I. The existing facility is located within a cupola structure on the rooftop. The new equipment will be located within the same structure. No changes to the cupola structure are proposed as part of this project. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that the project, as proposed, does not create a probable significant environmental impact and issued a Determination of Non - Significance (DNS). Type 2 Permit 6300 Southcenter Boulevard, Suite #100 • Tukwila, Washington 98188 • Phone 206-431-3670 • Fax: 206-431-3665 Decision on Substantive Permit: The Community Development Director has determined that the application for a Type 2 Wireless Facility Permit does comply with applicable City and state code requirements and has approved that application based on the findings and conclusions contained in the staff report. H.I. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 2 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is, by May 30, 2012. The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing parry's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as an open record hearing before the Hearing Examiner based on the testimony and documentary evidence presented at the open record hearing. The Hearing Examiner decision on the appeal is the City's final decision. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. If no appeal of the Hearing Examiner decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. The City's decision to issue a DNS, an MDNS or an EIS is final for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Jaimie Reavis, who may be contacted at 206-431-3659 for further information. Property owners affected by this decision may request a change in valuation for their property tax purposes. Contact the King County Assessor's Office for further information regarding property tax valuation changes. The proposal is to add 3 antennas, 6 Remote Radio Head (RRH) units, and one "squid" surge suppression unit to an existing facility located on the rooftop of the Hampton Heights Apartments located at 5711 S. 152nd Street (tax parcel number 115720-0370). The existing facility is located within a cupola structure on the rooftop. The new equipment will be located within the same structure. No changes to the cupola structure are proposed as part of this project. Existing Development The site is currently developed with six buildings which make up the Hampton Heights apartment complex. The wireless telecommunications facility is located on the rooftop of the building located at the southwestern corner of the property. This building includes a cupola structure in which the wireless facility is concealed. Surrounding Land Uses The property is zoned High Density Residential (HDR). Surrounding development on all sides of the subject property consists of multifamily development. BACKGROUND In 2006, the City adopted a Wireless Facilities Chapter (TMC 18.58) to the Zoning Code. The chapter provides specific location and design requirements for the placement of WCF within the City of Tukwila. Location Selection Tukwila Municipal Code (TMC) section 18.58.050 A, B and C provide a hierarchy of appropriate locations within the City. TMC section 18.58.050 A, Table A contains the different types of wireless communications and permit required, listed in order of preference from top of the table to bottom. Generally, co -locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The applicant has proposed to add the new wireless communication equipment to an existing wireless communication facility which is concealed within a rooftop architectural element of a residential building. The tables below indicate whether the applicant's proposal complies with the required standards. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. V The new equipment proposed with this application will be concealed within the cupola structure, a rooftop architectural element, which uses colors and materials consistent with the design of the apartment complex. 7. Antennas shall have the same color scheme as the structure they are located on. V The antennas will be concealed within a rooftop structure. 8. Towers shall only have safety lights if required by a government agency. V No towers or lighting are proposed. 9. No advertising is permitted on WCF V No advertising is proposed. 10. Each applicant shall be limited to an equipment enclosure of 360 square feet at each site. However, this restriction shall not apply to enclosures located within an existing commercial, industrial, residential or institutional building. V The existing equipment enclosure is approximately 286 square feet. There is no expansion of the existing equipment cabinet proposed as part of this application. Proposed facility must meet the height requirements of the applicable zoning category. a/ The new equipment will be located within an existing structure in the HDR zone. There are no changes proposed with the application which will impact the height of the existing structure. 2. Antenna aesthetics — The antennas must be concealed from view by blending with the architectural style of the building. This could include steeple -like structures and parapet walls. The screening must be made out of the same material and be the same color as the building. Antennas shall be painted to match the color scheme of the building(s). 1/ The cupola structure on the rooftop of the apartment building in which the wireless facility is located has been designed with the same materials and colors as the structure on which it is located. All equipment will be concealed within this structure. 3. Feed lines and coaxial cables should be located below the parapet of the rooftop. ,/ The feed lines and coaxial cables will be concealed from view. 4. Cabinet equipment — If cabinet equipment cannot be located within the building where the wireless communication facilities will be located, then the City's first preference is to locate the equipment on the rooftop of the building. 1/ The cabinet equipment is proposed to be concealed from view within the building. Setbacks — The proposed wireless communication facility must meet the setbacks of the applicable zoning category where the facility is to be located. 1/ The equipment will be located within the existing structure. The proposal to install 3 antennas, 6 Remote Radio Head (RRH) units, and one "squid" surge suppression unit to an existing facility located on the rooftop of the Hampton Heights Apartments located at 5711 S. 152nd Street will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in the tables above, the project meets all applicable development standards for a Type 2 concealed building attached wireless cellular facility. 3. The proposed project is compatible with the surrounding land uses in terms of traffic and pedestrian circulation, building and site design. The traffic generated from the facility will be minimal and will not have an impact on surrounding properties. 4. There will not be any noise generated from the facilities proposed with this application. 5. The new WCF have been designed in a way to minimize visual impacts. 6. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. RECOMMENDATION Staff recommends approval of this Type 2 non -concealed building attached wireless communications facility with no conditions. REVIEW OF THE ENVIRONMENTAL CHECKLIST The following lists the elements contained within the Environmental Checklist submitted for the proposed project. The numbers in the staff evaluation correspond to the numbers in the Environmental Checklist. If staff concurs with the applicant's response, this is so stated. If the response to a particular item in the checklist is found to be inadequate or clarification is needed, there is additional staff comment and evaluation. A. Evaluation is for compliance with current Federal Communications Commission (FCC) and local rules regarding public exposure to radiofrequency (RF) electromagnetic fields (EMFs). PROJECT The proposed AT&T project consists of a WCF (Wireless Communications Facility) located at 5711 S 152nd Street, Tukwila, WA 98188; Property parcel number 1157200370. AT&T site No WA647. The planned improvements will include the addition of antennas as described below. These antennas will be mounted inside an existing cupola structure at approximately 50.42' AGL to the centerline of the antennas. All antennas face outward and point directionally away. Therefore it is unlikely that anyone other than authorized RF workers could approach near enough to any of the transmit antennas to cause that person's RF exposure to exceed FCC limits. It is expected that RF exposure conditions near ground level at the site, and at all adjacent properties, due to the contributions from all transmitting antennas will be well below the FCC public exposure limit. Compliance is determined by comparing RF field predictions with the general population/uncontrolled environment (i.e., "Public") Maximum Permissible Exposure limits (MPEs) allowed by the FCC rules, as specified in CFR 47 §1.1310. The following formula has been used to calculate the power densities at specific locations: S = 0.36 x ERP / R2 Where: S = power density (mW/cm2) ERP = power in watts R = distance to the center of the radiation antenna (ft) Formula is based on Equation 9 on page 21 of OET Bulletin 65. It includes the effect of ground reflections. The Effective Radiated Power (ERP) depends on the vertical antenna pattern. THEORETICAL ANALYSIS All existing and proposed transmit antennas are highly directional and project the majority of the transmitted RF energy horizontally and well above all nearby accessible areas. The following theoretical calculations predict the peak exposure condition for a six-foot person standing at the nearest approach to the transmit antennas. A six-foot tall person standing on the ground near the base of the antenna support or building would be at least approximately 44 feet below all of the existing and proposed transmit antennas. AT&T Site WA647 5 CONTRIBUTION OF AT&T FACILITY TO RF EXPOSURE ENVIRONMENT Based on information provided by AT&T RF Engineers, the maximum ERP from any sector of the proposed AT&T facility will be Tess than or equal to 7369 watts with all channels activated. Thus the worst -case downward ERP is 73.69 watt (i.e., 1/100th of 100 watts) from the facility. By use of the power density formula previously described, with input values of 73.69 watt downwards ERP, and a distance of 44 feet, the worst -case calculated power density at head height from the AT&T facility to a six-foot person standing at ground level is 0.013445 mW/cm2. AT&T antennas will transmit and/or receive at different MHz frequency bands worst case being the LTE at 700 MHz. The Public MPE limit for the LTE frequency transmitted by this facility is 0.47 mW/cm2. The worst -case calculated exposure condition resulting from the AT&T facility is the power density divided by the Public MPE limit = 2.88107% of the Public MPE limit. This worst -case calculated exposure level is well below the 100% FCC limit. The actual exposure conditions are likely to be many times less than this worst -case value and all ground level areas are expected to have exposure conditions less than the calculated Public MPE due to the proposed AT&T facility. OTHER CARRIERS The following are examples of wireless carriers providing service to the local area: ESMR 851-866 Mhz Nextel Cellular 869-894 Mhz Verizon PCS >1800 Mhz Sprint, T-Mobile, CONTRIBUTION OF OTHER EXISTING CARRIERS TO RF EXPOSURE ENVIRONMENT To the best of our knowledge and information, there are no other carriers collocated on this structure. AT&T Site WA647 r1'ri 6 FCC COMPLIANCE The general population/uncontrolled exposure near this facility, including persons at ground level, surrounding properties, inside and on existing structures will have RF exposure much lower than the "worst case" scenario, which is a small fraction of the MPE limit. Only, trained personnel will be allowed to access the AT&T antennas and equipment for maintenance operations. It shall be the responsibility of AT&T and/or its contractors to provide adequate occupational training making employees fully aware of the potential for RF exposure, and to exercise control over their exposure that is within their occupational/controlled limits. The FCC has determined that at sites where multiple wireless facilities are co -located, the responsibility for site -wide RF safety compliance is the shared responsibility of all licensees whose facilities produce exposure conditions greater than 5% of the applicable MPE exposure limit. Thus a new applicant is responsible for compliance (or submitting an environmental assessment) at a multiple -facility site only if the proposed facility, when considered alone, would produce exposure conditions in excess of 5% of the MPEs. Wireless facilities that produce less than 5% of the applicable MPE exposure limit at accessible locations are considered to be exempt from further study. As demonstrated in this report by worst -case exposure calculations, the proposed AT&T wireless facility will produce far less than 5% of the applicable exposure limit for public environments. Therefore, pursuant to the Commission's rules no further calculations, measurements or other RF studies are required, and the proposed AT&T facility is presumed to be in compliance with the FCC's RF exposure rules. Because the proposed AT&T wireless facility is in compliance with federal rules, it is also in compliance with local regulations concerning RF exposure. The following is the complete text of 47 U.S.C. § 332(c)(7)(B)(iv): "No State or local government or instrumentality thereof may regulate the placement, construction, or modification of personal wireless service facilities on the basis of the environmental effects of radio frequency emissions to the extent that such facilities comply with the Commission's regulations concerning such emissions. AT&T Site WA647 -7- CONCLUSIONS Based on these calculations, the proposed WCF will comply with current FCC and local rules and guidelines regarding human exposure to radio frequency electromagnetic fields. This conclusion is based solely on the comparison of predicted RF conditions in specific areas with the corresponding safe exposure limits set forth in the FCC rules. The FCC exposure limits are based on recommendations by federal and private entities with the appropriate expertise in human safety issues. Proposal is for a concealed building mounted antennas, therefore a Type 2 Land Use Process and SEPA is required. 18.58.100 Concealed Building Mounted Development Requirements. 1. Height — The proposed facility must meet the height requirement of the applicable zoning category. The antennas can qualify under TMC Section 18.50.080, "Rooftop Appurtenances", if the antennas are located in a church spire, chimney or fake chimney, elevator tower, mechanical equipment room, or other similar rooftop appurtenances usually required to be placed on a roof and not intended for human occupancy. Stand-alone antennas shall not qualify as rooftop appurtenances. Answer: Proposal is for the addition of (3) new LTE antennas and ancillary equipment to be attached on existing building rooftop. The proposed antennas and equipment will be concealed with a "faux" cupola and will not increase the height of the existing. 2. Antennas aesthetics — The antennas must be concealed from view by blending with the architectural style of the building. This could include steeple -like structures and parapet walls. The screening must be made out of the same material and be the same color as the building. Antennas shall be painted to match the color scheme of the building(s). Answer: Antennas and ancillary equipment hardware will be painted to match the existing color of existing antennas and building. Proposed antennas will be contained an a faux cupola structure. 3. Feed lines and coaxial cables — Feed lines and cables should be located below the parapet of the rooftop. Answer: Coax lines will adhere to this section of the code 4. If the equipment can be screened by placing the equipment below the parapet walls, no additional screening is required. If screening is required, then the proposed screening must be consistent with the existing building in terms of color, style, architectural style and material. If the cabinet equipment is to be located on the ground, the equipment must be fenced with a 6-foot-tall fence, and materials shall be used to screen the equipment from view. The purpose of environmental review is to identify a proposal's significant adverse impacts, measures to minimize or avoid such impacts, and allow wide public review for a wide range of projects. REQUIREMENTS: SEPA review is required for any action associated with the following types of decisions: 1. Developing 10 or more dwelling units. 2. Developing agricultural structures over 10,000 s.f. 3. Developing office, school, commercial, recreational, service or storage buildings over 12,000 s.f. and 40 parking spaces (certain utility lines, personal wireless communication facilities, and normal maintenance/replacement activities are fully exempt). 4. Developing parking lots with over 40 spaces. 5. Landfills and excavations over 500 cubic yards. 6. Installation of impervious underground tanks with a capacity over 10,000 gallons. The accompanying application must be completed for anv new SEPA application or request to issue an addendum to anv previous SEPA determination. If a question does not apply, "Does not apply" or "NA" may be entered. Complete answers to the checklist may avoid unnecessary delays later. City staff may also be able to help about governmental designations (e.g., zoning, shoreline, and landmark status).
