WASHINGTON, a municipal corporation, hereinafter referred to as "GRANTEE" and M. A. SEGALE, INC., a Washington corporation, T

WITNESSETH, that the GRANTOR, for good and valuable consideration, receipt of which is acknowledged, and by the
benefits which will accrue to the land of the GRANTOR by the exercise of the rights herein granted, do hereby quitclaim unto
C� GRANTEE, its successors, assignees, licensees and permitees a perpetual and assignable Easement for the purposes hereinafter
stated, over and through, under, along and across, all or any part of that certain parcel of land situated in King County, State of
CV Washington, described in Exhibit "A" attached hereto and incorporated herein by this reference.
Said right and Easement are for the following purposes: The right to enter upon the land described in Exhibit "A to
construct, maintain, repair, operate, patrol and replace a flood protection levee, including all appurtenances thereto; reserving
C; however, to GRANTOR, its heirs and assigns, all such rights and privileges in the land as may be used without interfering with or
abridging the rights and easement hereby acquired; subject, however, to existing easements for public roads and highways, public
utilities, railroads and pipelines.
It is understood and agreed that the reservation described in the preceding paragraph shall include the right to construct
roads and /or utilities on, over, across, under and through the land described in Exhibit "A" in compliance with applicable U. S. ARMY
LORPS OF ENGINEERS standards and regulations for said construction.
It is understood and agreed that the Easement herein granted is for the specific uses and purposes described above and
not for any other uses and /or purposes.
1� It is understood and agreed that GRANTEE, its successors, assignees, licensees and permitees shall have the right to
appropriate from the land described in Exhibit "A such timber, rock, earth or gravel as may be necessary for the construction or
repair of said flood protection levee, including all appurtenances thereto.
GRANTEE, its successors or assigns, will release and quit claim back to the GRANTOR, its heirs and assigns, all rights herein
granted upon a showing that a levee, on the left bank of the Green River is tied to and upstream from the 1991 Section 205 project
CWIS 91634, and that the levee has been constructed to standard project flood (SPF) profile specifications approved by the U.S.
Army Corps of Engineers, and that an easement over the new construction area has been issued, granting the same rights as those
rights herein granted, to the appropriate diking or flood control district for future management.
I— If, in the exercise of the rights of GRANTEE hereunder, the soils, lawns, landscaping, paving, drainage, sprinkling, and /or
other site improvements of the real property described in Exhibit "A" are displaced, damaged or disrupted, GRANTEE shag repair
and restore said property to its condition prior to the exercise of the rights of GRANTEE hereunder.
The consideration above mentioned is accepted as full compensation for all damages incidental to the exercise of the
Easement above granted.
OD To have and to hold, all and singular the said easement and right of way, together with appurtenances, unto GRANTEE,
its successors, assigns, licensees and permitees.

Beginning at a point on the West margin of Mess County Road No. 76 (also known as Frager
Road S.) at the intersection with the South line of a parcel of land conveyed to M. A. Segale,
