Q: What happens if the chosen vendor violates RCW 46.63.170?
A: The vendor would be in clear violation of the Law and subject to penalties of the court. All
RCW protections of the RFP and contractual requirements.
Q: What I'm mostly concerned about are is the vendor taking photos of driver/interior of
vehicle and passing the info on to another agency such as ICE.
A. The vendor photographic hardware is NOT placed in position to capture approaching
vehicles. All photo and video evidence is captured from the rear. These requirements as stated
in RCW 46.63.170 will be contractual and RFP requirements. Also, RCW 46.63.170 prohibits a LE
agency from sharing automated enforcement data and images for any other purpose than the
enforcement of the infraction that occurred.
Q: Also, since this is a method to track vehicles what stops vendor from passing the vehicle info
on to another agency?
A. The technology is event based and not a tracking technology. Retention Criteria per the
state LE retention rules will strictly apply.
We will set the system to purge data per the state LE retention policy.
RCW 46.63.170 prohibits the sharing of infraction data internally or externally. Essentially, the
information can only be used for the issuance of the specific infraction.
Q: What action can the City take in such a circumstance? Can we include such repercussions for
such action in the contract with the vendor?
A: Termination of the contract for a contract or RCW violation.
CJIS - Assures confidentiality of information as required by the FBI requirement for handling LE
information. A violation could be catastrophic for a vendor.
CJIS - Requires Data Encryption and security protocols (RFP) focused on privacy protections.
Automated enforcement data will be handled the same way as Body Camera and In -Car Camera
data stored and managed by vendors such as Axon, Spillman etc.
