A. SEGALE, INC., a Washington corporation, and MARIO A. SEGALE, a married man acting with respect to his separate property, as their interests may appear, hereinafter w collectively referred to as "GRANTORS °O 0 0 WITNESSETH, that the GRANTORS, for good and valuable consideration, receipt of which is acknowledged, and by the x benefits which will accrue to the land of the GRANTORS by the exercise of the rights herein granted, do hereby quitclaim unto GRANTEES, their successors, assignees, licensees and permitees a perpetual and assignable Easement for the purposes hereinafter C\J stated, over and through, under, along and across, all or any part of that certain parcel of land situated in King County, State of c Washington, described in Exhibit "A" attached hereto and incorporated herein by this reference. 7 1. M Said right and Easement are for the following purposes: The right to enter upon the land described in Exhibit "A to 0 G construct, maintain, repair, operate, patrol and replace a flood protection levee, including all appurtenances thereto; reserving a however, to GRANTORS, their heirs and assigns, all such rights and privileges in the land as may be used without interfering with or abridging the rights and easement hereby acquired; subject, however, to existing easements for public roads and highways, public o utilities, railroads and pipelines. r It is understood and agreed that the Easement herein granted is for the specific uses and purposes described above and v not for any other uses and /or purposes. It is understood and agreed that GRANTEES, their successors, assignees, licensees and permitees shall have the right to 6 appropriate from the land described in Exhibit "A such timber, rock, earth or gravel as may be necessary for the construction or repair of said flood protection levee, including all appurtenances thereto. !l If, in the exercise of the rights of GRANTEES hereunder, the soils, lawns, landscaping, paving, drainage, sprinkling, and /or other site improvements of the real property described in Exhibit "A" are displaced, damaged or disrupted, GRANTEES shall repair and restore said property to its condition prior to the exercise of the rights of GRANTEES hereunder. The consideration above- mentioned is accepted as full compensation for all damages incidental to the exercise of the Easement above granted. To have and to hold, all and singular the said easement and right of way, together with appurtenances, unto GRANTEES, their successors, assigns, licensees and permitees.
