Mayor Todd reported that he has written a letter to the King County Executive regarding the 56th Ave. Bridge. He has been informed that Governor Spellman has signed the local option 2¢ sales tax bill. He reminded Council that all of the union contracts will be negotiated this year. This is a very important issue. The Pro Parks issue will be back to Council for a decision shortly. Council Member Phelps announced that the Finance and Personnel Committee will discuss library costs, salary plan update and the P L Development on April 29. Councilman Bauch said the Public Works Committee will consider the 6 -Year Street Plan on April 21. Mayor Todd noted the Finance Director's monthly report on in- vestments. Interest income for the month of March, 1982, amounted to $22,360 on the following activity. Investments Sold $3,352,000 Investments Purchased $3,113,000 Councilman Duffie noted that he has had complaints about young adults holding frisbee tournaments on weekends in the Tukwila Park. The general public is unable to use the park because of this. The group is asking them to leave. The park is for everyone, not for one group to take over. Councilman Bohrer suggested that the Police Department look into this. Councilman Bauch said he is surprised to find that there is no cleanup station scheduled for the McMicken Heights area. He asked why? Mayor Todd offered to look into this. The last one was located at 54th and Slade Way. Mr. Dick Goe, Chairman of the Sister City Committee invited the Mayor, Councilmembers, City employees and interested citizens to join them on their next visit to Ikawa, Japan. The next planning session is April 21 at Showalter Middle School. Mr. Dwayne Traynor, audience, noted that there seems to be a scheduling problem for the baseball field at Joseph Foster Memorial Park. The conduct of the adult men's team in a particular situation was questionable. These parks were completed for the young people, adults are secondary. Mr. Don Williams, Recreation Director, recognized the problem. Mayor Todd read a proclamation proclaiming April 18 through 24 as Volunteer Week and thanking the volunteers for their contribution to the City. He and Don Williams, Recreation Director, presented certificates of recognition to the volun- teers in the Parks and Recreation Program. Mayor Todd called the regular meeting back to order with Council Members present as previously reported. MOVED BY VAN DUSEN, SECONDED BY HILL, THAT THE CALL FOR BIDS TO REPLACE THE FIRE STATION ROOF BE TABLED AT THE REQUEST OF THE PUBLIC WORKS DIRECTOR. MOTION CARRIED. Councilman Bohrer said that this ordinance is very important to the City and it is imperative that Council act on it. Councilman Van Dusen said that this ordinance was started over six years ago. Everyone has had a chance to express an opinion. The Public Hearings were done properly. No one is completely happy with the final comprehensive plan and zoning code. It was estimated that $200,000 has been spent to get this ordinance to the point it is today. Many many hours have been spent by many people. Council approved the ordinance on March 16; following Mayor Todd vetoed it. If we do not do something with this to- night, we are back to the old ordinance. Councilman Duffie asked Attorney Hard if Council can vote on the zoning text and map separately? Attorney Hard agreed that this was possible but would prefer that it not be done that way. This is a comprehensive law that includes both the text and map. Councilman Hill agreed that a lot of work has gone into this ordinance. The main thing in contention right now is the zoning of the 27 acres on the north slope in the McMicken Heights area. There are some that feel the best protection for a residential area would be a buffer of duplexes around the residential area allowing heavier density stepping down the hill to an R -3 level TUKWILA CITY COUNCIL, REGULAR MEETING April 20, 1982 Page 3 OLD BUSINESS Cont. Ordinance #1247 Adopting a new zoning code and shoreline reg. (cont.) (15 units per acre). Apartment dwellers are not second class citizens. Putting apartments on that hillside is not going to turn it into a slum area. 3c,So Councilman Harris said that some way this must be resolved or the whole city will suffer. Attorney Hard called attention to the material on the Council table. It is information from Mr. Joel Haggard, attorney, representing one of the property owners on the hillside. Mr. Joel Haggard, 1700 Daon Building, Seattle, referred to his letter. "Perhaps, it is more improtant at this stage for each of us to listen to each other and to find an acceptable basis for a solution which respects the rights of all people, property owners, potential residents and residents." You have expended a lot of time and effort in what you are considering; you don't want to throw that out. He recommended that Council adopt the zoning text; it is well written, comprehensive, provides pro- tection and predictability for the property owners and the people that want to live here if new developments want to come in. He suggested that it may be appropriate to hesitate a little while with respect to the zoning map. Council does not want to put the whole zoning code in jeopardy. There is still one area of dispute. He displayed a map of the McMicken hillside area. Their property, clearly, is not within nor a part of, the McMicken Heights area. A natural topographic feature (about the 300- 305 foot elevation) is the natural boundary point. The I -5 and the SR 518 corridor is an arbitrary and capricious manmade barrier. Mr. Haggard suggested that Council adopt the zoning text, but withhold action on the zoning map for two weeks and instruct him to meet with the people from McMicken Heights. Maybe they could arrive at a compromise. He urged Council to adopt the zoning code; it is a good one, but take a second look at the 27 acres. He said they have advised their clients to accept a taking away of the existing RMV and R -4 zoning and re- placing it with R -3 subject to PRD. They also suggest that the property is not properly characterized as part of the McMicken Heights single family residential, detached neighborhood. Thus, what is done here does not affect the neighborhood integrity that residents in McMicken Heights have fought to maintain. Mr. Haggard noted his letter to his client, Mr. Herman M. Allenbach, giving them an opinion as to what might be in- volved and what their legal rights are to challenge since the constitution gives them the right to petition the government for redress of wrong. If R -1 is adopted, there is a meritorious basis for filing a complaint to question and to challenge the decision with respect to the imposition of R -1 zoning on this piece of property. His clients have given him strong indication they intend to pursue their reasonable rights in litigation unless some type of acceptable compromise, which protects not only McMicken Heights people, but also their rights as property owners is reached. Councilman Bohrer said the conditions stated by Mr. Haggard are very general appearance of fairness, environmental pro tection--so any person in the City could file the same claim. They are asking that Council deal with them and with other properties on a very limited basis. Once Council decides to do that under the threat of legal action, we are laying our- selves open to anyone else in the City who is not satisfied with their current zoning and wants to make the same claim. Mr. Haggard said his letter is not presented as a threat; it is simply his opinion that there may be a meritorious claim specifically with respect to concerns over either the procedure or the substance, assuming that R -1 zoning is adopted. It is unfortunate to be here at this late date requesting Council to exercise some prudent and second thought regarding this 27 acres. In all fairness, all members of the Council must consider all the information available to make sure they have adequate grounds for a decision and not one based upon an arbitrary and capricious boundary of a freeway cor- ridor as distinct from a natural topographic boundary. 3 (S/ Councilman Duffie asked if it would be legal to ask the citizens of McMicken Heights to help work out a compromise plan for Council review. Attorney Hard said Council could encourage people to attend a meeting for that purpose, but Council cannot delegate them a legislative function. Mr. Cris Crumbaugh, P.O. BOX 88050, Tukwila, Attorney, recommended that Council not adopt the zoning map separate from the zoning ordinance. For seven years, all discussions have been on a certain text geared to certain zoning desig- nations. If you adopt the text and not the map, you have different regulations on property you might never have conceived. Further, there could be a race to the Building Department for building permits based upon an old map and new text. He suggested Council make a decision and not split the adoption process. He noted that the code includes a severability clause. Mr. Dwayne Traynor, 14910 58th Ave. South, told Council they should stand up and be counted and adopt the zoning ordinance and map. Anyone can come back at a later date and request a change in the new ordinance. Councilman Bohrer noted that Mr. Haggard's request is not a new one. It has been before Council through the whole review process. Council has heard the same opinoin from the same people for the last four or five years. Now they are asking for further delay. In each case, with three separate Councils, the judgment was always that Council should continue with the approach in the Comprehensive Plan and leave the area as R -1. Further, he agreed that it would be a bad policy to divorce the map from the text. Mr. Dennis Robinson, 16038 48th Ave. South, said he is President of the Tukwila /McMicken Action Committee. The group was formed to deal with this land use issue. Nothing is going to change us, postponing this to talk with us again is only going to delay it and won't accomplish anything. Council should take a stand on the issue before them tonight. There should be no doubt on how we (McMicken Heights) stand. Mayor Todd asked Mr. Robinson if he lives in Tukwila and would he contribute to the Tukwila legal fund if litigation occurs because of this. Mr. Robinson said he does not live in Tukwila, but did make the effort to have his area annexed to the City. A vote of the people turned this down. We are impacted by your zoning ordinance. We are a community. Mayor Todd noted that Council has never denied them the right to speak on any occasion. Councilman Van Dusen asked if Mr. Robinson lives in the Tukwila planning area and was told "yes." Councilman Duffie noted that he does not represent just one area of town; he represents the whole city and will vote the way he feels is best. Councilman Van Dusen asked Attorney Hard if the city has followed all of the procedures and met all of the requirements of SEPA. Councilman Van Dusen asked if the city has met all of the requirements of the appearance of fairness. Attorney Hard agreed that the city has. The city has followed the appropriate procedures for adopting the zoning code under the State Enabling Act. Mayor Todd asked the City Attorney if it was not the duty and obligation of any elected official to represent all parties on a fair and equal basis. Attorney Hard said yes. Mayor Todd asked if the land owners that are being down zoned from RMH to R -1 are being fairly treated. Attorney Hard said his job is to see that the process has been fair. It is not his job to make legislative decisions. Councilman Bauch said that most of the significant changes in land use within the city have been done on a local rezone type situation. Generally there were more stringent conditions set on the rezones than were included in the zoning code. It would be impossible to include all of these things in the text. At the time Council adopted the Comprehensive Plan, they initiated a waiver process. Again, the waivers applied more stringent conditions. He urged Council to adopt the zoning ordinance and the map as it is now on the table. If situations change and there needs to be a compromise, it should be considered one parcel at a time. Councilman Hill commented that a PRD has to come before the Council, and they can put restrictions on the development. Council would have control. Mayor Todd explained that the concept of an area wide PRD to an R -3 density was conceived so that the first development would set the trend for all the rest of the developments in the area. Council would have some latitude in placing the building to give the least impact on the existing residential area. Attorney Hard explained a "Yes" vote is in favor of Ordinance No. 1247 as it is now written including the current map. It would override the Mayor's veto. Attorney Hard read, in its entirety, an ordinance of the City of Tukwila, Wash., amending Ordinance No. 1247 by repealing Section 5. MOVED BY VAN DUSEN, SECONDED BY HARRIS, THAT ORDINANCE NO. 1251 BE ADOPTED AS READ.* MOVED BY BAUCH, SECONDED BY VAN DUSEN, TO AMEND THE ORDINANCE BY ADDING "TO DECLARE AN EMERGENCY. Attorney Hard said it is unnecessary to declare an emergency on this ordinance. Mayor Todd called the regular meeting back to order with six Council Members present. MOVED BY BOHRER, SECONDED BY VAN DUSEN, THAT COUNCIL GO ON TO ITEM 8C.* Attorney Hard explained that Ordinance No. 1186 provided that the waiver process would become null and void either upon the passage of a new zoning code or at the first regular meeting in January, which ever came sooner. The waiver process was automatically repealed in January so there is no need to proceed with Mr. McNamara's waiver request. Councilman Bauch asked if there is any way to reduce the city's liability in there are water problems on the hillside. Attorney Hard said the City should require the developer of the property to pro- vide adequate, professional assurances to the City that there would be no danger. This would be provided by a certified engineer. Councilman Bauch asked if the City could request a second opinion and have the developer pay for it. Attorney Hard read an ordinance of the City of Tukwila, Wash., amending Ordinance No. 1203, establishing Green Fees for Foster Municipal Golf Links. MOVED BY BOHRER, SECONDED BY HARRIS, THAT THE ORDINANCE BE ADOPTED AS READ.* Councilman Hill said he has a problem in that a person, just because they are 62, can play for a reduced rate. It wouldn't bother him so much if the person is on a pension with Social Security; but you can't discriminate, can you? Attorney Hard said that some municipalities set fees based solely on income. Councilman Bauch said that the Park Board voted against this rate change. The seniors have plenty of opportunity during the off -peak hours to play. The rates on weekends should be premium rates. Councilman Phelps said the city received five petitions con- taining 139 signatures requesting a special weekend rate for senior citizens. The Foster Men's Club endorsed the request. The Community Affairs Committee reviewed this and recommends that the ordinance be adopted. Mr. Roy Moore, President of Golf Management, said they operate the golf course for the city. There are some problems with the proposed rate change. How do they police it? An addition like this does not cost the city; it costs Golf Management. Their contract with the city expires at the end of this year. They will not renew without some modifications. They have an analysis that indicates it would be possible to lose up to $2,000 a month if the rates are changed. This would be a material change in the contract. They are charged with all the maintenance and operation regardless of the amount of income. The golf course is not overly profitable as Council is already aware. Further, Section 4 of the ordinance deals with the fact that sales tax is included in the price. This is approximately a $4,000 reduction for them. The sales tax has been increased since their contract went into affect. Councilman Phelps requested a copy of the evaluation Mr. Moore referred to. Mr. John Hensley, 5711 So. 152nd, said he is a long time resident of Tukwila and is interested in the welfare of the senior citizens. They would like cheaper rates for seniors on weekends. It is a profitable operation. The weekend rate will not decrease their profit. Many believe there will be a gain. He recommended that Council vote for this rate change. He said that, if the senior weekend rate is passed, Foster would be one of the only courses that offers this type of rate. It would draw seniors from other clubs; they will crowd out some of the regular paying people. Mrs. Ann Crain, 5105 So. 163rd P1., said she sees no reason for the seniors to have a reduced rate on weekends. The golf course is crowded. It would be nice to have reduced rates for the residents, but unnecessary. Don Williams, Recreation Director, said they have requested more detailed information from Golf Management on the annual statement. There is a disagreement on this. The contract specifically says that fees are set by the Council. Councilman Bohrer stated that the City invested in a sprinklersystem that decreased some of the maintenance costs at the golf course and there was no contract adjustment for that. He has sympathy for the seniors, but there is already an adequate allowance for reduced rates on weekdays. TUKWILA CITY COUNCIL, REGULAR MEETING April 20, 1982 Page 8 OLD BUSINESS Cont. Brad Collins, Planning Director, suggested that May 11 be set as the public hearing date on the revised Sign Code. Council could then adopt the ordinance on May 18. He as- sured Council that all of the comments from the committees have been included in Draft No. 4 along with comments by the Planning Commission. Council agreed to the May 11 public hearing date. Attorney Hard read an ordinance of the City of Tukwila, Wash., appropriating funds for the Interurban Avenue Corridor Geo- metric Plan I -5 to 405 and amending the 1982 Budget as adopted by Ordinance No. 1241. Mayor Todd read an ordinance of the City of Tukwila, Wash., appropriating unanticipated funds for the purchase of eight parcels of land from Puget Western, Inc. and amending the 1982 Budget as adopted by ordinance No. 1241. The engineering is completed and ready to call for bids. Interurban Ave. South Geometric Plan Proposed Ordinance Changing the days for the Council Meetings Ordinance #1254 Appropriating un- anticipated revenue for warrant investi- gation for Municipal Court Resolution #820 Supporting the pro- tection of the Cedar River Water- shed Councilman Bauch said that the Public Works Committee have reviewed the alternatives and recommend Alternate No. 3. It is essentially the same as there is now a 2 way left turn lane and two traffic lanes on each side. It would have sidewalks and local bus turnouts. The purpose in accepting an alternate now is so the engineers can finish design. MOVED BY HARRIS, SECONDED BY HILL, THAT COUNCIL ACCEPT THE PUBLIC WORKS COMMITTEE RECOMMENDATION OF ALTERNATE THREE.* Councilman Phelps noted that in 1980, the Community Affairs Committee addressed the Interurban Corridor and made some recommendations. Alternate 3 does not provide a buffer between the street and the sidewalk. The committee recommended that a bicycle lane be provided on the east side where possible. Councilman Bohrer asked if the Public Works Com- mittee had considered these previous recommendations. Councilman Bauch said he is not aware that they did. Councilman Harris said the traffic on Interurban is inclined to be quite fast.
