Council President Bohrer called the Tukwila City Council Committee
of the Whole Meeting to order at 8:20 p.m.
EDGAR D. BAUCH, LIONEL C. BOHRER (Council President), JOE H. DUFFIE,
MABEL J. HARRIS, GEORGE D. HILL, DORIS PHELPS, GARY L. VAN DUSEN.
Mayor Todd reported the sales tax bill has passed, but has not
been signed by the Governor.
Alan Doerschel, Finance Director, said the tax bill will bring in
double the present tax revenue. He said the County can implement
a one -half cent sales tax. If the County imposes the tax and the
City does not, then the City cannot come back and impose the tax.
The City will get 85% and the County 15 AWC favors the increase
and there will be a meeting on May 18 and 21 about the bill and its
impact. Some of the cities are imposing the tax on May 1 and some
on January 1,
Phil Fraser, Acting Public Works Director, said the bridge will
cost close to 8 million dollars. It will be 80% federal funded.
The City share will be $800,000. The railroads are contributing
$50,000.
Mayor Todd suggested an LID with Renton be formed that would include
the railroads. City Attorney Hard said it would be hard to
determine the specific benefits. He has contacted the Renton City
Attorney to discuss the possibility.
Mayor Todd said the 56th Avenue Bridge repair is still in the process
of communication with the County.
Council President Bohrer said he had a letter from Herbert G. Forber
that he would refer to the Community Affairs Committee.
Councilman Bauch, Chairman of Public Works and Public Safety Com-
mittee said there would be a meeting on Wednesday at 4:45 p.m. to
consider the six -year street program and repair to the Fire Station.
Councilman Phelps said the Finance and Personnel Committee will
meet on Thursday at 4:30 p.m. On the agenda will be benefits for
non -union personnel and a report from Council Intern about the
library.
City Attorney Hard reported that Leanne Shirey has filed a case
again the City. He said he would request an Executive Session
at the next meeting to consider this subject.
MOVED BY VAN DUSEN, SECONDED BY HILL, TO APPROVE THE MINUTES OF
THE COMMITTEE OF THE WHOLE MEETING HELD MARCH 23, 1982 AS
PUBLISHED. MOTION CARRIED.
City Attorney Hard requested an Executive Session so he could
advise Council Members of the legal ramifications over the zoning
code.
MOVED BY VAN DUSEN, SECONDED BY DUFFIE, THAT THE COUNCIL GO INTO
EXECUTIVE SESSION TO DISCUSS A LEGAL MATTER. MOTION CARRIED.
The Tukwila City Council Committee of the Whole Meeting was called
back to order by Council President Bohrer, with Council Members
present as previously listed.
Council President Bohrer said the Mayor has proposed that some of
the property in McMicken Heights be designated PRD and also some
area south of 178th.

Mayor Todd stated he proposed that some of the parcels of property
on the hill in McMicken Heights be designated park use, some remain
R -1 and the rest of the parcels in question be designated PRD.
This would allow complete control by the City of any development.
Density would be 16 units per acre. In order to move forth this
seems a reasonable compromise. The zoning ordinance passed by the
City Council reduced the land area in the City open for multi family
use. He said all other objections to the ordinances passed by the
Council have been satisfied with proposed technical revisions. He
said he thought involved property owners would be willing to take
PRD -3 density.
Council President Bohrer said it was his understanding that the
revisions were mainly oversight corrections or typographical errors.
City Attorney Hard said attorneys for the property owners have
said they are willing to meet with appropriate City officials as
to a settlement on the density if it is greater than single- family.
He said this would not preclude the possibility of lawsuits,
however.
Dick Goe, 5112 South 163rd Place, said he was vice president of the
Tukwila McMicken Heights Action Committee and the citizens of McMicken
Heights are willing to risk lawsuits to keep the area single- family.
The committee held a meeting last night and considered the alterna-
tives. He asked all who were willing to take the risk to stand.
Many of the audience stood. He asked those willing to compromise
to stand. One citizen stood.
Leo Sowinski, audience, said the people here at the meeting do not
represent all of the people who are involved.
Dennis Robertson, 16038 48th Avenue South, said he was president
of Tukwila McMicken Heights Action Committee and they want to keep
their neighborhood single family. The location of the freeway is
a natural buffer.
Darlene West, 5212 South 164th, said she would like to keep the
McMicken Heights area single- family.
MOVED BY HILL, THAT PARCELS 5, 6, 7, 8, 9 BE IN THE PRD -R3 ZONING
AND THE BALANCE BE R -1 WITH PRD ZONING IN THE AREA SOUTH OF 178TH.
MOTION FAILED FOR LACK OF A SECOND.
MOVED BY HILL, SECONDED BY PHELPS, THAT PARCELS 5, 6, 7, 8, 9 BE
IN THE PRD -R3 ZONING WITH THE BALANCE R -1.
Council President Bohrer said this would establish a precedent for
multi family zoning in that area.
Dick Goe, 5112 South 163rd Place, said the freeway is a buffer. There
are steep slopes and they are buffers. The City has provided a lot
of condominiums and apartments. There is not a great demand for
them any more. The citizens of McMicken Heights were here last week
and they want the City Council to reconsider the zoning ordinance
and have the area of McMicken Heights just single- family. That is
what they want.

MOVED BY PHELPS, SECONDED BY HARRIS, THAT ORDINANCE NO. 1247 BE
ON THE AGENDA OF THE APRIL 20, 1982 REGULAR COUNCIL MEETING. MOTION
CARRIED, WITH HILL VOTING NO.
Brad Collins, Director of Planning, presented a brief history of
the McNamara condominium request.
Tom Walsh, attorney for Mr. McNamara, said they have submitted all
that has been requested by the City. He requested that Councilman
Bauch step aside from the discussion and vote due to signs he posted
on his front lawn, photos of which he requested be entered for the
record. He said they were indicative of the point of view he has
taken.

City Attorney Hard said he had discussed this matter with Mr.
Walsh and he thought the signs did not violate the appearance of
fairness. He said Councilman Bauch had discussed the matter before
he was a City Council Member. It is appropriate that the question
should be raised at this stage of the discussion. The decision will
have to be made by Councilman Bauch.
Councilman Bauch said he attended two meetings as a citizen in October
1980 and he read from the minutes of the meeting what he had said and
on November 10, 1980 at the Public Hearing. He said he did not wish
to withdraw himself.
Mr. Walsh said they had a soils report, a report on traffic and
various photos and other reports required by the City.
Dale Hemphill, Consulting Engineer, 4612 170th SE, Redmond, stated
his qualifications as a soils engineer. He described the soils
tests that were made on the McNamara property. He stated the
McNamara property is on the top and he did not observe anything
unusual. Test pits did not show a tendency to slide. He said he
would be present during construction of the project and would
verify the conditions that exist. He said he had made 11 test pits.
MOVED BY VAN DUSEN, SECONDED BY HARRIS, TO EXTEND THE MEETING TIME
TO 11:30 P.M. MOTION CARRIED.
Jim McIser, Engineer, Transpo Group, 23 148th Avenue SE, Bellevue,
said he had studied the impact of the proposed project and could
not find a significant impact on the traffic. The street system
is adequate. At the intersection of 53rd and Klickitat it would
add 2% to peak hour traffic. The intersection now has potential
hazards. As R -1 density the area would yield 14 single family homes,
it would yield 54 multi family units. Mr. McIser stated his
qualifications as an engineer.
MOVED BY VAN DUSEN, SECONDED BY PHELPS, THAT THE MCNAMARA WAIVER
REQUEST TO BUILD 54 CONDOMINIUM UNITS BE ON THE AGENDA OF THE
APRIL 20, 1982 REGULAR MEETING. MOTION CARRIED.
