The applicant will plant mitigation trees on the same property. Location: 4066 S. 128th Street. DECISION SEPA Determination: The City SEPA Responsible Official has previously determined that this application does not require a SEPA threshold determination because it is categorically exempt. Decision on Substantive Permit: The City Planning Supervisor has determined that the application for a Tree Clearing Permit does comply with applicable City and state code requirements and has approved that application, subject to the following conditions: 1. Prior to issuance, the applicant shall provide the City with a financial guarantee (cash or assignment of funds) in the amount of $750 (150% of the cost estimate for the trees provided by the applicant). The financial guarantee will be retained by the City for up to three years from initial planting of the trees. In the event that a tree dies and is replaced the three year time period will restart from the date the replaced tree is installed. The City, at its own discretion, may choose release all or a portion the financial guarantee at an earlier date. 2. Trees shall be removed by a licensed, bonded, and insured contractor. 3. The project shall comply with the redlines drawings provided by the City. 4. This approval does not include removal of the 7" birch and 6" cottonwood in the public right of way. No trees shall be removed within the City's right of way without the express, written authorization of the City of Tukwila. III. YOUR APPEAL RIGHTS The Decision on this Permit Application is a Type 1 decision pursuant to Tukwila Municipal Code § 18.104.010. Other land use applications related to this project may still be pending. One administrative appeal to the City Hearing Examiner of the Decision on the Permit itself is permitted. A party who is not satisfied with the outcome of the Hearing Examiner appeal process may file an appeal in King County Superior Court from the Hearing Examiner's decision. IV. PROCEDURES AND TIME FOR APPEALING In order to appeal the Planning Supervisor's decision on the Permit Application, a written notice of appeal must be filed with the Department of Community Development within 14 days of the issuance of this Decision, that is by January 6, 2012. The requirements for such appeals are set forth in Tukwila Municipal Code ch. 18.116. All appeal materials shall be submitted to the Department of Community Development. Appeal materials MUST include: 1. The name of the appealing party. 2. The address and phone number of the appealing party; and if the appealing party is a corporation, association or other group, the address and phone number of a contact person authorized to receive notices on the appealing party's behalf. 3. A statement identifying the decision being appealed and the alleged errors in the decision.. 4. The Notice of Appeal shall identify (a) the specific errors of fact or errors in application of the law in the decision being appealed; (b) the harm suffered or anticipated by the appellant, and (c) the relief sought. The scope of an appeal shall be limited to matters or issues raised in the Notice of Appeal. 5. Appeal fee per the current fee schedule, additional hourly charges may apply. In addition all hearing examiner costs will be passed through to the appellant. V. APPEAL HEARINGS PROCESS Any administrative appeal regarding the Permit shall be conducted as a closed record hearing before the Hearing Examiner based on the information presented to the Planning Supervisor who made the original decision. No new evidence or testimony will be permitted during the appeal hearing. Parties will be allowed to present oral argument based on the information presented to the Planning Supervisor before their decision was issued. The Hearing Examiner's decision on the appeal is the City's final decision. If no appeal of the Hearing Examiner's decision is properly filed in Superior Court within such time limit, the Decision on this permit will be final. VI. INSPECTION OF INFORMATION ON THE APPLICATION Project materials including the application, any staff reports, and other studies related to the permits are available for inspection at the Tukwila Department of Community Development, 6300 Southcenter Blvd., Suite 100, Tukwila, Washington 98188 from Monday through Friday between 8:30 a.m. and 5:00 p.m. The project planner is Brandon Miles, who may be contacted at 206-431-3684 for further information. Miles, Senior Planner RE: Approval of Tree Cutting Permit and Buffer Mitigation Plan for Rong Fe Li (L11-048). BACKGROUND Rong Feng Li has an approved two lot short plat approved at 4066 S. 128th Street. After approval of the short plat application, the applicant requested to slightly modify the site layout. The modification of the site plan will require the removal of three significant treesl on a steep slopes. Under TMC 18.52 and 18.54 a tree permit and mitigation is required for any signicant trees removed on a steep slope. TREE REPLACEMENT PLAN The applicant is requesting to remove a total of seven to nine trees. Only those trees that are on a steep slope are subject to the requirements of obtaining a tree a clearing permit. Tree #1, 2 and 3 in the table below are subject to a tree peiiiiit and replacement. Cottonwood 28" No Located in the driveway of new house. The removal of cottonwoods is exempt from the need to obtain a tree clearing permit. The plans also indicate that two trees will be removed within the City's adjacent right of way. A review of the approved Public Works Permit for the proposed project indicates that no work will occur in this area. The removal of trees within the City's Right of Way is not approved. There are some trees that will be retained as part of the project. As shown in sheet E3, the applicant has proposed tree protection measures around those trees that are to be retained. TMC 18.54 provides a tree replacement schedule for the removal of significant trees. The number of trees required to be planted is based the diameter of the trees removed. In order to mitigate the removal of a 10" maple, 14" ornamental; and a 14" unknown trees the applicant is required to plant ten trees. The applicant has proposed to plant ten Western Red Cedars along the north and east property lines of each of the new lots. The City's Urban Environmentalist reviewed the plans and has noted the Western Red Cedar requires watering in dry seasons for two to three years in order to get established. The applicant has proposed an irrigation system for watering. One concern with watering is that the applicant is constructing single family homes with each lot being sold off individually once the homes are constructed. In order to ensure that the trees are successful and replaced if damaged, a financial guarantee of $750 (150% of the trees' estimated costs) will be provided to the City. Because the City's code does not recognize cottonwoods as significant trees, no extra mitigation will be proposed. Since it is uncertain whether the construction will kill the trees, the contractor will be left to determine whether actual construction impacts will require the trees to be removed. 2. "Red Cedars typically need two to three dry seasons of watering in order to establish themselves. Provide details on supplemental watering until establishment of red cedars." Notes on the watering requirements for the trees have been added to sheet E3. 3. "Provide a cost estimate for all trees to be planted on the site." Specific exemptions from the requirement to obtain a Tree Clearing Permit are listed at TMC 18.54.050. 18.54.O50 Permit * Exempt Activities The following activities are exempt from the application of this chapter and do not require a Tree Clearing Permit: 1. Clewing of any vegetation; IUN1.13SS the site on which clearing is to occur is located in a sensitive area, sensitive area buffer, or shoreline zone. 2. On sites within a sensitive area, or sensitive area buffer, or shoreline zone: a. Clearing of up to 4 significant trees on a site currently zoned and developed for single-family residcmtial use within any 36-month period; UNLESS the significant trees to be removed are located within a wetland, watercourse and their associated buffers or within the shoreline zone. b. Clearing of any vegetation located outside a sensitive area, sensitive area buffer or outside the shoreline zone. c. Removal of hazardous {roes. d. Routine maintenance of vegetation necessary to maintain the health of cultivated plants, to contain noxious weeds, or to remedy a potential fire or health hazard or threat to public safety per TMC Commercial parking subject to TMC Chapter 18.56, "Of Street Parking and Loading Regulations.^8.2S, Nuisance.. e. Vegetation removal necessary to the operation of an established Christmas tree farm or conrmei cial plant nursery. f. Construction and 'maintenance of streets and utilities within City -approved rights -of -way and easements. DEFINITIONS: Sensitive areas means wetlands, watercourses, areas of potential geologic instability (other than Class 1 areas), abandoned coal mine areas, and fish and wildlife habitat conservation areas. Shoreline zone means a 200-foot area surrounding any shoreline in Tukwila composed of three zones: (1) aver environment, (2) low -impact environment, and (3) high impact environment. Significant tree Means a tree (Cottonwood excluded) which is 4 inches or more in diameter as measured 4.5 feet above grade. However, removal of any cottonwood tree that is 12 inches or greater in diameter (as measured 4.5 feet above grade) within the first 100' from the river shall require a tree permit; me 18.44,110, PROCEDURES: At the time you submit your application you must have all of the items listed on the attached "Complete Application Checklist." You may request a waiver from items on the checklist that are not applicable to your project. Please discuss this waiver request with City staffeither at a pre -application meeting or at the time of application submittal. Within 28 days of receiving your application, City staff will determine if it is complete based on the attached checklist. If not complete City staffwill mail you a letter outlining what additional information is needed. If you do not submit requested mat iials within 90 days from the City's rque.st foradditianal information the City may cancel your application. Once the application is complete it will be reviewed by the Director who will issue a decision to approve, modify or deny the application based on the review criteria. EXCEPTIONS: Per TMC 18.34.140 the Director of Community Development may grant exceptions from the requirements of the Tree Ordinance when undue hardship may be created by strict compliance with the provisions of the chapter. An application for an exception must be submitted by the property owner to the Department of Community Development and shall accompany the Thee Cleating Permit application. The materials listed below must be submitted with your application unless specifically waived in writing by the Public Works Department and the Department of Commtmity Development. Please contact each Department if you feet that certain items are not applicable to your project and should be waived. Application review will not begin until it is determined to be complete. ADDITIONAL MATERIALS MAY BE REQUIRED. The initial application materials allow project review to begin and vest the applicant's rights. However, the City may require additional information as needed to dish consistency with development standards.
