Deputy The Grantor(s) Corporate Property Investors, a Massachusetts Business Trust, for and in consideration of the sum of One Dollar ($1.00) in hand paid, receipt whereof is hereby acknowledged, do hereby grant, sell and convey to the City of Tukwila, Washington, a municipal corporation, Grantee, its successors and assigns, a perpetual non exclusive easement and right -of -way over, through, under, across, upon and in the following described real property situated in King County, Washington, TO -WIT: A. portion of Lot 16 of Short Plat No. MF -78 -SS according to the Short Plat recorded under King County Recording No. 7807210798, being a correction of Short Plat Recorded under King County Recording No. 7806260695, being in the southeast 1/4 and the northeast 1/4 of Section 35 and the southwest 1/4 and northwest 1/4 of Section 36, all in T.23N., R.4E., W.M., more particularly described as follows: BEGINNING at a point on the southerly line of said Lot 16, said point being 578 11 E 230.00 feet from the southwesterly corner of said Lot 16; thence from said POINT OF BEGINNING N l 1 "E 50.00 feet; thence 578 "E 50.00 feet to a point on "the easterly line of said Lot 16; thence tangent to said easterly line of Lot 16 along the arc of a curve to the right having a radius of 50.00 feet, a central angle of 90 and an arc length of 78.54 feet to the POINT OF BEGINNING. Said easement being for the construction, operation, maintenance and /or repair and /or replacement of an underground sanitary sewage lift station and appurtenances thereto, together with the right of ingress and egress to and from said easement for all purposes necessary and related thereto. This easement is granted with the understanding that upon completion of any work on the easement, the property affected will be restored as nearly as possible to the condition in which it was at the commencement of such work. The Grantee also agrees to indemnify and save harmless the Grantors from any liability or damages (including costs and attorney's fees) arising from the acts of omissions of Grantee and Grantee's agents, employees and contractors in the exercise of the rights granted herein.
