This amount is within the existing budget and does not require additional appropriation. BACKGROUND As a part of the Public Safety Plan, the City has been working on the design and construction of a new Justice Center to house the Police Department, Municipal Court and Emergency Operations Center. Early on, the City chose to use the General Contractor/Construction Management (GCCM), which allows the contractor to join the project early in the design process and inform the City and architects of cost impacts associated with design. City staff have found this to be a very productive delivery model, which has resulted in multiple steps of estimating and checking the budget in real time as decisions are made. The City has an existing contract with BNBuilders for $11,406,886, which includes pre - construction services, demolition/abatement of the former Sahara restaurant and Travelodge buildings and the "mini-MACC" approved by the Council earlier this year, which authorized proceeding with demolition and abatement of the remaining buildings, foundations/structures and waterproofing and earthwork and utilities. At that time, the Council also authorized spending the sales tax associated with the mini-MACC contract, as well a commensurate amount of the project's construction contingency for change orders. Construction on the Justice Center site began in April and to date, all remaining buildings have been abated and demolished, earthwork is underway and underground utilities are in the process of being installed. The total Maximum Allowable Construction Cost (MACC) includes all of the remaining work to complete the Justice Center. BNBuilders developed subcontract bid packages on the remaining bid packages for competitive bidding per State law. Bid packages were publicly advertised and BNBuilders worked to promote the packages to encourage a high number of bidders, which generally results in a better price for the owner. After receiving all subcontractor bids, working with the bidders and identifying opportunities for value engineering that will not affect either the public's experience or that of the end users, the project is on budget. One scope of work that was Tukwila City Hall. 6200 Southcenter Boulevard • Tukwila, WA 98188 • 206-4 3-1800 • Website: TukwilaWA.gov 1 originally carried in the Furniture, Fixtures and Equipment (FF&E) budget — low voltage cabling — was moved from the FF&E budget to the construction budget. For coordination and cost efficiency reasons, it made more sense for the contractor to perform that work and carry those costs within their contract instead of a separate City vendor. The corresponding budget was also moved from the FF&E budget to the construction budget. The amendment value of $23,155,541 does not include Washington State Sales Tax, typically not included in such a contract, which would be an additional $2,315,554. The current contract value and proposed contract value, with and without sales tax, are shown in the table below. This increases the total contract authorization to $34,562,427. •To spend $2,315,554 in sales tax associated with the contract amendment discussed above. This increases the full sales tax authorization to $3,456,243. •To spend, if needed, the full project's contingency for change orders, budgeted at 10% of the total construction cost, or up to $3,446,455. Steve Goldblatt, the Council's Project Management Quality Assurance consultant has reviewed the project status and agrees with this recommendation.
