Zoning and Comprehensive Plan Designation: High Density Residential (HDR) The following information was considered as part of review of this application. 1. SEPA Checklist and ESA screening checklist dated March 11, 2011. 2. Plans prepared by Pacific Telecom Services, LLC, dated March 25, 2011. 3. Non -Ionizing Electromagnetic Exposure Analysis and Engineering Certification prepared by Morrison Hershfield and dated March 27, 2011. 4. Coverage Map — Before and After project completion. 5. BACKGROUND/PROPOSAL The proposal is to add wireless facility equipment to an existing facility located on the rooftop of the Villanelle Apartments located at 3516 S. 146th Street (tax parcel number 004000-0315). New equipment to be added to the existing wireless telecommunications facility includes 3 antennas, 6 Remote Radio Head (RRH) units, 3 surge suppression units, and a "Back Pack" cabinet. The antennas, RRH units, and surge suppression units proposed with this application will be concealed within three new faux chimneys which will be painted to match other existing faux chimneys on the rooftop of the building. The "Back Pack" cabinet will be attached to an existing cabinet and will not increase the footprint of the equipment enclosure on the existing rooftop of the building. The new equipment will be the same height as the existing faux chimneys, which meet the definition of "Rooftop Appurtenances" under Tukwila Municipal Code section 18.50.080. V. REVIEW OF THE ENVIRONMENTAL CHECKLIST The following lists the elements contained within the Environmental Checklist submitted for the proposed project. The numbers in the staff evaluation correspond to the numbers in the Environmental Checklist. If staff concurs with the applicant's response, this is so stated. If the response to a particular item in the checklist is found to be inadequate or clarification is needed, there is additional staff comment and evaluation. A. This noise survey extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing ambient noise levels were measured on site with a Larson -Davis 820 sound level meter on February 25, 2011. Measurements were conducted as close to the proposed location as possible and the property lines in accordance with the State of Washington code for Maximum Environmental Noise Levels WAC 173-60-020. The average ambient noise level was 58 dB(A), due to traffic noise. The weather during the measurements was overcast with Tight snow and the roads were wet. Code Requirements The site is located within the City of Tukwila Zoning jurisdiction on property with an HDR zoning designation. Tukwila Municipal Code Chapter 8.22.020.5.a defines HDR as being within a Residential district. The receiving properties are all zoned HDR. The proposed new equipment consists of equipment support cabinets, which are expected to run 24 hours a day. Under Tukwila Municipal Code 8.22.040 noise from equipment on a within a Residential district is limited as follows: Residential District Receiver: Noise is limited to 55 dB(A) during daytime hours. During nighttime, defined as the hours between 10 p.m. and 7 a.m., maximum sound levels are reduced by 10 dB(A) for where the receiving property lies within a residential district of the City. As the support cabinets are expected to operate 24 hours a day, they must meet the 45 dB(A) nighttime limit. According to manufacturer data, the Alcatel -Lucent LTE cabinet produces a sound power level of 65 LW(A), which is equivalent to 55 dB(A) at 5 feet. The proposed LTE equipment will be mounted on an existing Argus TE43 rack, which is at grade level. To predict equipment noise levels at the receiving properties, this survey uses the methods established by ASHRAE and AHRI Standard 275-2010. Application factors such as location, height, and reflective surfaces, and noise reduction from intervening elements are accounted for in predicting the sound level at the receiving properties. The nearest receiving property line is 55 feet west of the equipment location. The predicted sound level at the nearest property line is shown in Table 1 below. AT&T proposes to modify the existing personal wireless facility by adding (3) new LTE antennas antennas, adding (6) RRHs units, and (3) surge suppression units mounted on existing facility on rooftop. The proposed antennas and additional appurtenances will be painted to match the existing. No increase in height. The modification will not result in a change in visual impact, and is part of a technology upgrade being performed on AT&T/New Cingular Wireless's network, in order to improve service to its customers and strengthen reliability and capacity in its network. Proposal is for a concealed building mounted antennas, therefore a Type 2 Land Use Process and SEPA is required. 18.58.100 Concealed Building Mounted Development Requirements. 1. Height — The proposed facility must meet the height requirement of the applicable zoning category. The antennas can qualify under TMC Section 18.50.080, "Rooftop Appurtenances", if the antennas are located in a church spire, chimney or fake chimney, elevator tower, mechanical equipment room, or other similar rooftop appurtenances usually required to be placed on a roof and not intended for human occupancy. Stand-alone antennas shall not qualify as rooftop appurtenances. Answer: Proposal is for the addition of (3) new LTE antennas and ancillary equipment to be attached on existing building rooftop. The proposed antennas and equipment will be concealed with faux chimneys and will not increase the height of the existing. 2. Antennas aesthetics — The antennas must be concealed from view by blending with the architectural style of the building. This could include steeple -like structures and parapet walls. The screening must be made out of the same material and be the same color as the building. Antennas shall be painted to match the color scheme of the building(s). Answer: Antennas and ancillary equipment hardware will be painted to match the existing color of existing antennas and building. The proposed antennas will be concealed in faux chimneys. 3. Feed lines and coaxial cables — Feed lines and cables should be located below the parapet of the rooftop. Answer: Coax lines will adhere to this section of the code 4. Cabinet equipment — If cabinet equipment cannot be located within the building where the wireless communication facilities will be located, then the City's first preference is to locate the equipment on the rooftop of the building. If the equipment can be screened by placing the equipment below the parapet walls, no additional screening is required. If screening is required, then the proposed screening must be consistent with the existing building in terms of color, style, architectural style and material. If the cabinet equipment is to be located on the ground, the equipment must be fenced with a 6-foot-tall fence, and materials shall be used to screen the equipment from view. Barbed wire may be used in the TVS, LI, HI, MIC/L, and MIC/H zones. Answer: Proposed "Back -Pack" cabinet will be attached to existing cabinet and will not increase the footprint of the equipment enclosure on existing building rooftop. 5. Tenant has the right to make Property improvements, alterations or additions ("Tenant Changes") appropriate for Tenant's use. Tenant agrees to comply with all applicable governmental laws, rules, statutes and regulations, relating to its use of the Communication Facility on the Property. Tenant has the right to modify, supplement, replace, upgrade, expand the equipment, increase the number of antennas or relocate the Communication Facility within the Premises at any time during the term of this Agreement. (b) Prior to the installation of Tenant's Changes, Tenant will supply the Landlord with plans and specifications ("Plans") to be reviewed and approved by the Landlord prior to commencement of Tenant's Changes. Landlord's approval will not be unreasonably withheld, conditioned or delayed (and in no event delayed beyond fifteen (15) days. After Landlord's (i) acceptance of any Plans; or (ii) failure to respond in writing to Tenant's proposed Plans within fifteen (15) days of their receipt; or (iii) failure to provide a written response within five (5) days of receipt of Plans revised by Tenant after comment from Landlord in accordance with this paragraph, the PIans will be deemed approved. After approval, the Plans will be considered incorporated in this Agreement as Exhibit 2. If the Landlord disapproves the plans then the Tenant will provide the Landlord with revised plans, such revisions to be within Tenant's reasonable discretion. In the event Landlord disapproves of the Plans upon a second (2nd) submission, Tenant may terminate this Agreement. Landlord will not knowingly permit or suffer any person to copy or utilize the Plans for any purpose other than as provided in this Agreement and will return the Plans to Tenant promptly upon request. 3. TERM. (a) The initial lease term will be five (5) years ("Initial Term"), commencing upon the Commencement Date, as defined below. The Initial Term will terminate on the last day of the month in which the fifth annual anniversary of the Commencement Date occurred (b) This Agreement will automatically renew for five (5) additional five (5) year Term(s) (the "Extension Term"), upon the same terms and conditions unless the Tenant notifies the Landlord in writing of Tenant's intention not to renew this Agreement at Least ninety (90) days prior to the expiration of the existing Term. (c) If Tenant remains in possession of the Premises after the termination or expiration of this Agreement then Tenant will be deemed to be occupying the Premises on a month to month basis (the "Holdover Term"), subject to the terms and conditions of this Agreement. (d) The Initial Term and the Extension Term and the Holdover Term are collectively referred to as the Term. ("Term"). 4. RENT. (a) Commencing on the date that Tenant commences construction (the "Commencement Date"), Tenant will pay the Landlord a monthly rental payment of _ _ „ plus any applicable tax, to Landlord, at the address set forth above, on or before the 561 day of each calendar month in advance. Rent will be prorated for any partial month. (b) Beginning with year one of the Extension Term, the monthly rent will increase by twenty percent (20%) over the previous year's rent. 5. APPROVALS. (a) Landlord agrees that Tenant's ability to use the Premises is contingent upon its suitability for Tenant's intended use and Tenant's ability to obtain all governmental licenses, permits, approvals or other relief required of or deemed necessary by Tenant for its use of the Premises, including without limitation applications for zoning variances, zoning ordinances, amendments, special use permits, and construction permits (collectively referred to as "Governmental Approvals"). Landlord authorizes Tenant to prepare, execute and file all required applications to obtain Governmental Approvals for Tenant's use under this Agreement and agrees to reasonably assist Tenant with such applications (b) Tenant has the right to obtain a title report or commitment for a leasehold title policy from a title insurance company of its choice and to have the Property surveyed by a surveyor of its choice. (c) Tenant may also obtain, at Tenant's sole cost and expense, soil boring, percolation, engineering procedures, environmental investigation or other tests or reports ("Tests") on, over, and under the Property, necessary to determine if the Tenant's use of the Premises will be compatible with Tenant's engineering specifications, system, design, operations or Governmental Approvals. 6. TERMINATION. This Agreement may be terminated, without penalty or further liability, as follows: (a) by either party on thirty (30) days prior written notice, if the other party remains in default under Paragraph 15 of this Agreement after the applicable cure periods; (b) by Tenant upon written notice, if Tenant is unable to obtain, or maintain, any required approval(s) or the issuance of a license or permit by any agency, board, court or other governmental authority necessary for the construction or operation of the Communication Facility as now and hereafter intended by Tenant or if Tenant determines in its sole discretion that the cost of obtaining or retaining the same is commercially unreasonable; (c) by Tenant on ninety (90) days written notice for any reason other than (a) or (b) above, or Paragraph 8, below, so long as Tenant pays Landlord a termination fee equal to six (6) months rent, at the current rent rate. 7. INSURANCE. Tenant will carry during the Term, at its own cost and expense, the following insurance: (i) "All Risk" property insurance for its property's replacement cost; (ii) commercial general liability insurance with a minimum limit of liability of $2,500,000 combined single limit for bodily injury or death/property damage arising out of any one occurrence; and (iii) Workers' Compensation Insurance as required by law. 8. INTERFERENCE. (a) Where there are existing radio frequency user(s) on the Landlord's Property, the Landlord will provide Tenant with a list of all existing radio frequency user(s) and their frequencies on the Property to allow Tenant to evaluate the potential for interference. Tenant warrants that its use of the Premises will not interfere with existing radio frequency user(s) on the Premises as long as the existing radio frequency user(s) operate and continue to operate within their frequencies and in accordance with all applicable laws and regulations. (b) Landlord will not grant, after the date of this Agreement, a lease, license or any other right to any third party for use of the Property, if such use may in any way adversely affect or interfere with Tenant's Communication Facility. Landlord will notify Tenant prior to granting any third party the right to install and operate communications equipment on the Property Nothing contained herein will restrict Tenant nor its successors and assigns from installing and modifying its communications equipment. (c) Landlord will not use, nor will Landlord permit its employees, tenants, licensees, invitees or agents to use, any portion of the Property in any way that interferes with the operations of Tenant or the rights of Tenant under this Agreement. Landlord will cause such interference to cease upon not more than twenty-four (24) hour notice from Tenant. In the event any such interference does not cease within the aforementioned cure period then the parties acknowledge that Tenant will suffer irreparable injury, and therefore, Tenant will have the right, in addition to any other rights that it may have at law or in equity, for Landlord's breach of this Agreement, to elect to enjoin such interference or to terminate the Agreement upon notice to Landlord. 9. INDEMNIFICATION. (a) Tenant agrees to indemnify, defend and hold Landlord harmless from and against any injury, loss, damage or liability (or any claims in respect of the foregoing), costs or expenses (including reasonable attorneys' fees and court costs) arising directly from the installation, use, maintenance, repair or removal of the Communication Facility or the breach of any provision of this Agreement, except to the extent attributable to the negligent or intentional act or omission of Landlord, its employees, agents or independent contractors. (b) Landlord agrees to indemnify, defend and hold Tenant harmless from and against any and all injury, loss, damage or liability (or any claims in respect of the foregoing), costs or expenses (including reasonable attorneys' fees and court costs) arising directly from the actions or failure to act of Landlord or its employees or agents, or the breach of any provision of this Agreement, except to the extent attributable to the negligent or intentional act or omission of Tenant, its employees, agents or independent contractors. (c) Notwithstanding anything to the contrary in this Agreement, each of Tenant and Landlord hereby waives any claims that they may have against the other with respect to consequential, incidental or special damages. 10. WARRANTIES. (a) Tenant and Landlord each acknowledge and represent that it is duly organized, validly existing and in good standing and has the right, power and authority to enter into this Agreement and bind itself hereto through the party set forth as signatory for the party below. (b) Landlord represents and warrants that: (i) Landlord solely owns the Property as a legal lot in fee simple, or controls the Property by lease or license, unencumbered by any liens, restrictions, mortgages, covenants, conditions, easements, leases, agreements of record or not of record, which would adversely affect Tenant's use and enjoyment of the Premises under this Agreement; (ii) as tong as Tenant is not in default then Landlord grants to Tenant sole, actual, quiet and peaceful use, enjoyment and possession of the Premises; (iii) its execution and performance of this Agreement will not violate any Laws, ordinances, covenants or the provisions of any mortgage, lease or other agreement binding on the Landlord; and (iv) if the Property is or becomes encumbered by a deed to secure a debt, mortgage or other security interest, Landlord will use best efforts to provide promptly to Tenant a mutually agreeable Subordination, Non -Disturbance and Attornment Agreement. 11. ENVIRONMENTAL. (a) Landlord and Tenant agree that each will be responsible for compliance with any and all environmental and industrial hygiene laws, including any regulations, guidelines, standards, or policies of any governmental authorities regulating or imposing standards of liability or standards of conduct with regard to any environmental or industrial hygiene condition or matters as may now or at any time hereafter be in effect, that are now or were related to that parry's activity conducted in, or on the Property. (b) Landlord and Tenant agree to hold harmless and indemnify the other from and to assume all duties, responsibilities, and Iiabilities at is sole cost and expense, for all duties, responsibilities and liability (for payment of penalties, sanctions, forfeitures, losses, costs, or damages) and for responding to any action, notice, claim, order, summons, citation, directive, litigation, investigation or proceeding which is related to (I) failure to comply with any environmental or industrial hygiene law, including without limitation any regulations, guidelines, standards or policies of any governmental authorities regulating or imposing standards of liability or standards of conduct with regard to any environmental or industrial hygiene conditions or matters as may now or hereafter be in effect, and (ii) any environmental or industrial hygiene conditions that arise out of or are in any way related to the condition of the Property or activities conducted by the party thereon, unless the environmental conditions are caused by the other party. (c) The indemnifications of this Paragraph specifically include reasonable costs, expenses and fees incurred in connection with any investigation of Property conditions or any clean-up, remedial, removal or restoration work required by any governmental authority. The provisions of this Paragraph will survive the expiration or termination of this Agreement. 12. ACCESS. At all times throughout the term of this Agreement, and at no additional charge to Tenant, Tenant and its employees, agents, and subcontractors, will have twenty-four hour, seven day access to and over the Property, from an open and improved public road to the Premises, for the installation, maintenance and operation of the Communication Facility and access to, over and under the Property for any utilities serving the Premises. In the event any public utility is unable to use the access provided to Tenant the Landlord hereby agrees to grant an additional access either to Tenant or to the public utility, for the benefit of Tenant, at no cost to Tenant. 13. REMOVAL All portions of the Communication Facility brought onto the Property by Tenant will be and remain Tenant's personal property and, at Tenant's option, may be removed by Tenant at any time during the Term. Landlord covenants and agrees that no part of the Communication Facility constructed, erected or placed on the Premises by Tenant will become, or be considered as being affixed to or a part oft, the Property, it being the specific intention of the Landlord that all improvements of every kind and nature constructed, erected or placed by Tenant on the Premises will be and remain the property of the Tenant and may be removed by Tenant at any time during the Term. Within one hundred twenty (120) days of the termination of this Agreement, Tenant will remove all such improvements. Footings, foundations, and concrete will be removed to a depth of one foot below grade. 14. MAINTENANCE; UTILITIES. (a) Tenant will keep and maintain the Premises in good condition, reasonable wear and tear and damage from the elements excepted. Landlord will maintain and repair the Property and access thereto, in good and tenantable condition, subject to reasonable wear and tear and damage from the elements. (b) Tenant will be solely responsible for and promptly pay all utilities charges for electricity, telephone service or any other utility used or consumed by Tenant on the Premises. Landlord will fully cooperate with any utility company requesting an easement over, under and across the Property in order for the utility company to provide service to the Tenant. In the event Tenant cannot secure its own metered electrical supply, Tenant will have the right, at its own cost and expense, to submeter from the Landlord. Tenant will pay on a monthly basis the current local utility company rate for submetered electric, after the meter is read by the Landlord and billed to Tenant. Landlord will not be responsible for interference with, interruption of or failure, beyond the reasonable control of Landlord, of such services to be furnished or supplied by Landlord. 15. DEFAULT AND RIGHT TO CURE. (a) The following will be deemed a default by Tenant and a breach of this Agreement: (i) non-payment of Rent if such rent remains unpaid for more than thirty (30) days after receipt of written notice of such failure to pay from Landlord; or (ii) Tenant's failure to perform any other term or condition under this Agreement within forty-five (45) days after receipt of written notice from Landlord specifying the failure. No such failure, however, will be deemed to exist if Tenant has commenced to cure such default within such period and provided that such efforts are prosecuted to completion with reasonable diligence. Delay in curing a default will be excused if due to causes beyond the reasonable control of Tenant. If Tenant remains in default beyond any applicable cure period, Landlord will have the right to exercise any and all rights and remedies available to it under law and equity. (b) The following will be deemed a default by Landlord and a breach of this Agreement. Landlord's failure to perform any term or condition under this Agreement within forty-five (45) days after receipt of written notice from Tenant specifying the failure. No such failure, however, will be deemed to exist if Landlord has commenced to cure the default within such period and provided such efforts are prosecuted to completion with reasonable diligence. Delay in curing a default will be excused if due to causes beyond the reasonable control of Landlord. If Landlord remains in default beyond any applicable cure period, Tenant will have the right to exercise any and all rights available to it under law and equity, including the right to cure Landlord's default and to deduct the costs of cure from any moneys owed to Landlord by Tenant 16. ASSIGNMENT/SUBLEASE. Upon written notification to the Landlord, Tenant may assign, sell or transfer its interest under this Agreement without the approval or consent of Landlord, to the Tenant's principal, affiliates, subsidiaries, subsidiaries of its principal or to any entity which acquires all or substantially all of the Tenant's assets in the market defined by the Federal Communications Commission in which the property is located by reason of a merger, acquisition, or other business reorganization. Upon notification to Landlord of such assignment, transfer or sale, Tenant will be relieved of all firture performance, liabilities and obligations under this Agreement. Tenant may not otherwise assign this Agreement without Landlord's consent 17. NOTICES. All notices, requests, demands and communications hereunder will be given by first class certified or registered mail, return receipt requested, or by a recognized overnight courier, postage prepaid, to be effective when properly sent and received, refused or returned undelivered. CONDEMNATION. In the event Landlord receives notification of any condemnation proceedings affecting the Property, Landlord will provide notice of the proceeding to Tenant within forty- eight (48) hours. If a condemning authority takes all of the Property, or a portion sufficient, in Tenant's sole determination, to render the Premises unsuitable for Tenant, this Agreement will terminate as of the date the title vests in the condemning authority. The parties will be entitled to share in the condemnation proceeds in proportion to the values of their respective interests in the Property, which for Tenant will include, where applicable, the value of its Communication Facility, moving expenses, prepaid rent, and business dislocation expenses. Tenant will be entitled to reimbursement for any prepaid Rent. 20. CASUALTY. Landlord will provide notice to Tenant of any casualty affecting the Property within forty-eight (48) hours of the casualty. If any part of the Communication Facility or Property is damaged by fire or other casualty so as to render the Premises unsuitable, in Tenant's sole determination, then Tenant may terminate this Agreement by providing written notice to the Landlord, which termination will be effective as of the date of such damage or destruction. Upon such termination, Tenant will be entitled to collect all insurance proceeds payable to Tenant on account thereof and to be reimbursed for any prepaid Rent. 21. WAIVER OF LANDLORD'S LIENS. Landlord hereby waives any and all lien rights it may have, statutory or otherwise, concerning the Communication Facility or any portion thereof The Communication Facility shall be deemed personal property for purposes of this Agreement, regardless of whether any portion is deemed real or personal property under applicable law, and Landlord hereby consents to Tenant's right to remove all or any portion of the Communication Facility from time to time in Tenant's sole discretion and without Landlord's consent. 22. MISCELLANEOUS. (a) Amendment; Waiver. This Agreement cannot be amended, modified or revised unless done in writing and signed by an authorized agent of the Landlord and an authorized agent of the Tenant. No provision may be waived except in a writing signed by both parties. (b) Short Form Lease. Either party will, at any time upon fifteen (15) days prior written notice from the other, execute, acknowledge and deliver to the other a recordable Memorandum of Lease. Either party may record this memorandum at any time, in its absolute discretion. (c) Bind And Benefit. The terms and conditions contained in this Agreement will run with the Property and inure to the benefit of the parties, their respective heirs, executors, administrators, successors and assigns. (d) Entire Agreement. This Agreement and the exhibits attached hereto, all being a part hereof; constitute the entire agreement of the parties hereto and will supersede all prior offers, negotiations and agreements. (e) Governing Law. This Agreement will be governed by the laws of the state in which the Premises are located, without regard to conflicts of law. (f) Interpretation. Unless otherwise specified, the following rules of construction and interpretation apply: (i) captions are for convenience and reference only and in no way define or limit the construction of the terms and conditions hereof; (ii) use of the term "including" will be interpreted to mean "including but not limited to"; (iii) whenever a party's consent is required under this Agreement, except as otherwise stated in the Agreement or as same may be duplicative, such consent will not be unreasonably withheld, conditioned or delayed; (iv) exhibits are an integral part of the Agreement and are incorporated by reference into this Agreement; (v) use of the terns "termination" or "expiration" are interchangeable, and (vi) reference to a default will take into consideration any applicable notice, grace and cure periods. The following theoretical calculations predict the peak exposure condition for a six-foot person standing at the nearest approach to the transmit antennas. A six-foot tall person standing on the ground near the base of the antenna support or building would be at least approximately 32 feet below all of the existing and proposed transmit antennas. AT&T Site SG19 m� 5 CONTRIBUTION OF AT&T FACILITY TO RF EXPOSURE ENVIRONMENT Based on information provided by AT&T RF Engineers, the maximum ERP from any sector of the proposed AT&T facility will be Tess than or equal to 2089 watts with all channels activated. Thus the worst -case downward ERP is 20.89 watt (i.e., 1/100th of 100 watts) from the facility. By use of the power density formula previously described, with input values of 20.89 watt downwards ERP, and a distance of 32 feet, the worst -case calculated power density at head height from the AT&T facility to a six-foot person standing at ground level is 0.007344 mW/cm2. AT&T antennas will transmit and/or receive at different MHz frequency bands worst case being the LTE at 700 MHz. The Public MPE limit for the LTE frequency transmitted by this facility is 0.47 mW/cm2. The worst -case calculated exposure condition resulting from the AT&T facility is the power density divided by the Public MPE limit = 1.57371% of the Public MPE limit. All ground level areas are expected to have exposure conditions less than the calculated Public MPE due to the proposed AT&T facility. OTHER CARRIERS The following are examples of wireless carriers providing service to the local area: ESMR 851-866 Mhz Nextel Cellular 869-894 Mhz Verizon PCS >1800 Mhz Sprint, T-Mobile, CONTRIBUTION OF OTHER EXISTING CARRIERS TO RF EXPOSURE ENVIRONMENT Based on our information, Sprint is currently collocated on the existing structure. Worst case parameters of similar facilities in the area, the maximum ERP from any sector of the existing Sprint antennas on the structure is less than or equal to 3000 watts with all channels activated. Therefore the worst -case downward ERP is 3000 / 100 = 30 watts from the existing facility. By use of the power density formula previously described, with input values of 30 watts downwards ERP, and a distance of 32 ft, the worst -case calculated power density at head AT&T Site SG19 6- height from the existing Sprint facility to a six-foot person standing at ground level is 0.0105469 mW/cm2. All of the existing antennas transmit and/or receive within the PCS, ESMR or Cellular frequency band. The Public MPE limit for all frequencies at worst case scenario for the purpose of this calculation is 0.567 mW/cm2. The worst -case calculated exposure condition resulting from Sprint's facility is the power density divided by the Public MPE limit = 1.86121 % of the Public MPE limit. All accessible ground level areas are expected to have exposure conditions less than the calculated Public MPE due to this existing facility. COLOCATED FACILITITES TOTAL MPE The predicted maximum worst -case RF exposure conditions resulting from all proposed and existing wireless facilities at all ground -level areas is the arithmetic sum of the contributions from each facility: 1.57371 + 1.86121 = 3.43492% of the Public MPE limit allowed by FCC rules. This worst -case calculated exposure level is well below the 100% FCC limit. The actual exposure conditions are likely to be many times less than this worst -case value. FCC COMPLIANCE The general population/uncontrolled exposure near this facility, including persons at ground level, surrounding properties, inside and on existing structures will have RF exposure much lower than the "worst case" scenario, which is a small fraction of the MPE limit. Only, trained personnel will be allowed to access the AT&T antennas and equipment for maintenance operations. It shall be the responsibility of AT&T and/or its contractors to provide adequate occupational training making employees fully aware of the potential for RF exposure, and to exercise control over their exposure that is within their occupational/controlled limits. The FCC has determined that at sites where multiple wireless facilities are co -located, the responsibility for site -wide RF safety compliance is the shared responsibility of all licensees whose facilities produce exposure conditions greater than 5% of the applicable MPE exposure limit. Thus a new applicant is responsible for compliance (or submitting an environmental assessment) at a multiple -facility site only if the proposed facility, when considered alone, would produce exposure conditions in excess of 5% of the MPEs. AT&T Site SG19 iri -7- Wireless facilities that produce Tess than 5% of the applicable MPE exposure limit at accessible locations are considered to be exempt from further study. As demonstrated in this report by worst -case exposure calculations, the proposed AT&T wireless facility will produce far less than 5% of the applicable exposure limit for public environments. Therefore, pursuant to the Commission's rules no further calculations, measurements or other RF studies are required, and the proposed AT&T facility is presumed to be in compliance with the FCC's RF exposure rules. Because the proposed AT&T wireless facility is in compliance with federal rules, it is also in compliance with local regulations concerning RF exposure.
