This Easement, made and entered into this, day of 1991, between KING COUNTY, WASHINGTON,

a political subdivision of the State of Washington, THE GREEN RIVER L�NTROL ZONE DISTRICT, a political subdivision of
the State of Washington, and THE CITY OF TUKWILA, WASHINGTON, a municipal corporation, hereinafter referred to as

"GRANTEES" and METRO LAND DEVELOPMENT, INC., a Washington corporation, M. A. SEGALE, INC., a Washington corporation,
and MARIO A. SEGALE, a married man acting with respect to his separate property, as their interests may appear, hereinafter

WITNESSETH, that the GRANTORS, for good and valuable consideration, receipt of which is acknowledged, and by the

benefits which will accrue to the land of the GRANTORS by the exercise of the rights herein granted, do hereby quitclaim unto
GRANTEES, their successors, assignees, licensees and permitees a perpetual and assignable Easement for the purposes hereinafter
C\J stated, over and through, under, along and across, all or any part of that certain parcel of land situated in King County, State of

Washington, described in Exhibit "A" attached hereto and incorporated herein by this reference.

G construct, maintain, repair, operate, patrol and replace a flood protection levee, including all appurtenances thereto; reserving

or abridging the rights and easement hereby acquired; subject, however, to existing easements for public roads and highways, public

It is understood and agreed that the Easement herein granted is for the specific uses and purposes described above and
v not for any other uses and /or purposes.
It is understood and agreed that GRANTEES, their successors, assignees, licensees and permitees shall have the right to

appropriate from the land described in Exhibit "A such timber, rock, earth or gravel as may be necessary for the construction or
repair of said flood protection levee, including all appurtenances thereto.
!l If, in the exercise of the rights of GRANTEES hereunder, the soils, lawns, landscaping, paving, drainage, sprinkling, and /or
other site improvements of the real property described in Exhibit "A" are displaced, damaged or disrupted, GRANTEES shall repair
and restore said property to its condition prior to the exercise of the rights of GRANTEES hereunder.
The consideration above- mentioned is accepted as full compensation for all damages incidental to the exercise of the
Easement above granted.
To have and to hold, all and singular the said easement and right of way, together with appurtenances, unto GRANTEES,
their successors, assigns, licensees and permitees.

Title No. 145188
That portion of Government Lots 9 and 10, Section 2, Township 22 North, Range 4 East,
W.M. being a strip of land 30 feet in width lying 10 feet on the west side and 20 feet on the
east side of the following described centerline:
Commencing at the northwest corner of said Government Lot 10, thence S87 °58'20 "E along the
north line of said Government Lot 10 a distance of 1,293.94 feet to the intersection of the
centerline of Frager Road;
Thence S 1 °52'37 "E a distance of 13.88 feet along said centerline to the point of curvature of
ti a curve to the right whose radial center bears S88 °07'23 "W 1,800.00 feet;
N Thence southwesterly along said curve, through a central angle of 9'16'13" an arc distance of
