Council President Bohrer called the Committee of the Whole
Meeting to order at 7:12 p.m.
EDGAR D. BAUCH, LIONEL C. BOHRER (Council President), JOE H.
DUFFIE, MABEL J. HARRIS, GEORGE D. HILL, DORIS PHELPS.
Mayor Todd reported on progress of Grady Way Bridge. Plans and
specifications for bidding are 95% complete. In 30 to 90 days
it will be necessary to provide some funding. Federal author-
ization to move forward has not been received. Funding (federal)
has not been furnished.
The City has been dismissed from the 1977 lawsuit on the gate
collision at Fort Dent Park that included the City of Tukwila.
The City Attorney reports that claims submitted by Wendy's is
not a valid claim.
Councilman Phelps, Finance and Personnel Committee, reported
that 1982 sales tax receipts which were estimated at $435,000
came in at $485,347, an increase of 12% over estimated revenue.
Councilman Bauch, Public Works Committee, reported the Committee
considered the pedestrian crossing at 52nd Street. It will be
considered on March 9 at the Committee of the Whole Meeting.
Also considered was the turnover of the utilities of Sunwood
Development. It will be on the agenda of March 9, 1982.
Councilman Harris said there are two areas that are quite steep
on one side and no guard rails. Has this been overlooked? Mayor
Todd said Administration is aware of this and a report will be
forthcoming.
Councilman Duffie said information is needed as to status of
Foster Point Annexation and repair of 56th Avenue Bridge.
City Attorney Hard said in the Fire District No. 1 lawsuit noti-
fication has been received that the order has been dismissed.
His opinion is that the annexation proceedings are back where
they were before the lawsuit, which is before the Board of
Adjustment. It will be reactivated before the Board of Adjustment
City Attorney Hard said on the matter of the 56th Avenue Bridge,
there is disagreement between King County and the City over the
degree of responsibility. King County would also like the City
to bear a percentage of the cost that occurred in cleaning up
when the bridge collapsed. It is position of the County that
City and County are equally responsible. It is the position of
the City that we may not be legally responsible for one -half
of the cost. Mr. Hard said he has tried to discuss some other
formula with the County but they are adamant it should be 50/50.
Brad Collins, Planning Director, said the sign ordinance review
will be before the City Council on March 9.
Robert Crain, audience, said the condition of 160th between
53rd and 51st has been deteriorating. It needs to be looked at.
Councilman Bauch said a Public Hearing was requested to get
input from the public.
Police Chief Lowery said the street is not a problem for the
Police Department. The hydrants are on the east side of the
street and when it turns to 147th the hydrants are on the north
side. The concern is for the Fire Department. The corner of
56th and 147th is a sharp 90 degree turn.

Chief Lowery said his recommendation was no parking on north
and east sides of street. Fire Department recommended no
parking on west and south sides of street.
Council President Bohrer opened the Public Hearing at 7:35 P.M.
Ernest Dahl, 14444 56th South, Tukwila, said the street is 28'
wide; the Fire Department says it is 25' wide. It is a resi-
dential street. It has never been intended as a flow street.
If parking two wheels on sidewalk were permitted on 147th
traffic could move easily down the street. As a resident of
the street he would like parking on both sides of the street.
It keeps the street from becoming a speedway. Banning parking
on one side would turn the street into an arterial.
Glen Anderson, 14475 56th South, Tukwila, said he agreed with
Mr. Dahl, parking should be permitted on both sides of the street
It slows down traffic. The Fire Department was called to his
home once and they were there in three minutes.
Gordie Benner, audience, said he agreed with Mr. Anderson and
Mr. Dahl. Traffic and speed would be worse if parking is
prohibited on one side of the street.
Richard Broderick, 14445 56th South, Tukwila, said he agreed
with his neighbors. There was agreement at the time the
street was built that there would be two sidewalks and parking
on both sides. The street was not designed to be a speedway.
He would like to keep it like it is.
David Elliott, 14463 56th South, Tukwila, said he has lived
there for 20 years. Recently there has been more traffic.
South 144th was designed as the arterial. There have been no
plans to improve 56th to make it an arterial. It is common
practice for people to use 56th; parking on both sides of
street has made the street safer and slower.
Gene Ives, 56th Avenue South, Tukwila, said there is no parking
problem on the street. The fire hydrants are on the east side
and if parking is changed to one side of the street he would
like to see the parking on the west side.
Mark Hauck, 14467 56th South, Tukwila, said parking on both
sides slows the traffic. He asked why the Fire Department did
not object when the street was put in?
Pete Gibbens, 14477 56th South, Tukwila, said parking on both
sides of the street slows the traffic.
David Elliott, audience, asked what prompted the Fire Department
to request the change?
Councilman Bauch said a letter from the Fire Chief expressed
concern about getting an emergency vehicle down the street
with parking on both sides.
Councilman Hill said about a year ago the City received
complaints from citizens about the parking on the streets.
One complaint was that the Fire Department had to back up
because a pickup would not give the fire truck the right -of -way.
Mr. Elliott, audience, said neighbors would like to see somethinc
done in announcing 56th is not an arterial street.
Mr. Broderick, audience, said all residents would like to
continue parking on both sides of the street.

Councilman Hill asked if citizens of the street would be willing
to allow the City to restrict parking on the street to not more
than 72 hours for any one car?

The Committee of the Whole meeting was called back to order by
Council President Bohrer, with Council Members present as
previously listed.
MOVED BY BAUCH, SECONDED BY HARRIS, THAT COUNCIL APPROVE THE
MINUTES OF THE FEBRUARY 9, 1982 COMMITTEE OF THE WHOLE MEETING
AS PUBLISHED. MOTION CARRIED.
Mr. Bowden presented the views of the Highline Community Council
Environmental Committee and Citizens to Save Puget Sound on
Metro's proposal for the Seahurst Park Sewage Disposal Site.
He stated it is the Committee's view that swimming cannot take
place if Metro's proposal takes place. Studies have shown that
one -third of the bottom fish have degenerated. It is the
presence of toxics that has created these problems. It will be
one of the largest sewage treatment plants in the Northwest.
The tunnel from Renton to Seahurst will be 6 miles long and cost
140 million dollars. It will pass a seismographic hazard zone.
Not one drop of water will be better treated. He said the
Committee is not suggesting the Council take any action; they
would like Council to understand the issue from the Committee
point of view.

Committee of the Whole Meeting was called back to order by

Consideration is being given to two ordinance, one for the
comprehensive plan to make it consistent with the zoning and the
other the adoption of the new zoning code.

City Attorney Hard said two draft ordinance have been prepared.
One will adopt the new zoning code and map in one ordinance;
another action would be to adopt two separate ordinances,adopting
the text by reference and the other the map. Another alternative
would be to adopt only the text of the new zoning code and leave
the map as is, leaving it up to Council to adopt the new map when
they want to.

ORDINANCE ADOPTING TEXT AND MAP. MOTION CARRIED.
Brad Collins, Planning Director, said Council .proposed
the property between 51st Avenue South and 52nd Avenue south of
151st Avenue as R -4 rather than R -3. That would necessitate a
Comprehensive Plan Map designation of high density rather than
medium density. With that minor change the comprehensive plan
ordinance would have to be amended.
John Lason, representing the property owner, said they would like
to maintain current zoning on the property. Rising costs require
multi family housing. Tukwila is a hub. Density should be close
to work and jobs. This property should not be downzoned to single
family residences.
Mr. Lason introduced Mr. Darrel Connel, engineer, who presented a
planned project for multiple housing units. He said this property
will never be developed as R -1. There are too many problems and
it would be too expensive for single family. The planned project
would feed onto a major arterial. Many units could be put on this
site without affecting the view from above.
Dennis Robertson, 16038 48th Avenue South, said these discussions
have gone on for five or six years. He is president of McMicken
Heights Improvement Club. This property is part of the McMicken
Heights community. McMicken Heights is mostly developed as single
family and they want to keep it that way.
Councilman Duffie said there seemed to be water running off the
property. What is going to be done about the water?
Mr. Lason said any water they create will be taken care of. Drainage
will not be a problem. The project will withstand earthquake and
fire.
Councilman Bauch pointed out that the whole area below the crest
of the hill has slid in the past and is still sliding. The storm
drain lines put in by the State failed last summer. The soils eng-
ineer thought they knew what they were doing. Mayor Todd said the
failure of the storm system was due to deterioration. Councilman
Bauch said the Public Works Department told him they expected the
drainage to last for 30 years. The soils condition caused it to fail.

Dick Goe, audience, presented a petition signed by residents of the
area, requesting McMicken Heights remain single family dwellings.
He said this is the most critical area in the City. It is the will
of the people who live on the hill. The residents of McMicken
Heights have been before the Council several times and this has been
their stand.

John Barnes, 15814 51st Avenue South, said he would like his
property to remain RMH. He said he did not have money to protect
his rights by hiring lawyers, architects, engineers. He would like
his neighbors and City Council to protect his rights.
Robert Crain, audience, said he has been trying to protect his rights.
He reminded Council that the only problems have not been soils.

There have been traffic counts. The traffic that would be
generated through the residential area would be tremendous. The
arguments remain the same as they were 5 years ago.
Councilman Hill said he would like to see a development so no one
would be hurt. Planners have said the only way to protect R -1
would be to put nothing more than R -2 next to it.
Herman Allenbach, owner of the property, said the way his project
is structured it will step down from R -1 to R -2. There are 3 acres
that will be a green belt and i twill be dedicated to the City for
their use. This is the area on the top part. He said he canvassed
door -to -door to see how the people felt. A P.R.D. would be agreeable
to him. His plan is to put the larger buildings near the freeway.
There would be soils tests to increase the stability.

Councilman Harris said she would like to speak on the reason she
voted as she did. She said she feels the soil is so unstable, maybe
six months ago she might have felt differently, but she has noticed
in the papers that several homes in Californis have slid downhill
and into other parts of the street due to mudslides. Eventually
this property may all be developed but she did not think this is
the time. Perhaps in 5 years this property may be developed. No
one has shown her any soils test yet that shows the hill to be
stable. She said this has been her stand.
