BOHRER, DORIS PHELPS, DANIEL J. SAUL. MOVED BY SAUL, SECONDED BY PHELPS, THAT COUNCILMAN BOHRER CHAIR THE MEETING. MOTION CARRIED. Councilman Saul noted that any changes made this evening by either a majority or 2 to 1 vote will stand unless the whole Council changes them at a later date. Mr. Tunnel noted that the wrong map was in Draft 5. This will be corrected in the final document. Mr. Collins clarified that the property owned by Helen Nelsen was R.A. and was not included in the height exception area. It has been rezoned M -1 for parking lot purposes. #5, Robert Crain Mr. Crain's comments were addressed at the last meeting. #6, Dwight Gardner Mr. Collins explained that Mr. Gardner's property has been changed to R -1 where previously part of it was R -4. Planning Commission recommended the R -l. The primary concern was that this area is accessed only through an R -1 district. MOVED BY PHELPS, SECONDED BY SAUL, THAT COUNCIL CONCUR WITH THE RECOMMENDATION OF THE PLANNING COMMISSION AND THAT THE PROPERTY REMAIN R -l. MOTION CARRIED. #7A, Andy Padvorac Request withdrawn to add "substation" to 18.46.030 (2). Mr. Collins said the City Attorney felt the Zoning Ordinance did not need to address the issue of private landowner's responsibility for landscaping utility easements. This can be dealt with in the easement documents. REVIEW OF PUBLIC COMMENTS FROM DECEMBER 7, 1981 Mr. Collins explained that Mr. Knudson has a parcel he would like to subdivide into three lots, one of which would be larger than 9,600 square feet and the remaining two less than 9,600 square feet each. MOVED BY SAUL, SECONDED BY PHELPS, THAT THE KNUDSON PROPERTY BE CHANGED TO 7,200 SQUARE FEET. MOTION CARRIED WITH BOHRER VOTING NO. MOVED BY PHELPS, SECONDED BY SAUL, THAT TWO MEMBERS THAT ARE PROPERTY OWNERS IN THE AREA BE ADDED TO THE PLANNING COMMISSION WHEN THEY SIT AS A SPECIAL REVIEW DISTRICT FOR PROPERTY ALONG INTERURBAN AVENUE. MOTION CARRIED. #2A, Joel Benoliel Correction has already been made by the City Attorney. Suggested that 5.5 parking stalls /1000 sq. ft. gross leaseable floor area for "shopping centers" be for developments greater than 300,000 sq. ft. Shopping Centers less than 300,000 should require 2.5 or 3.5 stalls /1000 sq. ft. gross leaseable floor area. This item will be discussed further at the December 21st meeting when the City Attorney is present. Mr. Bateman requested his client's property owned by Sanft, retain its existing zoning of M -1 rather than the proposed C -2. The property is adjacent to the M -1 zone. C D E #4, Harold Hill This item, related to parking requirements, is deferred to the December 21 meeting. #5, Gary Huff Discuss when he arrives at the meeting. #6A, Cris Crumbaugh Suggested that the Planning Commission, rather than the Board of Adjustment be the appeal authority. MOVED BY SAUL, SECONDED BY PHELPS, THAT COUNCIL RECOMMEND THE APPEAL AUTHORITY BE THE PLANNING COMMISSION. MOTION CARRIED. B B 3553 Suggested the penalty clause in 18.96.110 is too stiff. Mr. Collins suggested this be forwarded to the City Attorney. MOVED BY PHELPS, SECONDED BY SAUL, THAT THE LAST SENTENCE IN 18.96.110 BE DELETED, WITH APPROVAL OF THE CITY ATTORNEY. MOTION CARRIED. C. Deferred to the meeting of December 21. #7A, Andy Padvorac A has already been taken care of. B Has already been discussed. C Mr. Padvorac requested Item C be retracted. Mr. Collins offered that staff will add a definition of "low growing" and restrict it to five feet. #8A, Joanne Davis This will be answered on the 21st. Page 154, (2) suggested that the percentage of replacement cost is too little and that it should not be judged by the building official without a clause for appeals. Mr. Collins said there is language which allows setbacks to vary according to the average setback on a street. MOVED BY BOHRER, SECONDED BY SAUL, THAT AN OMNIBUS APPEALS CLAUSE BE PUT IN AND DEFER THE REPLACEMENT COST TO DISCUSSION WITH THE CITY ATTORNEY.* The appeal will be from staff to Planning Commission, Planning Commission to City Council. *MOTION CARRIED. C Mr. Collins said that the setback requirement affects only about four lots in the City. This does not relieve the residents al- ready non conforming. #5A, Gary Huff Staff will come back with a recommendation on definition of whether or not mechanical equipment is included in building height (18.06.120). B Correction already made; "mall" not "wall." MOVED BY PHELPS, SECONDED BY SAUL, THAT EXTERIOR COVERED LOADING DOCKS BE EXCLUDED FROM GROSS LEASEABLE AREA. MOTION CARRIED. Parking to be discussed at the meeting of December 21. Number of handicapped parking stalls to be discussed on December 21. Staff will research state requirements. TUKWILA CITY COUNCIL, C.O.W. PUBLIC COMMENT ON PROPOSED SHORELINE REGULATIONS OF DECEMBER 7, 1981 #1A, Harold Hill Mr. Hill's concern is that the Grantree building would become non conforming under the proposed shoreline regulations. It was agreed that Mr. Crumbaugh would work out this wording with staff and bring it back later. C Discussed earlier and to be handled the same. B To be discussed December 21. 3 SS MOVED BY SAUL, SECONDED BY PHELPS, THAT ALL PARKING AREAS SHALL HAVE SPECIFIC ENTRANCES OR EXITS TO THE STREET. THE COMMERCIAL AND MULTIPLE FAMILY DISTRICT ACCESS ROADS SHALL BE CONTROLLED BY THE DEPARTMENT OF PUBLIC WORKS. CURB CUTS WILL BE A MAXIMUM OF 28 FEET.* Access Road -A driveway or internal roadway that may provide access to one or more parking lots, properties, parcels or areas and may provide internal access from one street to another. Private roadways which provide internal circulation within a parking lot, property, parcel or area shall be deemed access roads. Definition of "Access Road" and "Curb Cut" will be dealt with on December 21. Mr. Collins noted that the Shoreline Regulations were adopted after the Grantree was built. The new regulations would not place additional hardships on the property. Mr. Hill's building is grandfathered in having been built prior to the adoption of the Shoreline Regulations. #2A, Cris Crumbaugh MOVED BY SAUL, SECONDED BY PHELPS, TO ADD THE DEFINITION OF DIKE MAINTENANCE ROADS AND FIRE LANES. MOTION CARRIED. Mr. Collins clarified, add Fire Lane to definition and add to the river environment as well as add Dike Maintenance Roads and clarify access roads that are for buildings or facilities and not included in this. B Mr. Crumbaugh cited 18.44, Shoreline Code included in the zoning code, and he requests that it include unique circumstances to be reviewed by the Council. It allows the public or an applicant, if they don't like something about a development, to bring it before the Council and Council can change it. This is not an appeal. #3A, Andy Padvorac Mr. Padvorac noted that 18.44.112 (1) and (2) do not include utilities so that excludes them from the river zone. This would not allow utilities to be attached to bridges crossing the river. Mr. Collins noted that if a utility bridges the river using the bridge structure, it might be considered part of it. Councilman Bohrer suggested "utilities, excluding electrical towers" be included. Council agreed. MOVED BY PHELPS, SECONDED BY SAUL, THAT 18.44.116 (a) BE REVISED TO READ" "STRUCTURES NOT TO EXCEED THIRTY -FIVE (35) FEET IN HEIGHT EXCLUDING UTILITY TOWERS." THEN REVISE (d): "UTILITIES, INCLUDING TOWERS." MOTION CARRIED. Mr. Padvorac withdrew his request. The phrase "except where a safety hazard would result" (18.44.114 (2) (C) (11) was included anyway. ZONING REVIEW December 16, 1981 Page 4 LETTERS Dated 12/4/81, Mr. Barnes requests that the zoning on his property at 15814 from John L. 51st Avenue South remain as zoned (R.M.H.). The new ordinance Barnes proposes to change the zoning to R1 -120 (single family residential). 8 #9 #11 Councilman Phelps stated that she felt a maximum of R -3 zoning might be appropriate if the property were required to develop under the Planned Residential Development concept. Councilman Bohrer recommended this be discussed by the whole council on December 29. Mr. Barnes noted that, to this date, there has been no objection to the multiple dwelling zoning from anyone within a 300 foot radius of the site. Dated 12/1/81 Mr. George Kropinski, Qestar Development Corp., expressed concern from Qestar that they do not wish to have their property at 51st Avenue South Development and Southcenter Blvd. to be adversely affected by the requirements Corp. of the proposed zoning. Councilman Bohrer noted that the area in question is proposed to be zoned C -2 so there should be no problem with an office development. PLANNING COMMISSION RECOMMENDATIONS ON POTENTIAL COMPREHENSIVE PLAN MAP AMENDMENTS COUNCIL ACCEPT THE #7 MOVED BY SAUL, SECONDED BY PHELPS, THAT THE /CAMPANELLA ZONING CLASSIFICATION THROUGH THE COMPREHENSIVE WAIVER PROCESS AND CHANGE THE COMPREHENSIVE PLAN MAP TO COMMERCIAL. MOTION CARRIED. MOVED BY SAUL, SECONDED BY PHELPS, THAT THIS AREA BE ZONED R -1 AND LEAVE LOW- DENSITY RESIDENTIAL ON THE COMPREHENSIVE PLAN MAP. MOTION CARRIED. MOVED BY SAUL, SECONDED BY PHELPS, THAT COUNCIL ACCEPT THE RECOMMENDATION OF THE PLANNING COMMISSION AND CHANGE THE COMPRE- HENSIVE PLAN MAP TO LIGHT INDUSTRY. MOTION CARRIED. #10 MOVED BY PHELPS, SECONDED BY SAUL, THAT COUNCIL ACCEPT THE RECOMMENDATION OF THE PLANNING COMMISSION AND CHANGE THE COMPRE- HENSIVE PLAN MAP DESIGNATION TO COMMERCIAL.
