M I N U T E S 3 5 yo City Hall Council Chambers In the absence of Council President Van Dusen, Councilman Saul called the Zoning Review meeting to order. L. C. BOHRER, MABEL J. HARRIS, GEORGE D. HILL, J. REID JOHANSON, DORIS E. PHELPS, DANIEL J. SAUL. Fred Satterstrom, Planning Department, said at the last meeting two consensus actions were taken: one was to show the Grantree site as light industrial on the Comprehensive Plan and two, reflect that designation with an M -1 classification on the proposed zoning map. Those are the only consensus actions that have been noted. Any development on his site would have gone through the B.A.R. as it is located in the Special Review District. Councilman Bohrer said this seems to be spot zoning as neighboring properties are C -2. He did not agree with Mr. Hill's statement that there would be a problem here any more than anywhere else. MOVED BY BOHRER, SECONDED BY JOHANSON, THAT BOTH THE COMPREHENSIVE PLAN AND THE ZONING MAP FOR THAT PIECE OF PROPERTY BE CHANGED BACK TO C -2. Fred Satterstrom, Planning Department, said Mr. Harold Hill submitted information at the Public Hearing that it would create a hardship on him. He expressed concern that there would be an inability to convert the building to an appropriate use in the C -2 classification. Councilman Johanson said he knew Mr. Hill was concerned about the C -2 parking. If he lost his tenant and had to go to a C -2 business he was concerned about the parking area. Fred Satterstrom said the parking issue is subordinate to his argument about converting his business to C -2 use. The C -2 use would likely require a greater ratio of parking than most industrial uses which would require a lesser ratio. The list of uses in the C -2, Mr. Hill contended, did not appear to him to be uses which were appropriate to that location or that facility. Councilman Hill asked if there would be problems with the setback? In C -2 are not the setbacks a little greater? Mr. Satterstrom said C -2 would require 20' in the front and the M -1 would require 25'; the side and rear are likely less in the M -1 zone. Councilman Phelps said she noted in Item C of the comments that it was suggested adding medical and dental laboratories. Medical and dental laboratories are already included in the P -0 classifi- cation. Mr. Satterstrom said laboratories do not appear until the M -1 or C -M zone, offices would. Data processing would be a commercial service and would be permitted in the C -2 zone. Tool equipment rental, sales and repair would depend on the scale of the operatior as to whether it belonged in the C -2 or M -1 districts. Confec- tionery manufacturing is only permitted in the M -1 or C -M district. Candy sales would be allowed, but manufacturing would be M -1. That was one of the reasons for going M -1 east of Maule Avenue as that would have rendered Hazels Candies, which is sales and manufacturing, nonconforming if it were C -1 or C -2. Councilman Phelps said perhaps the Council should modernize the C -2 classification with at least the data processing and record storage use. Councilman Harris asked why medical and dental laboratories would not be a use in C -2? It seems it is a commercial service. Brad Collins, Planning Director, said he would assume that medical and dental laboratories would be primarily involved in production of pharmaceutics and have a large amount of chemical activity with them. If a small laboratory was part of an office it would be permitted. Councilman Harris said this site was developed as M -1; it was built as M -1 and it has not overstepped its bounds or been detri- mental to the City. If the present tenant should leave and a new tenant come in she thought it should have to go through the Planning Commission or B.A.R. to make sure it was a tenant, since it is so close to the water, who would not be detrimental to the use of the river or detract from use of the river. Brad Collins, Planning Director, said it would be subject to the Special Review District requirements. *MOTION FAILED, WITH BOHRER, JOHANSON, AND PHELPS VOTING YES; HILL, HARRIS, AND SAUL VOTING NO. Councilman Saul said this property is like an island. Development cannot take place next door. He said Council would consider this matter at another date. Brad Collins, Planning Director, said the Planning Commission has submitted 18 recommendations on potential Comprehensive Plan Map amendments. The Planning Commission did not have too many controversies about the 18 recommendations. The origin of the 18 changes was the result of zoning map changes that came about through the review meetings. The items should bring the Comprehensive Plan in accordance with the Zoning Map. Councilman Bohrer suggested the Council do the Comprehensive Plan Map amendments first. *MOTION CARRIED. 359/ MOVED BY BOHRER, SECONDED BY PHELPS, THAT COUNCIL ACCEPT PLANNING COMMISSION RECOMMENDATION ON PARCEL 1 AND CHANGE IT FROM PARKS AND OPEN SPACE AS DESIGNATED ON THE COMPREHENSIVE PLAN TO M -1, THE PROPOSED ZONING CLASSIFICATION. MOTION CARRIED. MOVED BY HARRIS, SECONDED BY PHELPS, THAT COUNCIL ACCEPT PLANNING OPEN I SPACCE AS M DESIGNAT �DON TTHE TO R- 1-7. A THE PROPOSED ZONING CLASSIFICATION. Councilman Phelps said Parcel 2 covers only the property where the houses are located. The area where the farm is located is zoned R -A. MOVED BY PHELPS, SECONDED BY HARRIS, THAT COUNCIL ACCEPT PLANNING COMMISSION RECOMMENDATION ON PARCEL 3 AND CHANGE IT FROM PUBLIC FACILITIES TO M -1, C -2, R -A, THE PROPOSED ZONING CLASSIFICATION. Councilman Hill suggested that all of the right -of -way be zoned the same as the adjoining property. MOVED BY PHELPS, SECONDED BY HILL, TO AMEND THE MOTION SO PROPERTY NORTH OF 56TH AVENUE SOUTH BE ZONED M -1. Councilman Phelps asked the width of the strip of property? Mr. Satterstrom said it varies in width. Councilman Bohrer said we are now committing the property in front. Throughout the Corridor we have called the strip C -2. It is consistent. *AMENDMENT FAILED, WITH PHELPS AND HILL VOTING YES. *MOTION CARRIED, WITH HILL AND PHELPS VOTING NO. Fred Satterstrom, Planning Department, showed the location of the property on the wall map. Brad Collins, Planning Director, said the Council could say the zoning is to the toe -of- the slope. Councilman Hill said he did not want to see commercial use on top of the hill. *MOTION FAILED, WITH HARRIS AND PHELPS VOTING YES. MOVED BY HILL, SECONDED BY PHELPS, TO AMEND #6 PARCEL TO READ: THIS PIECE OF PROPERTY AND SOUTH OF THERE, ALL THAT HAS BEEN EXCAVATED IS C -2, IF IT HAS NOT BEEN EXCAVATED IT REMAINS R -l. Councilman Bohrer said this motion refers to the Comprehensive Plan and he would like to see the same motion carried to the zoning map. *MOTION CARRIED. MOVED BY HILL, SECONDED BY PHELPS, THAT THE TUKWILA CITY COUNCIL ZONING REVIEW MEETING RECESS FOR FIVE MINUTES. MOTION CARRIED. The meeting was called back to order by Chairman Saul with Council Members present as previously listed. 3 s yc1 Fred Satterstrom, Planning Department, said Harold Hill, 8910 SE 54th Street, Mercer Island, requested the Comprehensive Plan Map be revised from commercial to light industry on the Grantree site. He said it would be costly to remodel the building to commercial use if the present tenant were to vacate the premises. On the Zoning Ordinance (Draft #5) Mr. Hill requested that the present M -1 zoning be retained on the zoning map. Mr. Harold Hill suggested C -2 Regional Retail Business be changed in name to C -2 Regional Business if the Council decides to zone site to C -2. Viewed retail to be too restrictive as it implies customers walk through the door. MOVED BY BOHRER, SECONDED BY HARRIS, THAT COUNCIL ACCEPT MR. HILL'S RECOMMENDATION SUGGESTING C -2 REGIONAL RETAIL BUSINESS BE CHANGED IN NAME TO C -2 REGIONAL BUSINESS IF COUNCIL DECIDES TO ZONE SITE TO C -2. Brad Collins, Director of Planning Department, said the title, Regional Business, is not very definitive. It does not identify whether it is commercial or whether it is manufacturing type business. The reason the staff had Retail Business there was they wanted some definition as to how commercial is differentiated from manufacturing. *MOTION FAILED, WITH UNANIMOUS VOTE OF NO. MOVED BY PHELPS, SECONDED BY HARRIS, THAT THE DATA PROCESSING AND RECORD STORAGE USE BE INCLUDED IN PRINCIPALLY PERMITTED USES IN THE C -2 DISTRICT AS AN ACCESSORY TO THE BUSINESSES THERE. MOVED BY HILL, SECONDED BY JOHANSON, TO AMEND THE MOTION AND ELIMINATE TOOL EQUIPMENT RENTAL, SALES AND REPAIR, AND ACCEPT THE REST OF THE USES AS PERMITTED IN THE C -2 DISTRICT. Councilman Bohrer asked for a definition of medical and dental laboratories and whether or not it is consistent with C -2. TUKWILA CITY COUNCIL ZONING REVIEW December 14, 1981 Page 4 Public Comment, 12 -1 -81, contd. 3593 Brad Collins, Director of Planning, said there is one in Koll Business Center in Bellevue. They are related to the distribution of supplies. There is not much manufacturing or processing of the chemicals and testing. The State of New Jersey is the largest pharmaceutical producer in this country and most of the manufacturing is done in that particular area of New Jersey. The C -2 property in the City would not be a suitable location for that operation, however, in instances they are more in a C -M district than they would be in a C -2 d- strict. Councilman Johanson asked if this would involve a lot of trucking? Mr. Collins said that would not be characteristic of the medical supply distribution in Koll Business Center in Bellevue. Councilman Bohrer suggested a phrase be added that excludes manufacturing. MOVED BY BOHRER, SECONDED BY HARRIS, TO AMEND THE MOTION TO DELETE MEDICAL AND DENTAL LABORATORIES. *MOTION AND ALL AMENDMENTS WITHDRAWN, WITH APPROVAL OF SECONDS. not Brad Collins said it would /be acceptable to accept the rewording as suggested by Mr. Harold Hill: "Other business service and supply activities primarily serving regional residents and businesses such as those enumerated above and not included in any other classifica- tion. MOVED BY HILL, SECONDED BY JOHANSON, THAT MEDICAL AND DENTAL LABORATORIES BE INCLUDED. Councilman Bohrer said some medical and dental manufacturing firms are called laboratories. City Attorney Hard said the City would have to look at what the business intended to do. Brad Collins said staff would come back to Council with a definition of laboratory. *MOTION CARRIED. Brad Collins said medical and dental services and supplies are already in the C -2 district. MOVED BY JOHANSON, SECONDED BY HARRIS, THAT COUNCIL ACCEPT DATA PROCESSING AND RECORD STORAGE. MOTION CARRIED. MOVED BY HILL, SECONDED BY PHELPS, THAT COUNCIL DELETE TOOL EQUIPMENT RENTAL, SALES AND REPAIR. MOTION CARRIED. MOVED BY HILL, SECONDED BY HARRIS, THAT CONFECTIONERY MANUFACTURING BE INCLUDED IN C -2. Councilman Bohrer said if it is in conjunction with retail operation he does not have any concerns. There is the potential for sizable manufacturing with trucking that would be of concern. Brad Collins said if you had retail sales operation and manufacturing was auxiliary it would be allowed. If you had manufacturing and incidental retail it would not be allowed. Fred Satterstrom said a middle ground would be a limit on the number of employees. Councilman Bohrer said staff could look at the number of square feet. Councilman Hill said the City allows bakeries. Mr. Collins said it is retail only. Councilman Bohrer asked Mr. O'Dell how many square feet he has in his operation. Mr. O'Dell said he has 12,000 square feet and employs 13 people. MOVED BY BOHRER, SECONDED BY HILL, TO AMEND THE MOTION AND PERMIT CONFECTIONERY MANUFACTURING IN CONJUNCTION WITH RETAIL SALES NOT TO EXCEED 12,000 SQUARE FEET. MOTION CARRIED, WITH SAUL AND PHELPS VOTING NO. TUKWILA CITY COUNCIL ZONING REVIEW December 14, 1981 Page 5 *MOTION CARRIED, AS AMENDED, WITH PHELPS AND SAUL VOTING NO. Brad Collins, Planning Director, said Jane Merkle, 4426 South 136th, Tukwila, has objected to re zoning on her property from R -4 to R -3. It is improved property with an apartment building located on 58th Avenue South. She questioned what the City would gain from this action. MOVED BY HARRIS, SECONDED BY BOHRER, THAT THE MERKLE PROPERTY BE ZONED BACK TO R -4. MOVED BY HARRIS, SECONDED BY PHELPS, TO AMEND THE MOTION SO THE COMPREHENSIVE PLAN SHOWS THE MERKLE PROPERTY AS HIGH DENSITY. Councilman Bohrer pointed out the area on the proposed zoning map. Fred Satterstrom said the property would conform to R -4. Councilman Harris said the property was purchased as R -4 and they keep the property in good condition. Councilman Hill asked if it is R -4 could more apartments be built there? Fred Satterstrom said if they structured parking it is possible. The configuration of the property would make it difficult to build on it. *MOTION CARRIED. *MOTION CARRIED, AS AMENDED. 3599 Brad Collins, Planning Director, said Cris Crumbaugh had suggested the parking requirement for drive -in restaurants be amended to read: "One parking stall per 35 square feet gross floor area." He had also commented that other municipalities in the area have between one stall /50 square feet and one stall /100 square feet gross floor area. Fred Satterstrom said it would depend on the type of place as to the parking requirements. Councilman Bohrer said drive -in people come to purchase food and many eat in their cars. The discussion continued on the difference between drive -ins and restaurants and the parking that would be required. Councilman Bohrer said the parking requirement should be the minimum that is required. Some places have more parking than is requi red. MOVED BY PHELPS, SECONDED BY HARRIS, THAT DRIVE -IN PARKING BE REFERRED TO STAFF TO DETERMINE DIFFERENCE BETWEEN A DRIVE THROUGH RESTAURANT AND A DRIVE -IN RESTAURANT. MOTION CARRIED. Cris Crumbaugh said he had suggested changing minimum 3.1 stalls /1000 square feet gross floor area for office use to 2.5 stalls /1000 square feet gross floor area. Discussion followed comparing Bellevue parking with Tukwila parking. Brad Collins said staff was not supportive of Cris Crumbaugh's mention that Pietro has requested municipalities to reduce office parking. Cris Crumbaugh said we cannot compare Tukwila and Bellevue. Metro wants parking control so people will be forced to ride the bus and leave cars parked away from City centers. Councilman Harris said we have to think whether or not we want Tukwila to be blacktop and all parking. Most of the new places have tried to camouflage parking lots with landscaping. Tukwila is becoming metropolitan and we want less blacktop, but not just to give Metro more business. She said she could go along with the 2.5 stalls. It is a good compromise. MOVED BY HARRIS, SECONDED BY BOHRER, THAT THE PARKING BE 2.5/1000 SQUARE FEET. Councilman Hill asked if the citizens should park out of the City and then wait two years for Metro to decide to come in with the TUKWILA CITY COUNCIL ZONING REVIEW December 14, 1981 Page 6 RECESS 10:15 P.M. buses? Councilman Harris said we already have the buses, all we have to do is show the need for more of them. Councilman Bohrer said things have changed. We are going to have sidewalks and they are to encourage people to get out of their cars. If the City starts developing offices and far more dense commercial area than we have, some of this is going to occur. We have talked about improving bus service and a service equivalent to what Bellevue calls "Bell -Hop" to get people out of cars and into buses. We want people to be able to walk, that is the reason for the sidewalks. Fred Satterstrom, Planning Department, said he wanted to argue for the existing parking requirements. Most developers think that 3.1 is reasonable and in some cases has been inadequate. It is the existing requirement. We have the business community wanting to increase the pavement of the streets, and Metro telling us to reduce the parking requirements. He feared the City would end up providing too few parking stalls and traffic will end up in the streets and the streets are undersized because we thought Metro was going to come in. It gets more and more congested. Councilman Johanson said we are not accommodating the traffic we have today. We cannot get good service by Metro. *MOTION CARRIED, WITH HILL AND JOHANSON VOTING NO.
