Violation # 1 TREE PERMIT REQUIRED
Code Reference: TMC 18. 54.030 Tree Permit Required
1. A Tree Permit is required prior to work within the Critical Root Zone of any
Significant, Exceptional or Heritage Tree or prior to the removal or destruction of any
these trees within the City, unless the action is exempt from this chapter.
Observed Condition: On March 2, 2017, 1 observed several trees had been cut down on this vacant lot. There
were no active permits on file at that time.
Tree Permit L17-0030 application was submitted on June 6, 2017 and a Notice of Decision
was approved on June 29, 2017, requiring replacement of 16 trees on or before November
30, 2017. For reference, a copy of the Notice of Decision letter is included with this request
for Compliance.
To date, no trees have been re -planted and no payments into the City's tree replacement
fund has been made.
Corrective Action: Comply with requirements of the Notice of Decision letter dated June 29, 2017.

Violation #2 UNPERMITTED LAND USE- CONTRACTOR STORAGE YARD
Code Reference: TMC 18.09.010, Land Uses By District, Zoning Table 18-6,
Contractor storage yards are not a permitted use in the RC zone.

Observed Condition: On October 4, 2018, 1 observed a contractor's construction trailer has been placed on the
vacant lot. As of December 3, 2018, the trailer is still on the vacant lot.
There are no active development permits on file for this property and the parcel is
described as a vacant lot on King County Assessor's website.
The property is zoned RC, Regional Commercial.
Corrective Action: Remove the construction trailer from the property. Discontinue using the property as a
contractor storage yard.

Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1. The Code Enforcement case file number;
2. A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3. A brief statement of the specific order or action protested, together with any supporting facts;
and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.
