Dear: City of Tukwila,
Sound Transit would like to request your permission to enter your property as we
begin to gather information needed for the Interstate 405 Bus Rapid Transit (BRT)
Project. Your permission is voluntary and without compensation. You may rescind
any permission you grant at any time. Your cooperation with this request will allow
us to further develop our design and better understand the project corridor. Sound
Transit appreciates your prompt response.
Enclosed, you will find Right of Entry Agreement(s) that allow Sound Transit and
its representatives to enter your property, but not the inside of your home or
business, to conduct specific field work activities described in the form(s).
On the enclosed form, please include the name, telephone number, and email
address of the person to contact to coordinate access. Please provide any special
requirements for access such as locked gates, dogs in yard, etc. Please sign and
return the enclosed Right of Entry agreement(s) in the enclosed envelope. Our
field agent, may be contacting you in the next few weeks, via phone or in person,
to answer any questions you might have on this request. Sound Transit and its
representatives will make every effort to work around scheduling requests and on
an arranged day and time. We will schedule such times with you and notify you in
advance of arrival.

condition that existed before Sound,rransit's or its Representative's entry onto the Property.
4. Governing Law/Captions.
The validity, meaning, and etTect of this Agreement shall be determined in accordance with the laws of the State of
Washington.
5. No Third Party Rights/Assignment.
Nothing in this Agreement, express or implied, is intended to confer any rights or remedies upon any person other than
the parties and their respective employees and representatives.
6. License Agreement.
This license does not constitute a real property interest and does not confer any rights upon Sound Transit other than the
rights expressly granted herein. This license may be revoked by Owner at any time by providing notice to Sound Transit
at 206-903-7559.

ENTRY AGREEMENT

This Entry Agreement ("Agreement") is between the CENTRAL PUGET SOUND REGIONAL TRANSIT
AUTHORITY ("SOUND TRANSIT"), a regional transit authority of the State of Washington and City of Tukwila
("Owner"). This Agreement is effective as of the date Owner signs below (the "Effective Date").
RECITALS
Owner owns certain real property ("Property") described below. Sound Transit wishes to gain access to the Property for the
purpose(s) described below. Owner is willing to grant Sound Transit access to the Property on the terms and conditions of
this Agreement. The Property is described as follows:

I . Grant of License.
Owner grants to Sound Transita non-exclusive license of reasonable access to the Property for a period of twenty four
(24) months from the Effective Date, for the purpose of completing the Design Activities checked below. See
Attachment A for detailed description of Design Activities:
• Noise Monitoring
• Vibration Monitoring
Sound Transit will not permit any other party except Sound Transit's duly authorized representatives, employees, agents
and independent contractors (collectively "Representatives") to enter or use the Property.
2. Contacts.
In the event, Sound Transit and/or its designated Representatives cannot access some or all of the Property, the following
representatives of the owner can arrange for access to the Property.

3. Liability.
While on the Property, Sound Transit will comply and will cause all Representatives to comply with all applicable

Attachment A — Definitions of Work
Noise Monitoring
This will include installing, establishing, monitoring and removing sound equipment to document existing ambient
noise levels. The noise monitoring will be conducted in both indoor and outdoor areas and the monitoring duration
will generally take one (1) day to complete.
Vibration Monitoring
This will include setting up vibration testing equipment, monitoring and removing equipment to document how
vibration might travel from the proposed light rail tracks to nearby buildings. The vibration testing will be
conducted in both indoor and outdoor areas and will generally take one (1) day to complete which includes set Lip,
testing, and take down.
