DECISION SEPA Determination: The City SEPA Responsible Official has determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Hearing Examiner has determined that the application for a variance does comply with applicable City and state code requirements and has approved that application with no conditions. III. YOUR APPEAL RIGHTS The Decision on this Application is a Type 3 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. No administrative appeal of the Decision is permitted. A party who is not satisfied with the Hearing Examiner's decision may file an appeal in King County Superior Court. IV. PROCEDURES AND TIME FOR APPEALING Any party wishing to challenge the Hearing Examiner's Decision must file an appeal pursuant to the procedures and time limitations set forth in RCW 36.70C. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Brandon Miles, who may be contacted at 206-431-3684 for further information. A public hearing was held on the application on November 16, 2011, before the Tukwila Hearing Examiner at Tukwila City Hall. Represented at the hearing were the applicant, by Michael Mayes, and the Department of Community Development by Brandon Miles, Senior Planner. The record was held open after the hearing for the Examiner's viewing of the .site, which occurred on November 24, 2011. After due consideration of the evidence presented at the public hearing, the following shall constitute the findings of fact, conclusions and decision of the Hearing Examiner on this application. Hearing Examiner Decision L11-045 Clear Channel Outdoors Sign Variance Page 2 of 5 Findings of Fact 1. The subject property is located at the NE comer of West Valley Highway and South 180th Street in Tukwila, and is addressed as 2140 SW 43`d Street. The property is approximately 9600 square feet, and is owned by the City of Tukwila and leased to the applicant. 2.. The subject property is about ten feet below the grade of the two adjacent streets. The site is undeveloped, and is used for storage of equipment by NC Power Systems which is located on an adjacent site. A cabinet retail/manufacturing business is also located adjacent to the site. • 3. The site is within a designated billboard receiving area identified in TMC 19.08.067. There are eight properties within the receiving area along West Valley Highway and South 180th Street on which new billboards are permitted under the Code. 4. The applicant has proposed to install a billboard at this location, and seeks a variance from the 35-foot height limit for billboards set forth in TMC 18.38.040(d). Under the Code, the height of the proposed sign is measured from the lowest point within five feet of the sign. The proposed billboard would achieve a height of 35 feet above the adjacent street grade, but because the parcel is 10 feet below the level of the street, the billboard would be 45 feet above the property grade level. Exhibit 1, Attachment C. 5. The bottom edge of the proposed billboard, if it were limited to 35 feet in height, would be eight feet above the adjacent sidewalks. 6. The Department reviewed the application and recommended approval without conditions. 7. No public comments were submitted to the Department or the Hearing Examiner on this application. No public testimony was offered at the hearing on this application. 8. The sign variance criteria are set forth in TMC 19.28.030: The Hearing Examiner may grant a variance to the requirements of this code only when the applicant demonstrates compliance with the following: 1. The variance as approved shall not constitute a grant of special privilege, which is inconsistent with the intent of this Sign Code. 2. The variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property to provide it with use rights and privileges permitted to Hearing Examiner Decision L11-045 Clear Channel Outdoors Sign Variance Page 3 of 5 • other properties in the vicinity and in the zone in which the subject property is located. 3. Granting of the variance will not be materially detrimental to the public welfare or injurious to property, improvements or environment in the vicinity and in the zone in which the subject property is located. 4. The special conditions and circumstances prompting the variance request do not result from the actions of the applicant. S. The variance as granted represents the least amount of deviation from the prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. b. The variance request is not inconsistent with any other adopted City plan or policy, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. 7. Granting of the variance shall result in greater convenience to the public in identifying the business location for which a Sign Code variance is sought. Conclusions 1. The Hearing Examiner has jurisdiction over this application pursuant to TMC 19.28.010. All of the criteria set forth in TMC 19.28.030 must be met in order to grant a variance. 2. The first criterion is that the variance as approved will not constitute a grant of special privilege inconsistent with the intent of the Sign Code. No special privilege would be granted in this case. The grant of a variance would permit the proposed billboard to achieve a height of 35 feet above street level, which would be consistent with the intent of the Code. 3. The variance is necessary because of special circumstances related to the site's topography, which is ten feet below the level of the adjacent streets. In order to achieve visibility from the streets and to avoid having a sign that is only eight feet above the sidewalk, the additional ten feet of height are necessary. In addition, it appears that a Code -compliant billboard could obscure the visibility of the adjacent property's sign. 4. Granting the variance for height would not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the TUC zone. Hearing Examiner Decision L11-045 Clear Channel Outdoors Sign Variance Page 4 of 5 The additional height would not have any negative impacts on motorists' visibility along West Valley Highway or South 180th Street, or have any other negative impacts on the adjacent properties. 5. The special conditions and circumstances that necessitate the variance request are not due to the actions of the applicant. The site's elevation was not created by the applicant or the property owner. 6. The variance would be the least amount of deviation from the Code that is needed to accomplish the purpose for which the variance is sought. In this case, the property on which the sign will be placed is ten feet below the street level from which the signs are meant to be viewed. The requested ten -foot variance is intended to allow the sign to achieve 35 feet above street level. 7. The variance request was not shown to be inconsistent with any other adopted City plans or policies. Although the sign would exceed the required height limit, it would otherwise be required to comply with the applicable development standards of TMC 19.38. At 45 feet, the sign's height would match the height limit for structures on this property. 8. The variance would allow the sign to clear the adjacent sidewalks by 18 feet, rather than coming within 8 feet of the sidewalk, which would result in greater convenience to pedestrians. The taller sign would be clearly visible as a billboard to motorists on West Valley Highway and South 180th Street, to the extent this is of convenience to motorists. 9. The proposal would meet all of the variance criteria. The variance should therefore be granted. Decision The requested variance is hereby granted. Signs and electrical permits are still required for the installation of the sign. The variance request is only for height. All other requirements of the city's sign, Building, Public Works and Fi8re Codes must be met at the time of application for applicable permits. Entered this 28th day of November, 2011. Tukwila Municipal Code (TMC) 19.38 permits static and digital billboards2 outright within certain areas of the City. In order for a billboard to be installed in a designated billboard receiving area, the applicant must remove a specific number of existing billboards within certain designated areas of the City. The exact number of billboards that must be removed is based on whether the billboard will have a static or digital display and the total number of faces. Details on which billboards will be removed are addressed via an administrative sign permit and are not part of the variance discussion. TMC 19.38 outlines specific design standards that must be met for billboards. TMC 19.38.040 (d) states that billboards shall be no taller than 35 feet. The height of a freestanding sign, such as a billboard, is measured vertically from the lowest point of the elevation of the ground within five feet of the sign to the top of the sign3. CCO is proposing a 45 foot tall billboard sign. CCO request for a billboard that exceeds the maximum height requirement of TMC 19.38.040 (d) is due to the topography of the site where the billboard is proposed to be installed. The subject property sits nearly ten feet below the adjacent public streets. Thus, according to the applicant, a 35 foot tall billboard would not be sufficiently visible. For full disclosure, the property where the billboard is proposed to be installed is owned by the City of Tukwila. The City of Tukwila has entered into a lease agreement with CCO for the erection and operation of a digital billboard. The lease agreement requires that the applicant obtain all necessary permits for the billboard installation. Subject Property Site Conditions, Surrounding Uses and Vicinity. The subject property is a 9600 square foot4 land locked parcel located at the NE corner of West Valley Highway and S. 180th Street. The subject property sits about ten feet below the two adjacent public streets. Currently the site is vacant with some storage of equipment occurring from the adjacent NC Power Systems property. Adjacent uses include the NC Power Property and a cabinet retail/manufacturing business. Other uses in the area include restaurants, light industrial uses and office use. The proposed project must comply with criteria detailed in TMC 19.28.030, (1-7), concerning Variance requests. The applicant's response to variance criteria is attached to this staff report as Attachment (D). Staff makes the following findings under the city's variance criteria (TMC 19.28.030): 1. The variance as approved shall not constitute a grant of special privilege which is inconsistent with the intent of this sign code. Placement of a billboard on the subject property is clearly permitted under TMC 19.38. The subject property is located in a designated billboard receiving zone. There are only eight properties along West Valley Highway and S. 180t Street that are eligible for the placement of a new billboard structure. The question that is before the Hearing Examiner is not if the applicant can install a billboard on the property but how tall can the billboard be? The subject property sits below the surrounding roadway and thus the applicant has requested that the proposed billboard be permitted to extend an additional ten feet above the maximum height allowed under TMC 19.38.040 (d). The additional height is needed so that the billboard can be visible to passing motorists along West Valley Highway and S. 180th Street. If the variance is approved, the billboard structure would be 45 feet tall, but to passing motorist would only appear to be 35 feet tall. Figure 3: Photo of project site along West Valley Highway. The variance is necessary because of special circumstances relating to the size, shape, topography, location or surroundings of the subject property in order to provide it with use rights Page 701'12 and privileges permitted to other properties in the vicinity and in the zone in which the subject property is located. As shown in figures 3 and 4 above, the subject property sits below the surrounding streets. The grade difference appears to be approximately ten feet. The grade difference places the subject property at a disadvantage in trying to secure the installation of a billboard on the property, which is outright permitted. In order for a billboard to be successful it must be visible from surrounding streets. A 35-foot billboard would not be sufficiently visible from surrounding streets. In fact the bottom edge of a 35-foot billboard would only be eight feet above the surrounding sidewalks. The applicant has asked that a ten foot variance be granted due to the fact that the property is ten feet below the grade of the adjacent public streets. A 45-foot billboard structure on the property would only be 35 feet above the two adjacent sidewalks, so the visibility would be similar to that of a billboard installed on a flat site. All properties within the billboard receiving zone are eligible for the placement of a billboard structure. Selecting the exact location for a billboard involves several factors, such as road design, speed, trees and other factors. The height of the billboard is also important in order to allow the structure to be seen by passing motorists. The photos below show other properties eligible for the placement of a billboard structure. While these properties have a slight grade difference from surrounding streets, the grade difference is not as extreme as the subject property. Granting of the variance will not be materially detrimental to the public welfare or injurious to the property or improvements in the vicinity and in the zone in which the subject property is located. TMC 19.38 allows billboards by right on the subject property. The applicant is requesting a variance from the maximum height standard found in TMC 19.38.040 (d). All other development standards found in TMC 19.38.040 will be complied with, including the minimum change rate and setbacks from adjacent right of way and property lines. The above criteria regarding safety applies only to the question of, will the height increase be detrimental to the public welfare or injurious to the property or improvements in the vicinity. The need for the variance is because the subject property sits ten feet below the adjacent roadways. The City of Tukwila measures height from the lowest point within five feet of the subject sign. The applicant is requesting that the sign be permitted to be 45 feet tall; however to passing motorists, the sign would appear to be 35 feet tall. There is nothing in the record that raises concerns that granting the variance request would pose a risk for public safety. Page 9 of 12 The project is still required to comply with all development standards, including setbacks and rate change limitations for the digital sign. The applicant has provided a conceptual site plan and elevation. These are for illustrative purposes only and are not meant to depict final design. 4. The special conditions and circumstances prompting the variance request do not result from the actions of the applicant. As shown figures above, the property sits ten feet below the adjacent public streets. The applicant's variance request is to address the low elevation on the property. Neither the applicant nor the current property owner (the City) excavated the site in order to lower the elevation of the property. 5. The variance as granted represents the least amount of deviation from prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. TMC 19.08.145, measures height starting at the lowest point within five feet of the subject sign. This standard for measuring height works well in flat areas where there is very little change in elevation. However, the standard presents problems for the subject site, given that the property sits below the adjacent roadways. Essentially, the applicant is requesting that the lowest point for measuring height of the billboard be at the surrounding roadway and not from the lowest elevation point on the subject property. 5. The variance request is not inconsistent with any other adopted City P plan or policy, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. Staff is unaware of any conflicts that may exist between the proposed variance request and the zoning code, Walk and Roll Plan and/or Shoreline Master Program. The City's Zoning Code (TMC Title 18) permits a structure to be 45 feet tall on the subject property. Thus, the height request by the applicant is consistent with the maximum height for the underlying zoning. The billboard is required to comply with the specific development standards of TMC 19.38, including number of faces, total area, and setbacks. 7. Granting of the variance shall result in greater convenience to the public in identifying the business location for which the Sign Code variance is sought. By right the applicant could install a 35 foot tall billboard on the subject property. Placing a 35 foot tall billboard on the property would only allow eight feet of view clearance from the adjacent sidewalks. Granting the variance would permit the billboard to have a view clearance of 18 feet from the adjacent sidewalks. Allowing a slightly taller billboard in order to overcome the low elevation on the property allows the billboard to have the needed visibility in order for motorists on West Valley Highway and S. 180th Street to see the structure. Page 10 of 12 CONCLUSIONS 1. The Hearing Examiner has authority over the variance application pursuant to TMC 19.28.010. The specific criteria for variance applications are found in TMC 19.28.030. 2. A billboard is permitted to be placed on the property by right pursuant to TMC 19.38. An application to place a billboard on the subject property or any other property is an administrative application and the Hearing Examiner has no authority over any billboard application. 3. TMC 19.38.040 (d) specifies that billboards should not exceed a height of 35 feet. Pursuant to TMC 19.08.145, the height of a freestanding sign, such as a billboard, is measured vertically from the lowest point of the elevation of the ground within five feet of the sign to the top of the sign. 4. As shown in the photos provided, the subject property sits approximately ten feet below the surrounding city streets of West Valley Highway and S. 180 Street. A billboard that met the 35 foot height requirement of TMC 19.38.040 (d) would not be fully visible from the adjacent streets. 5. In staff's opinion the granting of the variance does not constitute a granting of special privilege. Due to the low elevation of the subject property, the property does not have the same rights and privileges as other property owners within the area. TMC 19.38 allows biillboards on eight properties along West Valley Highway and S. 180th Street. Other properties that are eligible for the placement of a billboard do not sit below adjacent streets as does the subject property. Granting the ten foot height variance allows the property to essentially be at equal footing with surrounding properties that are also eligible for the placement of a billboard. 6. The granting of the variance would likely not be detrimental to the public welfare. Billboards are permitted in the zone with specific development standards and standards governing the rate of change for a digital billboard. The applicant is simply requesting to place a billboard that will be 35 feet above the street grade. All other standards will remain in place. TMC 19.38.040 (b) requires that the applicant allow the billboard structure to be used for emergency alerts, such as amber alerts and evaluation orders. In attachment D, the applicant states that this is the only viable property in the West Valley corridor for the placement of a billboard structure. Placement of a billboard structure in this area of the City will provide for essential emergency alerts when needed. 7. The need for the variance is not the result of the actions of the applicant or property owner. The need for the variance is the direct result of the topography of the site. 8. The height increase will not create a public nuisance. The sign will be required to comply with setbacks and all other development standards. 9. The ten foot variance request is the minimum deviation needed from the prescribed regulations in order to address the low elevation of the subject property in relation to the two adjacent streets. While the billboard structure will be 45 feet tall, it would only appear to be 35 feet tall from the adjacent streets. Page 11 of 12 10. Based on information provided to the City, the proposed sign will not be in conflict with the Zoning Code, Walk and Roll Plan or Shoreline Management Plan. The proposed height will not exceed the maximum height permitted under the zoning code (Title 18). PUBLIC COMMENTS On October 13, 2011, as required by TMC 19.12.070, a Notice of Application was mailed to all property owners and tenants within 500 feet of the subject site and potentially impacted agencies. No comments were provided during the Notice of Application period. On November 2, 2011 a Notice of Public Hearing was mailed to all property owners and tenants within 500 feet of the subject site and potentially impacted agencies. TMC Title 19 does not require that the site be posted or that notice be provided in the Seattle Times. Staff did meet with representatives from NC Power, the neighboring property, to discuss the proposed project. RECOMMENDATIONS Staff recommends approval of the variance with no conditions. Notes Sign and electrical permits are still required for the installation of the sign. The variance request is only for height. All other requirements of the City's Sign, Building, Public Works and Fire codes must be met at the time of application of applicable permits. The variance is required because of special circumstances relating to the location and topography of the subject property. This parcel is the only viable location for a billboard within this Special Receiving Area and defined in the Tukwila sign code. Not getting this variance would prevent the applicant from being able to uphold their end of the lease agreement it has with the City of Tukwila to construct a static digital messaging center at this intersection. The subject location has about a 10 foot sloped drop off from the sidewalk abutting the property line to the ground level where the structure's pole will be placed. Building a 35 foot tall sign at this location will result in the bottom of the sign face being only 8 feet above street level, which is not appropriate clearance from the neighboring sidewalk. It would also provide easy access for vandals. Attachment D 3. Granting of the variance will not be materially detrimental to the public welfare or injurious to property, improvements or environment in the vicinity and in the zone in which the subject property is located. Failing to grant this variance would be materially detrimental to the public welfare. Clear Channel is applying for a permit to install a 14'x48' digital billboard on the Southwest corner of this parcel. The current height limitation for a billboard is 35 feet. The combined height of the combined sign face and walkway below the sign is 17 feet. Under normal circumstances this leaves 18 feet of clearance between the bottom of the sign and the ground. The 10 foot drop in topography at this location would cause the bottom of a 35' tall sign to be only 8 feet off the ground, which would impact visibility at the northeast corner of this intersection. Most municipalities measure sign height from the street level (meaning that a billboard can be 35' above grade at the sidewalk). My understanding is that Tukwila's code does not take the level of the street into consideration but rather measures from the base of the sign. We are requesting a variance to construct the sign at a height of 45 feet which will result in a sign which is 35' above the street level as the City's code intended. Raising the column height by 10' would place the sign face at an appropriate height. 4. The special conditions and circumstances prompting the variance request do not result from the actions of the applicant. The circumstances and conditions prompting the variance are not a result of the actions of the applicant. The drop off at this property has existed for many years. 5. The variance as granted represents the least amount of deviation from the prescribed regulations necessary to accomplish the purpose for which the variance is sought and which is consistent with the stated intent of this code. Allowing for 10' of additional below street -grade column height would solve the problem with the least amount of deviation from the prescribed regulations. 6. The variance request is not inconsistent with any other adopted City plan or policy, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. This variance is completely consistent with the current zoning code as it will result in a sign which in its real world use is exactly the same as all other signs already allowed in the city. The height of the sign as viewed from the street and sidewalk would be identical to a legally permitted 35' sign. 6. Granting of the variance shall result in greater convenience to the public in identifying the business location for which a Sign Code variance is sought. Granting the variance will provide 18 feet of clearance from the neighboring sidewalk and position the sign at an appropriate viewing level. This will provide greater convenience for identifying the sign located at the location where the variance is sought. The variance request is not inconsistent with any other adopted City plan or policy, including the Zoning Code, Walk and Roll Plan and/or Shoreline Master Program. Common examples of a variance include requesting a deviation from minimum setback provisions or the maximum height permitted for a sign. A sign variance is typically applied for due to physical contraints that make it impossible to install signage that fully complies with the terms of the sign code. Such physical contraints could include the shape of the site or the grades on the site or adjacent property. REQUIREMENTS: The criteria for a Sign Code Variance are located on the back of the application. The request for the variance must meet all of the criteria in order for the hearing examiner to approve the request. Variances cannot be requested to allow a sign type that is prohibited under the Sign Code. PROCEDURES: At the time you submit your application you must have all of the items listed on the attached "Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to your project. Please discuss this waiver request with City staff either at a pre -application meeting or at the time of application submittal. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached checklist. If not complete City staff will mail you a letter outlining what additional information is needed. If you do not submit requested materials within 90 days from the City's request for additional information the City may cancel your application. The Hearing Examiner will hold a Public Hearing before making a decision. A project's hearing date is determined when all application materials have been submitted and the application is determined to be complete. Staff will review the application, meet with the applicant as needed, and formulate a recommendation to the Hearing Examiner. The Hearing Examiner will approve, deny or conditionally approve the variance request based on review criteria presented in the application packet. If the variance is approved you must then submit for a sign permit to actually install the sign that was approved.
