Bid Award for LID #30.
Mayor Pro Tem Hill led the Council and audience in the Pledge of
Allegiance and called the Special Meeting of the Tukwila City
Council to order at 7:07 p.m.
Carl Carlson, Deputy City Attorney, said the City does not have
all of the property for LID #30 as of this date. Mr. Salant has
said he would sign the documents, but he has made some minor
changes in them. It is expected they will be signed within a day
or so.
Mayor Pro Tem Hill said the City has bids in on this street project
and P�lY. Salant has procrastinated for six to eight months. If
the City does not award this bid within the next week we are going
to run into the rainy season. The Public Works Committee
recommends that if Mr. Salant has not signed the deeds by Friday,
August 28, 1981, that the City reject all bids and go to bid
again next spring. This will cause the cost of the LID to go up
40 45 percent. Mr. Salant is a 75% participant in the LID.
The City has tried to cooperate with him.
Councilman Bohrer asked for information on bids that have been
received.
Ted Uomrto, Public Works Director, said the low bid was submitted
by Klokstad Construction Company in the amount of $138,794.92.
The next lowest bid was R. L. Alia Company in the amount of
$146,933.28. The engineer's estimate was $149,511. The bid is
within the budget for the LID. Mr. Uomoto said this is a 75 -day
construction bid that will be completed by Thanksgiving.
Mayor Pro Tem Hill said the City is on a tight schedule. If we
are held up by Mr. Salant we will be in the wet season when the
work cannot be done. Councilman Harris asked if condemnation
proceedings could be started? Mayor Pro Tem Hill said it could be
a long lengthy process if we go to court. Carl Carlson, Deputy
City Attorney, agreed on a lengthy procedure to go to court.
Mayor Pro Tem Hill said the Council lifted the moratorium on
building. If the LID is not going to be started does the Council
want to reinstate the moratorium?
MOVED BY PHELPS, SECONDED BY JOHANSON, THAT ALL REAL ESTATh AND
EASEMENT BE ACQUIRED BY 5:00 P.M. AUGUST 28, 1981 AND IF THEY
HAVE NOT BEEN SIGNED BY THAT DATE THAT A BUILDING MORATORIUM BE
REINSTATED AND THE CITY START OVER IN FORMING A NEW L.I.D.
Councilman Bohrer said he was disturbed that Mr. Salant wants to
make changes in the legal documents. The documents that are
signed should be the ones submitted to him rather than a document
he has made changes to.
MOVED BY BOHRER, SECONDED BY JOHANSON, TO AMEND THE MOTION THAT
MR. SALAMI' SIGN THE DOCUMENTS AS SUBMI'ri±D TO HIM WITHOUT ANY
CHANGES.
Councilman Phelps said if the changes are small words and punctua-
tion that should be acceptable. If there are substantial changes
they would not be acceptable.
Mayor Pro Tem Hill said changes in small words and punctuation can
change the whole meaning. The legal staff would have to assure
Council that they would not accept anything that would change
the meaning of the documents.
