E A S E M E N T
THIS AGREEMENT, made this,/day of 19ql, by and between
the City of Tukwila, a municipal corporation of Ring County,
Washington, hereinafter termed "Grantee" and Darlene Sipe McPhillips,
hereinafter termed "Grantor
W I T N E S S E T H:
Grantor, for valuable consideration, does by these presents
grant unto the Grantee a perpetual right -of -way easement for a public
storm main with the necessary appurtenances through, over and across
O the property described on Attachment A and shown on Attachment B

C" J which property is situated in Ring County, Washington.

Grantee shall have the right, without prior institution of any
suit or proceeding at law, at times may be necessary, to enter upon
said property, for the purpose of constructing, repairing, altering,
monitoring, maintaining, replacing or reconstructing said public

storm drain or making any connections therefor; provided that such
constructing, repairing, altering, monitoring, maintaining, replacing

or reconstructing of said public storm drain shall be accomplished in
a
such a manner that the private improvements existing in this

right -of -way shall not be disturbed or destroyed, or in the event

they are disturbed or destroyed, they will be replaced in as good a

condition as they were immediately before the property was entered
upon by the Grantee.

The Grantor shall retain the right to use the surface of said
Cn easement, so long as said use does not interfere with the

buildings, structures or improvements are placed on said easement.
This easement shall be a covenant running with the land and shall be

City Clerk, respectively, of CITY OF TUKWILA, the municipal
corporation that executed the foregoing Easement and acknowledged the
said Easement to be the free and voluntary act and deed of said
municipal corporation, for the uses and purposes therein mentioned,
and on oath stated that they are authorized to execute the said
Easement.

The Property:
Parcel A: Beginning at the southeast corner of Tract 7, The
Interurban Addition to Seattle, according to plat recorded in
Volume 10 of Plats, page 55, in King Country, Washington;
thence along the south line of said tract N 88 25'27 "W 5.00'
to the true point of beginning; thence N 1 21'40 "E garallel
with the east line of said tract, 99.07 thence N 85 27 "W
145.51 thence S 1 35'44 "W 106.58' to the south line of said
tract; thence along said south line S 88 25'27 "E 145.72' to
the true point of beginning. SUBJECT TO easement for right
of way over the south 20 feet thereof, recorded under
Cc; Auditor's File NO. 3802715.
