UNDERGROUNDING AGREEMENT
WAIVER TO UNDERGROUNDING ORDINANCE
OBLIGATION FOR FUTURE UNDERGROUNDING
In accordance with the Tukwila Municipal Code, the garage constructed under building
permit D15-0146, located within the City of Tukwila at 11847 44th Ave S, requires an
underground power connection.
The undergrounding requirement is hereby waived, provided that PAUL SHELTON
agrees to pay HIS proportionate share of costs for future undergrounding improvements
that may include the aforementioned property. Furthermore, if the L.I.D/U.L.I.D (Local
Improvement District/Utilities Local Improvement District) process is used to carry out
the construction of the underground improvements, PAUL SHELTON waives the right to
protest the L.I.D/U.L.I.D formation. However, PAUL SHELTON retains the right to
contest the method of calculating assessments in such L.I.D/U.L.I.D action, and the
amount thereof to be levied.
This Agreement shall be recorded by the City Clerk with the King County Auditor as
required by the RCW. This Agreement shall be binding upon the parties, their respective
heirs, legal representatives, assignees, transferees, and successors.
