APPLICABILITY —The provisions of TMC Chapter 18.45 shall apply to all land uses and all development activities in a sensitive area or a sensitive area buffer as defined in the "Definitions" chapter of this title. The provisions of TMC Chapter 18.45 apply whether or not a permit or authorization is required within the City of Tukwila. No person, company, agency, or applicant shall alter a sensitive area or buffer except as consistent with the purposes and requirements of TMC Chapter 18.45. The following are sensitive areas regulated by TMC Chapter 18.45: 2. Areas of potential geologic instability: Class 2, 3, 4 areas (as defined in the Definitions chapter of this title and TMC 18.45.120.A); 3. Wetlands; 4. Watercourses: TMC 18.45.195 A. VIOLATIONS. The following actions shall be considered a violation of this chapter: 1. To use, construct or demolish a structure or to conduct clearing, earth -moving, construction or other development not authorized under a Special Permission, Reasonable Use or other permit where such permit is required by this chapter. 2. Any work that is not conducted in accordance with the plans, conditions, or other requirements in a permit approved pursuant to this chapter, provided the terms or conditions are stated in the permit or the approved plans. 3. To remove or deface any sign, notice, complaint or order required by or posted in accordance with this chapter. 4. To misrepresent any material fact in any application, plans or other information submitted to obtain any sensitive area use, buffer reduction or development authorization. 5. To fail to comply with the requirements of this chapter. TMC 18.54.170 The following actions shall be considered violations of this chapter: clearing, planting, relocation, or maintenance of vegetation not authorized under or in accordance with an approved Tree Clearing Permit, where such permit is required, or not in accordance with the provisions of this chapter. Each tree which is cleared, not replaced, or not maintained as required by this chapter shall constitute a separate violation. The designations are: one Stream, two Stream Buffers (80 ft each), one Wetland, two Wetland Buffers (50 ft each), and two Landslide zones (Class 2 - Moderate and Class 3 - High). Environmentally Sensitive Areas Map Attached. Researched the Tukwila GIS iMap and reviewed aerial maps: 2009, 2012, 2013, and 2015 and determined no trees had been removed prior to 2015. Google Street View images taken from S Ryan Way dated August 2015 shows trees on the north, east, south, and west side locations around the house. Google Street View images taken from S Ryan Way dated August 2016 shows trees have been removed from the north, east, south, and west side locations around the house. Observed Condition: On October 9, 2017, observed from the public right-of-way numerous trees have been removed from the north, east, south, and west side locations around the house. Corrective Action: Contact City of Tukwila Planning Division at 206-431-3670, or in person at 6300 Southcenter Blvd., Suite 100, by January 29, 2018 apply for a Tree Removal and Landscape Modification Permit. You may also contact Carol Lumb, City of Tukwila Senior Planner, by email at: carol,qumb tukwilawa., wr to discuss permitting and or mitigation requirements for the trees that have been removed. Recreational vehicles, boats or trailers shall be parked, kept or stored on an approved durable uniform surface and shall not be parked, kept or stored in required front yard setbacks, except for a driveway. Recreational vehicle parking in the side or rear yard setbacks is allowed, provided no recreational vehicle is parked so as to prevent access by emergency responders to all sides of a structure. (TMC 18.56.065 A 3: No more than 50% of the front yard or 800 square feet, whichever is smaller, may be approved durable uniform surface.) Researching King County Assessor's Report, Land Data, Present Use is listed as Vacant. Also, there are no current development permits with the City of Tukwila. Observed Condition: On October 9, 2017 observed 2 recreational vehicles parked on grass. Corrective Action: Remove all recreational vehicles from the property. Compliance Date: March 30, 2018 This is a notice that your property is in violation of the Tukwila Municipal Code. You must complete the corrective action noted above by the compliance date indicated.
