Sec. 18.64.020 Sec. 18.64.050 Sec. 18.64.060 M I N U T E S City Hall Council Chambers The Tukwila City Council Special Meeting was called to order by Council President Van Dusen. L. C. BOHRER, MABEL J. HARRIS, DORIS E. PHELPS, Council President Gary L. Van Dusen. Council President Van Dusen stated a letter from Rockwood Products dated September 8, 1981 had been received and was entered into the records of the Minutes of this meeting. Brad Collins, Planning Director, presented a schedule that will be followed in the discussion, public hearings, and passage of the zoning code prior to the end of December 1981. Councilman Bohrer said if Council departs from the schedule, meetings will have to be held more frequently. Fred Satterstrom, Planner, explained the difference between conditional use and unclassified use permits. He stated a general conditional use permit approves procedures for unusual or unique types of land uses which, due to their nature, require special consideration of their impacts on the neighborhood and land uses in the vicinity. The unclassified use permit is for the regulation of uses processing characteristics of such unusual, large scale, unique and special form as to make impractical their being automatically in any class of use as set forth in the various zones. The unclassified use permit requires the recommendation of the Planning Commission and approval by the City Council. Council President Van Dusen stated Section 18.64.020 specifies the uses that will require a Conditional Use Permit in order to locate and operate in appropriate use districts within the City. Fred Satterstrom suggested there could be a change to Section 18.64.020 to clarify the uses requiring a conditional use permit, and state the uses listed might be permitted outright in certain districts. MOVED BY BOHRER, SECONDED BY HARRIS, THAT ITEM 14 BE ADDED TO SECTION 18.64.020 AND IT STATE: "CONDITIONAL USES LISTED IN THE SPECIFIED USE DISTRICTS." MOTION CARRIED. MOVED BY HARRIS, SECONDED BY PHELPS, THAT LINE 25, PAGE 115, HAVE THE FOLLOWING WORDING ADDED: "....FOLLOWING USES, UNLESS PERMITTED OUTRIGHT IN THE SPECIFIED USE DISTRICT." MOTION CARRIED. Cris Crumbaugh, audience, referred to Item 10, Page 116, and said motels, hotels and tourist cabins are allowed in the C -P district, it could be allowed outright in the C -2. MOVED BY BOHRER, SECONDED BY HARRIS, THAT HOTELS, MOTELS, AND TOURIST CABINS BE ALLOWED OUTRIGHT IN THE C -2 DISTRICT. MOTION CARRIED. Councilman Harris suggested that the words "tourist cabins" be deleted as they are practically nonexistent. Brad Collins, Planning Director, suggested leaving in tourist cabins and letting the Building Department address the definition of tourist cabins. Cris Crumbaugh, audience, referred to Page 117, Line 15, Item 3. He said if the word "generally" was inserted between the words "compatible" and "with" this would permit a person to get a building permit and not have the next door building object. MOVED BY BOHRER, SECONDED BY HARRIS, THAT LINE 15, PAGE 117, HAVE THE WORD "GENERALLY" INSERTED BETWEEN THE WORD "COMPATIBLE" AND "WITH." MOTION CARRIED. Cris Crumbaugh, audience, said he would like to see a longer period of time than 1 year in which to obtain the building permit. Also he would like to see a time extension on the two years required for substantial construction from the date the conditional use permit becomes effective. MOVED BY HARRIS, SECONDED BY PHELPS, THAT LINE 22, PAGE 120, HAVE THE WORD "FAVORABLE" DELETED FROM THE SENTENCE. MOTION CARRIED. Council approved Sections 18.66.080, 18.66.090, 18.66.100, and 18.66.110 as presented in the draft. Council President Van Dusen said Section 18.80.010 seemed to have an excess of words. MOVED BY BOHRER, SECONDED BY PHELPS, THAT SECTION 18.64.060 HAVE THE FOLLOWING SENTENCE ADDED AT THE END OF THE SECTION: "THE PLANNING COMMISSION MAY AUTHORIZE LONGER PERIODS FOR THE C.U.P. IF APPROPRIATE FOR THE PROJECT. MOTION CARRIED. Brad Collins, Planning Director, said that seems to provide the flexibility to make it clear. The Council approved Section 18.64.080 as presented in the draft. The Council approved Sections 18.64.100 and 18.64.110 as presented in the draft. Brad Collins, Planning Director, said there are uses not included in this Section as permanent, conditional or unclassified. Fred Satterstrom, Planner, said the Planning Director is responsible, when confronted by something not mentioned, to make a decision on the applicability. If the applicant does not agree he can appeal to the Board of Adjustment for a decision. MOVED BY BOHRER, SECONDED BY HARRIS, THAT TRANSIT SHELTER STATIONS, PAGE 121, LINE 21, BE LISPED AS A CONDITIONAL USE AND REGIONAL TRANSFER STATIONS BE LISTED AS AN UNCLASSIFIED USE. MOTION CARRIED. Council approved Section 18.66.030 as presented in the draft. MOVED BY BOHRER, SECONDED BY HARRIS, THAT LINE 21, PAGE 122, ITEM 2, READ: "AFFIDAVIT OF OWNERSHIP OR INTEREST IN PROPERTY." MOTION CARRIED. MOVED BY HARRIS, SECONDED BY PHELPS, THAT LINE 21, PAGE 123, ITEM 3, HAVE THE WORD "GENERALLY" INSERTED BETWEEN "COMPATIBLE" AND "WITH." MOTION CARRIED. MOVED BY BOHRER, SECONDED BY HARRIS, THAT SECTION 18.80.010 BE CHANGED TO READ AS FOLLOWS: "THE COUNCIL MAY AMEND, CHANGE, MODIFY OR REPEAL REGULATIONS AND RESTRICTIONS AS ESTABLISHED IN THIS TITLE, AND MAY CHANGE, RESTRICT OR EXTEND THE BOUNDARIES OF THE VARIOUS DISTRICTS ESTABLISHED IN THIS TITLE. BEFORE ACTING UPON ANY PROPOSED AMENDMENT, MODIFICATION, CHANGE, RESTRICTION OR EXTENSION, OR CHANGE IN THE MAPS OR TEXT OF THIS TITLE, THE SAME SHALL BE REFERRED BY THE COUNCIL TO THE CITY PLANNING COMMISSION. THE PLANNING COMMISSION SHALL SUBMIT A REPORT TO THE COUNCIL CONTAINING ITS RECOMMENDATION THEREON. MOTION CARRIED. Brad Collins, Planning Director, said Section 18.80.020 should be referred to the City Attorney for explanation as to why it was written in the draft as it was. Sec. 18.80.030 MOVED BY BOHRER, SECONDED BY PHELPS, THAT THE WORD "DIFFERENT" BE INSERTED BETWEEN THE WORDS "OF" AND "CLASSIFICATION" IN SECTION 18.80.030, LINE 5, PAGE 136. MOTION CARRIED. Sec. 18.80.010, .030,MOVED BY BOHRER, SECONDED BY PHELPS, THAT SECTIONS 18.80.010, .030, .040 .040 BE REFERRED TO THE CITY ATTORNEY, SINCE THEY SEEM TO DUPLICATE SECTIONS 18.70.020 AND 18.70.040.
