CALL TO ORDER Council President Van Dusen called the Special Zoning Meeting of
the Tukwila City Council to order at 7:20 p.m.

Letter from Ms. Frances Council President Van Dusen noted that a letter had been received
C. North. from Ms. Frances C. North, Box 441, North Bend 98045, dated
July 20, 1981, concerning the new zoning code for the Codiga
property on the west Duwamish River. Council President Van Dusen
said the letter would be entered for the record.

Council President Van Dusen said the discussion would start with
the setbacks in the single family district. If the grid in Table
4 is followed, how many houses in Tukwila would be nonconforming?
Fred Satterstrom, Planner, said he would discuss some of the
issues that have been raised about setbacks in the single
family district. Short of going out and measuring each single
family home in the City for front yard setback, Staff cannot come
up with an exact answer to the question asked by Council President
Van Dusen. Building Permit records have been kept since 1961
and a small minority of homes have been built since then.
Mr. Satterstrom said given the current zoning regulations affecting
setbacks in the single family zone, what should the setback be
according to the current regulations which affect the single- family
lot? He placed a map on the wall. The first step in determing
the setback on a single family lot is as follows: the code reads
the front yard setback has to be 25% of the depth of the lot.
Therefore, if you had a 100' deep lot the front yard setback
would be 25'. The rear yard is determined the same way. Thirty
feet is the maximum setback that would be required. There is
another step to go through and that is the building line cannot
be closer than 55' from the centerline of the street. He said
he had mapped out the areas of the City where the various setbacks
would apply. It is a situation where 321 lots require 35'
setbacks, 116 require 30' setbacks and 27 require 25' setbacks.
Council President Van Dusen asked how many houses would be non-
conforming if the new zoning ordinance is adopted. Fred Satterstrom
said less than 27 lots would be affected. They would be
"grandfathered" in. If you want to expand a nonconforming structure
you could build in the rear and /or sides.
Councilman Harris said she was not as concerned with the front
yard setback as the side yard requirements. Could a person add
a room to the back of his house if he has nonconforming side yard?
Fred Satterstrom said as long as it did not make the rear yard
nonconforming. The proposed ordinance allows a larger building
area. We have a lot of single- family homes that are nonconforming
now. The 30' setback is not going to harm a substantial amount
of single- family lots but will provide additional room in the
front yard.
Councilman Harris said the thought of having a large front yard
is not as attractive as it once was.. Most people prefer to have
a large back yard.
Fred Satterstrom, Planner, said the Planning Commission opted
for a 30' front yard and thought it was preferable over the 20'.
Some sort of an exception should be in the zoning ordinance where
you have a case of existing homes having already established a
front yard pattern along a street closer than 30'. It would not
be consistent or wise to require an undeveloped lot to be 30'
when it would be the only 30' setback on the street. There is
now Section 18.60.080 where a lot of homes qualify where you may
set up closer to the street line in such a case and the line where
you can build to is an average of the existing front yard setbacks
of the other homes on the lot.

Council President Van Dusen said the Council agrees with the
deletion of the word "through" on Line 20 of Page 91.
Fred Satterstrom said the exception clause would make it easier
for someone to get relief from the requirement.
Council President Van Dusen said side yards in the R -A and R -1
would be considered.
Mr. Satterstrom said presently it is 4' to 8' side yard requirement.
MOVED BY HARRIS, SECONDED BY PHELPS, THAT THE SIDE YARD REQUIREMENT
BE LEFT AS IT IS IN THE PRESENT CODE, THAT IS FOUR TO EIGHT FEET.
MOTION CARRIED.
Councilman Hill said if you add the relief section to R -1 you
have to add it to the rest of the zoning designations.
Council President Van Dusen said rear yards in R -A and R -1
would be considered. In the proposed zoning it would be 50' in
R -A and 10' in R -1. It was agreeable with Council to accept the
proposed rear yard setback.
Council President Van Dusen said minimum lot width would be
considered. There was no objection from Council Members to
leaving this as proposed in the ordinance.
Council President Van Dusen said the minimum area per unit in the
R -2 and RMH zoning would be as proposed in the draft ordinance.
Council President Van Dusen said building heights would be
discussed. The effect of cascading in the P -0 to M -2 zones was
discussed. It was determined if an apartment is located in the
building it could go up as high as the maximum building height
for the zone.
Fred Satterstrom said it would be advisable for the Department to
draw up a short memorandum to make the public aware, especially
before the Public Hearings, of the changes that have been made.
Council President Van Dusen said the height would be as proposed.
Council President Van Dusen said the front yard setbacks in R -2
through RMH would be discussed. They are proposed to be 30' in
all of these districts. Fred Satterstrom said it is currently 20'
in the RMH.
Councilman Harris said there should be some landscaping and it seem
30' is a lot. It seems a poor use of expensive property.
Fred Satterstrom said the Planning Commission thought of putting
the building back for the parking to be in front and then 15'
screened back. That will probably use more than 15' for parking.
Much of the parking will be in front. If a building is permitted
-up close then you will find parking interferringwith recreation
area. It is one way to mitigate the landscaping. It will serve
as an inducement.
Councilman Phelps said we are going to have to deal with land-
scaping and front yards. Fred Satterstrom said presently the
landscaping requirement is none. Councilman Johanson said if
people go to the recreation area they will have to go through the
parking area.
Council President Van Dusen took an oral vote from members of
the Council and it was three to two to have the front yard at
30'.

Council President Van Dusen said the side yard setback would be
discussed. All Council Members agreed to the side yard setback
as proposed.
Council President Van Dusen said the rear yard setback was proposed
to be 15' in R -2 and 25' in R -3 through RMH. All Council members
agreed to the rear yard setbacks as proposed.
Council President Van Dusen said minimum width would be as proposed.
Council President Van Dusen said the building height in P -0 would
be discussed. Council Members agreed to building height as proposed.
Council Members agreed to front yard setbacks in P -0 district as
proposed.
Council Members agreed to side yard and rear yard requirements,
as proposed.
Council Members agreed to maximum height in the C -1 district.
Councilman Harris asked if a row of C -1 buildings would have to
have a break between each one? Fred Satterstrom said if each
building was owned separately there would have to be a break
between the buildings. If a row of buildings was owned by one
owner they could be attached. It could be developed as a
cortisorium or P.U.D.
Councilman Johanson said the side yard would be useful in case of
fire.
Council Members agreed to side and rear yard setbacks in the C -1
district.
Council President Van Dusen said this subject would be discussed
at a later date.
Council Members agreed to the maximum building height, front yard,
side yard, rear yard, and minimum lot width in the proposed C -M
district.
Ann Nichols, representing Segale Business Park, said they would
like the side yard requirement to remain "none" as it is in
the present code.
Fred Satterstrom said the side yard requirement would correspond
to the 5' of landscaping.
Ann Nichols said landscaping cuts off truck maneuvering.
Councilman Harris said the M -1 requirement stems out of protest to
having every square foot on a piece of property used. The City
does not want a repeat of Cello Bag.
Councilman Phelps said she did not see the need of 5' side yard
requirements in M -1 district.
Fred Satterstrom said if landscaping is not put in, ground area
soon grows up in weeds.
Miss Helen Nelsen, audience, said Cello Bag Company was the first
building on West Valley Road between South 158th and 180th and
that was before the street was widened. They are within 8'
of the original road.
Council President Van Dusen took an oral vote from Council
Members and it was determined that in the M -1 and M -2 districts
the side yard setbacks would be "none" as in the present code.
