Mayor Todd led the Pledge of Allegiance and called the Regular
Meeting of the Tukwila City Council to order.

JOE DUFFIE, EDGAR D. BAUCH.
LAWRENCE E. HARD, City Attorney; PHIL FRASER, Acting Public Works
Director; BRAD COLLINS, Planning Director; MAXINE ANDERSON, City
Clerk.
Mayor Todd announced that the Block Grant Needs Application for
$30,000 to repair the Community Center roof has been approved by
the Committee and will go to the King County Council in March
for approval.
He further reported that in January, 1982, the Municipal Court
handled 283 more citations than in January, 1981. The court
time for judges has increased 23 hours for the same period.
Total revenue for January, 1982, was $20,571. The estimated
month's expenseswere $14,789. The Municipal Court and the Police
Department have been busy.

to execute a deferred compensation plan for the employees
of the City.
MOVED BY BOHRER, SECONDED BY HILL, THAT THE CONSENT AGENDA BE
ADOPTED AS SUBMITTED.*
Councilman Phelps noted that there were some vouchers included
for approval for small items. These should be handled by either
a charge card or petty cash.
*MOTION CARRIED.
At the bid opening on January 27, 1982, two bids were received.
The bids were higher than anticipated. The Public Works Budget
for this item is $5,000. MacDonald Miller Company bid $5,969.60
for the City Hall Mechanical System only. Staff recommends the
contract be awarded to them, but not started until March 1 to
stay within the budgeted amount.
MOVED BY BOHRER, SECONDED BY DUFFIE, THAT COUNCIL ACCEPT STAFF'S
RECOMMENDATION AND THE CONTRACT BE AWARDED TO MACDONALD MILLER
COMPANY IN THE AMOUNT OF $5,000 AND THAT THE CONTRACT START MARCH
1, 1982. MOTION CARRIED.

MOVED BY BOHRER, SECONDED BY DUFFIE, THAT THE PROPOSED RESOLUTION
BE READ BY TITLE ONLY. MOTION CARRIED.
Maxine Anderson, City Clerk, read a resolution of the City of
Tukwila authorizing the Mayor to execute a Water Purveyor's
contract with the City of Seattle.
MOVED BY BOHRER, SECONDED BY HILL, THAT RESOLUTION NO. 813 BE
ADOPTED AS READ. MOTION CARRIED.
Councilman Phelps said she voted in favor of this item, but has
two protests on the contents of the contract. (1) The 30 year
period of the contract for all of the purveyors allows little
flexibility for the local jurisdictions to develop their own
resources; (2) There is a very limited authority of the Purveyor
Committee in decisions affecting them.
Brad Collins, Planning Director, commented that the only question
on this is that the 20 foot setback may not accomplish the ob-
jectives of Hayden Island. Mayor Todd said he felt it was resolved,
at the last meeting, as to how many feet they needed. Staff
recommends the 20 feet, however, it could be changed.
MOVED BY BOHRER, SECONDED BY HILL, THAT THE PROPOSED ORDINANCE
BE READ BY TITLE ONLY. MOTION CARRIED.
City Attorney Hard read an ordinance of the City of Tukwila,
Wash., amending certain portions of Ordinance 1237 for purposes
of modifying setback requirements.
MOVED BY BOHRER, SECONDED BY DUFFIE, THAT ORDINANCE NO. 1244 BE
ADOPTED AS READ.*
MOVED BY BAUCH, SECONDED BY PHELPS, THAT THE THIRD WHEREAS BE
AMENDED BY ADDING THE FOLLOWING WORDS AFTER DISTANCE: "BECAUSE
OF CHANGED METHODS OF CONSTRUCTION REDUCING SETBACK REQUIREMENTS."
MOTION CARRIED WITH DUFFIE VOTING NO.
Councilman Bohrer said he feels this change is a waste of time
as it affects only about 1% of the building area.

MOVED BY DUFFIE, SECONDED BY HILL, THAT THE REGULAR MEETING OF
THE TUKWILA CITY COUNCIL ADJOURN. MOTION CARRIED.
