DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of a DNS or an EIS is permitted. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. If an MDNS was issued, any person wishing to challenge either the conditions which were imposed by the MDNS decision or the failure of the Department to impose additional conditions in the MDNS must raise such issues as part of the appeal to the Hearing Examiner. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Community Development Director decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision; that is, by May 22nd, 2012. The requirements for such appeals are set forth in Tukwila Municipal Code Ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing parry's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision, including any specific challenge to an MDNS. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Community Development Director who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Community Development Director before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. Any party wishing to challenge the Hearing Examiner's decision on this application must file an appeal pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. An appeal challenging a DNS, an MDNS or an Page 2 of 3 EIS may be included in such an appeal. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be fmal. The City's decision to issue a DNS, an MDNS or an EIS is fmal for this permit and any other pending permit applications for the development of the subject property. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Jaimie Reavis, who may be contacted at 206-431-3659 for further information. A new GPS antenna and three new LTE cables are proposed to be added to an existing ice bridge. The new cables on the ice bridge will run alongside the existing cables. LTE equipment that will be back pack mounted is proposed to be installed inside the existing equipment shelter. Existing Development: There is an existing 100-foot tall wireless communication monopole on the site along with a 336 square foot equipment shelter on the site. The monopole, equipment shelter, and associated parking for maintenance of the facility are enclosed within a six-foot high chain link fence. Trees are located along the inside of the fence to help screen the facility from view along 51" Place S and from adjacent properties. Surrounding Land Uses: Primary land uses in the area consist of manufacturing and industrial uses on the east side of 51 St Place S and areas to the further to the east within the MIC/H zone, and single-family homes on the west side of 51' Place S and areas to the west, north and south in areas zoned Low Density Residential (LDR). The project site is zoned MIC/H. Location Selection Tukwila Municipal Code (TMC) provides a hierarchy of appropriate locations within the City. Generally, co - locations and utilizing existing structures are favored over the development of new standalone WCF within the City. The applicant is proposing to attach additional antennas on an existing structure in a non-residential zone. General Requirements (TMC 18.58.070) The City provides general design standards for the placement of WCF within the City of Tukwila. The design of all buildings and ancillary structures shall use materials, colors, textures, screening, and landscaping that will blend the tower facilities to the natural setting and built environment. Trees located around the perimeter of this wireless facility help screen the equipment shelter and the base of the monopole from view. 7. Antennas shall be of a neutral color that is identical or closely compactible with the supporting structure. X Antennas will be a white color to match the existing antennas on the monopole. 8. WCF poles and towers shall only have safety lights if required by a government agency. X There is no lighting proposed as part of this project. 9. Setbacks shall not apply when an applicant installs new antennas on an existing tower and uses an existing equipment enclosure. If the equipment enclosure is increased, it must meet setbacks. The existing equipment shelter will be used to house the back pack mounted equipment, and there is no change proposed to the size of the equipment enclosure. Page 4 of 5 CONCLUSIONS 1. The proposal to install three LTE antennas, one GPS antenna, six Remote Radio Head (RRH) units, one surge protector, a "back pack" LTE unit, and three lines of cable to an existing wireless facility located at 12228 51St Place S will not be materially detrimental to the public welfare or injurious to property or improvements in the vicinity. 2. As demonstrated in Tables 1 and 2 the project meets all applicable development standards for a Type 1 WCF. 3. The applicant has submitted an acoustical report which demonstrates that noise generated from the new equipment, to be located inside the existing equipment shelter, will meet the noise regulations contained in TMC 8.22. 4. The proposed project is in keeping with the goals and policies of the Comprehensive Land Use Policy Plan. 5. AT&T has applied for a business license to operate a Wireless Communications „facility at this location, per TMC 18.58.070 (2). DECISION Staff recommends approval of a Type 1 WCF with no conditions. This noise survey extends from the proposed equipment to the nearest properties. The purpose of this report is to document the existing conditions and the impacts of the acoustical changes due to the proposed equipment. This report contains data on the existing and predicted noise environments, impact criteria and an evaluation of the predicted sound levels as they relate to the criteria. Ambient Conditions Existing ambient noise levels were measured on site with a Larson -Davis 824 sound level meter on April 11, 2011. Measurements were conducted as close to the proposed location as possible and the property lines in accordance with the State of Washington code for Maximum Environmental Noise Levels WAC 173-60-020. The average ambient noise level was 65 dB(A), primarily due to traffic noise from Interstate 5 and King County Airport. The weather during the measurements was partly cloudy and the roads were dry. According to manufacturer data, the Alcatel -Lucent LTE equipment produces a sound power level of 65 LwA, which is equivalent to 55 dB(A) at 5 feet. To predict equipment noise levels at the receiving properties, this survey uses the methods established by ASHRAE and AHRI Standard 275-2010. Application factors such as location, height, and reflective surfaces, and noise reduction from the shelter or intervening elements are accounted for in predicting the sound level at the nearest receivers. The nearest receiving property is 83 feet north of the equipment location. The proposed and existing equipment are located on the ground level. The predicted sound level at the nearest property line is shown in Table 1 below. Section 2 of OET Bulletin 65 demonstrates that "for a truly worst -case prediction of power density at or near the surface, such as at ground -level or on a rooftop, 100% reflection of incoming radiation can be assumed, resulting in a potential doubling of predicted field strength and a four -fold increase in (far field equivalent) power density". Therefore the following equation is used: S = EIRP/TrR2 Where S = power density (mW/cm2), EIRP = equivalent isotropically radiated power and R = distance to the center of the radiation antenna (cm) Attached as an exhibit are the MPE (Maximum Power Exposure) calculations using the above referenced formula and the antenna manufacturer vertical pattern information using a conservative 20 dB loss below main lobe. The calculations show that the maximum MPE at ground level (6' above AGL) at the base of the monopole and the power density is 0.001707 mW/cm2 with power levels as provided by AT&T RF Data Sheet. This is 0.3002% of the MPE limit for the general population/uncontrolled exposure of 0.567 mW/cm2 as referenced in Table I OET Bulletin 65 Appendix A for the lowest frequency range. ENVIRONMENTAL EVALUATION Routine environmental evaluation is required if the PCS broadband facility is less than 10 m (32.81 feet) AGL and has a total power of all channels in any given sector greater than 2,000W ERP as referenced in "Table 2 Transmitters, Facilities and Operations subject to Routine environmental Evaluation" of Bulletin 65. As the proposed antennas lowest point above ground level is 29.3 m (96 feet), the WCF is categorically exempt from requirement for routine environmental processing. FCC COMPLIANCE The general population/uncontrolled exposure near the monopole, including persons at ground level, surrounding properties, inside and on existing structures will have RF exposure much lower than the "worst case" scenario, which is a small fraction of the MPE limit. Only trained persons will be allowed to climb the monopole for maintenance operations. AT&T and/or its contractors will provide training to make the employees fully aware of the potential for RF exposure occupational training and they can exercise control over their exposure that is within the occupational/controlled limits. CONCLUSIONS Based on calculations, the proposed WCF will comply with current FCC and county guidelines for human exposure to radiofrequency electromagnetic fields. During the initial Option Period and any extensions thereto, and during the term of this Lease, Landlord agrees to cooperate with Tenant in obtaining, at Tenant's expense, all licenses and permits required for Tenant's use of the Premises (the "Governmental Approvals"). 3. TERM. The term of this Lease shall be five years, commencing on the Commencement Date, and terminating at Midnight on the last day of the month in which the fifth anniversary of the Commencement Date shall have occurred. Tenant shall have the right to extend this Lease for five additional five-year terms ("Renewal Terms"). Each Renewal Term shall be on the same terms and conditions as set forth herein, except that Rent shall be increased as provided in Paragraph 4(a) below. This Lease shall automatically be renewed for each successive Renewal Term unless Tenant shall notify Landlord of Tenant's intention not to renew this Lease at least ten (10) days prior to the expiration of the term or any Renewal Term. 4. RENT. a. Upon the Commencement Date, and during the initial five-year term of this Lease, Tenant shall pay Landlord, as rent, the sum of Four Hundred Dollars ($400.00) per month ("Rent"). Rent shall be payable on the first day of each month in advance to Landlord at Landlord's address specified in Paragraph 14 below. The Option Fee and the Additional Option Fee shall be credited to Tenant's account as Rent paid hereunder, and shall be applied toward the payment of Rent each month commencing on the Commencement Date until such funds are exhausted. During the Renewal Terms, if any, Rent shall be increased by fifteen percent SITEABCREV#P2 (15%) of the Rent in effect for the previous term. Landlord shall be responsible for communicating the amount of each rental adjustment to Tenant. For years 11 through 30 the rate of rent shall be increased annually by the Seattle Tacoma CPI, but shall increase by no more than 5% and no less than 3%. b. If this Lease is terminated at a time other than on the last day of a month, Rent shall be prorated as of the date of termination, and, in the event of termination for any reason other than nonpayment of Rent, all prepaid Rents shall be refunded to Tenant. 5. INTERFERENCE. Landlord shall not use, nor shall Landlord permit its tenants, licensees, invites or agents to use any portion of Landlord's properties in any way which interferes with the operations of Tenant. Such interference shall be deemed a material breach by Landlord, and Landlord shall have the responsibility to terminate said interference. In the event any such interference does not cease promptly, the parties acknowledge that continuing interference will cause irreparable injury to Tenant, and therefore Tenant shall have the right, in addition to any other rights that it may have at law or in equity, to bring action to enjoin such interference or to terminate this Lease immediately upon notice to Landlord. 6. IMPROVEMENTS; UTILITIES; ACCESS. a. Tenant shall have the right, at its expense, to erect and maintain on the Premises improvements, personal property and facilities, including without limitation an antenna tower and base, radio transmitting and receiving antennas, and an electronic equipment shelter (collectively the "Antenna Facilities"). The Antenna Facilities shall remain the exclusive property of Tenant, and Tenant shall have the right to remove the Antenna Facilities following any termination of this Lease. At the termination of the lease Tenant shall return the property to its original condition as close as is possible, including removal of concrete pads to one foot below grade, reasonable wear and tear accepted, excluding replacement of any foliage. b. Tenant shall have the right to install utilities, at Tenant's expense, and to improve the present utilities on the Premises (including, but not limited to the installation of emergency power generators). Tenant shall have the right to permanently place utilities on (or to bring utilities across) the Property in order to service the Premises and the Antenna Facilities. Landlord shall execute an easement evidencing this right upon Tenant's request. c. Landlord represents and warrants to Tenant that Tenant shall enjoy ingress, egress, and access from an open and improved public road to the Property adequate to service the Property and SITEABCREV#P3 the Antenna Facilities at all times during the term of this Lease or any renewal thereof at no additional charge to Tenant. Landlord shall execute an easement evidencing this right upon Tenant's request.. 7. TERMINATION. Except as otherwise provided herein, this Lease may be terminated, without any penalty or further liability, on thirty (30) days' written notice as follows: (a) by either party upon a default of any covenant or term hereof by the other party, which default is not cured within sixty (60) days of receipt of written notice of default (without, however, limiting any other right available to the parties at law, in equity, or towards or pursuant to any other provisions hereof); (b) by Tenant if it is unable to obtain or maintain any license, permit or other Governmental Approval necessary to the construction and/or operation of the Antenna Facilities or Tenant's business, or if Tenant reasonably determines the cost or time involved in obtaining such approval is prohibitive; (c) by Tenant if the Premises are or become unacceptable under Tenant's design or engineering specifications for its Antenna Facilities or the communications system to which the Antenna Facilities belong. 8. TAXES. Tenant shall pay any personal property taxes assessed on, or any portion of such taxes attributable to, the Antenna Facilities. Landlord shall pay when due all real property taxes and all other fees and assessments attributable to the Premises. However, Tenant shall pay, as additional Rent, any increase in real property taxes levied against the Premises which is directly attributable to Tenant's use of the Premises, and Landlord agrees to furnish proof of such increase to Tenant. 9. INSURANCE. a. Tenant will provide Comprehensive General Liability Insurance in an aggregate amount of $1,000,000.00, and name Landlord as an additional insured on the policy or policies. Tenant may satisfy this requirement by obtaining appropriate endorsement to any umbrella policy of liability insurance Tenant may maintain. b. Neither party shall be liable to the other (or to the other's successors or assigns) for any loss or damage caused by fire or any of the risks enumerated in a standard "All Risk" insurance policy, and, in the event of such insured loss, neither party's insurance company shall have a subrogated claim against the other. SITEABCREV#P4 10. DESTRUCTION OF PREMISES. If the Premises or the Antenna Facilities are destroyed or damaged so as, in Tenant's judgment to hinder the effective use of the Antenna Facilities, Tenant may elect to terminate this Lease as of the date of the damage or destruction by so notifying Landlord not more than 45 days following the date of damage. In such event, all rights and obligations of the parties shall cease as of the date of the damage or destruction and Tenant shall be entitled to the reimbursement of any Rent prepaid by Tenant. 11. CONDEMNATION. If a condemning authority takes all of the Property, or a portion sufficient, in Tenant's determination to render the Premises unsuitable for the use which Tenant was then making of the Premises, this Lease shall terminate as of the date the title vests in the condemning authority. The parties shall be entitled to share in the condemnation proceeds in proportion to the values of their respective interests in the Premises (which for Tenant shall include, where applicable, the value of its Antenna Facilities, moving expenses, prepaid rent, and business dislocation expenses). Sale of all or part of the Premises to a purchaser with the power of eminent domain in the face of the exercise of the power, shall be treated as a taking by condemnation. 12. HOLD HARMLESS. Tenant agrees to hold Landlord harmless from any and all claims arising from the installation, use, maintenance, repair or removal of Tenant's Antenna Facilities, except for claims arising from the negligence or intentional acts of Landlord, its agents or independent contractors. 13. RIGHT OF FIRST REFUSAL. During the term of this Lease, as extended, Landlord shall, prior to selling the Property or any portion thereof, notify Tenant in writing of the sale price and terms offered by a third party, together with a copy of the third -party offer. Tenant shall have the right of first refusal to purchase the Property or the portion to be sold, on the same terms and conditions (or cash -equivalent terms, if a property exchange is proposed) by giving Landlord notice of its intention to purchase the same within thirty (30) days of receipt of Landlord's notice. If Tenant gives no such notice of intention to purchase the Property, Landlord may sell the Property to the third party on the stated terms and price, as long as such sale closes within six (6) months of the date of the third party's offer. ASSIGNMENT. Tenant may assign or sublet this Lease upon notice to Landlord. Any sublease that is entered into by Tenant shall be subject to the provision of this Lease. Additionally, Tenant may, upon notice to Landlord, mortgage or grant a security interest in this Lease and the Antenna Facilities, and may assign this Lease and the Antenna Facilities to any such mortgagees or holders of security interests including their successor or assigns (hereinafter collectively referred to as "Mortgagees"). In such event, Landlord shall execute such consent to leasehold financing as may reasonably be required by Mortgagees. Landlord agrees to notify Tenant and Tenant's Mortgagees simultaneously of any default by Tenant and to give Mortgagees the same right to cure any default as Tenant except that the cure period for any Mortgagee shall not be less than ten (10) days after receipt of the default notice. 17. SUCCESSORS AND ASSIGNS. This Lease shall run with the Property described in Exhibit A. This Lease shall be binding upon and inure to the benefit of the parties, their respective successors, personal representatives and assigns. 18. WAIVER OF LANDLORD'S LIEN. MISCELLANEOUS. a. The substantially prevailing party in any litigation arising hereunder shall be entitled to its reasonable attorneys' fees and court costs, including appeals, if any. b. Each party agrees to furnish to the other, within ten (10) days after request, such truthful estoppel information as the other may reasonably request. c. This Lease constitutes the entire agreement and understanding of the parties, and supersedes all offers, negotiations and other agreements. There are no representation or understandings of any kind not set forth herein. Any amendments to this Lease must be in writing and executed by both parties. d. If either party is represented by a real estate broker in this transaction, that party shall be fully responsible for any fee due such broker, and shall hold the other party harmless from any claims for commission by such broker. e.
