They would like to reconsider the percentage. Mr. Joel Benoliel, Benaroya Co., said the proposed definition is good as it codified what was intended. He suggested that a percentage isn't necessary because it reads "not intended for human occupancy." Mr. Collins explained that if it is an area that visually doesn't change the building, then that would not be included in the height limitation. The minute the mechanical gets out to the edge of the building and becomes a part of the visual image, then there is a problem. Councilman Bauch suggested that Council pass this, then let staff come back with an amendment. *MOTION CARRIED. Councilman Bauch asked staff to come back with a revision to exclude mechanical so that a mechanical floor can be built without a penalty. It doesn't necessarily have to be the top floor. MOVED BY PHELPS, SECONDED BY BAUCH, THAT COUNCIL ACCEPT THE AMENDMENTS TO LINES 7 THROUGH 17, PAGE 119.* "Curb -cuts: All parking areas shall have specific entrance and /or exit areas to the street. The width of access roads and curb cuts or exit areas to the street shall be determined by the Public Works Director. The edge of the curb cut or access road shall be as required by the Public Works Director for safe movement of vehicles or pedestrians. MOTION CARRIED. Mr. Seethoff,Southcenter Shopping Center, contends the definition of "access road" does not clearly differentiate it from a "curb cut." If the access roads at the shopping center were identified as curb cuts, they would be nonconforming. Considerable discussion followed on this subject. MOTION CARRIED. The definition suggested for medical and dental laboratories limits it to experimental study. This definition is not broad enough. 35 s MOVED BY PHELPS, SECONDED BY HARRIS, THAT THIS DEFINITION BE REFERRED BACK TO STAFF FOR FURTHER CLARIFICATION. MOTION CARRIED. MOVED BY PHELPS, SECONDED BY DUFFIE, THAT COUNCIL ACCEPT STAFF'S DEFINITION. "An aisle, lane, or roadway on an improved site which is designed, constructed, and required for emergency access of fire and aid unit vehicles." MOTION CARRIED. Concern has been expressed that the proposed definition for "Shopping Center" (mall) planned "is not significantly clear as to differentiate between groupings of commercial buildings such as Southcenter Shopping Center and Parkway Plaza. The difference is important when it comes to parking requirements. Mr. Collins said they contacted the Urban Land Institute Office and were told that their new report recommends 5 parking spaces per 1000 square feet of gross leaseable area. A 4 -tier classification is proposed that goes from 5.5 parking spaces to 2.5. MOVED BY BAUCH, SECONDED BY DUFFIE, THAT COUNCIL ACCEPT THE FOUR TIER PLAN.* *MOVED BY PHELPS, SECONDED BY DUFFIE, THAT THIS ITEM BE TABLED TO FEBRUARY 8 PENDING RECEIPT OF THE NEW URBAN LAND INSTITUTE STUDY AND FURTHER REVIEW BY STAFF. MOTION CARRIED. Councilman Harris said she would like to have a definition of what isconsidereda Mall. Mr. Collins offered that staff would dif- ferentiate between Mall and Arcade. MOVED BY DUFFIE, SECONDED BY PHELPS, THAT COUNCIL ACCEPT STAFF'S RECOMMENDATION ON ITEM NO. 7.* Staff did not bring the procedure outlined under the "Unique Circumstances" on the Shoreline Master Plan forward to the proposed shoreline regulations as they were felt to be vague. The issues are dealt with in other ways. The problem is in de- fining a "unique circumstance." Mr. Crumbaugh offered that he would draw up a list, limited to specific things, for Council consideration. Councilman Hill asked to have this back on the agenda for the 16th. Councilman Phelps recommended that they go ahead and accept staff's recommendation at this time keeping the provision open for Mr. Crumbaugh to come back to Council. *MOTION CARRIED. Andy Padvorac, Puget Power, has requested that a limitation be specified for the height of landscaping in utility easements. MOVED BY HARRIS, SECONDED BY PHELPS, THAT COUNCIL ACCEPT THE RECOMMENDATION OF STAFF.* Mr. Crumbaugh noted that there are many underground utility ease- ments in the City that have existing trees over five feet tall. Mr. Padvorac said his intention was to have included wording for easements with Overhead Utility Lines. *MOTION FAILED. MOVED BY PHELPS, SECONDED BY HARRIS, THAT THE FOLLOWING SENTENCE BE ADDED TO PARAGRAPH (3), PAGE 111: "IN AREAS OF OVERHEAD POWER TRANSMISSION LINES NO SHRUBS WILL BE ALLOWED OVER 5 FEET AT MATURITY.
