III. YOUR APPEAL RIGHTS
The Decision on this Application is a Type 3 decision pursuant to Tukwila Municipal Code § 18.104.010.
Other land use applications related to this project may still be pending.
No administrative appeal of the Decision is permitted. A party who is not satisfied with the Hearing
Examiner's decision may file an appeal in King County Superior Court.
IV. PROCEDURES AND TIME FOR APPEALING
Any party wishing to challenge the Hearing Examiner's Decision must file an appeal pursuant to the
procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's
decision is properly filed in Superior Court within such time limit, the Decision on this permit will be
final.
VI. INSPECTION OF INFORMATION ON THE APPLICATION
Project materials including the application, any staff reports, and other studies related to the permits are
available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd.,
Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The

Property owners affected by this decision may request a change in valuation for their property tax purposes.

Introduction
The applicant seeks a conditional use permit to allow the use of 74,029 square feet within
an existing building as office space. A public hearing was held on the application on
August 18, 2011 at the Department of Community Development, 6300 Southcenter
Boulevard, Tukwila, WA. Represented at the hearing were: the Department, by Brandon
Miles, Senior Planner, and the applicant, Group Health Cooperative, by Bella Colthurst
of CB Richard Ellis, and Jeffrey Strockbine, project architect. The record was held open
after the hearing to receive documents related to a 2007 CUP decision concerning the
same building.
After due consideration of the evidence presented at the public hearing, the following
shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on
this application.

Findings of Fact
1. The property is addressed as 12400 East Marginal Way South. The site is
currently developed with a Group Health Cooperative (GHC) building approximately
326,800 square feet in size, of which 90,000 square feet is in office use and the remainder
is warehouse space. The site contains 113 surface parking spaces and 637 parking stalls
within a parking structure, for a total of 750 parking spaces. The existing uses in the
building include a mix of office, warehouse and distribution, research, and
manufacturing. The building is one of several used by GHC within the vicinity.
2. The proposal is to convert 74,029 square feet of existing warehouse space into
office space. No new construction or expansion of the existing building footprint is
proposed.
3. The Comprehensive Plan and zoning designations for the site is Manufacturing
Industrial Center/Light (MIC/L). In the MIC/L District, offices smaller than 20,000
square feet are permitted outright, and offices which are 20,000 square feet or larger may
be permitted as conditional uses.
4. The subject building was built in 1977 under King County codes in effect at the
time. The site was annexed into the City in 1989. The City did not allow standalone
zoning office buildings in the MIC/L District until 2001, so the existing GHC office use
was legally nonconforming under the Codes in effect at the time. The Code was
amended in 2001, allowing for offices in the MIC/L District as outright permitted or
conditional uses, as noted above. In 2007, GHC applied for and was granted approval of
a conditional use permit to recognize 90,000 square feet of existing space in the building
as as a permitted conditional use rather than a nonconforming use.
5. The surrounding uses include the Integrate East technology park, a trucking
facility, and two other GHC buildings located west across East Marginal Way from the
site. The other GHC buildings do not utilize the parking stalls on the subject property.
To the east is the Link Light Rail line and SR 599. To the north is a King County Metro
Transit facility, and to the south is an undeveloped sloped area.
6. The site is primarily flat, and is landscaped. Two vehicle access points are
located along East Marginal Way South. No changes to the landscaping, access points,
or other construction activities are proposed as part of this application.
7. There are currently no traffic deficiencies identified in the MIC area. At the time
of the application for a building permit, the applicant will be required to satisfy the City's
Traffic Concurrency and Traffic Impact Fee Ordinance.

8. The Code -required parking for office uses is three spaces per 1000 square feet of
usable floor area; for manufacturing uses, the requirement is one space per 1000 square
feet of usable floor area. Thus, 164,029 square feet of office use (including 90,000
square feet of current office space and the proposed 74,029 square feet of additional
office space for this proposal) would require 492 parking stalls. The remaining 51,413
square feet of manufacturing use would require 52 parking stalls. A total of 545 parking
stalls would be required by the Code for the uses at the site.
9. The criteria for the granting of a conditional use permit are set forth in TMC
18.64.050:
1.' The proposed use will not be materially detrimental to the public
welfare or injurious to the property or improvements in the vicinity of the
proposed use or in the district in which the subject property is situated;
2. The proposed use shall meet or exceed the performance standards that
are required in the district it will occupy;
3. The proposed development shall be compatible generally with the
surrounding land uses in terms of traffic and pedestrian circulation,
building and site design;
4. The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan;
5. All measures have been taken to minimize the possible adverse impacts
which the proposed use may have on the area in which it is located.
Conclusions
1. The Hearing Examiner has jurisdiction over this application pursuant to TMC
18.104.010.
2. The proposed use would not be materially detrimental to the public welfare or
injurious to properties or improvements in the vicinity or district. The proposed change
of use will not cause any changes to the exterior of the building or to the site. The change
to office use may generate higher parking demand, but there are 750 existing parking
stalls on the site, in excess of the 545 stalls that would be required under the Code. Any
impacts from increased traffic generated by the change in use would be addressed by the
Traffic Concurrency and Traffic Impact Fee Ordinance.
3. The proposed office use would meet performance standards for the MIC/L
District (identified in TMC 18.36.080). These standards relate to compliance with the

standards adopted by the Puget Sound Air Pollution Control Agency for odor, dust,
smoke and other airborne pollutants; the Code's noise standards; and adopted state and
federal standards for water quality and hazardous materials. The development at the site
currently complies with the standards and no change in this regard is expected as a result
of the increased area of office use.
4. The proposed use will be compatible with surrounding land uses with regard to
traffic and pedestrian circulation, building site and design. The existing building includes
both office and manufacturing uses, and the proposal will result in a continued mix of
those uses at this site. The change from warehouse to office use may generate additional
traffic and parking demand, but these impacts are addressed by the parking capacity at
the site and the requirements of the Traffic Concurrency and Impact Fee Ordinance.
5. The proposed use is consistent with the goals and policies of the Comprehensive
Land Use Policy Plan. The Comprehensive Plan identifies the MIC area as one intended
for industrial activity, and the Zoning Code implements this policy by limiting non-
industrial uses that may occur in the MIC. The proposed office use is anticipated by the.
Code, which was specifically amended by City Council in 2001 to permit office uses
larger than 20,000 square feet as conditional uses within the MIC/L District.
6. The possible adverse impacts of this proposal would be the generation of
additional parking demand and traffic. The impacts would be addressed by the existing
parking capacity, and compliance with the City's traffic impact ordinance.
7. The proposed conditional use would meet all of the applicable criteria and should
be granted.
Decision
The conditional use permit is hereby granted.

Industrial Center (MIC). The uses in these buildings include a mix of office, warehousing,
distribution, research, and manufacturing.
The GHC building that is subject to this application was built in 1977 under King County
jurisdiction and annexed into the City in 1989. When the City adopted its revised
Comprehensive Plan and Zoning Code in 1995, the City did not allow standalone office
buildings in the MIC, however given that GHC office use was already established it become
legally non -conforming. In 2001, the City adopted Ordnance 1954, which listed offices under
20,000 square feet as a permitted outright use in the MIC/L zone and offices over 20,000 square
feet as a conditional use. In 2007, GHC received approval of a conditional use permit from the
City to recognize the 90,000 square feet of the existing office space in the subject building as a
legal office use rather than a non -conforming use. GHC is now requesting to convert an
additional 74,029 square feet of the existing building space into office. No exterior physical
changes to the building are proposed.

Tukwila's Manufacturing/Industrial Center is an important regional center of industrial activity.
It is one of four such centers designated in King County. The Manufacturing/ Industrial Center
(MIC) is an area that is meant to preserve and enhance manufacturing and industrial activity, and
the land that allows these activities to operate. King County's Countywide Planning Policies set
parameters for the employment and uses that may occur within an MIC.
City of Tukwila Comprehensive Plan policies establish that the Manufacturing Industrial Center
is intended for industrial activity in order to "maximize the employment and economic benefits
to the people of Tukwila and the region, while minimizing the impacts on residential
neighborhoods." The Zoning Code, which implements the Comprehensive Plan's policies, limits
non -industrial uses, especially office and retail, which may occur in the MIC, and reserves the
land for industrial activities and some limited support for these uses.
The City divides the MIC area into two zoning categories, Manufacturing Industrial
Center/Heavy (MIC/H) and Manufacturing Industrial Center/Light (MIC/L). The MIC/H zoning
classification allows for heavier industrial uses than what is permitted within the MIC/L zones.
However, both zones limit uses that are not compatible with manufacturing and industrial uses.

To achieve the City's goal of preserving the MIC zone for manufacturing type of uses, several
non -compatible uses such as residential are prohibited while other uses, such as the proposed
office use is required to obtain a conditional use permit (CUP).

The applicant is requesting Hearing Examiner approval for a conditional use permit to convert
an additional 74,029 square feet to office space within an existing GHC building. The
applicant's proposal will result in a total of 164,029 square feet of office space within the
building (90,000 sf existing office + 74,029 sf proposed). No new construction or expansion of
the building footprint is proposed.
Existing Development
The site currently contains a 326,800 square foot warehouse/office building, 113 surface parking
stalls, and 637 stalls within a private parking structure (Attachment B: Site Plan and Attachment
C: Aerial Photo).
Surrounding Land Uses
Across East Marginal Way to the west are two additional GHC buildings (these building do not
use the parking on the subject property), the Intergrate East technology park and a trucking
facility. To the east is the Link Light Rail line and State Route (SR) 599. To the north is a King
County Metro Transit facility. To the south is an undeveloped slope (Attachment C: Aerial
Photo).
Topography
The site is primarily flat but does have some slopes to the south. These slopes will not be
disturbed as a result of this project (Attachment C: Aerial Photo).
Vegetation
The site has existing landscaping that will not be altered as a result of this project.
Access
Two vehicular access points are located off of East Marginal Way South. These access points
will not be altered as a result of this project (Attachment B: Site Plan).
CONDITIONAL USE PERMIT DECISION CRITERIA
The applicant is requesting to convert existing uses to additional office square footage in their
existing building. As required by TMC, a conditional use permit, approved by the Hearing

Examiner, is required. In the following discussion, the Conditional Use Permit review criteria
found in TMC 18.64 are shown in bold, followed by City staff's comments. For the applicant's
response to the criteria see Attachment E.
1. The proposed use will not be materially detrimental to the public welfare or
injurious to the property or improvements in the vicinity.
No changes to the exterior of the existing building are required as a result of this proposal. The
office use will be located within the existing building on the site. The additional parking demand
(discussed below) will be accommodated by the existing parking, both surface and structured,
located on the property (Attachment D: Existing and Proposed Floor Plan and Attachment E:
Applicants Response to CUP Critiera) .
2. The proposed use shall meet or exceed the performance standards that are required
in the district it will occupy.
TMC 18.36.080 states, that a use, activity, and operation within a structure or site shall comply
with 1) standards adopted by the Puget Sound Air Pollution Control Agency for odor, dust,
smoke and other airborne pollutants, 2) TMC Chapter 18.22 "Noise" and 3) adopted State and
Federal standards for water quality and hazardous materials.
The development currently complies with these standards. Office uses typically do not have
difficulty complying with these performance standards.
3. The proposed development shall be compatible generally with the surrounding land
uses in terms of traffic and pedestrian circulation, building and site design.
The applicant's proposal will convert existing warehouse space into office space. Office use has
a higher trip generation and parking demand than warehouse. However, the applicant's proposal
is to use an existing building and existing parking spaces to accommodate the proposed office
use. The existing site plan, existing vehicular and pedestrian access points, and existing
landscaping will not be modified as a result of this project. At the time of issuance of the
building permit to change the use from a warehouse to an office, the applicant will be required to
comply with the City's Traffic Concurrency and Traffic Impact Fee Ordinance (Attachment E:
Applicant's Response to CUP Criteria).
4. The proposed use shall be in keeping with the goals and policies of the
Comprehensive Land Use Policy Plan
In 2010 and 2011, the City of Tukwila undertook a comprehensive analysis of the City's land use
polices within the MIC area. After considerable public involvement, the City reconfirmed its
intent of protecting the MIC area from certain non -manufacturing uses. The requirement for a
conditional use permit for offices over 20,000 square feet was not changed.

As noted, GHC initially was considered a non -conforming use when it was annexed into the City.
In 2001, the City adopted Ordinance 1954, which allowed offices over 20,000 square feet within
the MIC with an approved conditional use permit application. At the time the City Council
approved Ordinance 1954, their biggest concern was impacts associated with traffic that would
be generated by the office use and the conflicts the traffic would have with the manufacturing
uses. There are currently no traffic deficiencies in the area. At the time of issuance of the
building permit, the applicant will be required to comply with the City's Traffic Concurrency and
Traffic Impact Fee Ordinance.
5. All measures have been taken to minimize the possible adverse impacts, which the
proposed use may have on the area in which it is located.
The applicant is proposing to convert existing warehouse space into office space. There will be
no exterior changes to the building or the site as a result of this project. One possible impact that
could result, is the additional parking demand created by office. Office space has a higher
parking demand than warehouse (Attachment E: Applicant's Response to CUP Critiera).

After the project is complete, the project will require 545 parking stalls. There are currently 750
total parking stalls (both surface and structured) available to the property. Thus, even with
completion of the project, there will be a total of 205 surplus parking spaces on the property
(Attachment E: Applicant's Response to CUP Critiera).
CONCLUSIONS
Permitting the conversion of an 74,029 square feet of warehouse use to office space at the subject
property should have no impact on the surrounding area given that 1) the applicant will use an
existing building and there will be no exterior changes to the building or modifications to the site
design and 2) the additional parking generated by the proposed use will be accommodated on the
site and finally 3) the additional traffic generated by the proposed use will be subject to City
Traffic Concurrency and Traffic Impact fees at the time of building permit issuance.
RECOMMENDATION
Staff recommends approval of the Conditional Use Permit with no conditions.

Expiration and Renewal of Conditional Use Permit
Per TMC 18.64.060, a conditional use permit shall automatically expire one year after a Notice
of Decision approving the permit is issued unless a building permit conforming to the plans for
which the CUP was granted is obtained within that time period. A conditional use permit shall
automatically expire unless substantial construction of the proposed development is completed
within two years from the date of a Notice of Decision approving the permit is issued.
NOTES
This conditional use permit is only to approve the use as required by Title 18. The applicant is
required to fully comply with all building, fire, public works and other city regulations at the time
of submittal of complete development application to the City.
At the time of building permit, the project is subject to the City's Traffic Concurrency and Impact
Fee Ordinance. Traffic Concurrency Test Fee to be based on Gross Floor Area (Office). Credit
may be given for existing Gross Floor Area (Warehouse — Industrial 2).
Transportation Impact Fee to be based on Gross Floor Area (Office) per TMC 9.48 and City
Ordinances 2111 & 21561. Credit may be given for existing Gross Floor Area (Industrial /
Warehousing) in Zone 3.
Applicant may provide at their own expense; a Traffic Impact / Trip Generation Study prepared
by a Washington State Licensed Engineer proficient in Transportation Engineering. The study
should calculate the Net PM Peak Hour trips for this change of use. The study will be evaluated
by the City. Completing a study may result in paying lower impact fees.

Attachment A — Review Criteria
1. The proposed use will not be materially detrimental to the public welfare or injurious to
the property or improvements in the vicinity. All office use activities will be conducted in
an existing building, with no external additions or external remodels necessary to
accommodate additional office personnel.
2. The proposed use shall meet or exceed the same standards for parking, landscaping,
yards, and other development regulations that are required in the district it will occupy.
The existing building that will house the office uses applied for meets the standards for
parking, landscaping, yards, and other development regulations required for this district.
Regarding parking at this site: The City of Tukwila Zoning Code requires 1 parking space
per each 1000 square feet of .manufacturing space, and 3 parking spaces per each 1000
square feet of office space. The existing building has a total area of 270,937 square
feet; of this amount, 90,000 square feet was originally approved in a prior Conditional
Use application to be an Office occupancy. An additional 74,029 square feet are
requested to be Office occupancy with this application, for a total Office occupancy of
164,029 square feet. The remaining 108,737 square feet are currently split between
Manufacturing space (51,413 square feet) and unclassified common areas used by all
staff — cafeterias, fitness center and locker rooms, conference rooms, circulation,
restrooms, mechanical rooms, etc. (55,495 square feet).
Existing parking capacity at this property includes a freestanding parking garage with
637 internal parking spaces; there are on -site an additional 66 standard surface parking
spaces, 30 handicap accessible parking spaces adjacent to the building, and 17 vanpool
parking spaces for a total of 750 parking spaces.
The Office occupancy requested of 164,029 sf, will require 492 parking spaces
(164,029/1000 * 3); the Manufacturing occupancy, 51,413 sf, will require 52 parking
spaces (51,413/1000 * 1), for a total required parking capacity of 545 spaces;
unallocated/available parking will total 205 spaces.
3. The proposed development shall be compatible generally with the surrounding land
uses. The surrounding land uses include stand-alone dedicated office buildings, Tight
industrial/manufacturing uses, municipal transit centers and transportation corridors that
are all compatible with the proposed office use. The building exterior is similar in
materials and appearance to the majority of facilities in this area.
4. The proposed use shall be in keeping with the goals and policies of the Comprehensive
Land Use Policy Plan. Office uses are allowed in the MIC/L zone if a Conditional Use
permit is obtained. The office uses requested in this application support activities and
uses within the existing Group Health facility that are permitted outright in the MIC/L
zone.

5. All measures shall be taken to minimize the possible adverse impacts which the
proposed use may have on the area in which it is located. Because this is an existing
building that will not be modified in any way on the exterior, the only foreseeable impact
to the area may be in additional traffic flow in this area. It should be noted that the City's
review and approval process of two Group Health office buildings constructed in 2000
across East Marginal Way South resulted in the construction of traffic improvements that
serve all quadrants of the intersection at East Marginal Way South and 124`h Street,
along with the development of a traffic monitoring program to monitor levels of service.
6. The majority of Group Health employees working within this building have flexible work
schedules that enable them to start work as early as 6 am, or as late as 10 am, reducing
congestion at the entrance to the site to a great degree. Additionally, a majority of new
staff to occupy this building will be help-line/call center staff who will, in all probability,
work on multiple shifts over an extended work day timefrrame; this, too, along with the
flexible scheduling of staff will mitigate traffic impacts into and out of the site during peak
traffic periods.

Applicant shall provide a completed Traffic Concurrency Certificate Application as
part of future Building permit — see enclosed.
Traffic Concurrency Test Fee to be based on Gross Floor Area (Office) per schedule
on Page 2 of 2 of application. Credit may be given for existing Gross Floor Area
(Warehouse — Industrial 2).
Transportation Impact Fee to be based on Gross Floor Area (Office) per TMC 9.48
and City Ordinances 2111 & 2156. See Public Works Bulletin A3 — enclosed.
Credit may be given for existing Gross Floor Area (Industrial / Warehousing) in
Zone 3.
Applicant may provide at their own expense; a Traffic Impact / Trip Generation
Study prepared by a Washington State Licensed Engineer proficient in
Transportation Engineering. The study should calculate the Net PM Peak Hour trips
for this change of use. The study will be evaluated by our Senior Transportation
Engineer for approval.

Attachment A — Review Criteria
1. The proposed use will not be materially detrimental to the public welfare or injurious to
the property or improvements in the vicinity. All office use activities will be conducted in
an existing building, with no external additions or external remodels necessary to
accommodate additional office personnel.
2. The proposed use shall meet or exceed the same standards for parking, landscaping,
yards, and other development regulations that are required in the district it will occupy.
The existing building that will house the office uses applied for meets the standards for
parking, landscaping, yards, and other development regulations required for this district.
Regarding parking at this site: The City of Tukwila Zoning Code requires 1 parking space
per each 1000 square feet of manufacturing space, and 3 parking spaces per each 1000
square feet of office space. The existing building has a total area of 270,937 square
feet; of this amount, 90,000 square feet was originally approved in a prior Conditional
Use application to be an Office occupancy. An additional 74,029 square feet are
requested to be Office occupancy with this application, for a total Office occupancy of
164,029 square feet. The remaining 108,737 square feet are currently split between
Manufacturing space (51,413 square feet) and unclassified common areas used by all
staff — cafeterias, fitness center and locker rooms, conference rooms, circulation,
restrooms, mechanical rooms, etc. (55,495 square feet).
Existing parking capacity at this property includes a freestanding parking garage with
637 internal parking spaces; there are on -site an additional 66 standard surface parking
spaces, 30 handicap accessible parking spaces adjacent to the building, and 17 vanpool
parking spaces for a total of 750 parking spaces.
The Office occupancy requested of 164,029 sf, will require 492 parking spaces
(164,029/1000 * 3); the Manufacturing occupancy, 51,413 sf, will require 52 parking
spaces (51,413/1000 * 1), for a total required parking capacity of 545 spaces;
unallocated/available parking will total 205 spaces.
3. The proposed development shall be compatible generally with the surrounding land
uses. The surrounding land uses include stand-alone dedicated office buildings, light
industrial/manufacturing uses, municipal transit centers and transportation corridors that
are all compatible with the proposed office use. The building exterior is similar in
materials and appearance to the majority of facilities in this area.
4. The proposed use shall be in keeping with the goals and policies of the Comprehensive
Land Use Policy Plan. Office uses are allowed in the MIC/L zone if a Conditional Use
permit is obtained. The office uses requested in this application support activities and
uses within the existing Group Health facility that are permitted outright in the MIC/L
zone.
5. All measures shall be taken to minimize the possible adverse impacts which the
proposed use may have on the area in which it is located. Because this is an existing
building that will not be modified in any way on the exterior, the only foreseeable impact
to the area may be in additional traffic flow in this area. It should be noted that the City's
review and approval process of two Group Health office buildings constructed in 2000
across East Marginal Way South resulted in the construction of traffic improvements that
serve all quadrants of the intersection at East Marginal Way South and 124th Street,
along with the development of a traffic monitoring program to monitor levels of service.
6. The majority of Group Health employees working within this building have flexible work
schedules that enable them to start work as early as 6 am, or as late as 10 am, reducing
congestion at the entrance to the site to a great degree. Additionally, a majority of new
staff to occupy this building will be help-line/call center staff who will, in all probability,
work on multiple shifts over an extended work day timefrrame; this, too, along with the
flexible scheduling of staff will mitigate traffic impacts into and out of the site during peak
traffic periods.
