Gerald E. Schneider and Gail M Schneider, husband and wife,
Grantor, as a donation and for no other consideration, does
by these presents grant unto the Grantee, the City of
Tukwilla, a municipal corporation, a perpetual right of way
easement for roadway and utilities with the necessary appur-
tenances through, over and across the property described on
Attachment A which property is situated in King County, Wash-
ington.
Grantee shall have the right, without prior institution
of any suit or proceeding at law, at times as may be neces-
sary, to enter upon said property, for the purpose of con-
structing, repairing, altering or reconstructing of said
roadway and utilities or making any connections thereto; pro
vided'that such constructing, repairing, altering, or recon-
structing of said roadway and utilities shall be accomplished
in such a manner that the private improvements existing in
this right -of -way shall not be disturbed or destroyed, or in
the event they are disturbed or destroyed; they will be re-
placed in as good a condition as they were immediately before
the property was entered by the Grantee.
The Grantor shall retain the right to use said easement,
so long as said use does not interfere with the installation
and maintenance of the roadway and utilities and so-long as
no permanent buildings, structures or improvements are placed
on said easement.
This easement shall be a covenant running with the land
and shall be binding on the successors, heirs and assigns of
the Grantor hereto.

W A permanent easement for roadway and utility purposes, being
a portion of the following described parcel: That portion of
the William H.Gilliam Donation Land Claim Number 40, in Sec-
tion 23, Township 23 North, Range 4 East, W.M.in King County,
Washington described as follows:
Beginning at the southwest corner of Tract 28 of the Interur-
ban Addition to Seattle, according to the plat thereof re-
corded in Volume 10 of Plats page 55,in King County, Washing-
ton.
thence South 89 47' 00" East along the south line of said
Tract 28, 22 feet;
thence South 24 25' 00" East 65 feet to the true point of
beginning; thence South 68 00' 00" West 156 feet;
thence South 37 00' 00" West 120 feet, more or less, to the
east margin of 65th Avenue South;
thence southeast along said east margin 70 feet, more or
less, to its intersection with the north margin of State
Highway Road No.11;
thence east along said north margin 270 feet; more or less,
to a point from which the true point of beginning bears North
24 25' 00" West 113 feet, thence North 24 25' 00" West 113
feet more or less, to the true point of beginning.
BEGINNING at the Southeast corner of the above decribed par-
cel; said corner being 40.00 feet when measured at right
angles from the centerline of right -of -way of Southcenter
blvd; thence South 59 34' 53" West bearings refer to
K.C.A.S. meridian along the Northwesterly right -of -way line
of said Southcenter Blvd, a distance of 58.76 feet; thence on

curve on the Northeasterlv right -of -way line of Macadam Road
and the radius point of said curve bears North 20 02' 49"
East, a distance of 45.00 feet; thence along said curve to
the right in a Northwesterly direction, having a radius of
45.00 feet, through a central angle of 17 44' 49 an arc
distance of 13.94 feet to a point on a curve and the radius
point of said curve bears North 16 44 52' West, a distance
of 666.34 feet; thence along said curve to the left in a
northeasterly direction, having a radius of 666.34 feet,
through a central angle of 13 36' 35 an arc distance of
158.28 feet; thence North 59 34' 53" East, a distance of
60.04 feet to the Northeasterly line of the aboved described
parcel; thence South 23 02' 47" East along said Northeast-
erly line, a distance of 10.08 feet to the POINT OF BEGIN-
NING.
Containing an area of 2145 square feet more or less.
