Wetland Buffer Violations Violation 81 Code Reference: Observed Conditions: CLEARING AND GRADING WITHOUT A PERMIT TMC 16.54.050 PERMIT A. A permit is required for all grading activities occurring within the City limits. TMC 8.45.020 VIOLATIONS B. In addition to specific civil violations enumerated throughout the Tukwila Municipal Code, the following actions are unlawful and are subject to enforcement through this chapter; 2. It is unlawful for any person to use, construct, locate, demolish or cause to be used, constructed, located, or demolished, any structure, land, or property within the City in any manner that is not permitted by the terms of any permit or authorization issued pursuant to the applicable provisions of the Tukwila Municipal Code. On August. 12, 2019, I observed clearing and grading activities throughout the five cited parcels. Researching Tukwila iMap, Parcels 3365900005, 3365900010, 3365900015, and 3365900020 are encumbered by a Class II Wetland and its 100 ft. Wetland Buffer. Clearing and Grading activities may have occurred within the required buffer. Researching TRAKiT for all five parcels, I found PW19-0101 permit for Clearing and Grading has been applied for on August 6, 2019 but has not been issued. Corrective Action: 1. Discontinue all activities associated with the unpermitted clearing and grading activities. 2. Stabilize all disturbed soils as required by TMC 16.54.060* with straw mulch (3 inches minimum over all disturbed soils excluding driveway), install silt fencing around all disturbed soils, call Jim Toole, 206-431-3676, for an inspection once completed. All grading activities require erosion prevention and sediment control that prevents, to the maximum extent practicable, the transport of sediment from the site to drainage facilities, rights -of -way, water resources, and adjacent properties. Erosion and sediment controls shall be applied commensurate with the degree of risk, and as specified by the temporary erosion and sediment control measures, performance criteria, and implementation requirements of TMC Chapter 14.30 and the Surface Water Design Manual. Violation # 2 UNPERMITTED LAND USE - CONTRACTOR STORAGE YARD Code Reference: TMC 18.09.010, Land Uses By District, Zoning Table 18-6, Contractor storage yards are not a permitted use in the LDR zone, Observed Conditions: On August 9, 2019, I observed five pieces of heavy equipment / machinery being stored on Parcel # 3365900100 / 14487 56t" Ave 5. On August 12, 2019, this equipment / machinery remains on the property. Corrective Action: Remove all heavy equipment / machinery from the property until all applicable permits are issued and a pre -construction meeting is conducted with Public Works Inspector. Discontinue using the property as a contractor storage yard. Compliance Date: August 26, 2019 Violation # 3 TREE PERMIT REQUIRED Code Reference: TMC 18.54.030 TREE PERMIT REQUIRED Observed Conditions: A. Permit Required. 1. A Tree Permit is required prior to work within the Critical Root Zone of any Significant, Exceptional or Heritage Tree or prior to the removal or destruction of any these trees within the City, unless the action is exempt from this chapter. On August 5, 2019, I observed from an adjoining property, with the property owner's permission, that numerous significant trees have been removed. Researching Tukwila iMap, Parcels 3365900005, 3365900010, 3365900015, and 3365900020 are encumbered by a Class II Wetland and its 100 ft. Wetland Buffer. These trees may have been removed from within this buffer. Researching TRAKiT for all five parcels, I did not find any issued Tree Permit for the removal of these trees. Corrective Action: Apply for and receive a Tree Permit. Contact the Permit Center at 206-431-3670, or in person at 6300 Southcenter Blvd, Suite 100 during business hours to speak to a planner regarding this permit. Compliance Date: Submit a complete Tree Permit Application by August 26, 2019 Violation # 4 ACCUMULATION OF RUBBISH AND GARBAGE Code Reference: IPMC 308.1 (as adopted by TMC 8.28.020) ACCUMULATION OF RUBBISH OR GARBAGE All exterior property and premises shall be free from any accumulation of rubbish or garbage. Rubbish is defined as combustible and noncombustible waste materials, except garbage; the term shall include the residue from the burning of wood, coal, coke and other combustible materials, paper, rags, cartons, boxes, wood excelsior, rubber, leather, tree branches, yard trimmings, tin cans, metals, mineral matter, glass crockery and dust and other similar materials. (206)431-3671 Garbage is defined as the animal or vegetable waste resulting from the handling, preparation, cooking and consumption off food. Observed Conditions: On August 5, 2019, I observed from an adjoining property, with the property owner's permission, several piles of branches and logs throughout these parcels. Corrective Action: Remove all branches and logs from the properties and properly dispose of these materials. Do not remove this material until all silt fencing is installed. Compliance Date: August 26, 2019 Violation # 5 WEEDS AND OVERGROWTH Code Reference: IPMC 302.4 (as adopted by TMC 8.28.020) WEEDS. Premises and exterior property shall be maintained free from weeds or plant growth in excess of 12 inches. Noxious weeds shall be prohibited. Weeds shall be defined as all grasses, annual plants and vegetation, other than trees or shrubs provided; however, this term shall not include cultivated flowers and gardens. Observed Conditions: On August 9, 2019, I observed from the public Right -of -Way of 56th Ave S, overgrowth throughout 14487 566 Ave S. The overgrowth conditions remain on August 12, 2019. Corrective Action: Corrective Action only applies to 14487 50 Ave 5 / Parcel #3365900100 property. The remaining four parcels must not be touched until all applicable permits are applied for, issued, and a pre -construction meeting is conducted with Public Works Inspector. Manually trim back overgrowth to a height of 12 inches or less on entire property and remove trimmings from the property. Heavy equipment / machinery can not be used to remove the overgrowth on this property. Compliance Date: August 26, 2019 This is a notice that your property is in violation of the Tukwila Municipal Code. You must complete the corrective action noted above by the compliance date indicated.
