Mayor Mayor Todd reported that the Department of Transportation has
notified the City of Tukwila that funds in the amount of $75,000
are available for a signal at Andover Park East and South 180th
and have allotted $60,000 for modifying the signals on Southcenter
Parkway.
Council Members Councilman Phelps reported that everything is ready for the Call
For Bids for the Data Processing Services and the Finance and
Personnel Committee has approved the timeline.
City Attorney Attorney Hard reported that the acquisition of property necessary
to proceed with LID #30 has been completed.

Mayor Todd, presiding, led the Pledge of Allegiance and called the
Regular Meeting of the Tukwila City Council to order.

INCLUDE THE CALL FOR BIDS AS ITEM 9D. MOTION CARRIED.
Ms. Wendy Morgan, Canyon Estates Condominiums, said she is the
Vice Chairman of the Friends of the Library. She presented Council
with a fact sheet representing the last 18 months of library ser-
vice. They are furnishing Council the information prior to the
budget review sessions. The library was one year old on December
26, 1980, and served 1082 citizens in its first eighteen months
of operation. They have offered special programs throughout the
year and have had an average of 20 in attendance. The Friends of
the Library would like to request permission to place a box in
City Hall for people to put books in. They are having a book sale
on October 31. The money raised will go for programs for the library.

The low bidder, Hi -Line Asphalt Company, has withdrawn their
bid claiming an error in calculation. Therefore, the Public
Works Department recommends that the bid for the Street Repair
Project be awarded to Lakeside Industries in the amount of $39,372.
The available funds are included in the 1981 budget.

MENDATION OF STAFF AND AWARD THE BID FOR THE STREET IMPROVEMENT

City Attorney Hard read an ordinance of the City of Tukwila,
Wash., vacating that portion of South 168th Street lying easterly
of 53rd Avenue South.

ADOPTED AS READ.*
Councilman Hill asked if anyone checked with Puget Power to see
where the right -of -way is located and how much is the City going
to have to retain as a utility easement. Mr. Uomoto reported that
they checked with Puget Power and their response was that they
would have to look into this in detail. They will report back to
the City. Their "general" statement was that they would need twenty
five feet on each side of the power line. Councilman Hill noted
that this ordinance cannot be passed without the easement infor-
mation. Mayor Todd noted that Puget Power should have gotten the
easement when they installed the line. They have to deal with a
private party. Councilman Hill noted this easement and asked how
each property owner would be fairly assessed. Is the south half
worth as much money as the north half?
Mr. Uomoto noted that the City will have to improve South 166th
St. eventually. At the present time, there is only a 30 foot
right -of -way. If we stay within this right -of -way, Council will
have to consider a narrower street. It would be possible to place
a 20 foot roadway plus a 5 foot sidewalk within the 30 feet. We
would need to acquire some property on the north side to make a
smooth turning radius. If Council were to consider abandoning
South 166th Street, 54th Avenue South and South 168th would be the
alternate route.
Councilman Phelps noted that the City might want to retain an
easement over the same property as the utility.

Mr. Dwayne Hayes, 53rd Avenue South, suggested that the City's
responsibility ends with their present ownership of property.
The utility has never had any access or right to anything outside
of that right -of -way. The utility chose to put their line five
feet from the edge of the right -of -way, not in the middle. They
have lived with this access. I don't see that the City is at all
obligated to provide more than they have now. If Council wanted
to take action tonight, they could specify an easement like ones
granted for other areas of the City. The utility probably doesn't
own any equipment wider than ten feet so there is no justification
for anything bigger than that. This way the City is staying com-
pletely within its franchise agreement.
Councilman Saul noted that the citizens in the area have never
asked to have South 166th Street improved.

Councilman Hill said he voted NO for two reasons: (1) There
should be some mention made in the ordinance of the utility
easement so there is a record, and (2) The person on the south
should not pay the same amount as the person on the north. With
an easement running through, the property is not as useable.

Mr. Les Davis, party on the north side, said that all he needs is
a ten foot strip for a side setback so he can build a new garage.
The remaining twenty feet could go for an easement. I will pay
more than the guy on the south side. Mayor Todd said the City
needs to take another look at the asking price for the south portion
because it is not as valuable as the north portion.
Councilman Bohrer noted that the staff report points out the two
properties have different assessed value. The one to the south is
lower. The basis is computed on the average, not on individual
property values. He explained that his NO vote is based on the
fact that the issue of the utility easement should be resolved
first.
Mayor Todd said the City will proceed to find out where the ease-
ment is and if there isn't one, we will have one executed with
Puget Power. The City Attorney will investigate the purchase price
to be fair to both properties and still comply with the State Law.
Mr. Hoffner said he cannot see paying 99ct per square foot for the
right -of -way. Mayor Todd noted the calculations show that each
property owner will owe $3,361.53. This is $1.06 a square foot.
If the petitioners aren't willing to pay this amount for the
property, the City cannot vacate the street. Mr. Hoffner said
the property was not worth $3,361.53 to him. He can use the
right -of -way the way it is. Mr. Davis said he needs 8 to 10 feet
for the sideyard setback. He was told by staff that requesting
a variance was out of the question; the only possible change was
a vacation.
Mayor Todd suggested that the City, if it is legal, vacate the
north 10 feet of the property for Mr. Davis. Attorney Hard agreed
to look into the matter.
Mayor Todd referred to a letter from Mr. H. A. Smith, President
of Spring Ridge Investments LTD in which they agree to pay half
the cost to install a one way valve to control flooding from
Andover Park West on to their property known as Tukwila Pond.
Their contribution is not to exceed $1,500.

Councilman Saul asked what results might be expected by this
installation and does the City have money enough to pay for
those results. How are we going to take care of the water?
Mr. Uomoto said that the water will seek the lowest point be-
cause there willbe no outlet for the water. This would be the
City street and they will have to be blocked off. Councilman
Hill said he doesn't like to see the City allowing its water to
back up on private property. Mayor Todd recommended that Council
approve this; it is worth much more than the cost to the City.

Mr. Uomoto reported that they considered proposals by both R. W.
Beck and Horton Dennis and Associates. If cost were not a con-
sideration, the Public Works Committee concluded that either con-
sultant could do the job. R. W. Beck's proposal, with a $10,000
reduction, is still $10,000 higher than the Horton Dennis proposal.

BE APPROVED AS THE CONSULTANTS FOR A COMPREHENSIVE WATER AND SEWER
IMPROVEMENT PROGRAM. MOTION CARRIED.
MOVED BY PHELPS, SECONDED BY SAUL, THAT COUNCIL APPROVE THE CALL
FOR BIDS FOR AUTOMATED DATA PROCESSING SERVICES. MOTION CARRIED.
Councilman Bohrer said the issue of cost for vacated street
property appeared to be a surprise to the property owners that
the cost is as high as it is. At the same per footage basis,
the next vacation will run the property owners $2,400 $2,500
per lot. Are they still interested in proceeding with this vacation?
The City has no plans to change the use of the property.
Mayor Todd felt those people who have petitioned for the vacation
of 54th Avenue South should give it consideration. If they don't
want to pay this amount, the City can't sell it any cheaper. Mr.
Davis said he is willing to pay his share for South 168th. Mayor
Todd suggested that the petitioners be notified of the potential
cost and see if they want to proceed.
Mr. Hayes said he understood, in a vacation, the adjacent property
owner has first opportunity to buy the property, but is is not
a requirement. What position are we in if all of the property
owners do not want to purchase the vacated right -of -way? Attorney
Hard agreed to look at the law. The City needs assurance there is
a buyer for the property before the vacation is completed.
