I. Decision on Substantive Permit: The City Hearing Examiner has determined that the application for a sign variance for the placement of one monument sign does comply with applicable City and state code requirements and has approved that application, subject to the following conditions: 1. Prior to issuance of a sign permit, the applicant shall obtain a Public Works permit for all work within the City's easement. The cost associated with rotating the signal cabinet shall be borne by the applicant. If the rotation of the signal cabinet cannot be achieved in a manner approved by Public Works, the variance application will be void. YOUR APPEAL RIGHTS The Decision on this Application is a Type 3 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of the Decision is permitted. A party who is not satisfied with the Hearing Examiner's decision may file an appeal in King County Superior Court. IV. PROCEDURES AND TIME FOR APPEALING Any party wishing to challenge the Hearing Examiner's Decision must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. A public hearing on the application was held on September 8, 2011, at Tukwila City Hall. Represented at the hearing were the applicant, Wig Properties, by Mon Wig, owner; and the Department of Community Development, by Brandon Miles, Senior Planner. No member of the public offered testimony at the hearing. After due consideration of the evidence presented at the public hearing, the following shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on this application. Hearing Examiner Decision L11-041 Wig Properties Sign Variance Page 2 of 5 Findings of Fact 1. The property address for the application is 17150 Southcenter Parkway (the 'applicant noted at hearing .the property itself includes 17100 through 17250 Southcenter Parkway). The property is approximately 600 feet wide, but relatively deep, with portions of the site located as muchas a quarter -mile away from Southcenter Parkway. The site of the proposed monument sign is the northeast comer of Southcenter Parkway and Minkler Boulevard, five feet from the adjacent curb. 2. Currently, there are two large signal equipment boxes located at this corner, on a City easement over .the applicant's property, approximately four feet from the property line. Two bollards are located in front of the cabinets, and there is a small sidewalk area between the signal cabinet and the adjacent street. 3. ' The applicant proposes to install a monument sign, as shown in Attachment B. A portion of the sign would be located in front of the signal cabinets, and would encroach approximately two feet six inches into the required setback. area. One of the cabinets would be rotated, and new bollards would be installed to replace the existing bollards. The sign is intended to be visible to motorists driving north on Southcenter Parkway; the entrance to the property is approximately 500 feet north of the sign's location. 4. If the sign were located so as to meet the setback requirements at this location, it would need to be placed behind the signal cabinets, one of which is taller than the proposed sign. 5. In 2007, the Southcenter Square Development properties were constructed. At that time, the traffic signal light at Minkler Boulevard and Southcenter Parkway was upgraded, and the City placed the signal cabinets on the applicant's property. Under the Code in effect, the property was allowed two freestanding signs, which were installed along Southcenter Parkway. 6. The City amended the Code in August, 2010. Under the new provisions, the property could have up to.a total of nine freestanding signs. In 2011, the City's Board of Architectural Review (BAR) approved a Master Sign Program for the subject property, allowing installation of nine freestanding signs, including the proposed monument sign which is the subject of this application. The BAR reviewed and approved the size, location, height, area, and design of this sign. 7. The Comprehensive Plan designates the site as Tukwila Urban Center (TUC). The zoning designation is also TUC. 8:. The Department has reviewed the application and recommends approval with conditions. The sign variance criteria are set forth in TMC 19.28.030: The Hearing Examiner may grant a variance to the requirements of this code only when the applicant demonstrates compliance with the following: 1. The variance as approved shall not constitute a grant of special privilege, which is inconsistent with the intent of this Sign Code. 2. The variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located 3. Granting of the variance will not be materially detrimental to the public welfare or injurious to property, improvements or environment in the vicinity and in the zone in which the subject property is located 4. The special conditions and circumstances prompting the variance request do not result from the actions of the applicant. S. .The variance as granted represents the least amount of deviation from the prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. 6. The variance request is not inconsistent with any other adopted City plan or policy, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. 7. Granting of the variance shall result in greater convenience to the public in identifying the business location for which a Sign Code variance is sought. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 19.28.010. All of the criteria set forth in TMC 19.28.030 must be met in order to grant a variance. 2. The first criterion is that the variance as approved will not constitute a grant of special privilege inconsistent with the intent of the Sign Code. The proposed monument sign would meet all applicable Code standards except for the required setback, and would ti Hearing Examiner Decision L11-041 Wig Properties Sign Variance Page 4 of 5 be consistent with the intent of the Sign Code. No special privilege is being granted in this case, since the variance would allow for signage that could be installed but for the presence of the City's signal boxes. The three other properties at this intersection, which are not similarly constrained, are able to install monument signs at their sites. 3. The variance is necessary because of special circumstances related to the location and shape of the property, and the presence of the City's signal cabinets. As noted above, the cabinets are located where a Code -compliant monument sign could otherwise be placed. Placing a sign behind the cabinets so as to comply with the setback requirement would not be feasible, since the sign would be blocked from view by the cabinets. The depth of the property and the location of its entrance also necessitate use of a monument sign at this location to alert the public to the presence of the businesses at the site. 4. Granting the variance would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the TUC zone. The sign's dimensions and design will be consistent with the Code. The sign's location will allow for access to the signal cabinets by City staff, and will not impair pedestrian movement in the area. No impacts on vehicle traffic or safety are expected at this controlled intersection. The Department has also proposed conditions in order to ensure that the signal cabinets are protected during construction. 5. The special conditions and circumstances that necessitate the variance request are not due to the actions of the applicant. The applicant granted the City an easement in order to place the signal cabinets on the applicant's property in 2007. At that time; the property had two free-standing signs, the maximum permitted under the Code then in effect, so the granting of the easement had no effect on the location of a sign. However, the City changed the Code in .2010, which allowed the property to install additional monument signs. The applicant cannot be considered responsible for creating the circumstances that led to the need for a variance from the setback requirement. 6. The variance would allow a portion of the sign to encroach approximately two feet six inches into the required setback, although most of the sign will meet the five-foot setback requirement. The requested variance is the least amount of deviation needed to allow for a monument sign at this location which will meet other Code standards, while preserving maintenance access to the cabinets and pedestrian access at the intersection. 7. The variance request was not shown to be inconsistent with any other adopted City plans or policies. 8. The variance would allow a monument sign to be placed at this location which would result in greater convenience to the public, by advising motorists and pedestrians as to the location of the businesses at the site. A Code -compliant sign would be obscured by the signal cabinets. Prior to issuance of a sign permit, the applicant shall obtain a Public Works permit for all work within the City's easement. The Master Sign Program called for the installation of nine freestanding signs (seven monument signs and two grand monument signs) on the subject property. One of the monument signs approved as part of the Master Sign Program is the subject of this variance application. The BAR approval included the size, location, height, area and design of the sign. However, the BAR does not have the authority to approve a variance to the prescribed setback requirements for monument signs. Authority to approve variance applications lies solely with the Hearing Examiner (TMC 19.28.010). The applicant desires to place the proposed monument sign in front of two large signal equipment boxes located at the northeast corner of Southcenter Parkway and Minkler Blvd (Attachment B: Site Map and Attachment C: Aerial Photo). These signal boxes are located in a City easement on the applicant's property. As shown on Attachment B, the sign will be 5 feet from the adjacent curb and will not comply with the City's requirement that monument signs be setback five feet from all property lines. Page 2 of 9 1 Figure 2: Proposed Sign Location The question before the Hearing Examiner: Should the monument sign be allowed to encroach into the prescribed setback requirement of TMC 19.20.040 (3)? VARIANCE CRITERIA The proposed project must comply with criteria detailed in TMC 19.28.030, (1-7), concerning Variance requests. The applicant's response to variance criteria is attached to this staff report as Attachment D. Staff makes the following findings under the city's variance criteria (TMC 19.28.030): 1. The variance as approved shall not constitute a grant of special privilege which is inconsistent with the intent of this sign code. TMC 19.04.020 states the intent of Title 19 "Sign and Visual Communication Code": The purpose of this code is to enhance the City's aesthetic character; to protect the public health, safety and welfare; and to increase the effectiveness of visual communication in the City by providing opportunities for Tukwila businesses, residents and property owners to display signage. The regulations for signs have the following specific objectives: 1. To have signs that attract and invite rather than demand the public's attention along the City's streetscapes. 2. To have streets that appear orderly and safe, because clutter is minimized. 3. To have signs that enhance the visual environment of the City, because they are in harmony with building architecture and landscape design. 4. To allow business identification that is not unduly hindered by regulatory standards. S. To ensure typical communication and civic discussion is fostered in the City's residential neighborhoods. 6. To allow signs that utilize high quality construction materials, fine architectural detailing, harmonious proportionality, and that serve a multi -modal environment. Under Title 19 of the TMC, the applicant is provided an allowance of freestanding signage. The Page 3 of 9 r allowance is based on the total amount of linear frontage along private and public streets. The subject property has over 3600 linear feet of frontage on three public streets and one private street (Attachment B: Site Plan). Based on this number, the property would be permitted to have nine monument signs. The monument sign that is subject to this variance application is one of the nine signs allowed to be placed on this property. As previously noted, the sign's design has been approved by the City's BAR. The applicant is requesting a variance from the City's setback requirements in order to screen signal cabinet from view and to place a sign at busy intersection. Without the variance the applicant would be unable to place a sign at this intersection given that the sign would have to be placed behind the signal cabinet. With the exception of the setback issue, the sign meets all prescriptive sign standards. The signal cabinet is located on the applicant's property in a City easement. If the signal cabinet was not there, the applicant would be able to install a sign on the property that meets setbacks. The other properties at the intersection are not impacted by signal cabinets. 2. The variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property in order to provide it with use rights and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. The subject property is flat and there are no issues with topography that hinder the placement of a sign at the intersection of Southcenter Parkway and Minkler Blvd. The applicant is proposing to install a monument sign at a busy intersection; however the location of the City's signal cabinets interfere with the placement of the freestanding sign. Placing a monument sign behind the cabinet would result in the sign being screened from view and thus ineffective in achieving the sign's desired outcomes. The other three surrounding properties have the ability to install monument signs at the intersection because the City did not locate its equipment on their properties. Another unique situation related to the property is depth of the property compared to other properties along Southcenter Parkway. This depth makes some of the buildings on the site over '/4 of a mile away from Southcenter Parkway. Thus, the businesses in these buildings cannot rely on their building mounted signs for visibility, but instead must utilize freestanding signs along the street. 3. Granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is located. The applicant is proposing a monument sign at the corner of a busy intersection. The intersection is controlled by a traffic light. All turning movements at the intersection are controlled. The sign will be placed within an existing sidewalk, directly in front of two signal cabinets. The existing signal cabinets are four feet from the adjacent property line and more than six feet from the adjacent travel lanes (Attachment B: Site Plan). There are two bollards currently located in front of the signal cabinets. A small sidewalk area exists between the signal cabinet and the adjacent street. The sign has also been designed to allow City employees to view over the sign to view the traffic lights Page 4 of 9 while standing at the signal cabinet. Once the new monument sign has been installed, the remaining sidewalk area between the signal cabinets and the street will largely be unusable. However, the main pedestrian sidewalk located behind the signal cabinets will remain sufficiently wide to meet access standards. Figure 3: Existing Signal Cabinets and Bollards Figure 4: Sidewalk Area Behind the Cabinets The sign's height will accommodate the City's signal cabinets by allowing City staff to be able to work on the signal cabinets while still viewing the traffic lights. Replaced bollards will also be placed in front of the sign. These bollards will protect both the sign and the signal cabinets, which will now be located Page 5 of 9 behind the sign, from cars that may jump the sidewalk. One concern that might exist from placement of the sign is that it could hinder visibility from automobiles turning left from Minkler Blvd to Southcenter Pkwy. The sign is located directly within the line of sight of someone trying to view north up Southcenter Parkway. However, this concern is addressed by the fact that the intersection is controlled with a traffic light. The sign will not impact right turns given that drivers will be looking the opposite direction when making turns. The pedestrian crossing across Southcenter Parkway is not impacted due to that the fact that a pedestrian would initially be looking at northbound traffic while standing at the intersection. Also, the pedestrian crossing is controlled. 4. The special conditions and circumstances prompting the variance request do not result from the actions of the applicant. The proposed monument sign will be part of the total sign package for the Southcenter Square Development which was constructed in 2007. As part of the construction, the light at Minkler Blvd and Southcenter Pkwy was upgraded and the signal cabinets were placed on the applicant's property through an easement arrangement. At the time of construction and when the easement was originally granted, the subject property was allowed two freestanding signs which were installed along Southcenter Parkway. In August of 2010, the City adopted a new sign code which allowed the subject property to add an additional seven monument signs. The applicant now wishes to install one of those permitted monument signs at the location where they granted the City an easement. Page 6 of 9 • 5. The variance as granted represents the least amount of deviation from prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. TMC 19.20.040 (3) requires that all freestanding signs be placed at least five feet from all property lines. As shown in Attachment B: Site Plan, the majority of the sign will meet the City's setback requirements; however a small portion of the sign to the north will encroach 2 feet 6" into the required setback area. The encroachment is the result of having to "bend" the sign around the signal cabinets. The sign will maintain a distance of 6" from the signal cabinet, needed for maintenance and access. 5. The variance request is not inconsistent with any other adopted City plans or policies, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. Staff is unaware of any conflicts that may exist between the proposed variance request and the zoning code, Walk and Roll Plan and/or Shoreline Master Program. 7. Granting of the variance shall result in greater convenience to the public in identifying the business location for which the Sign Code variance is sought. The proposed sign is intended to be visible to motorists driving north on Southcenter Parkway. A main entrance to the property is located approximately 500 feet north of where the sign is located and the sign would assist in directing motorists to this entrance point. The applicant is entitled to place a sign at this corner; however a sign that fully complied with code would be placed behind the signal cabinets and likely would not be visible to the travelling public. CONCLUSIONS 1. The proposed variance request will be consistent with the intent of the City's Sign Code. The applicant is proposing a high quality designed sign that has been approved by the City's Board of Architectural Review. The sign's design "invites" and does not "demand" the public's attention (TMC 19.04.020 (1)). 2. Granting of the variance and allowing the sign to screen the signal cabinet would assist in creating an environment where the streets, "appear orderly and safe, because clutter is minimized (TMC 19.04.020 (2))". 3. In staff's opinion that granting of this variance does not constitute a granting of special privilege. The other properties at the busy intersection of Southcenter Parkway and Minkler Boulevard could place a sign at the corner which would provide visibility for their properties. The applicant cannot place a sign at the required setback which would be visible because the City's signal cabinets which would block the view of any sign. 4. The signal cabinets create a special condition not applicable to other similarly situated property owners in the area. However, should the signal cabinets be removed the special condition would Page 7 of 9 no longer exist. 5. The depth of the applicant's property also creates a unique situation that impacts signage for tenants on the property. Given the distance from Southcenter Parkway tenants cannot rely on building mounted sign for visibility, but instead must use freestanding signs. 6. The granting of the variance would likely not be detrimental to the public welfare. The City does maintain an easement in this location and there is considerable City infrastructure in the proposed sign location. In order to ensure the public welfare is being maintained, the City's Public Works Department should approve all construction. There is also a concern that during construction there would be no protection for the signal cabinets because the bollards would temporarily be removed. 7. This setback reduction will not create a public nuisance. The sign will be set back a safe distance from the sidewalk to prevent interference with pedestrians. It is also far enough away from the street intersection so it will not jeopardize the visibility of motorists. While the sign may partially block views for motorist those views are already blocked by the signal cabinet and the turning movements are controlled by the traffic light. 8. The applicant granted the City an easement for the signal cabinets when the project was originally constructed in 2007. Granting of this easement was voluntary. In August of 2010, the City adopted a new sign code. With adoption of this sign code, the City bestowed on the applicant the ability to install seven additional signs on their property. When the applicant granted the City the easement they were unaware that the new sign code would allow them to have additional signs. In staff s opinion, the applicant has not created the circumstances necessitating the need for the variance. 9. Only about 40 percent of the sign will encroach into the required setback area. The remaining sign will fully comply with the prescribed setback requirements. The setback encroachment is the minimum needed in order to achieve the applicant's objectives. The applicant has attempting to minimize the setback encroachment by placing the sign as close to the signal cabinets as possible. 10. Based on information provided to the City, the proposed sign will not be in conflict with the Zoning Code, Walk and Roll Plan or Shoreline Management Plan. 11. The proposed sign will actually increase convenience to the public in identifying the business location. Placing the sign in front of the signal cabinets will allow motorists to quickly identify the property and make decisions about where to turn. Placing a sign at this location which is behind the signal cabinets would be infeasible given that the sign could not be seen. RECOMMENDATIONS Staff recommends approval of the variance with the following conditions: 1. Prior to issuance of a sign permit, the applicant shall obtain a Public Works permit for all work within the City's easement. The cost associated with rotating the signal cabinet shall be borne by the applicant. If the rotation of the signal cabinet cannot be achieved in a Page 8 of 9 manner approved by Public Works, the variance application will be void. 2. During construction the applicant shall see that impact protection measures are in place to protect the signal cabinets. If construction will take place over several days, the applicant must install temporary measures to protect the signal cabinet. Another option would be to install the new bollards as soon as the existing ones are removed. 3. One of the monument signs approved as part of the Master Sign Program is the subject of this variance application. The BAR approval included the size, location, height, area and design of the sign. However, the BAR does not have the authority to approve a variance to the prescribed setback requirements for monument signs. Authority to approve variance applications lies solely with the Hearing Examiner (TMC 19.28.010). The applicant desires to place the proposed monument sign in front of two large signal equipment boxes located at the northeast corner of Southcenter Parkway and Minkler Blvd (Attachment B: Site Map and Attachment C: Aerial Photo). To allow business identification that is not unduly hindered by regulatory standards. 5. To ensure typical communication and civic discussion is fostered in the City's residential neighborhoods. 6. To allow signs that utilize high quality construction materials, fine archi detailing, harmonious proportionality, and that serve a multi -modal environment. Under Title 19 of the TMC, the applicant is provided an allowance of freest mg signage. The allowance is based on the total amount of linear frontage along private a public streets. Placing a monument sign behind the cabinet siginals would likely result in the sign -from being screened from view and thus ineffective in achieving the sign's desired outcomes. The other three surrounding properties have the ability to install monument signs at the intersection because the Citv did not locate its equipment on their propertiesy. Another unique situation related to the property is depth of the property compared to other properties along Southcenter Parkway. This depth makes some of the buildings on the site over '/4 of a mile away from Southcenter Parkway. A main entrance to the property is located approximately 500 feet north of where the sign is located and the sign would assist in directing motorists to this entrance point. The applicant is entitled to place a sign at this corner; however a sign that fully complied with code would be placed behind the signal cabinets and likely would not be visible to the travelling puhlicmotorist. CONCLUSIONS 1. The proposed variance request will be consistent with the intent of the City's Sign Code. The applicant is proposing a high quality designed sign that has been approved by the City's Board of Architectural Review. The sign's design "invites" and does not "demand" the public's attention (TMC 19.04.020 (1)). 2. Granting of the variance and allowing the sign to screen the signal cabinet would assist in creating an environment where the streets, "appear orderly and safe, because clutter is minimized (TMC 19.04.020 (2))". 3. In staff's opinion that granting of this variance does not constitute a granting of special privilege. The other properties at the busy intersection of Southcenter Parkway and Minkler Boulevard could place a sign at the corner which would provide visibility for their properties. The applicant cannot place a sign at the requiredsetback which would be visible because ef-the City's signal cabinets which would block the view of any sign. 4_The signal cabinets create a special condition not applicable to other similarly situatedien property owners in the area. However, should the signal cabinets be removed the special condition would no longer exists. 4,5.The depth of the applicant's property also creates a unique situation that impacts sienage for tenants on the property. Given the distance from Southcenter Parkway tenants cannot rely on building mounted sign for visibility, but instead must use freestanding signs. 5:6.The granting of the variance would likely not be detrimental to the public welfare. The City does maintain an easement in this location and there isare considerable amount of City infrastructure in the proposed sign location. In order to ensure the public welfare is being maintained, the City's Public Works Department should approve all construction. There is also a concern that during construction there would be no protection for the signal cabinets because the bollards would temporarily be removed. The sign will be set back a safe distance from the sidewalk to prevent interference with pedestrians. It is also far enough away from the street intersectioso it will not jeopardize the visibility of motorists. 78_The applicant granted the City an easement for the signal cabinets when the project was originally constructed in 2007. Granting of this easement was voluntary. In August of 2010, the City adopted a new sign code. With adoption of this sign code, the City bestowed on the applicant the ability to install seven additional signs on their property. When the applicant granted the City the easement they were unaware that the new sign code would allow them to have additional signs. In staff's opinion, the applicant has not created the circumstances necessitating the need for the variance. $:9.Only about 40 percent of the sign will encroach into the required setback area. The remaining sign will fully comply with the prescribed setback requirements. The setback encroachment is the minimum needed in order to achieve the applicant's objectives. The applicant has attempting to minimize the setback encroachment by placing the sign as close to the signal cabinets as possible. 9: I O. Based on information provided to the City, the proposed sign will not be in conflict with the Zoning Code, Walk and Roll Plan or Shoreline Management Plan. 10.1 l _ The proposed sign will actually increase convenience to the public in identifying the business location. Placing the sign in front of the signal cabinets will allow motorists to quickly identify the property and make decisions about where to turn. Placing a sign at this location which is behind the signal cabinets would be infeasible given that the sign could not be seen. RECOMMENDATIONS Staff recommends approval of the variance with the following conditions: 1. Prior to issuancee of a sign permit, the applicant shall obtain a Public Works permit for all work within the City's easement. The cost associated with rotating the signal cabinet shall be borne by the applicant. If the rotation of the signal cabinet cannot be achieved in a manner approved by Public Works, the variance application will be void. 2. During construction the applicantic r shall see that impact protection measures are in place to protect the signal cabinets. If construction will take place over several days, the applicant must install temporary measures to protect the signal cabinet. Another option would be to install the new bollards as soon as the existing ones are removed. 3.
