King County Assessor, Accounting Division Washington State Department of Ecology Jack Pace, Director This letter serves as a notice of decision and is issued pursuant to TMC 18.104.170 on the following project and permit approval. I. PROJECT INFORMATION FILE NUMBER: L11-0018 TYPE OF APPLICATION: Special Permission from the Director to locate two cargo containers on a parcel. NOTIFICAION: No notification requirements for a type II land use application. LOCATION: 4600 South 134th Place, Tukwila, WA ZONING: Commercial Light Industrial (C/LI) APPLICANT: Bonny O'Conner Holaday-Parks, Inc. 4600 S 134th Place Tukwila, WA 98188 STAFF: Stacy MacGregor, Assistant Planner BACKGROUND A. The Holaday-Park property is zoned Commercial/Light Industrial use (C/LI). Tukwila Municipal Code (TMC) 18.26.030 (2) permits cargo container as an accessory use in the C/LI zone provided they obtain special permission from the Director and meet the requirements of TMC 18.50.060 (C). B. TMC 18.50.060 (C) notes the following requirements in order to place a cargo container in the C/LI zone: B 1. Only two cargo containers will be allowed per lot, maximum length of 40 feet. B2. The container is located to minimize the visual impact to adjacent properties, parks, trails, and rights of way as determined by the Director. B3. The cargo container is sufficiently screened from adjacent properties, parks, trails and rights -of -way, as determined by the Director. Screening may be a combination of solid fencing, landscaping, or the placement of the cargo containers behind, between or within buildings. If located adjacent to a building, the cargo container must be painted to match the building's color. B5. Cargo containers may not occupy any required off-street parking spaces. B6. Cargo containers shall meet all setback requirements for the zone. B7. Outdoor cargo containers may not be refrigerated. B8. Outdoor cargo containers may not be stacked. C. The application material submitted to the City included a site map showing the location of two 8'x24' proposed cargo containers. The containers are to be located outside the required side and rear yard setbacks and are not adjacent to a building. The containers are not refrigerated; they will be used to securely store materials. Some of these materials are already stored on the site but have been subject to theft or vandals. The containers will not be stacked. D. The containers are to be placed in a location that is currently used to store materials, a use permitted in the C/LI zone. Some of this area used as outdoor storage has been striped for parking. Outside of the storage area, the site (in conjunction with the adjacent warehouse to the south also owned and used by Holaday-Parks) provides 111 parking stalls; code requires 106 stalls for the Holaday-Park use. E. On April 13th, 2011, staff met the applicant onsite to view the proposed location for the cargo containers and to determine if screening is necessary. The proposed location of the containers is at the base of a hill with the Link Light Rail line and Highway 599 above. The containers may be visible from the highway and light rail but cannot be screened from above and are no more visibly detracting that the storage yard where they will be placed. F. The cargo containers are screened from view by their proposed location. To the east, the hill screens the containers. To the north, the nearest container is approximately 150' from the property line with the area between filled with vehicle parking and outdoor storage. The parcel to the south is also owned by Holaday-Parks with the building and light rail line blocking the line of site. A loading dock that always is occupied by tractor -trailers and vehicle parking blocks the line of site between the containers and the public right of way which is over 300 feet away. Any screening the City could require that would be effective would need to be taller than or as a roof over the cargo containers. G. The applicant provided a copy of a letter from Sound Transit granting Holaday-Parks permission to store materials in the guideway easement including storing materials in cargo containers. DISCUSSION The two proposed cargo containers meet the City's criteria for locating cargo containers. The containers meet the quantity and size requirements. They are located to minimize their visual impact and due to distance from other properties and topography, screening with landscaping or fencing would not be effective. They are not located next to a building or occupy any required parking spaces. They are not refrigerated or stacked. The applicant meets the code provisions that are required in order to place two cargo containers. II. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The Community Development Director has determined that the application for two cargo containers does comply with applicable City and state code requirements and has approved the application based on the findings and conclusions contained herein. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not SM Page 2 of 3 04/21/2011 H:\L11-018 Holiday Park Cargo\NOD.doc satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within fourteen (14) calendars days of the issuance of this Decision, which is May 6th, 2011. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 4. The appeal fee is per the current fee schedule, additional hourly charges may apply. In addition, all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Stacy MacGregor, who may be contacted at 206-433-7166 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. L11-018, PL11-011 Notice of Incomplete Application dated March 17, 2011 Dear Stacy, In regard to the above Notice, I have attached a new drawing of our two sites, showing the property line, setbacks as required, and parking for both lots. There is no setback required by Sound Transit, with the lease specifically stating that we may store materials under the track. You will see that I have drawn in the required parking spaces for each lot, plus some extra spaces on the 4600 side. We normally do not use the blocking spaces on 4650, with vehicles first using the extra spaces on 4600. The parking along the South property line of 4650 was approved by Fire Chief Tamaso, to ensure emergency access to the Sound Transit line. We also lease additional parking as needed from Analytical Resources across the street, but I know you cannot count those spaces for this application. As for screening, I described sight lines in my former cover letter to the application, and welcome the opportunity to discuss this further, perhaps as you suggest, with an on -site inspection. These materials may be stored loose, on metal pallets or in enclosed metal containers. Holladay Parks has also asked to be able to perform certain activities within the Guideway Easement area, including staging, loading, and fabrication and assembly using non-flammable, inert means, methods and materials. This letter constitutes written approval by Sound Transit for Holladay Parks to perform staging, loading, and fabrication and assembly using non-flammable, inert means and methods in connection with the materials approved for storage within the Guideway Easement area as provided for in the preceding paragraph. Wood pallets are considered to be flammable and their use within the Easement Area is not approved by Sound Transit. Furthermore, Holladay Parks must also understand that Sound Transit retains the right to enter the easement area to perform maintenance and/or repairs to the Guideway or the Light Rail system. Under such circumstances, Holladay Parks would be expected, after reasonable notice, to clear the area needed in order to perform such repairs and/or maintenance. The approvals set forth in this letter are personal to Holladay Parks and are irrevocable so long as Holladay Parks is the principal tenant at the subject property and so long as Holladay Parks complies with the terms of these approvals. Finally, we understand that Holladay Parks has asked about reconstruction of the fence that existed along the property's northern boundary, and about installation of fencing along the rear portion of the southern boundary and along the eastern boundary. Sound Transit will install fencing in the rear of the property along the northern and southern boundaries. These fences will become your property and you will be responsible for their maintenance. The WA State DOT will install a fence just outside of your eastern boundary. The DOT will own and maintain that fence. In order to be a complete application, the following must be added to the site plan to allow review: Show the lot line between your two parcels. Show setbacks from the containers to the east and south property lines and to the required Link Light Rail guideway. The required setback is 12.5' from the east property line as it is a second front. The required setback between your two parcels is 5' from the property line. The setback from the light rail is per your easement agreement with Sound Transit. c. An aerial photo of your site indicates that the area proposed for the cargo containers is a parking area. Demonstrate that the parking code is met for the use of your building. Create a table that shows the various uses by square foot and the required parking for each use. Ensure that the required parking is provided on the plans. These applications will expire if we do not receive the additional information within ninety days of the date of this letter unless an extension is granted pursuant to Section 18.104.070(E). These two containers both measure 8' by 24' and will be located at the back of our yard between our two buildings at 4600-4650 S. 134th PI. in Tukwila. We already have two containers on the adjacent parcel 2616600030 behind our fabrication shop, permitted in December 2003. The secure storage inside the cargo containers is necessary because we have had several break-ins that resulted in a loss of over $20,000 worth of copper and brass (these have been reported to the police). The warehouse on this parcel, and the fabrication shop and offices on the adjacent parcel will hide this storage area from the street for the most part. There is a C/LI parcel directly across the street to the West, and the location of these two new cargo containers will not be visible from the only residential properties on this street. On the East side, our entire yard is below Highway 599 and the light rail —this storage area will not be visible from the trains or cars on the freeway. The South view of this storage area is blocked by a rockery and foliage along 47th Ave. S. which dead -ends at the light rail storage yard, and the North view is from the parking area behind the Ironworkers building.
