Code Reference: TMC 8.45.020(B): It is unlawful for any person to Oitrat% maintain, or cause to be initiated
or maintained, the use of any structure, land or property within the City without first
obtaining the permits or authorizations required for the use by the applicable provisions of
any of the Tukwila Municipal Code.
IBC 105.1 (as adopted by TMC 16.04.020) PERMITS REQUIRED
Any owner or authorized agent who intends to construct, enlarge, alter, repair, move,
demolish, or change the occupancy of a building or structure, enlarge, alter, repair,
remove, convert or replace any electrical, gas, mechanical or plumbing system, the
installation of which is regulated by this code, or to cause any such work to be done, shall
first make application to the building official and obtain the required permit.
IPMC 107.6 (as adopted by TMC 16.04.020) Transfer of ownership.
It shall be unlawful for the owner of any dwelling unit or structure who has received a
compliance order or upon whom a notice of violation has been served to sell, transfer,
mortgage, lease or otherwise dispose of such dwelling unit or structure to another until
the provisions of the compliance order or notice of violation have been complied with, or
until such owner or the owner's authorized agent shall first furnish the grantee, transferee,
mortgagee or lessee a true copy of any compliance order or notice of violation issued by
the code official and shall furnish to the code official a signed and notarized statement
from the grantee, transferee, mortgagee or lessee, acknowledging the receipt of such
compliance order or notice of violation and fully accepting the responsibility without
condition for making the corrections or repairs required by such compliance order or
notice of violation.

TMC 16.04.020 Codes Adopted
Effective July 1, 2016, the following codes are adopted by reference as if fully set forth
1. The International Building Code, 2015 Edition, as published by the International Code
Council and as amended and adopted by the State of Washington. The following
Appendices, standards and amendments are specifically adopted:,
(2) One-story detached accessory structures used as tool and storage sheds, playhouses
and similar uses, provided the floor area does not exceed 120 square feet, and such
structure is outside of and entirely separated, as prescribed by Code, from any existing
building on the premises.

On December 13, 2018, 1 observed the existing building has new windows, doors, and
siding. A new accessory building has been constructed on the east side of the existing
building. The new accessory building is over 120 sq. feet and has been constructed within
the required setbacks.
On a site visit on December 19, 2018, Deputy Fire Marshal Captain Andy Nevens observed
that renovation work inside the existing building has changed the occupancy from a Type B
to a Type A-3.

During the December 19, 2018 site visit I observed two new bathrooms as evident from
new windows and vent stacks and one exterior door has been removed and walled over
(see attached photographs), and several new electrical fixtures have been installed,
including recessed lights, outlets, and light switches.
I also observed there were more than 50 chairs stored in the existing building.
From my previous code enforcement case, CE17-0359, for this property, the use was a
business (Type B). The current use is a place of assembly (Type A-3).
Researching this property through utilizing Google Street View I discovered that windows
and doors have been removed, new windows and doors have been installed, siding has
been replaced, vent stacks on the roof have been removed and new vent stacks installed, a
new exhaust vent has been installed under the roof overhang located on the north end of
the building, and the fire alarm bell and strobe has been removed.
Researching previous Code Enforcement Case CE17-0359, photographs taken for this case
confirm windows, doors, siding, vent stacks, exhaust vent, and the fire alarm bell and
strobe have either been removed or added since this case closed on December 8, 2017.
Researching the City of Tukwila TRAKiT system, I did not find any permits applied for,
issued, or finaled.
Corrective Action: Submit complete Building Plans and Building Permit Application(s) for the repair or
demolition of the building. Permits are not considered completed until a final inspection
has been approved by a city inspector.
Contact the building department at 206-431-3655 for permit requirements, or by visiting
the Permit Center located at 6300 Southcenter Blvd, Suite 100 Monday — Friday from 7:30
am to 4:30 pm.

This is a notice that your property is in violation of the Tukwila Municipal Code. You must complete the corrective
action noted above by the compliance date indicated.
FAILURE TO COMPLY WITH THIS ORDER SHALL SUBJECT YOU TO A MONETARY PENALTY OF UP TO
$250 PER DAY PER VIOLATION FOR EACH DAY THAT THE VIOLATION EXISTS PURSUANT TO TMC 8.45.120(2).

Appeal Instructions
A person may, within ten days of being served this notice, file with the Tukwila City Clerk a
written notice of appeal along with payment of the $300 appeal fee, containing the following:
1.The Code Enforcement case file number;
2.A brief statement setting forth the names, mailing address(es), and legal interest of each of the
persons appealing this notice and order;
3.A brief statement of the specific order or action protested, together with any supporting facts;
and
4. A brief statement of the relief sought, and the reasons why it is claimed that the notice and order
should be reversed, modified, or otherwise set aside.
Any appeal of this Notice of Violation and Order must be filed WITHIN 10 DAYS of being served this
notice. There will be no other opportunity to appeal this order, and noncompliance with this order
may result in further legal action.
