewalk along Strander Blvd, as well as at least two additional trees in
the area in front of "Building C". Additionally, groundcover should be located on the north side of the
building in the landscape area between the building and the sidewalk. On the west side of the building,
there are two tree wells located on either side of the building entrance. One of these trees is missing.
On the south elevation, the landscape area has become overgrown with ivy. Staff's recommendations
to bring landscaping around the Jos. A. Bank into conformance with the design review (see attached
letter) were provided to Chris Daniell, Southcenter Plaza property manager, on March 18, 2011. As a
condition of approval of this permit, landscaping shall be replaced to be consistent with the original
landscape planting plan. Landscaping shall be installed and inspected prior to final approval of the
building permit for Jos. A. Bank.
4. Miscellaneous Structures
Building elevation drawings submitted for this minor modification permit, as well as for the sign
permit, include a variety of signage. Proposed signage includes flush -mounted building signs/walls
signs, awning face signs, additional small plaques (considered flush -mounted building signs), and
permanent window graphics. One flush -mounted building sign per elevation with an exterior public
entrance is allowed. The south and west sides of the building meet this requirement. The north
elevation has been designed to meet the criteria for incentive signage, so one flush -mounted building
sign will also be allowed on the north building elevation. The channel letter signs proposed on the
north, south, and west elevations meet the requirements in terms of the type of sign allowed. The
white color of the channel letter signs will compliment the white color of the decorative tubular metal
work on the building facade as well as the mullions. Sign details, including sign size, will be reviewed
as part of the sign permit.
Awning face signs are only permitted on awnings located over a public entrance to the building per
TMC 19.20.050 (B) (2). None of the awnings proposed will be located over an exterior public
entrance, so none of the awning face signs will be permitted. The window graphics proposed to have
the store name are considered permanent window signs. Permanent window signs are permitted to be
placed within ground -floor windows that provide a direct line of sight in and out of an area open to the
public. The only window signs which meet this requirement include those on the west building
elevation, and those window graphics located under the entry canopy on the north side of the building
including the entrance doors and the windows located on either side of the entrance doors. All signage

proposed for Jos. A. Bank - including flush -mounted building signs, awning face signs, plaques, and
window graphics as shown on elevation drawings submitted for the building permit and minor
modification permit - are not approved with this minor modification design review application and
shall be reviewed separately as part of the sign permit review.
DECISION
The proposed revisions to the approved design are considered minor modifications as permitted under
18.60.030 (E). This request for minor modification to the Board of Architectural Review approved design
is approved subject to the following conditions:

Re: Landscaping at 321 Strander within the Southcenter Plaza Shopping Center
Dear Mr. Daniell,
City of Tukwila staff made a site visit to Southcenter Plaza on Monday, February 28 to compare existing
landscaping located on the site with the landscape plans approved by the City during design review of the
Southcenter Plaza project. Staff limited review of the landscaping to areas on the north, west, and south side of the
tenant space located at 321 Strander Blvd; the tenant space for which Jos A. Bank has applied for a building and
design review permits.
Based on our observations on site and a review of the landscape plan originally approved for the area, staff has the
following recommendations to bring the landscaping into conformance with the approved landscape design and to
address comments related to screening and landscaping submitted to the applicant as part of the design review:
• Add two Red Maple (Acer rubrum) street trees between the roadway and sidewalk. You will need to
coordinate street tree location with Pam Brady of Olympic Pipeline at (425) 981-2506.
• Add Flowering Cherry or Chanticleer Flowering Pear trees on the north and west sides of the building. On
the north side of the building, trees should be placed so they screen the view of the eastern -most bank of
windows underneath the metal work where Jos A. Bank is proposing to add window film to 'eliminate
window transparency. Trees should also be placed to screen the blank wall area in the vicinity of the
service door on the north side of the building. On the west side of the building, replace the tree that is
missing from the tree well.
Add groundcover along the north side of the building in between the hedge and the grass area/sidewalk.
Recommended groundcovers include Privet Honeysuckle/Boxleaf Honeysuckle (Lonicera pileata) or
Ornamental Raspberry/Crinkled Creeper (Rubus calcinoides).
• Remove ivy from the landscape area on the west and south sides of the building, and replace with
groundcover (see recommended groundcovers above)

Below is a list of technical comments, based on a review of materials submitted with your application for
a minor modification to the design review approved by the Board of Architectural Review for the
property located at 321 Strander Blvd in Tukwila. Materials for this application were reviewed by the
Planning Department. Please revise plans and other materials submitted with your application to address
the comments listed below:
1. The window treatment for windows along the north facade facing Strander that will not be used
as a display is still a concern. We have received feedback from our Board of Architectural
Review that eliminating window transparency by placing a white film on the inside of the
window is not in keeping with the pedestrian -oriented nature that is envisioned within the
Tukwila Urban Center and the design review criteria. Use of white film particularly draws visual
attention to the blank window area. Please propose a different window treatment, which will
either create visual interest or will serve to detract attention from the proposed blank window
area. Our recommendations include creating a window display area in between the windows and
the wall, use of window blinds and/or screens of a more temporary nature than window film, or
use of a darker film that does not act to draw attention to the area. Please submit pictures of the
proposed window treatment for review. If pictures are not available, the window treatment may
be able to be reviewed through a series of inspections in the field during installation.
2. A review of the plans approved by the Board of Architectural Review, and pictures of the north
side of the building reveal that trees should be located in between the building and the sidewalk.
Google Streetview showed trees were recently located in this area, and helped to screen the area
where the wall will be placed directly behind the windows (see attached picture). Per a recent site
visit, these trees have been removed. Trees shall be replanted in this area to comply with the
original design review approval, and to help screen the blank window area from view.
3. The awnings proposed, if used, shall be located on all sides of the building. The colors and
materials used for the awnings shall be designed to match color scheme of Southcenter Plaza.
Please submit samples of materials and colors or colored building elevations showing how the
color of the awnings will tie in with the design of the rest of the shopping center.
Please let me know if you have any questions related to any of the above comments.

Dear Ms. Walker:
I have had a chance to review the application materials you submitted last week requesting a modification to the
approved Board of Architectural Review (BAR) decision, for the tenant space located at 321 Strander Blvd within
the Southcenter Plaza development. The exterior modifications proposed with your request include the addition of
awnings above windows, and the elimination of window transparency on the north and south sides of the building.
On the south side of the building and a portion of the north side of the building, a wall located a few feet back from
the windows on the interior side of the tenant space is proposed to create a window display area. The remaining
window area on the north side of the building facing Strander Blvd. will be covered on the inside of the tenant
space with a transparent film and a wall will be located directly behind the window area. In context with the scale
of the overall Southcenter Plaza development these changes will be considered a Minor Modification and will
therefore be reviewed administratively.
Your application for a Minor Modification to an approved Board of Architectural Review decision is considered

We are forwarding this letter in response to plan check corrections forwarded by
the Planning Division at the City of Tukwila. It has been brought to our attention that
our proposed frosted window film along Strander Blvd., is in violation of the design
intent established by both the City of Tukwila and the Board of Architectural Review.
With this said, we would like to apply to have our modification reviewed by the Director
of the Board of Community Development / Board of Architectural Review. Please let
this letter serve as our formal request for an exception to the Tukwila Municipal Code
(TMC) section 18.60.030 (E), for the above mentioned project.
While we have maintained 100% transparency into the two other exterior
elevations, in an effort to create the variety of detail and visual interest, as described in
the Tukwila Municipal Code, we are proposing to provide 50 percent transparency of
the wall area between the height of two and ten feet along Strander Blvd. This
transparency will provide a pedestrian view into a display area. This display area will
include a three foot depth to provide visual graphics and display to help generate
pedestrian interest and travel along Strander Blvd. It is our understanding that the City
of Tukwila and the Architectural Review Board desire to maintain visual a connection
between this building and pedestrians, and we feel this can be achieved with the above
mentioned changes.
As a national retailer, the interior of Jos A Bank retail stores are designed to
provide an enjoyable, functional and safe place for customers to shop. We provide floor
merchandise, wall merchandise, creative window displays, fitting areas, restrooms and
we also provide tailoring services. Due to the unique layout and existing location of the
two existing exit doors (not facing Strander Blvd), we were forced to locate the room for
tailoring services and the required restrooms, in a location away from our main sales
floor along Strander Blvd. Because of this, we are requesting that the City of Tukwila
and Board of Architectural Review please consider an exception to provide a frosted
window film on a single window opening along Strander Blvd. It is important for Jos A
Bank to provide privacy to their customers using the restroom facilities and staff in their
work area. The window film has been incorporated to provide a more appropriate and
presentable view of this window from the exterior.

With all of the previous items considered, we have made a great effort to maintain an
indoor retail space conducive to the sale of merchandise and utilization of tailoring
services. While we understand that 100% transparency for all windows into the space
would be ideal, we hope the City of Tukwila and Board of Architectural Review will take
into consideration our request. Floor and wall space are essential to the presentation and
sale of store merchandise which is critical to the retail success of Jos A Bank Clothiers,
and in turn, of Southcenter Plaza.
