Tukwila, WA 98188 RE: Boundary Line Adjustment L11-037 PL11-028 (Project File Number) 15857 42nd Ave S. (Parcel #s 810860-0682 and 810860-0702) Dear Mr. Mitin, The Short Subdivision Committee has completed review of your Boundary Line Adjustment application (No. L11-035), and determined that it complies with all applicable City code requirements. The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. This letter serves as the Notice of Decision per TMC 18.104.170. Based on the latest project submittal, preliminary approval is granted subject to the conditions stated below. There are three basic steps in the boundary line adjustment approval process; (1) Preliminary Approval; (2) Final Approval, and (3) Recording. Instructions for each step are provided below. 1. Preliminary Approval This letter constitutes your preliminary approval. The application was reviewed by the Tukwila Short Subdivision Committee and approved with conditions. The conditions imposed are to ensure the boundary line adjustment is consistent with the Criteria for Preliminary Approval listed at TMC 17.08.030 (C) in the Tukwila Subdivision Code. The existing sheds on new Parcel Z are only allowed as an accessory use. Since new Parcel Z is vacant, the sheds will need to be either demolished or relocated to Parcel Y prior to final approval of this boundary line adjustment. If the sheds are relocated from Parcel Z to Parcel Y, they shall meet setback requirements. The front yard setback on Parcel Y is along the eastern property line (20 foot setback); there is a second front yard located along the south property line adjacent to S. 160th Street (10 foot setback), and the side yards for Parcel Y are located on the north and west sides of Parcel Y (5 foot setback requirement along both sides). 2. Revise boundary line adjustment survey per redlines shown on the enclosed copy to remove the sheds shown on Parcel Z of Sheet 2 of 2, and to add the Tukwila file number L11-037 to both sheets of the survey. Access 1. Revise the boundary line adjustment survey to show the location of the driveway which connects the covered carport/new garage to S. 160th Street. 2. At least two parking spaces are required for the existing home on Parcel Y. Areas of the site used to store vehicles are required to be of an approved durable uniform surface, which should consist of one of the following materials listed below. Please revise the boundary line adjustment survey to show where parking will be located to meet vehicle storage needs on Parcel Y. Please note that the area of approved durable uniform surface is limited to 1,695 square feet on Parcel Y, per TMC 8.25.020 (D). 1) Two inches of 5/8 minus compacted rock, provided mud or other fine material do not work their way to the surface of the rock. Alternate sized minus compacted rock may be used upon approval by the City; or 2) Concrete (4" Portland cement concrete) over gravel section as described in Section 8.25.010; or 3) Blacktop (2" asphalt concrete pavement) over gravel section as described in Section 8.25.010; or 4) Any other configuration of materials, approved by the City, which maintains a durable uniform surface. Miscellaneous 1. The address for new Parcel Z will be 4044 S. 160th Street. 2. At such time as a building permit is submitted for construction on Parcel Z, installation of utilities to serve Parcel Z will be required. The building permit will be reviewed according to applicable codes in place at the time the building permit is deemed complete by the City of Tukwila. Please not that current codes require new single family homes to have sprinklers for fire protection. APPEALS This boundary line adjustment approval decision may be appealed to the Hearing Examiner. One administrative appeal of the decision on the boundary line adjustment, excluding challenges to the Boundary line adjustment L11-037 JR Page 2 of 4 08/30/2011 12:56:00 PM H:\BLAS\Mitin\Preliminary Approval_Boris Mitin BLA_L11-037.doc DNS, is permitted. If no valid appeals are filed within the time limit, the decision of the Department will be final. In order to appeal the decision a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of the Notice of Decision (09/23/2011). The requirements for such appeals are set forth in Tukwila Municipal Code 18.116. Appeal materials shall include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. Any appeal shall be conducted as an open record hearing before the Hearing Examiner. The Hearing Examiner's decision on the appeal is the City's final decision. A party who is not satisfied with the outcome of the administrative appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision pursuant to the procedures and time limitations set forth in RCW Ch. 36.70C. An appeal challenging a DNS, an MDNS or an EIS may be included in such an appeal. 2. Final Approval The next step is to comply with the conditions of approval and submit the necessary boundary line adjustment documents (survey, legal descriptions, and other required paper work). All taxes and fees assessed against the property must be current prior to fmal approval. Please check with the King County Assessor's Office and the City of Tukwila Finance Department prior to submitting fmal documents. After the documents have been found to be in order, and the all of the requirements of the boundary line adjustment have been met, the Chair of the Short Subdivision Committee signs your boundary line adjustment which constitutes a grant of fmal approval. Expiration The fmal approved boundary line adjustment must be filed with the King County Department of Records by September 9, 2012, one year from the date of this preliminary approval or the application will expire. The City may grant a single one year extension if requested in writing prior to the expiration date. Recording The signature of the Chairman of the Short Subdivision Committee certifies that your boundary line adjustment application is ready for recording. It is your responsibility to record the City approved boundary line adjustment documents with the King County Department of Records. You will need to pay the recording fees and submit your approved original boundary line adjustment to King County. The boundary line adjustment is not complete until the recording occurs and copies of the recorded documents are provided to the Department of Community Development. After recording, the County returns the recorded original to the City of Tukwila within 4-6 weeks, at which time your boundary line adjustment is considered complete. You can shorten this processing time by hand -delivering a copy of the recorded boundary line adjustment to the project planner. In many circumstances, building permits on the boundary line adjustment may not be issued until a copy of the recorded boundary line adjustment (or original) is returned to the Department of Community Development. (Ord. 1833 §1(part), 1998) CHAPTER 17.08 BOUNDARY LINE ADJUSTMENTS AND LOT CONSOLIDATIONS Sections: 17.08.010 Purpose 17.08.020 Scope 17.08.030 Preliminary approval 17.08.040 Recording 17.08.050 Expiration 17.08.010 Purpose It is the intent to provide an efficient and timely process that allows consistent review; to ensure such actions do not create non -conformities with zoning and other city regulations; to provide a permanent record of boundary line adjustments and lot consolidations; and to ensure appropriate provisions are made for access and utility easements; in a manner con- sistent with RCW 58.17.040(6). (Ord. 1833 §1(part), 1998) 17.08.020 Scope This chapter applies to all boundary line adjustments and lot consolidations which are otherwise exempt from RCW 58.17.040(6), Subdivision Regulations. (Ord. 1833 §1(part), 1998) 17.08.030 Preliminary approval A. In order to receive preliminary approval, the applicant must submit to DCD a complete application, in quantities spe- cified by DCD, and meet the criteria for approval. B. A complete application consists of the following: 1. A completed application on a form provided by the Department of Community Development and fee as identi- fied in TMC Chapter 18.88. 2. A neat and readable plan drawn to a standard decimal (engineer) scale. A survey may be required if it is determined that level of information is needed to ensure the adjustment meets the approval criteria. The plan shall show the following information: ✓a. Property lines, with those that remain in their existing location shown as a solid line, those that are be- ing moved or removed shown as a dashed line, and those that have been relocated shown as a solid line and clearly identi- fied as a relocated line. .,/b. No additional lots, sites, parcels, tracts or divi- sions are created. 2. The adjustment will not create non -conforming lots with respect to zoning dimension and area standards, zon- ing setbacks and lot area coverage standards. CD The degree of non-conformance on existing non- conforming lots with respect to zoning dimension and area standards, zoning setbacks and floor area ratio are not in- creased. 4. All lots have legal access to a public road. Exist- ing required private access road improvements and easements are not diminished below subdivision ordinance standards for lots that are served by a private access road. 5. Existing easements for utilities are appropriate for their intended function, or they are extended, moved or otherwisgg altered to an appropriate location. J6. The adjustment does not create any non - conformities with respect to the Uniform Building Code or any other locally administered regulation. (Ord. 1833 §1(part), 1998) 17.08.040 Recording A. After preliminary approval has been granted, an ap- plication for final approval shall be submitted to DCD for final review. B. A complete final application shall consist of the doc- uments required for recording including: 1. Drawing or survey of the boundary line adjust- ment. 2. Before and after legal descriptions of the affected lots. 3. Affidavit of ownership. 4. Application on a form provided by the Depart- ment of Community Development. 5. Other documentation necessary to demonstrate the conditions of the approval have been met. C. Upon receiving approval from the City, the applicant will be responsible for picking up the documents from DCD and recording them with King County Office of Records. A copy of the recorded documents must be returned to DCD to finalize the approval process. The adjustment shall not be deemed complete until the City receives these documents. (Ord. 1833 §1(part), 1998) 11.08.050 Expiration The boundary line adjustment application shall expire if it has not been recorded within one year from the date of ap- proval. Upon written request from the applicant prior to the expiration date, the Short Subdivision Committee is authorized to grant one extension, not to exceed six months.
