The Council appreciates hearing from citizens and members of the public, and may not be able to answer questions or respond during the meeting. PUBLIC COMMENTS Members of the public are given the opportunity to address the Council on items that are NOT included an the agenda during PUBLIC COMMENTS. Please limit your comments to 5 minutes. If you have a comment on an Agenda item, please wait until that item comes up for discussion to speak on that topic. SPECIAL MEETINGS/EXECUTIVE SESSIONS Special Meetings may be called at any time with proper public notice. Procedures followed are the same as those used in Regular Council meetings. Executive Sessions may be called to inform the Council of pending legal action, financial, or personnel matters as prescribed by law. Executive Sessions are not open to the public. PUBLIC HEARINGS Public Hearings are required by law before the Council can take action on matters affecting the public interest such as land -use laws, annexations, rezone requests, public safety issues, etc. Section 2.04.150 of the Tukwila Municipal Code states the following guidelines for Public Hearings: 1. The proponent shall speak first and is allowed 15 minutes for a presentation. 2. The opponent is then allowed 15 minutes to make a presentation. 3. Each side is then allowed 5 minutes for rebuttal. 4. Members of the public who wish to address the Council may speak for 5 minutes each. No one may speak a second time until everyone wishing to speak has spoken. 5. After each speaker has spoken, the Council may question the speaker. Each speaker can respond to the question, but may not engage in further debate at that time. 6. After the Public Hearing is closed and during the Council meeting, the Council may choose to discuss the issue among themselves, or defer the discussion to a future Council meeting, without further public testimony. Council action may only be taken during Regular or Special Meetings. COUNCIL MEETING SCHEDULE No Council meetings are scheduled on the 5th Monday of the month unless prior public notification is given. Regular Meetings - The Mayor, elected by the people to a four-year term, presides at all Regular Council Meetings held on the 1st and 3rd Mondays of each month at 7:00 p.m. and Special Meetings. Official Council action in the fonn of formal motions, adopting of resolutions and passing of ordinances can only be taken at Regular or Special Council meetings. Committee of the Whole Meetings - Councilmembers are elected for a four-year term. The Council President is elected by the Councilmembers to preside at all Committee of the Whole meetings for a one-year term. Committee of the Whole meetings are held the 2nd and 4th Mondays at 7:00 p.m. Issues discussed there are forwarded to Regular or Special Council meetings for official action. Telephone taxes were $104.8 thousand below allocated budget which accounts for almost half of the ° |nharfund utility taxes were $524.8 thousand; $176.5thouoond |eoo than the allocated budget of $701.3 thousand. The variance is primarily due to the change in timing of surface waterpayments as they are now collected by King County. Actual revenue is expected to catch up to budget as the year progresses. ° Gambling and excise taxes through March were $98.8thousand which was $132.8 thousand less than the allocated budget of $1.1 million. Two of the casinos located in the city saw revenue decrease compared to the same period inthe prior year. ° Licenses and permits revenue was $3.2million; $505.1thousand over the allocated budget of $2.7 million. Revenue from business licenses was $2,Omillion; $544.7over the allocated budget nfG2-2 ° Intergovernmental revenue was $987.1 thousand; $2827thousand less than the allocated budget of $1.3 million. The variance is primarily doe to grant revenue and state entitlements being$2OO.9 thousand and $58.5 thousand below allocated budget, respectively, due to timing. Major variances were: • Community Development was $7.5 thousand over budget primarily due to costs ($51.0 thousand) related to structural code compliance review for a local business. This overage was offset by salary and benefits being $43.6 thousand under budget through the first quarter due to some vacant positions. Staff is also working toward determining and collecting a reimbursable amount from the local business for work performed. • Fire was $139.5 thousand over budget through the first quarter. Salaries and benefits were $221.0 thousand over budget resulting from filling four unbudgeted pipeline positions ($113.1 thousand) and overtime costs that were over budget through the first quarter ($107.9 thousand). It should be noted that $30.3 thousand of overtime and benefits costs were related to the February snow events. Services and supplies were under budget by $81.5 thousand partially offsetting the amount the department was over budget on salaries and benefits. As of the May 28th Finance Committee meeting, the Finance Committee began an ongoing analysis of options to address the Fire operating budget issues. • Street Maintenance and Operations was $56.8 thousand over budget through the first quarter primarily due to overtime and supplies costs related to the snow events. Overtime was $25.7 thousand over budget while supplies were $53.0 thousand over budget. These amounts were partially offset by Public Utilities being $18.6 thousand under budget due to the timing of utility invoice payments. Travel was also under budget by $2 thousand. It is expected that fund balances will comply with the City's reserve policy at year-end. 7 INFORMATIONAL MEMO Page 6 OTHER FUNDS Special Revenue Funds Special revenue funds account for revenue sources and expenditures that are legally restricted to a specific purpose. The City has two special revenue funds: Lodging Tax and Seizure. The Lodging Tax fund receives a special excise tax on lodging charges and is used to promote tourism. The seizure fund accounts for the accumulation of drug seizure funds and is used for seizure related expenditures. A ribbon cutting to recognize completion of the 53td Ave S project is planned for August while the 42nd Ave S project is in its final stages of review. Several arterial streets projects continued throughout the first quarter. The S 140th Intersection Improvements project and Boeing Access Road Bridge Rehabilitation project have both been completed. The Boeing Access Road Bridge over Airport Way Seismic Retrofit is in design. Annual Overlay and Repair and Annual Signal programs are underway. As part of the Public Safety Plan (PSP), a groundbreaking was held for Fire Station 51 and a contract was issued to begin construction. Work on Fire Station 52 is out to bid. Demolition of buildings on the Justice Center site also began in the first quarter. 8 INFORMATIONAL MEMO Page 7 To provide funding for the Public Works shops, the City is expected to issue Unlimited Tax General Obligation (UTGO) and Limited Tax General Obligation (LTGO) bonds not to exceed $40.885 million and $25 million; respectively, later in the year. Enterprise Funds The City's four enterprise funds account for operations with revenues primarily provided from user fees, charges, or contracts for services. The City has three utilities and one golf course. The golf course should see an increase in revenue during the spring and summer months. The City's reserve policy states that, at the close of each fiscal year, the unrestricted balances of the Enterprise Funds shall equal or exceed 20% of the previous year revenue, exclusive of the effects of GASB Statement 68, as well as, significant non -operating, non -recurring revenues. It is expected that ending fund balances will comply with the City's reserve policy. Internal Service Funds Internal service funds provide services to other City departments and include functions such as employee and LEOFF 1 retiree medical insurance as well as equipment rental and replacement (ER&R). Through the first quarter, all internal service funds have sufficient funds to meet expenses. PRESENTATIONS II. BUSINESS AGENDA A. May 2019 Departmental Budget-to-Actuals Report Staff presented the Committee with the May 2019 Financial Report, which describes the general state of departmental expenditures and highlights significant trends. General Fund expenditures totaled $27.1 million as compared to the allocated budget of $27.4 million. The allocated budget reflects year-to-date spending patterns of the previous year. Significant unbudgeted events include the East Marginal Way power pole accident on April 5 and the February snowstorms. The City filed a claim with the Washington State Cities Insurance Authority for reimbursement of the expenditures associated with the power pole incident, and partial payment has been received with the balance coming in later. DISCUSSION ONLY. B. 2019 1st Quarter Financial Report Staff presented a summary of the 2019 1st Quarter financial report, including budget variances, sales and property tax and other revenues, expenditures, departments, fund balance, special revenue funds, capital projects, enterprise funds, and internal service funds. The City is on track to meet its reserve policy at year-end. FORWARD TO AUGUST 12, 2019 COMMITTEE OF THE WHOLE. C. Fire Department Budget: Service Levels Chair McLeod opened the discussion stating that the Fire Department has consistently been over budget since 2012, and this Committee will be working to identify the right funding and service model going forward. He urged everyone to keep an open mind and expect to have honest conversations, and that the Council will be making the best decision for the community. Staff noted that there will need to be a 2019 budget amendment for Fire regardless of this decision - making process. Building upon previous Committee discussions on the Fire Department budget, staff provided an overview of minimum and current service levels, excluding the Fire Marshal's Office. The website will also be updated accordingly. • Channel 21— City staff will put materials on Channel 21 for viewers to see regarding the ban and citations. • Digital Message Board — Staff is reaching out to the advertiser of the digital message board at West Valley Highway and S. 180th Street to push out a message both about the fact that there will not be fireworks at Ft. Dent this year as well as the fireworks ban in the City of Tukwila. • Code Red — The City will push out messages to people in Tukwila that have signed up for non -emergency alerts reminding people that fireworks are illegal in the City of Tukwila and to warn them that citations will be issued this year. • Yard Signs in Parks — As the department has done in previous years, Parks and Recreation will develop "Respect the Ban" yard signs and place them in parks throughout the City reminding people about the fireworks ban. • Tukwila School District Coordination — City staff will work with the School District to try and utilize some of their channels — social media, sign at Foster High School — to also push out the message of the ban and planned citations. City of Tukwila Fireworks Emphasis After Action Summary • The intent for the 2019 fireworks emphasis patrol was focused on a proactive approach to fireworks enforcement. • This was the first time in many years where the staffing allowed us(Fire and PD) to engage at this level. • The absence of the 2019, 4th At The Fort fireworks display freed up resources • The police department restricted vacation days on the 4th to allow for maximum staffing • There were 6 commissioned officers and two firefighters (8 total) focused on fireworks education and enforcement. • Both Public Safety Chiefs were actively patrolling the Tukwila neighborhoods to gain a realistic perspective of the fireworks issue. City of Tukwila Fireworks Emphasis After Action Summary • The fireworks emphasis patrol ran from 8:00 PM to 1:00 AM because calls and explosions subsided around 12:45 in the evening. • There was a fully engulfed house fire around 11:00 PM however; this fire did not detract from the enforcement efforts. • The house fire located about the 1500 block of 42nd Ave S. was not attributed to fireworks. • EXPECTATIONS: • I expected personnel to actively patrol Tukwila neighborhoods and engage individuals who were actively violating the fireworks ordinance. • I also expected, that if an officer witnessed a violation, that he/she would issue the appropriate citation. • In addition, if officers were called or responded to the sounds of fireworks without witnessing the actual violation, community members would receive a warning. • Tukwila police would respond to all fireworks complaints in the city. • Finally, I expected that the numbers this year to be higher because of the on -view contacts generated in addition to the 911 calls for service. City of Tukwila Fireworks Emphasis After Action Summary • The overall calls for service combined (911 plus on -view calls) increased. • There were no citations written by officers. • This year, the 911 calls remained average as compared to the last five years. • The emphasis team provided education in the form of warnings. It was very difficult to catch individuals actively lighting off fireworks. • Fireworks were depleted by the time officers arrived. • Our responses were as a result of a 911 call or if we heard explosions and moved to the sounds for investigation. • There is an open invite for any City Council member to ride -a -long on next year's emphasis. The passage of Initiative 1639 brought changes that impact the department, and he is tracking the increased workload closely. The Committee has previously requested more detailed crime statistics, particularly those indicating calls for service by neighborhood. Committee members and staff discussed the current display of crime statistics as included in the packet and what changes the Committee may want to see. Chair Robertson stated that he would like sexual assault and rape included as well as geographic areas displayed. He would prefer to see total numbers over a period of 3-5 years so that he can easily identify trends. Councilmember Idan would like more information about homelessness response, which is not currently tracked. Chief Linton noted the ongoing work of the homeless engagement team which do not usually result in service calls or case reports because there is no crime. Councilmember Idan also asked for more information about hate crimes. Councilmember Kruller agreed that a map would be helpful. Staff reminded the Committee that the data on CommunityCrimeMaps.com is available for public viewing, but it does not include sensitive cases such as domestic violence. Staff will incorporate some of the suggestions discussed and return with some new reports. DISCUSSION ONLY. III. MISCELLANEOUS Report on 2019 4th of July Fireworks Emphasis After Action Report Chiefs Linton and Wittwer provided an after action report on the fireworks emphasis this past July 4 holiday. As previously shared with Council there was a renewed emphasis this year including more community outreach and a proactive patrolling approach. The cancellation of the Fourth at the Fort fireworks display freed up resources in both Police and Fire to have more active patrols in neighborhoods. In 2019 overall calls for service increased and there were no citations written by officers. It is very difficult to catch individuals in the act of lighting off a firework, which is needed for a citation. Councilmembers Robertson and Kruller both stated they felt it was a quieter year overall. The Committee asked that the report be given to the full Council at a meeting.
