O'BRIEN, husband and wife, hereinafter referred to as "GRANTOR for s hereby acknowlwdged to be fair and just compensation, do by these presents grant unto THE CITY OF TUKWILA, 10 WASHINGTON, a municipal corporation, hereinafter referred to as "GRANTEE a perpetual right -of -way easement for sidewalk and utilities with the necessary appurtenances through, over and across the property \LI described on Exhibits A and B, which property is situated in King County, Washington. GRANTEE shall have the right, without prior institution of any suit or proceeding at law, at times as may be necessary, to enter upon said property, for the purpose of constructing, repairing, altering or reconstructing said o sidewalk and utilities or making any connections therefore; provided that such constructing, repairing, altering or reconstructing of said sidewalk and utilities shall be accomplished in such a manner that the private improvements existing outside the sidewalk area in this right -of -way shall not be disturbed or destroyed, or in the event they are disturbed or destroyed, they will be replaced in as good a condition as they were immediately before the property was entered upon by the GRANTEE. G The GRANTOR shall retain the right to use said easement, so long as said use does not interfere with the g; installation and maintenance of the sidewalk and utilities and so long as the use does not interfere with use and 00 purposes herein mentioned. O GRANTEE agrees that upon completion of such work, the surface of such easement shall be restored and C\! replaced to a condition substantially equal to that before the work was commenced, to the extent that it is 0" practical to do so. This easement shall be a covenant running with the land and shall be binding upon the successors, heirs and assigns of the GRANTOR hereto.
