JMW 11-18-2011 Jon Morrison Winters From: Trish Nygreen <trishn@claritysigns.com> Sent: Wednesday, October 05, 2011 2:33 PM To: Jon Morrison Winters Cc: Donna Green Subject: Emerald City Cash / City of Tukwila Jon, Thanks for your call — Donna stepped out of the office but please accept this e-mail as our formal request to extend the permit for Emerald City Cash by 30 days. Best, Trish Nygreen Clarity Signs, Inc. 425/485-9600 1 Dear Donna, Upon review of the plans you sent to me, it appears that the existing sign (sign A) did not meet the requirements of the old Sign Code. As I discussed with you on the phone, the total permitted area of the sign was 28.4 square feet. Since the sign did not meet the old code, it cannot be changed in any way without being brought into compliance with the new Code. Additionally, the plans you submitted indicated a new sign (sign B), for which no permit was obtained. In order for the code enforcement action to be satisfied, these two signs must be removed or a permit must be obtained to bring them into compliance with the new Sign Code. The freestanding (pole) sign on the premises also does not appear to be in compliance with the old Sign Code, as it appears to be too tall. The old Code generally required a freestanding sign to be no taller than the building which it identifies. This means that you will not be able to reface the sign without bringing it into compliance with the new Code. Otherwise, the sign must be removed, as it is considered an abandoned sign (meaning it advertises a business which has not been located on the premises where the sign is displayed for 60 days or more). Please let me know if you have any more questions. I or Senior Planner Brandon Miles will be happy to work with you, the tenant, and the building owner during this process. Sorry for not getting back with you earlier. I did not have time to respond on Friday, and have been out of the office until today. Regarding the size of the incentive sign, you are referring to the correct section of the code. However, using the method indicated in that section, the maximum sign of the size will be 10 square feet. Based on your plans, the wall where the sign will be installed is 364 sq ft in size, so you need to take 50% of the results of the formula: EBF x .05 or 20 sq feet, whichever is larger. In this case, EBF is 364, so the result of the formula is 20 square feet. 50% of 20 square feet is 10 square feet. If this is still unclear, we can discuss it over the phone. I recall you had a question about why the pole sign on the property was considered "abandoned." The appropriate code section defining an abandoned sign is 19.08.020: "Abandoned Sign means any sign that file://C:\Documents and Settings\dcd-intern\Local Settings\Temp\XPgrpwise\4D9ED6B7... 04/08/2011 Page 2 of 4 advertises a business, lessor, owner, product, service or activity that has not been located on the premises where the sign is displayed for 60 days or more or a sign cabinet where the face has been broken or missing for 30 days or more." Hope that helps. -Jon Jonathon Morrison Winters Planning Intern City of Tukwila iwi nters(&ci.tu kwi la.wa. us »> "Donna Green" <donnag©claritysigns.com> 04/04/2011 4:24 PM »> Hi Jonathan - Just wanted to confirm that you got my response last week. Upon review of your plans, it appears that the sign on the East side of the building (Sign A on your plans) will meet code. For Sign B on the north side of the building, you must use the area of the wall where the sign will be located to determine the maximum allowable area of the sign. Assuming that this wall meets one of the criteria noted in section 2 of the application form and based on the wall area of 364 square feet, the maximum allowable sign area is 10 square feet. Please resubmit plans showing a sign within the maximum allowable area of 10 square feet. Only one copy of the revised plans is necessary, and you may e-mail it to me as a pdf attachment. Also please let me know if the property owner intends to have the abandoned signs that I referenced in my previous e-mail removed or brought into compliance. If you have any questions about this or any other requirements of the Sign Code, please contact me at the e- mail address below or call our office at 206-431-3670.
