Page 84 Review with the City Attorney changes he has made in the proposed zoning ordinance. Discussion is continued from Monday, January 18, 1982. MOVED BY BAUCH, SECONDED BY DUFFIE, THAT COUNCILMAN HILL BE CHAIRMAN FOR THE MEETING. MOTION CARRIED. No Change. Discussion was held on where firelanes, parking and storage areas can be located. The proposed revision says they cannot be within the 40 foot River Environment. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT (g) BE ADDED BETWEEN LINES 11 AND 12 TO READ "FIRELANES AND DIKE MAINTENANCE ROADS" AND DELETE "FIRELANES" FROM LINE 14. MOTION CARRIED. Line 16 MOVED BY DUFFIE, SECONDED BY HARRIS, THAT THE WORD "LEAD" BE PUT BACK INTO LINE 16.* MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE MOTION BE AMENDED TO ADD "EXCEPT WHEN THE RAILROAD LEAD TRACK IS BRIDGING THE RIVER" AT THE END OF LINE 18. MOTION CARRIED. 3S Puget Power has requested that it be made clear that the owner of the property is the one to bear the expense of installing, main- taining, repairing and replacing the landscaping of utility ease- ments. Line 9, 3E MOVED BY BAUCH, SECONDED BY DUFFIE, THAT 3E BE LEFT AS WRITTEN. MOTION CARRIED. Item 3F has been deleted from page 79 and added to Line 12, Page 72. Concern was expressed that there are certain activities that occur within the Shoreline area where it would not be appropriate to have the applicant do a full landscape plan. It was suggested by Mayor Todd that if someone wants to do something new, build something, then is the time when they should submit a landscaping plan. MOVED BY BAUCH, SECONDED BY HARRIS, THAT COUNCIL MOVE ON WITH THE REVIEW. MOTION CARRIED WITH DUFFIE VOTING NO. Councilman Hill noted that this is an unresolved issue and will be discussed further at a later date. Attorney Hard has deleted Chapter 18.46.040, Planned Residential Development, from the text and included a definition of Planned Residential Development in Chapter 18.06, Definitions. Question was raised as to why 18.46.070 includes the densities when Chapter 18.50 is the reference for densities in the rest of the text. MOVED BY BAUCH, SECONDED BY HARRIS, THAT THE WORD "BELOW" BE DELETED AND ADD "IN CHAPTER 18.50 THEN, DELETE LINES 12, 13, 14 and 15. MOTION CARRIED. Attorney Hard said the original draft imposed a requirement that in the event the open space in a PRD wasn't maintained by the Home Owners Association, the City had the right to provide the maintenance and bill the association. He deleted this because of the possible enforcement problems. Line 18 through MOVED BY BAUCH, SECONDED BY HARRIS, THAT COUNCIL CONCUR WITH THE 22 CITY ATTORNEY ON THE PAGE 86 REVISIONS. MOTION CARRIED. MOVED BY BAUCH, SECONDED BY HARRIS, THAT COUNCIL CONCUR WITH THE CITY ATTORNEY AND DELETE LINES 12, 13 AND 14, PAGE 87. MOTION CARRIED. 35 7c). Attorney Hard noted the change to Item 2; "The Public Hearing shall not be held before completion of all necessary and appropriate review by City Departments." He felt the City wanted this pro- vision because the Planning Commission cannot conduct an intelligent public hearing until they get comments from all the City Depart- ments on the impact. Councilman Bauch asked if it wouldn't be more prudent to allow reasonable time for the review. If you allow one of the City Departments to hold up a public hearing, it could create a problem. MOVED BY DUFFIE, SECONDED BY HARRIS, TO CONCUR WITH THE CITY ATTORNEY.* MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE MOTION BE AMENDED TO ADD "THIS REVIEW TO BE COMPLETED WITHIN A REASONABLE LENGTH OF TIME" TO THE END OF LINE 20. MOTION CARRIED. *MOTION CARRIED. No Change. Line 17, omit the last word, submitted. No Changes. Chapter 18.48.040, Planned Mixed Use Development Superimposed was deleted and the definition included in the Definition Section. Attorney Hard noted that he has moved the requirement that "outdoor storage shall not exceed twenty (20) feet in height" from Chapter 18.52 to Line 18 (18.50.020). Pages 117, 118, No Changes. 119 120 35 73 Councilman Hill called the meeting back to order with Council Members present as previously reported. Attorney Hard said it is not clear in Chapter 18.50 that the City is going to permit buildings up to 115 feet in the area designated by diagonal lines on Page 102. Councilman Bauch indicated he wouldlike all Council Members present when this section is clarified. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THIS ITEM BE HELD UNTIL THERE ARE MORE COUNCIL MEMBERS PRESENT. MOTION CARRIED. Page 105, Line 8 Attorney Hard noted that old paragraph (11) was made a new section, 18.50.050, Building Permits for structures exceeding the basic height limits. (The word "exceptions" was deleted.) Line 15 Attorney Hard noted that the appeal section has been omitted by mistake. Line 15 should be 18.50.060, Appeal from height acceptions. Any appeal from this decision shall be governed by Chapter 18.60. Attorney Hard will reword this paragraph. Pages 106, 107 108 No Changes. Page 109, M -1 Cris Crumbaugh called attention to the chart on page 109. On M -2 M -1 and M -2 the side yard was deleted, but the chart on landscape areas requires 5 feet. If the side yard has been deleted, the landscaping requirement should be deleted too. Mr. Collins agreed, replace the "5's" with "none." No Changes. The sentence on Line 18 has been chagned to exclude areas within a Planned Residential Development District. Those requirements are in chapter 18.60. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT COUNCIL ACCEPT PAGE 111 AS REVISED BY THE CITY ATTORNEY. MOTION CARRIED. Change the word "ordinance" to "title." MOVED BY BAUCH, SECONDED BY HARRIS, THAT PARAGRAPH (C) BE DELETED.* Councilman Bauch said he has reviewed this and there are enough standards so that staff can look at the plans and tell if they have complied. *MOTION CARRIED. No Change. MOVED BY DUFFIE, SECONDED BY BAUCH, THAT COUNCIL CONCUR WITH THE CITY ATTORNEY AND STRIKE "WHICHEVER THE APPLICANT DESIRES. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT THE MOTION BE AMENDED BY CHANGING LINE 16 TO DELETE THE WORD "REQUIRE" AND REPLACE IT WITH "IN LIEU THEREOF, OBTAIN." MOTION CARRIED. No Changes. 35 7Lf Attorney Hard noted that the Shopping Cneter use has been changed by adding (MALL), PLANNED. There is no definition for Shopping Center in the text. This is still an unresolved issue because Council still has to decide if there is going to be other kinds of Shopping Centers and what the parking requirements will be. Attorney Hard noted that he has deleted the word "criteria" from Line 10 and added the word "guidelines." The rest of the changes are editorial. Page 127 No Change. Page 128 Attorney Hard said he added to Line 8 "and other materials as required by the Planning Department." Line 5 Councilman Hill noted that there is an extra "shall" in Line 5. Attorney Hard noted that the guidelines on pages 128, 129, 130 and 131 are fairly vague. Apparently other jurisdictions have similar guidelines and are able to work under them. The changes he has made are editorial. Pages 133, 134 No Changes. 135 Page 136 Attorney Hard explained the change he has made on Page 136. MOVED BY DUFFIE, SECONDED BY BAUCH, THAT COUNCIL CONCUR WITH THE REVISIONS MADE BY THE CITY ATTORNEY ON PAGE 136. MOTION CARRIED. Page 137 Attorney Hard explained that on Page 137 he has rewritten the Appeals section. The old provision said the applicant shall have the right to appeal to the City Council. It has been changed to read "any aggrieved party may appeal..." This would allow citizens the right to appeal a decision of the Board of Architectural Review. An unresolved issue is still how someone can appeal a decision of the City Council. There is nothing in the text and Attorney Hard would like to have it included. Everyone has the right to go to Superior Court if they want to. MOVED BY HARRIS, SECONDED BY DUFFIE, THAT COUNCIL ACCEPT THE REVISIONS PROPOSED BY THE CITY ATTORNEY ON PAGE 137.
