A. Permit Required.
1. A Tree Permit is required prior to work within the Critical Root Zone of any
Significant, Exceptional or Heritage Tree or prior to the removal or destruction of any
these trees within the City, unless the action is exempt from this chapter.
Observed Condition: On June 25, 2018 1 observed one significant poplar tree in the process of being limbed up
for the purpose of removal. This tree is located in the southeast corner of the property.
A Notice and Order was posted on June 25 to cease all tree trimming and tree removal
work and to obtain a Tree Permit.
As of November 19, 2018, there is no Tree Permit on file, and the limbed tree is in the
same condition.
Corrective Action: 1. Discontinue all activities associated with tree removal prior to the issuance of an
approved Tree Permit.
2. Apply for a Tree Permit by December 14, 2018.
3. With an approved Tree Permit, complete the removal of the damaged poplar tree.
Removal of any additional trees must be requested on the Tree Permit application
and will require mitigation.
Contact the Planning Division at 206-431-3670 to discuss the Tree Permit application,
process and requirements. Reference this case number (CE18-0207) when speaking with a
planner.

Code Reference: IBC 105.1 (as adopted by TMC 16.04.020) PERMITS REQUIRED
Any owner or authorized agent who intends to construct, enlarge, alter, repair, move,
demolish, or change the occupancy of a building or structure, enlarge, alter, repair,
remove, convert or replace any electrical, gas, mechanical or plumbing system, the
installation of which is regulated by this code, or to cause any such work to be done, shall
first make application to the building official and obtain the required permit.
c. Work exempt from a building permit
...(2). One-story detached accessory structures used as tool and storage sheds, playhouses
and similar uses, provided the floor area does not exceed 120 square feet, and such
structure is outside of and entirely separated, as prescribed by Code, from any existing
building on the premises.
Observed Condition: On November 19, 2018 1 observed an abandoned canopy structure installed in the
driveway. The frame is attached to the adjacent side fence, and the canopy cover is torn.
The structure appears to be over 120 square feet in size and there is no permit on file for
this accessory structure.
Corrective Action: Remove the unpermitted structure and all resulting debris from the property.

This is a notice that your property is in violation of the Tukwila Municipal Code. You must complete the corrective
action noted above by the compliance date indicated.
FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY OF UP TO
$25O PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PURSUANT TO TMC 8.45.120(2).

Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1. The Code Enforcement case file number;
2. A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3. A brief statement of the specific order or action protested, together with any supporting facts;
and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.
