Ir-iON OF CASHSL *9.00 RECOW" 1, i /Cads KikL"U!+iY The City of Tukwila, a Washington municipal corpora- tion (the "City and the owner of the property referred to below (the "Owner hereby enter into this Easement Agreement Tr on the terms set forth below. a ti Whereas Owner is the owner of the property described in Exhibit A attached hereto and incorporated herein by,this reference (the "Property and r4 0 Whereas the City has a 20 foot wide right -of -way for South 147th Street (the "Right -of -Way through the Prop- erty as shown on the map of the Property attached hereto as Exhibit B and incorporated herein by this reference; and Whereas in conjunction with construction with certain improvements on the Property in 1981 the City required certain improvements be constructed at Owner's expense on the Right -of -Wav in the nature of a walkway, sidewalks and other such improvements for what is known as "Tukwila Trail No. S�_ 1 which trail is located on the Right -of -Way, and which improvements have been completed and approved by the City; and a Whereas the parties desire to complete and document C, the status of and relationship of the Property and the a Right-of-Way by the granting of the mutual easements as set y forth herein; Now, therefore in consideration of the mutual cove- nants contained herein and other good and valuable considera- tion, the parties agree as follows: 1. Owner hereby grants the City a non exclusive easement for ingress and egress over and across the paved road and parking portions of the Property for the sole purpose of maintaining Tukwila Trail No. 1 on that portion of the Right -of -Way adjacent to the Property. 2. The City hereby grants Owner a non exclusive easement for ingress, egress, utilities (subject to Owner obtaining any required permits from the City for installation of any such utilities) and uses reasonably related to use of the Property on, over and across that portion of the Right -of -Way which passes through or is bordered by the Property. No.l on the Right -of -Way and the City shall not obstruct or block parking or ingress or egress to the Property. 4. Owner hereby covenants and agrees that neither the existing contour nor vegetation of that portion of the Property which is currently undeveloped and is identified by the cross hatching on Exhibit A shall be disturbed by Owner as a result of contiguous development by Owner of the Property. 5. Owner further covenants and agrees to maintain that portion of the Tukwila Trail No. 1 as it presently exists on that portion of the Right -of -Way which runs through the Property, at Owner's cost. er 6.
